Abstract

Pancasila is not just born, but through a very thorough planning process and reviewed by National figures through the session of the Preparatory Committee for the Preparation of Independence (BPPK). Pancasila as the foundation of the philosophy of the state of the Republic of Indonesia has the composition of five precepts which is a unity and unity and has the nature of the unity of the absolute, which is the nature of the monodualist nature as individual beings as well as social beings, and position as a personal being that stands alone and simultaneously also as a creature of God. The consequences of Pancasila as the basis of the state of Indonesia are all aspects in the administration of the state covered by the values  of Pancasila which is the human nature that monodualis.

Abstract

Balinese perception of marriage in gelahang including positive, because it is seen as a reality that already exist in society, and never questioned. The inheritance system in the family that carries out the marriage in gelahang in Bali basically adheres to the parental principle, namely the inheritance system that inherits the family of the male and female families. The pattern of parenting in the family formed through marriage in gelahang generally chooses the pattern of democratic care that is characterized by the rights and obligations of parents and children is the same, in the sense that they are complementary. The process of execution of marriage in gelahang is not different from ordinary marriage process, and generally executed by the process of marriage, which was preceded by dating period. In the marriage at gelahang there are two relatively similar ceremonies, namely at the residence of the bridegroom and at the residence of the bride?s. The equation of marriage in gelahang with marriage nyentana namely: equally an alternative marriage, based on love the same love, there are religious witnesses (banten ceremony) and social witness (community) and both want to get offspring. While the difference is that marriage in gelahang status of men and women there is no change in status, so often called parental. The positions of born children are held jointly, unless there is another agreement. An important aspect of marriage in gembles that is rarely encountered is an agreement between husband and wife witnessed by the families of both parties, the agreement can be written and can be verbal.

Abstract

One of the authorities of the Consumer Dispute Settlement Agency (BPSK) is to receive both written and unwritten complaints from consumers regarding the occurrence of violations of consumer protection. Article 52 Sub-Article g of the Consumer Protection Law (UUPK) au- thorizes BPSK to summon business actors who allegedly violate consumer protection. However, in practice in the field, BPSK is not authorized to force involuntary calling of business actors so that many business actors refuse to be present at consumer dispute resolution in BPSK. This research is Normative and Analytical Descriptive Research. In this case, it is a Nor- mative Legal Research in the form of research to find the Law of Concreto, the research to find the law for a case in concreto is an attempt to find out whether the appropriate law to apply in cocreto in order to solve a particular case and see the rule of law is found . This research will illustrate various legal issues and other symptoms related to cases concerning consumer protec- tion and BPSK Implementation of consumer protection law enforcement in practice is not yet fully fea- sible. It can be seen apart from awareness of the ability and independence of consumers to protect themselves against the rights and kewajibanya, also can be seen from law enforcement officers who have not performed optimally. efforts that can be made by BPSK after forced calling of business actors who refuse to attend the consumer dispute resolution can make a verdict verdict if the business actor is not present 3 times on the summons of the session by BPSK as stipulated in Article 52 UUPK and Kemendag. 35/2001.

Abstract

The problems caused by the influx of migrant population (Krama Tamiu) is the presence of immigrants who often do not report to the Village Prajuru, Head of the Environment and lack understanding of the rights and duties of the residence. In Balinese customary law is generally regulated about Krama Tamiu which is contained in Awig-awig Desa Adat / Desa Pakraman. Immigrants (Krama Tamiu / Tamiu) entering other areas, must know and follow the rules, as there is a convention between rights and obligations to be obtained and implemented. The immigrant population (Krama Tamiu) will receive a guidance (pasayuban) in the form of security guarantees, relief from all kinds of dangers that may occur during the respective stay in the region. As compensation for the rights it receives, the migrant population (Krama Tamiu) is subject to certain obligations whose type and form varies according to Awig-awig Desa Adat.

Abstract

Society in social life always there is a means in the form of control or control to regulate the various behavior or behavior anngota social group, It means that human behavior should be limited by the rules so that humans can know what to do and actions that should not be done. Behavior that is governed means a limit of values ??and norms deviant and antisocial. Con- versely, the behaviors that are ordered mean that they contain values ??and norms that are komformis. Prevention or handling efforts for the community not to violate the rules, then within the community group must have a set of values ??and norms is none other than to prevent or reduce the violation of the rules. This is called the form of social control. When looking at the function of social control that applies to the life of the community, is to develop a fear that someone not to do acts that are not in accordance with the values ??and norms that apply, and provide compensation for people who comply with the values ??and norms -the prevailing norms so as to reinforce a sense of confidence in society that the value is supposed to be adhered to for the life of society towards the better. And able to create a legal system (the rules are formally formulated with the sanctions contained in it). From these limitations, it can be interpreted that social control is a designed or not designed and controlled means and process aimed at engag- ing, educating, and even forcing citizens to comply with prevailing social norms and values.

Abstract

Every child has the right to survival, growth and development and is entitled to protection from violence and discrimination as provided for in the 1945 Constitution of the State of the Republic of Indonesia. A child is a person who is not yet 18 years old, including a child who still in the womb. The legal issues raised in this study are: what is the risk for underage child labor according to positive laws in Indonesia?; and how children?s rights and legal protections for child labor are based on Law no. 13 of 2003 on Manpower and Law no. 35 Year 2014 on Child Protection? This research is normative juridical research with analytical descriptive and qualitative descriptive research specification. This is a Library Research by using secondary data. Some factors that can prevent children to work are: social institutions (custom rules in hereditary societies); weak business that is impossible to work in it or because of the high level of welfare; public view; Education related to the exam season, scholarships, school rules and working hours coinciding with school hours; and the attitude and prohibition of work from parents. Child labor reduction program and children?s opinion are crucial to local potential as a resource of action and community?s responsibility to participate. The program should involve all institutions related to the causal factors and carried out with good coordination because the problems of child labor and its emerging protection are interrelated and strengthen each other.

Abstract

Nusa Penida is an island which located on southeast of Bali and separated by the Badung Strait. By a variety of tourist pulling magnets to come to Nusa Penida, it also gives effect to the occurrence of crime. The purposes of the research are to develop the science of law, especially in the field of criminal law and to know and study the type and frequency of crime in Nusa Penida Tourism Area so that it can be constructed effective countermeasures formulation. The method used in the achievement of research objectives, methods of approach Juridical Empirical, namely legal research by way of existing facts approach by way of conducting observations and research through in-depth interviews of the object research. The result of the research shows that there are many types of criminal acts in Nusa Penida area, the most often frequency is the persecution of 24 reports, then theft of 12 reports, then another conventional crime based on data obtained from 2014 until 2017, crimes of a conventional type as stipulated in the Criminal Code and there are crimes that are classified as specific criminal acts such as narcotics abuse. Some obstacles are the existence of darknumber by reason; the omission of the community such as perceiving such acts as cock fighting, seeing guests using addictive drugs, there is also not want to take a risk by  reporting an incident, even the police sometimes do not take action or ignore a suspected incident is a crime because it avoids the occurrence of threats to the apparatus itself. Criminalization committed against such crimes as stipulated by the Criminal Code, namely Article 351, 362, 184, 338, 406, 385, 310, 187, 303, 368 and 285. However, there are also crimes threatened with the provisions of the law outside the Criminal Code : Law No. 23 of 2004 on Elimination of Domestic Violence and Law No. 22 of 2009 on Road Traffic and Transportation. There are other obstacles in relation to law enforcement in Nusa Penida crime, which is still unclear authority between Nusa Penida Police Station and Klungkung Police because of the type of crime they handled.

Abstract

Any person or entity that wishes to carry out a particular activity which may cause harm, harm, and disruption shall equip themselves with a Disturbance License or Hinder Ordonnantie. The granting of the Nuisance License in general is the authority of the bupati or mayor. In carrying out Nuisance Licenses, the Regional Government may impose a levy called the Distribution License License. The existence of this levy is considered very useful for the Region because it provides a substantial income for the local treasury. However, in early 2017, the Minister of Home Affairs Tjahjo Kumolo revoked the Regulation of the Minister of Home Affairs which regulated the guidelines for the determination of permit disruption in the region. That way, all local regulations governing Nuisance Permissions automatically no longer have a legal basis. So that local government since that time practically no longer able to organize Nuisance Permit. In fact, the authority of the Region to administer the permit is an authority born by Hinder Ordonnantie which is a legally binding regulation of wetgevende organization in colonial Indonesia. Legal research conducted with historical approaches and legislation is intended to describe the authority of the Region in organizing Nuisance Permits.

Abstract

The Writing of ?The Synergicities of Policies and Strategies of Prevention  Terrorism?s Crime of Bali Province? are aimed to develop legal science in general and particular in the field of criminal?s law as well as knowing and studying the synergy between roles and strategies from the government, law enforcers and the community and to find, to analyze, to review and to provide legal solutions to obstacles in the effort to prevent terrorism in crime of Bali Province so it can be constructed to be an effective counter measures formulation. The method used in the achievement of the goal is approach Juridical Empirical method, namely legal research with facts approach by observation and in-depth interviews on object of research. The research was conducted on Bali Police, Kesbangpolinmas Bali, FKPT, FKUB, MUDP, and Religious figures in Bali. The results disclosed that each agency / organization / institution / individual has carried out the obligations according their tasks effectively and strive synergize the policies and strategies of prevention in terrorism. There are a few obstacles ranging from funding, facilities, quality-quantity of human resources to the constraints associated with legislation. By identifying several issues and to find the best solution for more effective prevention of acts of terrorism in synergy and sustainable.
