Abstract

Food amid humans is a great pleasure in the world because food is one of the sources of human life. Allah is the Rabb who gives food to humans to relieve their hunger. Among the characteristics of the occupants of Heaven is that they often feed the needy. Situbondo Regency is located on the north coast of Java, in the TapalKuda (Horseshoe) area. This research aims to investigate the motives and concept offeedingotherpeopleon Friday, the benefits of feeding people on Friday, and seek for ahadith that advocate feeding others. This research used a qualitative approach with the study of living hadith model. The results of this study indicate that: (1) The motives for feeding people are to get the benefits of sharing food with fellow Moslems, the desire to share, and be part of the social activity. Regular and non-permanent donors support the feeding concept. Food distribution is made every Saturday morning on the east side of AsembagusGreat (Jami') Mosque. Food is distributed to farmers, pedicab drivers, waste pickers, and people who could not afford it. (2) The benefits of feeding others are social care, more people, and laypeople interested in joining the study. (3) Several hadiththat prescribe to feed other people.

Abstract

The book "RiyadhusSholihin" is a monumental work written by one of the great scholars who had a high reputation among the Muslims, namely Imam Nawawi. Although the main topic of the book is about inspiriting anddishearteningand purification of the self, the book also includes themes of creed and oneness of Allah conceptualized by the author in separate chapters accompanied by the evidences of Qur'an and hadith, including the chapters ofBelief and Reliance. So, how is the correlation between the verses and hadiths that he brought with that chapter and with the tauhid ulooheeyah ‘maintaining the unity of worship’? This simple paper attempts to answer these questions by using a library research method and qualitative research with a content analysis approach.The discussion of this paper is divided into several sub-discussions: introduction, brief biography of Imam Nawawi, the meaning of tauhid ulooheeyah, belief and reliance, and the study of the correlation of the chapter and its arguments with tauhid ulooheeyah, and finally the conclusion, including the followings: (1) The RiyadhusSholihin is not a mere hadith book that discusses the themes of inspiriting anddishearteningand purification of the self, but also contains materials of creed; (2) Imam Nawawi's foresight in conceptualizing the chapters of the book and selecting related evidencesfor them; (3) The correlation of the evidences presented with the Chapter of Belief and Reliance is very clear and close; (4) Belief and reliance have a very close correlation, because reliance is the fruit of belief; (5) The correlation between the chapter Belief and Reliance with tauhid ulooheeyahis very real, because belief and reliance are the foundation of faith and excellence in all acts of worship, their position is like the head of the body.

Abstract

The world, without exception, our country, is being hit by the Covid-19 outbreak, which until now is not clear when it will end. This epidemic is not only threatening public health, but also collapses all aspects of the world economy. From the scale of the country, corporations, SMEs, to individuals, are affected by this outbreak.Not surprisingly, all circles are struggling to find a way to survive these two great threats; the covid-19 outbreak and the economic crisis. For the Muslim community, the Prophet Muhammad peace and blessings of Allah be upon him is a role model in all aspects of life, because his teachings have presented everything that mankind needs, both in matters of the hereafter and in the world. Through qualitative research, the researcher tried to reveal the guidance of the Prophet Muhammad peace and blessings of Allah be upon himin facing and resolving the threat of economic crisis. By collecting the data from the Qur’an, hadith, and scholars' statements, the researcher tries to get a clear picture of these guidance.Hopefully, these guidance can be applied by the Muslim community in facing the threat of the economic crisis that is currently haunting the international community. From this research, it was revealed that the main cause of the economic crisis was human behavior that deviated from the guidance of Sharia.Therefore, faith in Allah the Exalted, the Lord of the universe, is a solid foundation as well as a source of inspiration for Muslims in facing all the dynamics of life, including the threat of economic crises. As it is revealed that the Islamic Sharia has arrangedcomplete solutions to solve the threat of the economic crisis.

Abstract

Al-'adah muhakkamah, literally ‘customary usage is the determining factor’,is one of the five universal maxims of Islamic jurisprudencewhich have a wide branch coverage agreed upon by the scholars.This maxim is built on the basis of custom and local wisdom that exists in every community, where this custom is continuously carried out by the community without any denial from them; it is precisely individuals who violate these customs will be considered "freaks". Therefore, Islam makes the customs of a community a legal basis as long as they fulfill the requirements stipulated by Sharia.The formulation of the problem in this study is about: (1) the definition of the al-'adah muhakkamah maxim, (2) the conditions for applying it, and (3) its application in determining the amount and type of dowry. This paper tries to study a jurisprudence principle and apply it to a jurisprudence problem so as to form a complete understanding of the rules as well as how to apply them in the branch of jurisprudence. The conclusions of this study are: (1) that 'adah is something that happens repeatedly which is accepted by common sense and human nature, (2) an 'adah can become a legal basis if it does not contradict the arguments of the Sharia, it is more often done than abandoned, there is no words of the' adah doer who excludes, and the 'adah must exist at the time the covenant occurs,(3) the rule of al-'adah muhakkamah can be applied to determine the number and types ofmis^ldowries, as well as musamma dowries which are absolutely stated.

Abstract

Marriage is a bond between humans on a voluntary basis, according to religion and law. The normative procedure for organizing a marriage is regulated in Law Number 1 of 1974 concerning Marriage. In the implementation of marriage, it must fulfill the pillars in the form of: 1. fiancé, 2. fiancée, 3. marriage guardian, 4. two witnesses and, 5. consent and acceptance. However, sometimes marriage is hindered by a guardian who is reluctant or refuses to marry off which is known as adhal.This study seeks to determine the definition of adhal and adhal guardian and its laws in Islam, the factors that cause guardian to do adhal and how it is resolved in the perspective of Islamic law. The writing method used is descriptive qualitative by looking at data in the field and studying of relevant literature. Factors that cause the occurrence of adhal can be due to fiancédoes not meet the criteria of guardian in terms of origin, nature, social, economy, as well as the unharmonious relationship between the guardianand the woman under his guardianship, or motives for hurt toward ex-wife.The solution of adhal guardian is to use kinship persuasive advice. If this does not work, the bride and groom can ask for the appointment of a guardian to the Religious Court. After the verdict is issued, the marriage can be carried out with the magistrate guardianand registered at the KUA.

Abstract

This article attempts to elaborate the confusion in the terms risk and speculation by explaining the differences between the two, as well as the relationship between them.This article also explains the concept of classifying speculation into positive and negative and formulates and analyzes indicators of both. The research method used is a qualitative method with a comparative study approach. The data sources are classical books, journal articles, related dissertations, dictionaries, economic dictionaries and internet articles. The data collection and analysis are done deductively. The results of this study are: 1. There is a close relationship between risk and speculation. Speculation is sometimes used to mean risk (positive speculation), and sometimes it is used to mean negative speculation; 2. Positive speculation is speculation that has a small possibility of loss, occurs in derivative activities, contains large benefits, is harmless and does not contain elements of akl al-mal bilbathil;3. Negative speculation is speculation that has a large chance of loss, occurs in major economic activities, contains great danger, is not beneficial and contains elements of akl al-mal bilbathil. 4. Not all speculation is forbidden by Islam. Only negative speculation is forbidden.

Abstract

لما بين الحافظ ابن حجر رحمه الله أقسام أحاديث المستدرك في نكته وجدنا أنه تعرض لوصف "صحيح على شرط الشيخين" وهو أن يكون رواة الحديث الذي أخرجه الحاكم هم رواة البخاري ومسلم في صحيحيهما، وأن يكونوا قد احتجا بهم في كتابيهما على صورة الاجتماع، وأن يكون سالما من العلل. فأردنا أن نتثبت هل الحديث الذي حكم عليه الحاكم بأنه صحيح على شرط الشيخين هو فعلا صحيح على شرط الشيخين عند ابن حجر أم لا.ومنهجنا في جمع البيانات في هذا البحث المنهج الكيفي، بحيث إنا جمعنا خمسة أحاديث حكم عليها الحاكم بالصحة على شرط الشيخين من كتاب الإيمان من المستدرك كأنموذج وذلك لضيق الوقت. ومنهجنا في تحليل البيانات المنهج الكيفي أيضا، وذلك بدراسة سند الحديث والنظر إلى جميع رواته واحدا واحدا ثم النظر إلى متنه، هل توافر فيه شروط الصحيح على شرط الشيخين عند ابن حجر أم لا، ثم بعد ذلك الحكم على الحديث.والنتيجة أن ومن خلال دراسة خمسة أحاديث حكم عليها الحاكم بأنها صحيحة على شرط الشيخين من باب الإيمان من المستدرك لايوجد منها حديث توافر فيه شروط الصحيح على شرط الشيخين عند ابن حجر، ولا يوجد حديث صحيح على شرط الشيخين عنده. فالأحاديث التي حكم عليها الحاكم بالصحة على شرط الشيخين قد لا تكون صحيحة على شرط الشيخين عند ابن حجر العسقلاني.

Abstract

وقد كثر الجفاء في زماننا بلا تحديد بالأمكنة ولا الأوقات، وكثر المارقون والمنهزمون من المنتسبين إلى الإسلاموغيرهم الذين يستهزئون بتعاليم الإسلام وقيمه وربما بالتطاول على مقام النبوة. وصور الجفاء كثيرة، سواء كانت في الوسائل الاجماعية أو وسائل الإعلام المقروءة والمشهودة أو حديث المجتمعات، وأشدّ جفاءً وتفريطاً في حقوقه نسبته إلى ما لا يليق بمقام النبوة كالطعن فيه وفي أهله وأصحابه أو الاستهزاء بدينهوسنته .فقام البعض بالدفاع عنه ولكن في الوقت نفسه لديهم مفاهيم خاطئة ومن هنا لابد من تقويم وتصحيح تلك المفاهيمالتي تنتشر في المجتمع المسلم بأدلة من الكتاب والسنة وأقوال سلف الأمة.وسلك الباحث في إعداد هذا البحث المنهج الاستقرائي والاستنباطي من خلال النصوص الشرعية من الآيات القرآنية والأحاديث النبوية ثم الرجوع إلى المراجع والمصادر الإسلامية التي لها علاقة بموضوع البحث.قد تناول الباحث نماذج من المفاهيم الخطئةعند الجفاة في الدفاع عن النبي ، منها: الدفاع مع ترك طاعته ، الدفاع بوضع الأحاديث المكذوبة عليه، الدفاع مع بغض آل بيته الأطهار، الدفاع مع سبّ أصحابه الأبرار، الدفاع مع تنقصه أو تفضيل غيره من البشر عليه. ومن هنا لابد من تنبيه المسلمين وتذكيرهم في تلك المسائل حتى يسلكون المنهج الصحيح والصراط المستقيم في الدفاع عن النبي.

Abstract

Various countries including Indonesia have enacted laws regulating the age limit for marriage. The determination of thelimit is certainly not free from criticism and controversy. On the other hand, the presence of a state to regulate people's affairs is highly emphasized in Islam, both relating to religious issues and world problems.This is what is known as siyasah shar'iyah ‘good governance in Islam’. However, the determination of the age limit for marriage needs to be studied further from the perspective of siyasah shar'iyah. This study aims to determine the general concept of siyasah shar'iyah, the stipulation of the age of marriage in Islam, the age limit for marriage in Indonesia, and the conformity of these rules to the concept of siyasah shar'iyah.This research is a library research that uses a qualitative approach. The results of this study indicate that the general concept of siyasah shar'iyah is the authority of the leader to regulate matters that have not been determined by sharia arguments, as well as things in sharia that are not permanent or have many legal points of view. As for the age limit for marriage, it is not specified in Islam. However, a guardian (father) may even marry off their young children. Meanwhile in Indonesia, a person is not allowed to get married before reaching the age of 19, whether male or female. This stipulation of the age limit for marriage is not in line with the concept of siyasah shar'iyah. As this has legal consequences that are contrary to what has been established by Islam through the sharia argument, which is that it is permissible for someone to marry under that age.On the other hand, it also contradicts the recommendation of the Sharia to hasten marriage if it is possible.
