Al-Adalah: Jurnal Hukum dan Politik Islam contains several researches and reviews on selected disciplines within several branches of Legal Studies (Sociology of Law, History of Law, Comparative Law, etc.). Abstract

The implementation of regional autonomy provides the opportunity for local governments to create progress in many aspects, including in the field of health. The research site is in Bone Regency.The research aimed (1) to investigate and understand the legal politics of the regional autonomy in realizing the good governance in health sector; (2) to investigate and understand the application of the good governance principles in the implementation of the administration affairs of the government.The research was an empirical legal research which usually called a socio-legal research. The research was conducted in the Regional Government of Bone Regency. The research was qualitative and was supported legal materials. The data were analyzed using the descriptive and qualitative content analysis.The research result indicated that (1) the legal policy of the regional autonomy in the realization of the good governance in health sector in Bone Regency was based on right of the health protection; that the government must give the right to every citizen, and the local government of Bone Regency should be involved in the health protection based on the principles of autonomy. That between the local government and the central government there should be a division of authority in order to avoid the overlapping authority. Therefore, the formats of regulatory, funding, and implementation are needed in order that the implementation of the health service could reach the community directly. (2) The application of a good governance in the implementation of the government affairs in the health sector in Bone Regency is measured based on: the community access to the information about the government coordination, the community trust in the government institutions (particularly in the health sector), the consistency of the local government of Bone Regency in enforcing the law when executing the government, and the involvement of the non-governmental elements in the policy making (particularly in the health sector). All these effect satisfaction level of the authority implementation of the local government of Bone regency in the health sector, 20 out of 40 respondents has given their good evaluation in the health sector; that the health service in the regency has been running well.

Abstract

This study aims to know and analyze the party system in Indonesia and compare then with party system in various countries. This type of research is a normative legal research. The approach used is the approach of legislation, conceptual approach and case approach. The result of the research shows that the construction of party system arrangement in Indonesia shows the inconsistent arrangement and the existence of repetition of norm to formulation of legislation related to party and the implementation of parliamentary threshold as effort to create simple multi party is considered failed because facts happened in election 2014 with parliamentary threshold 3,5% resulted in 10 political parties in parliament, in contrast to the 2009 elections with a 2.5% parliamentary threshold that resulted in 9 political parties in parliament.

Abstract

Health jurisdiction at this time is increasingly widespread, people are becoming increasingly aware of their rights protected by law. Juridically the hospital is responsible for all losses caused by negligence of health workers in the hospital. To minimize or eliminate losses due to negligence of medical personnel, hospitals hire employees in accordance with his profession to give direct patient health. In the background there is a legal issue in hospital services, namely legal responsibility for mentally ill patients who have escaped from the inpatient hospital. There will be legality problems and the burden of responsibility to the hospital or guard officer in the inpatient room for mental patients who escape from the hospital inpatient room. The research method used in the research is descriptive normative, using a statute approach and conceptual approach. Legal materials used are a source of primary law (criminal code, civil code, the law of the health sector, and regulations the minister of health) and secondary legal materials (textbooks, literature, the literature related to the discussion). Results of the research showed that responsibility for mental patients who escaped from the room inpatient can be grouped into three groups, namely responsible for the field of hospital, the person in charge is the head of the hospital, responsible for the medical field, the person in charge is each doctor, responsibility of the nursing field, the person in charge is each nurse. Where this is a civil case then becomes the responsibility of the home, and when the criminal case it becomes important responsibility beach offender.

Abstract

This study aims to examine the importance of the approval of the Regional Notary Honorary Council in taking photocopies of the minuta notary deed for examination in criminal cases carried out by notaries and inspection mechanisms by the Regional Notary Honorary Council in approving alleged criminal acts committed by Notaries. This research is empirical juridical research. The results of the study show that the Honorary Board of Notaries in the South Sulawesi Province still get obstacles in carrying out their duties and functions, especially in giving decisions both in approval and rejection of requests from law enforcement officials. Based on the results of the study the authors inventory the obstacles that come from notaries and law enforcement officials as well as in terms of legal rules. The suggestion in the future is the need for continuous guidance to notaries and law enforcement officials so that both parties can understand their respective positions in carrying out the profession as well as understanding the duties and functions of the Regional Notary Honorary Council.

Abstract

Ombudsman merupakan sebuah lembaga yang memiliki kewenangan melakukan pengawasan terhadap penyelenggaraan pelayanan publik yang diselenggarakan oleh penyelenggara negara dan pemerintahan termasuk yang diselenggarakan oleh Badan Usaha Milik Negara dan Badan Usaha Milik Daerah yang diberi tugas menyelenggarakan pelayanan publik. Ombudsman hadir untuk mewujudkan aparatur penyelenggara negara dan pemerintahan yang efektif dan efisien, jujur, bersih, terbuka serta bebas dari korupsi, kolusi, dan nepotisme. Dengan demikian Ombudsman diharapkan pula dapat membuat reformasi birokrasi yang baik sehingga keberadaannya benar-benar dapat dirasakan oleh masyarakat Indonesia. Diharapkan pula para penyelenggara negara dan pemerintahan memiliki kesadaran hukum yang baik untuk dapat mentaati rekomendasi yang dikeluarkan oleh Ombudsman.

Abstract

Transparency of service is very important for government agencies in the provision of public services, because with the transparency of services so the public can easily find information or access about procedures in services provided olen government agencies. This study aims to describe, measure and analyze the Transparency of Public Service in the Office of Investment and Service of One Door of Bone Regency. This research is a qualitative research, approach method used is approach (social legal reserarch), data collection is done through interview, observation and documentation to informant in applying of transparency of public service. data analysis includes data reduction, data presentation and conclusion. The results of the research show that the application of transparency of the One Bint Department of Investment and Service Bone District has not been fully implemented in the indicator of service transparency expected by the service recipients such as Authorized and Responsible Officials there are still some authorities who have not yet fully know what they should do so much training is needed that can encourage transparency. Constraints faced by the internet network factors are not adequate so slow in the process of service delivery.

Abstract

This paper examines the praxis (actions) of the Prophet Muhammad in the phase of Mekka and Madina with the viewpoint of modern political theory. The aim is to provide a theoretical and rational explanation that the actions of the Prophet can not only be seen from a religious viewpoint but can also be seen from a political perspective in measures of political and state theory. One of the Prophet's political actions in the Mecca phase was to build agreements with representatives from the city of Yastrib in the event of the first and second Bai'at Aqabah. The event in the size of political science can be called a social contract, namely building a social agreement to form a joint political entity. So that the event is considered as the first fundamental foundation of the building of the Islamic State. Politically, the Bai'at event can be read like a meeting of two interests in one historical momentum. First, the interests of Muhammad as a messenger of Allah to transmit Islamic teachings to the people of Yastrib. Second, the interests of the Yatsrib community for the presence of a leader who was able to mediate in the social conflict between them - a conflict between the Aus tribe and the never-ending Khazraj tribe. While in the Medina phase, the Prophet's political action was to build a written agreement as a common legal basis that became a guideline for the people of Medina in acting, both socially and politically. This political document is called Shahifah in the original text and later experts call it the Medina constitution, which is the basis for the formation of a state for the Muslim community in Madina.

Abstract

Islam datang tidak hanya membawa ajaran akidah semata, tidak juga datang untukmengatur perilaku manusia semata yang kemudian dijadikan dasar nilai dalammembangun kesepahaman di antara mereka. Akan tetapi Islam di samping datangmembawa hal-hal yang disebutkan, juga membawa syariat dengan penuhkejelasan dan nilai-nilai keadilan. Syariat itulah yang kemudian mengaturkehidupan umat manusia secara keseluruhan. Selain mengatur semua bentukhubungan manusia, Islam juga telah meletakkan banyak nilai-nilai serta prinsipprinsipyang bersifat umum guna dijadikan oleh manusia sebagai dasar dalammelakukan interaksinya dengan sesama. Karena Islam telah datang membawaberbagai macam aturan dan prinsip-prinsip hidup maka kemudian untukmengimplementasikan semua itu dalam kehidupan nyata, umat Islam dituntutmendirikan negara agar semuanya dapat diatur dengan baik. Oleh sebab itu Islamkemudian disebut dengan risalah khalidah, dinan alamiyyan dan penutup semuarisalah untuk umat manusia, bersifat menyeluruh sampai dunia berakhir.Semenjak Nabi SAW tinggal di Madinah bersama para sahabatnya, beliaumenjadikan Madinah sebagai tanah airnya. Para sahabat memberikan kewenangankepada Nabi untuk menjadi pemimipin di tengah-tengah mereka denganmenjadikan syariat Islam yang bersumber dari al-Qur‟an dan hadis sebagai aturanyang harus dipatuhi oleh semua. Maka dari itu, nampak jelas bahwa Islam bukanhanya sekedar agama yang mengajarkan masalah akidah dan ibadah ritual semata,akan tetapi Islam adalah agama dan negara. Itulah sebabnya para ulamamenyatakan bahwa syariat Islam diwahyukan oleh Allah kepada Nabi, tujuannyaagar manusia dapat hidup bahagia tidak hanya di dunia, tetapi juga di akhirat.

Abstract

Negara Republik Indonesia sejak didirikan pada tanggal 17 Agustus Tahun 1945 hingga saat ini telah beberapa kali mengalami perubahan maupun pergantian Undang-Undang Dasar. Dan pasca reformasi tahun 1998 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 sudah empat kali mengalami perubahan. Terjadinya perubahan dan/atau amandemen Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 berimplikasi terhadap terjadinya perubahan disegala bidang kehidupan ketatanegaraan, utamanya perubahan politik hukum. Sehingga lembaga Majelis Permusyawaratan Rakyat (MPR/S) juga telah mengalami perubahan baik kedudukan, tugas, fungsi dan wewenang serta produk hukum yang dikeluarkannya. Produk hukum yang dikeluarkan oleh Majelis Permusyawaratan Rakyat (MPR/S) pasca amandemen Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 bukan lagi bersifat Regeling tetapi hanya bertsifat Beschkking. Abstract

This study aims to find out and analyze the position and function of the National Counter Terrorism Agency (Badan Nasional Penanggulangan Terorisme/BNPT). This type of research is normative legal research. The approach used is the legislative approach, conceptual approach and case approach.The results of the study indicate that the BNPT is a non-ministerial state institution under the President and is responsible to the President. In carrying out its duties and functions, BNPT is coordinated with the Coordinating Minister for Politics, Law and Security. The task and function carried out by BNPT is to counter terrorism in Indonesia by using the soft power main approach (prevention). Through a soft power approach BNPT implements two programs, namely deradicalization and counter radicalization. Both of these programs are based on BNPT's view that reducing radicalism does not always have to use a repressive approach as done by the police in general. Law enforcement must be balanced with preventive measures (prevention) by using a pattern of humanitarian approaches so as not to create a sense of revenge and give birth to a new form of violence.
