Abstract

The Qur'an introduces Islam as ad din, therefore, Islam is not just a "religion" in the narrow sense, but covers all aspects of human life. in ad-din al Islam, humans are required to menggayutkan all its activities, either born or spiritual to the supreme absolute reality, that is God Almighty. Being a Muslim, meaning, expression forever subservient and obedient to Allh SWT, devote yourself to Him.The teachings of Islam, he said, ordered to consider the interests of minorities, recognize their rights, especially all the rights included in the circle of human rights. in the concept of this country as the reference is the Qur'an and Sunnah. Thus requiring an ijtihad to review it.Countries in the Islamic perspective, if explored further in fact no concept of the state in the Qur'an Q.S. Ali Imran (3): 140, Q.S. Al-Hashr (59): 7, Q.S. Al Bagarah (2): 213, Q.S. Shura (42): 38, Q.S. An Nisa (4), while the Government of the Prophet with a combination of the people of the Ansar and muhajrin an early milestone of unity and brotherhood, as well as other people are tribes that are in the Medina area in conducting their activities as social beings with their charter Medina. Abstract

Rasulallah Saw. was sent to the earth was carrying the mission that Allah is the almighty and take the mandate to build human civilization more dignified than ever. One form of construction was built by Rasulallah Saw. In order to create a dignified human being from the aspect of the economy. The economic aspect is a form of a right economy that is, protected from things prohibited by syara 'such as manipulation, fraud, corruption and so forth.The history records that, the beginning of Islamic economic thought has actually been done by Rasulallah Saw. and his companions (khulafaurasyidin). The economic problems of the people become very serious concerns because economic problems are the pillars of the faith that must be considered. This is as narrated by Muslims, that Rasulallah Saw. Says "Poverty leads people to disbelief". So the effort to eradicate poverty is part of the social policies undertaken by him at that time. Rasulallah Saw. laid the foundations of the state's financial system in accordance with the provisions of the Qur'an. The whole paradigm of thinking in the economic field and its application in everyday life that was inconsistent with Islamic teachings was removed and replaced with a new paradigm that conforms to Qur'anic values, namely brotherhood, equality, freedom and justice. So this was a very significant step, as well as brilliant and spectacular at the time.

Abstract

Art is defined as the expertise to disclose or express ideas and thoughts a esthetics, including the ability and imagination to realize the creation of objects or the work atmosphere capable of inflicting a sense beautiful. Art is diverse and most of it always questionable in terms of Islamic law. In general, the art divided into two: first, sculpture, painting and drawing. And second, sound art. The main problem in sculpture, painting and drawing is if the object of animate beings, because on the one hand there are numbers of hadith that prohibit making images that are either raised or incurred and three dimensions. While on the other hand it has been commonly done in the community, especially in the natural environment that is fertile and rich with a variety of animals created by God as our State that inspired the artists. In addition, the sculpture on the side can be an expression of sheer beauty, it also has benefits for lessons and so on. Furthermore, sound art is a universal cultural phenomenon, practiced by many nations. In the time of the Prophet himself has been known to sing and play music. In terms of general principles of religious teachings that sound art including mu'amalat dunyawiyyah category. Restrictions on the arts (sculpture, painting, drawing, and sound) for their prudence of Muslims. Prudence was intended that they do not fall to the things that are contrary to the values of Islam which is the focal point at that time. Art as an aesthetic manifestation of the spirit of monotheism and not a waste of money but the art necessary for the improvement of human life, promotion of the dignity and the dignity and refining the soul and the mind. If so the purpose of art, then it is possible that the skill and sunnah favor, not against it.

Abstract

Islamic inheritance law makes three categories of siblings with different parts. This difference shows that the position of siblings, siblings of one father and siblings of one mother is not the same. This is understood from the explanation of the different inheritance of the brother in the Qur'an, namely verse 12 and verse 176 surah an-Nisa '. This reading leaves a problem because in reality there is no significant importance in the distinction except the attempt to reconcile the two verses. By using a systematic reading of the theme of kalalah followed by the theory of the primary and secondary heirs, it is found that the difference in the brother's part as the heir is more to the difference of his position as the primary or secondary heir, not the difference as a sibling, siblings of one father and siblings of one mother. Therefore the repositioning of sibling position in Islamic law of inheritance should be applied.

Abstract

Based on the fact lately, there were some methods of seeking treasure in social life nowadays. One of them was Money Game (the term of Money Game actually never found in any encyclopedia neither Wikipedia, but found only for interpretation of Ponzi Scheme Business), through members’ or investors’ recruitment. They were promised getting profit from their membership and investment, more than any bank even conventional or sharia banking ever promised. The last case of Money Game method was Dream for Freedom (D4F), found in year 2015 and ended in April 2016. The founder offered the extra ordinary profit and benefit, such as 1% profit per a day from member’s investment. This condition successfully recruited hundred thousands of members, from the low rank of education to the high one. Indonesian’s Government such as the Financial Services Authority (OJK) actually has been preventing the people from being victims and spreading of Money Game’s methods, but still the founder of any Money Game find the way to eliminate those preventing ways. Therefore Government has to try another way, through involving another institutional, even government’s Institutional or Social’s Institutional and organizations.

Abstract

The issue of shariah compliance is increasingly important, given that Islamic finance is always challenged by demand from market participants to be innovative and business oriented (eg. offering new instruments and products), as conventional financial does. This fact can encourage the Islamic financial position further improve. On the one hand they should accommodate the demand of customers that may be contrary to shariah principles, but on the other hand Islamic banks are strictly bound by shariah compliance. This paper will focus on the importance of applying aspects of shariah compliance in Islamic banking.In various opinions, the meaning of shariah compliance in Islamic banks is “the application of Islamic principles, shariah and traditions in financial transactions and banking and other related business”. Shariah is one of the indicators of Islamic disclosure to ensure the adherence of Islamic banks to shariah principles. Furthermore, at the operational level, shariah compliance is compliance to the Dewan Syariah Nasional which is the embodiment of shariah principles and rules that must be adhered in Islamic banking.Some provisions that can be used to assess shariah compliance within Islamic financial institutions are: First, contract used for the collection and distribution of funds in accordance with the priciples of shariah and the rules of shariah. Second, Zakat funds is calculated and paid, managed in accordance with the rules and principles of shariah. Third, All transactions and economic activities are reported fairy in accordance with applicable shariah accounting standards. Fourth, the work environment and corporate culture in accordance with shariah. Fift, business that are financed do not conflict with shariah. Sixthly, there is Shariah Supervisory Board (DPS) as a shariah director for the overall operational activities of Islamic banks. Seventh, the source of funds comes from a legitimate and lawful source according to shariah.Related to the implementation mechanisme of shariah compliance, there are two underlying concept both in the context of the fulfillment of accuntability horizontally and transcendental. First, The concept of shariah review must be done by DPS to conduct supervision on shariah compliance. Second, the concept of shariah internal review, Islamic banking as one of internal audit function. If the optimazation of the implementation of shariah compliance aspect in Islamic banking is a necessity, so that the impact of Islamic bank can be the only option for the society to save and do the financing.

Abstract

Dinul Islam is a comprehensive living system that Allah swt down through His Apostle. Which includes aqidah, ubudiah, mu'amalah, mu'asyarah and morals that guide people so life is full of glory. Comprehensive concept means comprehensive rules that encompass various aspects of life, whether of dimension of belief (aqidah), ritual of self-servant (ubudiah), and social aspect ie mu'amalah, mu'asyarah and morals. In everyday life, economy is the wheel of life as a container to meet the material needs of human beings, both in individual life, and social. Islam leads its people to embrace and practice Islamic teachings in a kaffah (comprehensive / comprehensive) in all aspects of life.

Abstract

This aim of study were to determine the effect of Islamic income on financial health of sharia banks; To know the effect of financing profit sharing on financial health of sharia banks; To determine the effect of Islamic income on the fraud of sharia banks; To know financing profit sharing on fraud of sharia banks and to determine the effect financial health on fraud of sharia banks. The population research were all sharia banks in Indonesia. Selected samples were 8 sharia banks. Analysis method used path analysis. The results showed that Islamic income had positive and significant effect on financial health, financing profit sharing had positive and significant effect on financial health. Islamic income had a negative and significant effect on fraud. Shared financing had a negative and significant effect on fraud. Financial health hada positive and significant effect on fraud.

Abstract

Mudaraba is a joint venture agreement between two parties, where the first party provides the entire capital is called shahibul mall and the second as the manager of the capital called mudharib. In other words, mudaraba is a term for the act of a person who entrusts his property to others to merchantability and split the profits for the two based on their agreement while losses to be borne by the property owner. Mudaraba concept was applied by sharia banks on savings accounts products, general investment accounts through deposits, special investment accounts, financing with the principle of profit sharing and mudaraba sukuk.Mudaraba as a principle of profit sharing is still practiced by Islamic banks in Indonesia with revenue sharing not lead to a profit and loss sharing. Here we can see that Islamic banks are still not ready to share profits and losses with the customer, but every effort will face profit and loss. However, we hope that in the future Islamic banks could apply the concepts of profit and loss sharing.

Abstract

The challenge of financial globalization impact on Islamic finance businesses to maintain shariah compliance aspects as a means of mistake prevention and possible risks in the real sector. Compliance functions as actions and measures, both are preventive to ensure the policies, rules, systems and procedures, the business activities carried out by the Islamic Bank. The design of this study is library reaserch approach. The result shows that the system of supervision of compliance toward sharia must been done based on the rules by DPS. The functions of DPS on Islamic Banking, normatively must been implemented in accordance with the principles of compliance, the compliance culture, management risk and the values of shariah systems. The existence of DPS really determines the establishment of sharia compliance, which becomes the main unsure in the existence and continuity of syariah financial industry.
