Abstract

Bali Customary Law is a law or regulation written with unwritten conditions that contain commands and prohibitions for the behavior of indigenous peoples in matters governed by human relations with God, human relations with the environment, and human relations with humans, which in Bali is known as dialogue Tri Hita Karana. The imposition of traditional sanctions is a way to restore balance or neutralize the shock caused by traditional violations that have taken place in the Pakraman village environment. Such as the imposition of the Penyamil Customary Sanction which was handed down because the community committed acts that violated the existing provisions in Desa Pakraman Tanggahan Peken. Based on this, the issues discussed in this study include: What legal actions can be imposed by the Penyamil Customary Sanction in Pakraman Tanggahan Peken Village, Sulahan Village, Susut District, Bangli Regency? The problems that arise are examined using the theory of validity and effectiveness of the law in dissecting the formulation of problems regarding legal actions that can be subject to Penyamil Customary Sanctions in the Village of Pakraman Tanggahan Peken, Sulahan Village, Susut District, Bangli Regency. Data collection in this study used interview techniques, literature study techniques, questionnaire distribution and observation. In this study, the type of research used is a type of empirical legal research. Penyamil Customary Penalty Occurrence in Desa Pakraman Tanggahan Peken due to harsh/dirty words and misbehavior in a holy place or in a village meeting, and because of this error aperson who is violated is subject to Penyamil Customary Sanction which can be in the form of financial penalties or Maprayascita fines , depending on the mistakes made. The factors that influence the occurrence of violations of the Penyamil Customary Sanction due to community ignorance, emotional, and developments in the current era of globalization.

Abstract

Disabilitas merupakan suatu ketidakmampuan tubuh dalam melakukan suatu aktifitas atau kegiatan tertentu sebagaimana orang normal pada umumnya yang disebabkan oleh kondisi ketidakmampuan dalam hal fisiologis, psikologis dan kelainan struktur atau fungsi anatomi. Ketika penyandang disabilitas berhadapan dengan hambatan maka hal itu akan menyulitkan mereka dalam berpartisipasi penuh dan efektif dalam kehidupan bermasyarakat berdasarkan kesamaan hak.Pengembangan bahasa isyarat bagi yang berkebutuhan khusus yaitu penyandang disabilitas sangat dibutuhkan dalam pengembangan dan pembinaan bahasa di Indonesia. Kekurangan ini tentunya memberikan hambatan serta menyulitkan penyandang disabilitas salah satunya dalam menikmati beritamaupun hiburan pada siaran televisi. Undang-UndangNomor 32 Tahun 2002 tentang Penyiaran menjamin bahwa hak memperoleh informasi adalah hak mutlak bagi setiap warga negara tanpa memandang kelompok. Jaminan ini harusnya juga diberikan kepada mereka yang memiliki kemampuan yang berbeda atau kaum disabilitas seperti tuna rungu. Pasal 39 ayat(3) UU Penyiaran No.32 Tahun 2002 menyatakan jaminan akan hak informasi dengan ketersediaan penerjamahan. Akan tetapi pasal dalam UU tersebut tidak tegas mewajibkanserta tidak adanya pengaturan sanksi bilamana tidak menerapkannya dengan baik terhadap kepastian pemenuhan secara maksimal bagi kaum disabilitas dalam menikmati siaran televisi. Berdasarkanpemaparantersebut di atas, makadapatdirumuskanpermasalahansebagaiberikut, 1. Pengaturan bagi kaum disabilitas dalam memperoleh informasi; 2. Urgensi perlindungan serta Affirmative Action terkait kepastian dalam pemenuhan hak menikmati acara televisi bagi kaum disabilitas. UU telah memberikan jaminan kepada penyandang disabilitas untuk mendapatkan informasi dan berkomunikasi melalui media yang mudah diakses; dan menggunakan dan memperoleh fasilitas informasi dan komunikasi berupa bahasa isyarat, braille, dan komunikasi augmentatif dalam interaksi resmi, serta mewajibkan Pemerintah serta Pemerintah Daerah utk menjaminnya.UU Penyiaran didalamnya belum secara tegas mengatur mengenai kewajiban stasiun televisi untuk menyediakan aksesuntuk kaum disabilitas tuna rungu untuk menikmati semua acara di televisi sangat urgen untuk memberikan pengaturan yang lebih menjamin pemenuhan hak menikmati acara televisi bagi kaum disabilitas tuna rungu dengan menentukan suatu Affirmative Action yang mewajibkan bagi stasiun TV untukmenyertakan Bahasa Isyarat dalam setiap siarannya.

Abstract

In Bali, the existence of customary law is still stable and sustainable until now and it is very easy to find it in some areas that still maintain the lives of indigenous people through the institution of customary villages or villages. Traditional law dibali generally include; awig, awig, perarem, eka elikita, and other customary rules. In carrying out customary rules, there are customary sanctions that will be imposed on violators of customary rules. These customarysanctions are of various kinds and are different in each customary area in Bali.Dedosan sanction is an example of one of the sanctions that exist in customary rules. As applied in banjar pegok through banjar awig-awig adat which makes dedosan sanctions as an alternative in minimizing losses arising from the negligence of customary manners in carrying out customary obligations, so that the activities of manners customs that are preoccupied with matters outside the customs, do not interfere with the development of traditional traditions thatare still ongoing. Although the application of customary sanctions has begun to be more flexible in the present, it should still be carried out firmly and clearly, so that it does not cause jealousy and does not accustom customary manners to carry out dedosan sanctions just to avoid adat activities. So that if this is allowed to continue then it will certainly also affect the existence of adat thatprevails in an area.

Abstract

Due to the upward trends of business transaction both in conventional and online basis, it is deemed necessary to find an effective ways to settle disputes in the event of a losses to the consumers.In general, consumer disputesinvolve small amount of lossand complaint filed by the consumers for material compensation. In Indonesia, consumer disputeresolutionis carried out not only by the Consumer Dispute SettlementBody (BPSK)but also throughthecourts. Recently,there are manynewly-established consumer disputesettlement institutions.A quick, simple,and low-cost consumer dispute mechanism isneeded to cope with Indonesian economic growth by accelerating the time of a dispute settlement (time efficiency). The purpose of this research is find out how consumer disputes are resolved in Indonesia and legal discource in the frame work oft he consumer?s disputere solution which have lawcertainty.it can be concluded that the pluralityof consumer disputesettlement in Indonesia has ledtoconvoluted mechanisms and procedures in settling disputes. Dispute settlement through Badan Penyelesaian Sengketa Konsumen/Consumers Dispute Settlement Agency (BPSK) is not final and binding. Through this article, it is recommendedto utilise Small Claims Procedures that combines informal and formal mechanisms in order to achieve legal certainty in the settlement of consumer disputes in Indonesia.

Abstract

Lahirnya Undang-Undang Perlindungan Konsumen dilatarbelakangi oleh adanya globalisasi dan perdagangan bebas yang didukung dengan kemajuan teknologi dan informatika. Disisi lain kemajuan dan kesadaran konsumen masih rendah sehingga terjadi ketidakseimbangan antara konsumen dan pelaku usaha. Ketidak seimbangan dimaksud diperparah dengan masih rendahnya tingkat kesadaran, kepedulian dan rasa tanggung jawab pelaku usaha tentang perlindungan konsumen baik didalam memproduksi, memperdagangkan maupun mengiklankan. Perlindungan konsumen pada hakekatnya adalah segalaupaya untuk menjamin adanya kepastian hukum. Konsumen yang bermasalah terhadap produk yang dikonsumsi akan dapat memperoleh haknya secara lebih mudah dan efisien melalui peranan Badan Penyelesaian Sengketa Konsumen. Selain itu bisa juga menjadi sebuah akses untuk mendapatkan infomasi dan jaminan perlindungan hukum yang sejajar baik untuk konsumen maupun pelaku usaha.Setelah diberlakukannya Undang-undang Perlindungan Konsumen (UUPK) sejak tanggal 20 April 2000, diharapkan dapat dapat melindungi konsumen secara keseluruhan, mendorong tumbuhnya iklim dunia usaha yang sehat, tangguh , jujur dan bertanggung jawab dalam menghadapi era perdagangan bebas yang penuh dengan persaingan melalui penyediaan produk yang berkualitas. Badan Penyelesaian Sengketa Konsumen (BPSK), merupakan suatu lembaga yang berwenang untuk menyelesaikan sengketa konsumen diluar pengadilan.BPSK dibentuk melalui Keppres No. 90 Tahun 2001 yang diharapkan dapat melaksanakan penyelenggaraan perlindungan konsumen melalui kegiatan penyelesaian sengketa antara pelaku usaha dan konsumen secara adil dan seimbang.

Abstract

The court is obliged to uphold justice regardless of one?s social status. Resolving criminal cases is carried out through the courts with various types of examination processes. The examination process is referred to as a normal examination, a short examination, a quick examination in accordance with the Criminal Code. Therefore, it is necessary to know whether the implementation of the rapid inspection program has been carried out in accordance with theapplicable rules both in the Criminal Code and other legal rules. The implementation of the quick inspection program at the Bangli District Court can be carried out effectively and efficiently so that the achievement of legal objectives, namely justice and legal certainty for the entire community. It is inseparable from the factors that influence its implementation. So that in thisstudy the author discussed what are the factors that influence the implementation of the rapid inspection program in Bangli District Court and whether there are any factors that become obstacles in the implementation of the rapid examination program at Bangli District Court. The results of the study are as follows: Factors that influence the implementation of the rapid inspectionprogram at Bangli District Court namely; law enforcement, community, facilities and facilities as well as cultural factors.

Abstract

Pencatatan perkawinan memegang peranan yang sangat menentukan dalam suatu perkawinan karena pencatatan perkawinan merupakan suatu syarat diakui dan tidaknya perkawinan oleh negara. Bila suatu perkawinan tidak dicatat maka perkawinan tersebut tidak diakui oleh negara, begitu juga sebagai akibat yang timbul dari perkawinan tersebut. Berdasarkan Peraturan Pemerintah Nomor 9Tahun 1975 ini, maka pencatatan perkawinan dilakukan oleh 2 (dua) instansi pemerintah, yaitu Kantor Urusan Agama (KUA) bagi mereka yang beragama Islam, dan Kantor Catatan Sipil (KCS) bagi mereka yang bukan beragama Islam. Pentingnya pencatatan perkawinan bagi keabsahan perkawinan, melindungi warga negara dalam membina keluarga, memberikan kepastian hukum dan kekuatan hukum bagi suami istri dan anak-anak, memberikan jaminan dan perlindungan terhadap hak-hak tertentu yang timbul karena perkawinan antara lain hak untuk mewaris dan sebagainya

Abstract

caused by several factors, both heredity and even social factors. From these factors cause future impacts on the couple themselves and even on children born. Based on the background above, the problem discussed in this study is the impact on children in Marriage to Gelahang in Pakraman village, Tanggahan Peken, Sulahan Village, Susut District, Bangli Regency. Data collection in this research uses observation, interview and literature study techniques. The research location was set in the village of Pakraman Tanggahan Peken, Sulahan Village, Susut District, Bangli Regency. The Occurrence of Marriage to Gelahang in the village of Pakraman Tanggahan Peken because there are two factors, namely heredity and social factors, where these factors have an impact on children for the future. The resulting impact is a psychological impact, where the existence of Marriage to Gelahang causes pressure on children, both mentally, such as the unpreparedness of children to carry out double obligations when implementing Marriage to Gelahang with different banjar / village andphysically, where when the child is siblings with many obligations that must be fulfilled, where both obligations cannot be abandoned, it causes physical pressure and even financial pressure for the child. In addition to psychological effects, marriage to Gelahang also causes social impacts, because there isno regulation on marriage that raises questions from the community why the obligations undertaken in the village and in the banjar are the same as a married couple who carry out ordinary marriages.Besides that, in family law there are two impacts, positive and negative. And the last is the inheritance system, where having one child will have an impact on the heirs or successors in the future.

Abstract

The results of research entitle the protection of consumers in buying and selling houses through developers in Denpasar is only limited on minor damages when the guarantee given by the developer, in the case of buying and selling houses through developers in Denpasar concerning the issue of consumer rights both safety, comfort and security in occupy housesthat are purchased through the Developer. As for the resolution of the problem between the developer and theconsumer in Article 52 of Law Number 8 of 1999 concerning Consumer Protection and the absence of a settlement in the court institution. In the empirical level, the solution is choosing a consensus and if there is no agreement between the two parties, then asking help from the Notary as the mediator is needed. The constraints faced by developers and consumers in resolving disputes of law No. 8 of 1999 concerning consumer protection, namely the constraints faced by socio-juridical namely due to the lack of understanding of consumers and developers toward the existence of the Consumer Protection Act, andthe lack of socialization in the community about the existence of the Consumer Protection Act. In this case, the non-juridical constraints due tothe lack of human resources, both those that are on the developer and the consumers, beside that the facilities and devices do not support it. Therefore, the efforts would be made in order to be able to resolve the problem of housing consumer dispute in Denpasar. Another obstacle is the lack of consumers? aspirations in choosingthe resolution ofthe consumer dispute until the judicialroute. The efforts that is made both by developers and consumers in dealing with obstacles in the settlement of buying and selling houses through developers, namely: legal protection for the people. It is divided into 2, Preventive Efforts (Preventive) and Refressive efforts.
