Abstract

This research uses legal field research methods or normative research to explain legal implications. Field data collection was carried out through interviews and observation stages. Furthermore, all data collected was selected based on reliability and validity. This study aims to legally analyze the implementation of the Seda’ customary sanctions in Mamuju Regency. The researcher examines the relationship between the existence of Seda’ customary sanctions and positive law in Indonesia, is there a conflict in its implementation? Basically, the people of Bonehau Regency want to prioritize customary sanctions when cases of elopement occur. The existence of the Seda’ customary sanction which is still recognized by the community in Bonehau Regency is one of the manifestations of customary civil law. The form of Seda’ sanction or punishment is the imposition of non-physical sanctions in the form of humiliation, expulsion from the village, and ostracism from the community, especially their family. The customary sanction of Seda’ in practice is carried out in groups (siko’bon), with the stipulation that those who are allowed to perform Seda’ are people who have family or blood relations with the person who is eloping (silariang). ___ Referensi Buku dengan penulis: Afandy, M. Abstract

The purpose of study can be need for comparisons between regulations and what happened in the field in order to find out the good or bad implementation of health insurance and legal protection for BPJS's participants in Semarang. In this study, the writer use empirical juridical research methods, namely legal research about the enactment or implementation of normative legal provisions in each particular legal event that happen in society. BPJS or social health insurance administration body has been going on and the community has felt the benefit of BPJS, but there are still some obstacles and problems that happen in Semarang, Middle Java. Article 2 of Law Number 24 of 2011 about BPJS consist of three principles in the service of BPJS participants, including: humanity, benefit and social justice for all Indonesians. The result of the study show the implementation of health insurance in Semarang have been appropriate with Law Number 24 of 2011 about BPJS. Abstract

Indonesia is a developing country that needs a lot of funds to finance development. The need for additional capital budget from the private sector both from foreign and domestic investors. One of the policies that the Indonesian government needs to issue is a national strategic project. The birth of Law Number 11 of 2020 concerning Job Creation brings a new norm regarding the government's authority to intervene in regional taxes and fees in order to provide a good investment climate to attract investors to finance national strategic projects. The birth of this policy is considered contrary to the principle of regional autonomy. This paper examines the laws that allow government intervention in regional taxes related to the principle of regional autonomy. This study uses normative legal research methods. The results of the study show that the intervention of regional taxes and fees does not conflict with the principles of regional autonomy. Although the unitary state gives the widest possible authority to regional governments, the responsibility remains with the central government. Abstract

Every Indonesian citizen has the same right to get public services provided by the government, including the blind. The blind need special facilities in carrying out their activities in public spaces, such as the accessibility of guide lines/tactile paving. The purpose of this study is to explain the implementation of accessibility rights for the blind in Pekanbaru City. This type of empirical research is used in this study, with a sociological approach, which aims to observe the fulfillment of accessibility rights for blind people in Pekanbaru City. The results found, the provision of tactile paving in Pekanbaru City is still very minimal. It can be concluded that, the implementation of the fulfillment of guideline accessibility rights for persons with visual disabilities in Pekanbaru City has not been carried out properly, and the obstacles to fulfilling guideline accessibility rights in Pekanbaru City are regulatory issues, budgets which result in the unavailability of sidewalks on the roadside. Abstract

This study aimed to find out the provisions for the use of the discretionary authority of the police as regulated in laws and regulations and to find out the operational standards for implementing police discretion in securing demonstrations/demonstrations. The type of research used in this research was normative research. The results of this study indicated that the provisions for the use of the discretionary powers of the Police are regulated in Article 5, paragraph 1, letter a number 4 of Law Number 8 of 1981 concerning the Criminal Procedure Code, Article 16, paragraph 1, Article 5 paragraph 1 letter a number 4 of Law Number 8 of 1981 concerning the Criminal Procedure Code and Article 16 paragraph 1 of Law Number 2 of 2002. And operational standards for the implementation of Police discretion in securing mass actions when expressing opinions in public (demonstrations), namely the Dalmas unit is prohibited from carrying sharp weapons or firearms, mobile units by order of the commander and in a unit bond. Dalmas members are prohibited from arguing with the masses (submitted by the negotiating team), using the “T Stick” only to encourage the masses not to beat, using hollow bullets and rubber bullets at the request of the regional head of regional police and carried out by the action unit, and checking individual/unit equipment. ___ References Books with an author: Arifin, Z. Abstract

Violent crime is a social problem that is always interesting and demands serious attention from time to time. The problems in this article are related to why one person is capable of committing a crime against another and what kind of legal sanctions should be imposed on the perpetrator based on the focus of the study on decision Number 67/Pid.B/2020/PN.Liwa. The research method used is a normative approach. The cause of the occurrence of criminal acts of violence against people in the case of decision Number 67/Pid.B/2020/PN.Liwa is because the perpetrators cannot control their emotions, causing violent crimes against other people. The perpetrator admitted his guilt through a trial which was proven by the public prosecutor through Article 170 paragraph 1 which was legally proven that the perpetrator was proven guilty. Abstract

Guarantee law is very important in sustaining development and economic recovery which is being actively implemented in Indonesia. The land guarantee institution is one of the guarantees that has the ability to provide legal certainty in protecting the guarantor and the guarantee recipient, or commonly called the mortgage right. This study aims to analyze the implementation of electronic mortgage registration in Gorontalo District. This research is an empirical legal research that uses primary legal data and secondary legal sources. The data obtained, both primary data and secondary data, were then analyzed qualitatively. The results of the study show that the implementation of electronic mortgage registration has several obstacles in the socialization process. There are still many people who have not received information regarding the process and implementation of registration of mortgage rights electronically. Abstract

Non-Fungible Token (NFT) is a new digital platform that helps artists empower their work with easy access and secure tools and methods that can be used easily. The problem is how is the legal protection of NFT technology as an intellectual work identity? How is the NFT form a solution in protecting Indonesia’s intellectual property rights in a review of Law Number 28 of 2014 concerning Copyright? The research method uses a juridical-empirical approach. By using primary and secondary legal materials obtained from literature and field studies by means of observation and interviews. The results of research on legal protection of NFT technology as the identity of intellectual works explain that in Indonesia itself there are no specific regulations that strictly regulate NFT as objects of legal protection, considering that NFTs are born through a process of creation (which is followed up with conversion/printing) where NFT is basically electronic data. NFTs become objects of digital artwork so that NFTs can be categorized as creations in accordance with the provisions of Article 1 Number 3 of Law Number 28 of 2014 concerning the Copyright Act and regulated in the provisions of Law Number 19 of 2016 concerning Information and Electronics, and Regulations Government Number 71 of 2019 concerning Implementation of Electronic Systems and Transactions. The NFT form can be a solution in protecting Intellectual Property Rights in Indonesia when viewed from Law Number 28 of 2014 concerning Copyright that the certainty of ownership rights in every digital artwork which is then converted into NFT has its own code or token. Abstract

Verdict verstek is a decision handed down by a panel of judges without the presence of the Defendant, and his absence is without a valid reason even though he has been summoned officially and properly. This study uses a normative legal research method with a statutory approach. The purpose of this study is to find out the judge’s consideration of the verstek decision in divorce cases in Decision Number 1916/Pdt.G/2022/PA.Tnk and what reasons made the trial judge in Decision Number 1916/Pdt.G/2022/PA.Tnk decides on divorce cases verstek. The results of the judicial review of the judge’s consideration of the verstek decision in the divorce case in Decision Number 1916/Pdt.G/2022/PA.Tnk is the verstek decision in a contested divorce case. Legal considerations from judges in deciding verstek are contained in Article 149 paragraph 1 Rechtreglement voor de Buitengewesten (RBg). In the absence of the defendant to fulfill the summons without a valid reason, in by Article 125 paragraph 1 and Article 126, the judge can decide verstek. This verstek issue cannot be separated from the provisions of Article 12 Herzien Inlandsch Reglement (HIR), Article 77 Reglement op de Rechtsvordering (Rv) and Article 125 Paragraph 1 HIR, Article 73 Rv and the verstek decision stipulated in Article 125 Paragraphs 1, 2, 3, 4 HIR. The causes of the court judge deciding the verstek divorce case in Decision Number 1916/Pdt.G/2022/PA.Tnk found causal factors, namely that the defendant never attended court even though he had been summoned properly and officially based on the provisions of the applicable laws. As long as the Defendant is not present and is not caused by a reason justified by law—while the Plaintiff’s lawsuit is not against the law—then based on the provisions of Article 149 R.Bg, the Plaintiff’s lawsuit can be granted verstek. ___ Referensi Buku dengan penulis: Fauzan, M. Abstract

Land as a part of life and as a foothold for humans on earth has an important role as a source of welfare, prosperity, and life. Land registration in Indonesia has been regulated in Article 19 of Law Number 5 of 1960, then implemented by Government Regulation Number 10 of 1961 which has been in force for 27 years, then replaced by Government Regulation Number 24 of 1997 which has come into force since October 8, 1997. This article discusses the implementation of a complete systematic land registration policy for obtaining accelerated land certificates at the National Land Agency of Lampung Province. The research method used is normative-juridical research. The approach used by the author is the statutory approach. The results of the research discussion show that land registration determines the legal relationship between people and land as fixed objects. The legal relationship between people and land as a fixed object is included in land law and is not part of agrarian law. A collection of laws governing the synergistic relationship of various branches of law and the legal status of civil rights of people over land as permanent objects, which are controlled to be owned and used and enjoyed by humans, both individually and in the form of communities living together. ___ Referensi Buku dengan penulis: Arifin, F.
