Abstract

ABSTRACT In article 303 of Book II of the Criminal Code (Penal Code), Gambling is classified as a crime. The occurrence of gambling crime is not solely due to society that is not lawful and violate the existing legal norms in society, but all that can not be separated also from the system of tribal tradition or a particular area. Gambling that for some people only used as a regular game at the tongkrongan while filling free time, is now a great game that can be risking property and even sometimes can be up to risk your life. Gambling practices in Tajen held by certain groups of people in Bali are legally in violation of the Criminal Code, Article 303. Police have done their best to dissolve either persuasively or repressively, in fact the tajen here and there are still held, if the tajen is stopped should grow from all levels of society itself, the Police will not be able to stop to zero because Tajen it is their habit and custom according to the law is difficult to change takes a very long time and must remain continuous conducted by all public figures and community itself and Relevant Government Agencies. Abstract

ABSTRAK Perubahan materil yang terdapat dalam RUU KUHP merupakan penyempurnaan dari KUHP yang substansi perubahannya cukup signifikan sehingga sangat menarik perhatian para ahli hingga para akademisi untuk turut sumbangsih pemikiran mengenai RUU KUHP sehingga penulis tertarik untuk dapat menulis dari perspektif teori hukum pembaharuan dalam RUU KUHP tersebut. Penulisan ini bertujuan untuk mengetahui apa saja yang menjadi pilar-pilar pembaharuan hukum pidana dalam merancang RUU KUHP dan mengetahui ketentuan yang mengatur tindak pidana korupsi dalam Buku II KUHP. Dalam penulisan ini penulis menggunakan metode penelitian normatif dengan menggunakan data sekunder. Pembaharuan hukum pidana yang ada di Indonesia memang sarat dengan banyak pihak yang berkepentingan, tentunya kepentingan yang dapat merugikannya sehingga dalam perjalannya banyak sekali hambatan sedangkan hukum yang berlaku sudah tidak sesuai dengan dinamika perkembangan jaman. namun upaya pembaharuan hukum pidana tetap berlanjut Kata Kunci : Hukum Pidana, Pembaharuan Hukum

Abstract

Salah satu masalah dalam penyelengaraan ibadah haji yang muncul sejak lama adalah pengelolaan dana calonjamaah haji, dimana pengelolaan dana calon jamaah haji ini menimbulkan berbagai macam pertanyaan mulai bagaimana dana tersebut di kelola dan di investasikan dalam bentuk apa hingga berapa nilai manfaat atau keuntungan bagi hasil yang diperoleh dari tabungan Haji yang pergunakan tanpa izin dari calon jemaah haji yang sampai sekarang dana Haji mencapai +/-Rp. 120 triliun dan dampak ekonomi apa yang timbul dari investasi dana calon jamaah haji tersebut. Penelitian dalam penulisan makalah ini adalah dengan cara kajian pustaka dari berbagai sumber yang bertujuan untuk menganalisis bagimana pengelolaan dana calon jamaah haji dilakukan dan melalui instrument invenstasi apa dana tersebut di simpan serta sejauh mana nilai manfaat atau keuntungan bagi hasil atas pengelolaan dana tersebut bagi calon jamaah haji dan bagi perekonomian bangsa, selain itu pola kontrak apa yang dibuat oleh Badan Pengelola Keuangan Haji (BPKH) dengan calon jamaah haji dalam pengelolaan dana tersebut. Kesimpulan dari artikel ini adalah bahwa manajemen pengelolaan dana calon jamaah haji yang dilakukan oleh BPKH dapat diinvestasikan untuk mendukung pembiayaan infrastruktur dan investasi lain karena jamaah haji memiliki mengisi dan menandatangani formulir kontrak wakalah ketika membayar setoran awal dari BPIH (Biaya Perjalanan Ibadah Haji). Berupa kontrak wakalah, calon jamaahhaji sebagai Muwakkil memberikan kekuatan untuk BPKH. Jadi BPKH untuk dapat memberikan nilai manfaat atas optimalisasi nilai dana calon jamaah haji dan tetap harus memprioritaskan keamanan dan kehati-hatian atas dana pendaftaraan haji para jamaah. Berdasarkan undang-undang nomor 34 tahun 2014, pemerintah Indonesia mendirikan Badan Pengelola Keuangan Haji (BPKH) yang mempunyai fungsi untuk mengelola dan mengawasi investasi dana calon jamaah haji yang digunakan dalam investasi dan pembiayaan untuk mendapatkan nilai manfaat yang optimal untuk peningkatan layanan penyelenggaraan ibadah haji dengan memberikan prioritas kepada keamanan atau integritas atas dana tersebut. Kata Kunci : Dana Haji, BPKH dan Wakalah.

Abstract

Negara yang berdaulat dalam pergaulan internasional diakui memiliki jurisdiksi penuh yang tidak bisa diintervensi oleh negara atau kekuatan asing manapun. Kedaulatan (sovereignity) merupakan modal dasar, prinsip utama, dan kode etik yang menjadi dasar hubungan antar negara dalam pergaulan internasional. Pada awalnya, kedaulatan negara dimaknai sebagai kedaulatan absolut yang kebal terhadap kekuasaan asing manapun berdasarkan prinsip kedaulatan wilayah, resiprositas, dan kesetaraan antar negara berdaulat. Oleh karena itu, tidak ada satu negara pun dapat menghakimi tindakan suatu negara sekalipun tindakan itu dilakukan di wilayah teritorial negara lain (par in parem non habet jurisdictionem). Karena itu, setiap permasalahan yang timbul antar negara tersebut tidak dilakukan melalui penerapan hukum yang memaksa, melainkan diselesaikan melalui jalur diplomatik. Sikap ini merupakan wujud kesetaraan antar negara berdaulat yang termasuk kategori ‘undisputed principle of customary international law’.

Abstract

During the second term of his administration, President Joko Widodo is planning to launch the Omnibus Law as solution to revise hundreds of conflicting articles in numerous existing laws and regulations simultaneously, not only at the central government level but also at the regional levels. This is a good opportunity for the Indonesian nuclear community to rearrange its nuclear energy regime, which can be seen, especially in the field of the energy sector, does not make significant progress. In the upcoming policy, more parties must be involved in the utilization of nuclear energy, especially in terms of financing and investment, for benefits to the greatest prosperity of the Indonesian people.

Abstract

The dynamics in the system and structure of the Indonesian constitution began in the reform era so quickly developed. All can run properly and correctly because it was initiated by reforming the constitution through an amendment or constitutional amendment mechanism (the 1945 Constitution) in four stages of change (1999 - 2002). One of the essence of the amendment, gave birth to the Regional Representative Council (DPD RI) as a state institution with its constitutionality can be found explicitly in Chapter VIIA Article 22 C Paragraph 1 - Paragraph 4 and Article 22 D Paragraph 1 - Paragraph 4. And UUNO. 17 of 2014 Jo UUNo.2 of 2018 concerning the MPR, DPR, DPD, DPRD. As a new post-amendment state institution, the DPD is designed as a strong bicameral second chamber of our parliament which was originally only unicameral, namely the DPR RI as a state institution and a representative institution of the people. But one of the characteristics of bicameral is if both parliamentary chambers carry out the legislative function as they should. However, if examined carefully until now based on the substitution of article 22 C and Article 22D of the 1945 Constitution of the Republic of Indonesia in 1945 the authority and authority of the DPD is still very limited. So that as an organic law does not give much space for the implementation of authority to the DPD in carrying out its main duties and functions, especially the legislative function like the DPR. For this reason, in order to strengthen and empower the future, the DPD's consistency and authority need to get priority place in the context of the subsequent amendments to the 1945 Constitution of the Republic of Indonesia as the Holder of strategic and fundamental national political decision authority. Everything is inseparable from the problems in the DPD now is a matter of the authority granted by the constitution to him, especially in the context of the legislative function to make laws. Its existence is expected to bridge the relationship between the center and the regions, in a two-chamber parliamentary frame which has strong bicameralism authority.

Abstract

Abstract As a state of law, Indonesia is obliged to provide human rights protection against the victims of heavy human rights violations. The idea of the formation of the KKR begins with the willingness of historical disclosure of truth on past interpretations that have never been dismantled as a preliminary answer to giving a sense of justice for the victims. What is expected in the reconciliation process is the recognition of past history that allows the victim to open an apology door for perpetrators of heavy human rights abuses. The Truth and Reconciliation Commission is a phenomenon of transition arising from the context of countries facing the transition from the authoritarian regime to the democratic regime. One of the very quaint and dilematical problems facing the new government in this situation is to answer the community's demands on human rights crimes (gross violation of human rights) occurring under the previous regime. The transitional Government sought to answer this problem by attempting to reconcile punitive tendencies on one side with a tendency to apologize or amnesty on the other side. So it can be said, the ability of transitional governments is limited to the effort to provide transitional justice that is not entirely satisfactory. The Truth and Reconciliation Commission (KKR) should be regarded as a real progress in the gross violations of human rights in the past who were able to provide substantial justice to its rights to the realization of human rights protection in Indonesia.
