Abstract

Fundamental changes that have a direct impact on the national economy , is globalization and trade liberalization . Globalization and trade liberalization means that the world market will be more open to our products , and vice versa domestic potential we will  be more open as well for the influx of capital, technology and ideas that can bring progress . Judging from the demand side , consumer goods and services will require an increasingly diverse and demanding higher quality assurance . Higher consumer demands it should encourage economic operators in the sector of manufacturing and service industries to translate consumer tastes at the opportunity to invest in particular on a cruise.

Abstract

Denial of justice as be the emergence of state responsibility in international law if the country does not meet certain standards in carried out justice against foreigners . In essence, the denial of justice is a concept of protection for investors , which is based on three elements , foreigners, the state responsibility under international law , and how unfair in holding the judiciary . The legal consequences of denial of justice is a state should be responsible for either restitution orcompensation . ( Zephaniah B.P. Naidoo , 2015: 11 ) . Denial of justice (denial of justice) this comes as no availability or provides a means of justice as appropriate in resolving the case by using local legal institutions ( the exhaustion of local remedies ) . So when there is denial of justice one party can sue the State Responsibility of the provider country of law .

Abstract

Article 33 (3) of the 1945 constitution state that “the land, the water and the nature riches contained there in shall be controlled by the state and exploited to the greatest benefit of the people”. As Stuart G Gross that article 33 (3) goes beyond traditional affirmation articulating, rather, a fundamental, inviolable precept of Indonesian constitutional law. Thus, contracts of the work (CoWs) resemble traditional concession contract only some ways, such as the manner in which revenue is transferred back to the state in the form of taxation and royalties and the level of control holders of CoWs have over operation. However, in the important ways foreign mining companies act not as concessionaires but as contractors for republic of Indonesia, which retains title to unextracted minerals and for whom the mining companies work.

Abstract

AbstractThis research aims to find out and understand the meaning of crime and criminal acts and how is the accountability of the perpetrators of criminal acts spreading fake news through social media. The conclusion of the research is that a criminal act or a criminal act is an act that is incompatible with or violates a legal rule or an act that is prohibited by a legal rule accompanied by a criminal sanction where the rule is aimed at the act while the threat or criminal sanction is aimed at the person who commits or the person. that caused the incident and the perpetrators of the crime of spreading fake news through social media can be held accountable if they violate Article 28 paragraph (1) of the ITE Law, which is an act intentionally, and without the right to spread false and misleading news that results in consumer losses in Electronic Transactions, at where the perpetrator can be sentenced to imprisonment of up to 6 (six) years and/or a maximum fine of Rp 1,000,000,000.00 (one billion rupiah). Research suggestions are to prevent participating in spreading fake news, we should eliminate the habit of sharing content without reading the contents thoroughly. then we should not easily believe or be tempted by certain news or offers through social media so that we do not become victims of fake news or offers through social media.Keywords: Criminal Liability; Fake News; Social Media.AbstrakPenelitian ini bertujuan untuk mengetahui dan memahami pengertian tindak pidana dan tindak pidana serta bagaimana pertanggungjawaban pelaku tindak pidana menyebarkan berita palsu melalui media sosial. Kesimpulan dari penelitian ini adalah bahwa perbuatan pidana atau tindak pidana merupakan suatu perbuatan yang tidak sesuai atau melanggar suatu aturan hukum atau perbuatan yang dilarang oleh aturan hukum yang disertai dengan sanksi pidana yang mana aturan tersebut ditujukan kepada perbuatan sedangkan ancamannya atau sanksi pidananya ditujukan kepada orang yang melakukan atau orang yang menimbulkan kejadian tersebut. Kemudian pelaku tindak pidana penyebaran berita bohong melalui media sosial dapat dimintakan pertanggungjawabannya apabila melanggar Pasal 28 ayat (1) UU ITE yaitu suatu perbuatan dengan sengaja, dan tanpa hak menyebarkan berita bohong dan menyesatkan yang mengakibatkan kerugian konsumen dalam Transaksi Elektronik, di mana terhadap pelaku dapat dipidana dengan pidana penjara paling lama 6 (enam) tahun dan/atau denda paling banyak Rp1.000.000.000,00 (satu miliar rupiah). Saran penelitian adalah untuk mencegah turut serta menjadi penyebar berita bohong, maka hendaknya kita menghilangkan kebiasaan membagikan konten tanpa membaca isinya secara menyeluruh. Kemudian hendaknya kita jangan mudah percaya atau tergiur dengan adanya berita atau penawaran tertentu melalui media sosial sehingga kita tidak menjadi korban berita atau penawaran bohong melalui media sosial.Kata kunci: Tanggung Jawab Pidana; Berita Bohong; Media sosial.

Abstract

Auctions usually must be carried out in an open manner as a form of sales effort for goods or an object and must be carried out in public by using the bidding method at predetermined prices in written form or it can also be orally to get a fixed price. the highest authority in carrying out the auction in carrying out the auction mechanism who has the authority to make a legal deed in accordance with the current regulations, the auction official. Abstract

Bank Indonesia created an appropriate regulatory regime to drive the pace of innovation carried out by Financial Technology Providers while still applying the principles of consumer protection, risk management and prudence. One of the efforts made by Bank Indonesia was by issuing provisions concerning a regulatory sandbox for Financial Technology Providers along with their products, services, technology and/or business models in a Board of Governors Member Regulation No 19/14/PADG/2017 on the Limited Technology Testing Room (Regulatory Sandbox) Financial Technology. Meanwhile, the Financial Services Authority also issued regulation regarding the Regulatory Sandbox for Financial Technology Organizers in Financial Services Authority Regulation No. 13 / POJK.02/2018 on the Digital Financial Innovations in the Financial Services Sector. The main point of view to be analysed is the existence of regulatory sandbox approach held by Bank Indonesia and the Financial Services Authority as an effort to encourage the growth of Financial Technology in Indonesia.

Abstract

The decision of Act No. 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition is expected to create healthy competition and efficient markets. Indonesia as a country has a new Anti-Monopoly Act need to learn the countries who first implemented similar legislation. The legal reform is important, because at present the current Asian countries have been in the process of legal reform a new competition and firm. It research about comparative law in regarding the form and type of cartel, the scope of proving cartel, and than sanctions imposed from the both of Act No. 5 of 1999 (Indonesia Anti-Monopoly Act) and Act No. 54 of 14 April 1947(Japan Anti-Monopoly Act).  Japan Anti-Monopoly Act in the scope of forms and types of cartels is more clearly because in directly it is expressed as a violation of antitrust laws and as per se rule. While the Act No. 5 of 1999 must be proven in monopolistic practices and unfair business competition, then it see as reasonable restraint.

Abstract

Penulisan jurnal ini membahas mengenai kajian yuridis Wanprestasi dalam peraturan perundang-undangan di Indonesia terkait dengan kasus perdata yang dilakukan oleh Debitur dalam perjanjian pembiayaan Konsumen. Permasalahan dalam penelitian ini adalah bentuk wanprestasi yang terjadi, upaya hukum terhadap Debitur yang tidak melaksanakan perjanjian dan pelaksanaan eksekusi dalam putusan Nomor : 60/Pdt.G/2021/PN.Tjk. Wanprestasi diatur dalam Pasal 1243 Kitab Undang-Undang Hukum Perdata (KUHPdt) yang merupakan penggantian biaya, kerugian dan bunga karena tak dipenuhinya suatu perikatan mulai diwajibkan, bila debitur walaupun telah dinyatakan lalai, tetap lalai untuk memenuhi perikatan itu atau jika sesuatu yang harus diberikan atau dilakukannya hanya dapat diberikan atau dilakukannya dalam waktu yang melampaui waktu yang telah ditentukan. Metode Penelitian ini menggunakan metode pendekatan yuridis normatif yang bersifat kualitatif adalah penelitian yang mengacu pada norma hukum yang terdapat dalam berbagai peraturan perundang-undangan, putusan pengadilan, dan diakhiri dengan kesimpulan beserta saran-saran.

Abstract

A civil dispute is a civil case that occurs between the disputing parties in which it contains a dispute that must be resolved by both parties. If one of the parties feels that their rights have been violated or harmed by the other party, then the party who feels that their rights have been violated or harmed can file a lawsuit or claim their rights legally through the Judiciary. Land disputes occur when the parties do not want to settle the case peacefully, they can resolve it by submitting the case to the District Court. The research method uses a normative and empirical juridical approach. The types of data used are secondary data and primary data. Collecting data through library research (library research) and field research (field research). The data analysis used is juridical qualitative. The judge's considerations in determining the decision regarding the execution of land in decision Number 32/Pdt.Plw/2020/PN Mgl, he parties in a case must be clear, so that later when the decision has become legally binding there will no longer be any basis from the Panel of Judges against the party who filed resistance to an execution because in the first case the Panel of Judges has decided that the party who is said to be in control of the object of execution does not only control the object of execution. the defendant, there is a need for harmony to be taken into consideration in deciding which parties should be the subject of a case.
