VARIA HUKUM: Jurnal Forum Studi Hukum dan Kemasyarakatan is a periodical scientific journal published by the Law Studies Program, Faculty of Sharia and Law, State University of Sunan Gunung Djati, Bandung. The birth of the VARIA HUKUM journal is inseparable from the transformation of IAIN into UIN. This transformation has encouraged the delivery of faculties/general study programs and strengthened the existing faculties/religious studies programs. One of the general study programs is the law study program. The characteristics developed by the Legal Studies study program at UIN Sunan Gunung Djati Bandung are a legal, educational institution that can integrate the existence of sharia-based legal scholarship. This is a distinct colour in the world of higher legal education. The Journal of Varia Hukum is published every six months, in January and July. The review process in this journal employs a double-blind peer-review, which means that both the reviewer and author identities are concealed from the reviewers, and vice versa.

Abstract

AbstractThe high number of early weddings in South Kalimantan, including both hand-arranged marriages and those performed formally with court-provided marriage dispensation services, is the subject of this study. to more thoroughly investigate the legal factors that South Kalimantan religious court judges take into account while handling cases of marriage dispensation. This study attempts to address the issue of early marriage in relation to the court's ability to grant dispensation from marriage as a requirement for legalizing marriage for those who have not reached the legal marriageable age through a constitutional approach, legal sociology, and legal anthropology. The review revealed that the majority of the dispensation petitions submitted had been approved. The judge uses procedural and substantive factors based on laws and regulations to decide the marriage dispensation case, taking into account the facts of the case while also paying attention to the fiqh and the guiding principles of Islamic law, which are derived from the verses of the Koran and hadith. Although there is a perception that judges are quick to grant requests or are thought to play a role in South Kalimantan's legalization of early marriage.AbstrakFokus kajian ini adalah mengenai tingginya pernikahan dini di Kalimantan Selatan baik yang dilakukan dibawah tangan maupun yang dilakukan scara resmi dengan fasilitas dispensasi kawin dari pengadilan. Untuk selanjutnya menelaah secara mendalam pertimbangan hukum hakim Pengadilan Agama di Kalimantan Selatan dalam memproses perkara dispensasi Kawin. Melalui pendekatan konstitusional dan pendekatan sosiologi hukum dan antropologi hukum penelitian ini  mencoba menjawab persoalan pernikahan dini dikaitkan dengan kewenangan pengadilan dalam memberikan dispensasi kawin sebagai syarat untuk melegalkan perkawinan bagi  mereka yang belum mencapai usia minimal kawin. Dari telaah yang dilakukan mendapatkan temuan bahwa sebagian besar permohonan dispensasi yang diajukan adalah dikabulkan. Hakim dalam memutus perkara dispensasi kawin didasarkan kepada fakta persidangan dengan menggunakan pertimbangan prosedural dan substansial yang di dasarkan peraturan perundangan dengan tetap memperhatikan prinsip Hukum Islam yang bersumber dari ayat ayat al Quran dan hadis serta kaidah kaidah fikih. Walaupun ada kesan hakim begitu gampang mengabulkan permohonan atau dianggap ikut terlibat dalam legalitas pernikahan dini di Kalimantan Selatan.

Abstract

AbstractThis paper wants to try to provide an overview of the Legal Politics of Amending the Criminal Code in Indonesia, both in legal normative theory and in practice. This research is normative legal research conducted through library research by conducting studies and analyzing primary, secondary and tertiary legal materials. In this writing, researchers also conducted observation activities on Legal Politics in the Changes to the Criminal Code. The problems that will be studied in this research are: (1) How is the politics of criminal law in Indonesia? (2) How is legal politics in criminal law reform in Indonesia? This research is normative legal research using normative case studies in the form of legal behavior products. The results of the research show that it is time to update the criminal law of the Dutch colonial legacy which is still based on the principles and foundations of that time and replace it with a criminal law system and a new criminal law that is more relevant to the lives of Indonesian people.AbstractTulisan ini ingin mencoba memberikan gambaran tentang Politik Hukum Perubahan KUHP di Indonesia, baik secara teori normatif hukum maupun dalam prakteknya. Penelitian ini merupakan penelitian hukum normatif yang dilakukan melalui penelitian kepustakaan dengan melakukan kajian dan menganalisis bahan hukum primer, sekunder dan tersier. Dalam penulisan ini, peneliti juga melakukan kegiatan observasi terhadap Politik Hukum dalam Perubahan KUHP. Permasalahan yang akan dikaji dalam penelitian ini adalah: (1) Bagaimana Politik Hukum Pidana di Indonesia? (2) Bagaimana Politik Hukum dalam Pembaruan Hukum Pidana di Indonesia? Penelitian ini merupakan penelitian hukum normative dengan menggunakan studi kasus normatif berupa produk perilaku hukum. Hasil penelitinya menunjukkan bahwa Sudah saatnya untuk memperbarui hukum pidana peninggalan kolonial Belanda yang masih berdasarkan asas dan landasan pada masa itu dan menggantinya dengan sistem hukum pidana dan hukum pidana baru yang lebih relevan dengan kehidupan masyarakat Indonesia

Abstract

AbstractThe purpose of this research is to find out how to compare the eradication of corruption in Indonesia and Singapore. The research methodology used by the author in solving this problem is by using normative legal research. Using normative legal research because in practice, the authors use existing library materials to conduct research. The conclusion of the research results shows that the regulatory regulations related to the eradication of criminal acts of corruption in Singapore differentiate more between the perpetrators, namely officials or private employees. While in Indonesia it is more to the offense he committed. The independent CPIB institution in Singapore was previously part of the police but then separated due to bribery within the police agency. Meanwhile, in Indonesia, the Corruption Eradication Commission exists as an effort to eradicate criminal acts of corruption which replaces previous institutions which were considered less effective in carrying out their duties and powers. Regarding any differences in eradicating corruption in Indonesia and Singapore, it can be seen from various aspects such as laws, sanctions, institutions, culture and politics, the number of employees, the structure of the anti-corruption commission, and the structure of the institution. AbstrakTujuan dilakukannya penelitian ini ialah untuk mengetahui bagaimana perbandingan dalam pemberantasan tindak pidana korupsi yang ada di Indonesia dengan Singapura. Metodologi penelitian yang digunakan penulis dalam memecahkan permasalahan ini ialah dengan menggunakan penelitian hukum normatif. Menggunakan penelitian hukum normatif karena pada praktinya, penulis menggunakan bahan pustaka yang ada untuk dilakukan penelitian. Kemudian lanjut pada tahap penelitian, penulis menggunakan bahan hukum sekunder seperti, buku, jurnal, artikel dan karya tulis lainnya yang dianggap penulis memiliki kesinambungan dengan permasalahan yang sedang penulis telititi. Karena penulis menggunakan penelitian hukum normatif maka teknik pengumpulan data yang dilakukan oleh penulis ialah dengan cara bahan pustaka atau studi dokumen serta untuk menganalisis bahan hukumnya penulis menggunakan teknik dedukasi dan interpretasi yaitu menganalisis bahan hukum yang ada secara umum ke khusus dan melalui penafsiran. Regulasi pengaturan terkait pemberantasan tindak pidana korupsi yang ada di Singapura lebih membedakan kepada pelakunya yaitu pejabat atau pegawai swasta. Sedangkan di Indonesia lebih kepada delik yang dilakukannya. Lembaga independen CPIB yang ada di Singapura sebelumnya merupakan bagian dari kepolisian namun kemudian ia memisahkan diri akibat adanya penyuapan didalam lembaga kepolisian tersebut. Sedangkan di Indonesia KPK hadir sebagai upaya pemberantasan tindak pidana korupsi yang menggantikan lembaga-lembaga sebelumnya yang dianggap kurang efektif dalam melaksanakan tugas dan wewenangnya. Terkait perbedaan apa saja terhadap pemberantasan tindak pidana korupsi di Indonesia dan Singapura dapat dilihat dari berbagai aspek seperti, Undang Undang, sanksi, lembaga, budaya dan politik, jumlah pegawai struktur komisi anti korupsi, dan struktur lembaga.

Abstract

The Constitutional Court was established in 1945 as part of a plan to ensure that people rights under the Constitution of the State Republic of Indonesia would be upheld. One aspect of the Constitution that has changed significantly since it was ratified in 1945 is that it provides greater and more genuine protection for people constitutional rights in particular and human rights in general. Since the Constitution of 1945 has been fundamentally altered, any discussion of constitutional complaints in connection to that document must focus on that document. Because Therefore, it is crucial to explain the existence of a constitutional complaint process and the need for it for the reader to have a firm grasp on the significant changes that have transpired since The 1945 Constitution. As a result, the Constitutional Court is now empowered to hear and rule on complaints of a constitutional nature.

Abstract

Refusal to become an heir is one of the things that is possible in the Civil Code. The reluctance to take care of the inheritance, the amount of debt left behind, to the desire to give their inheritance to other heirs who need it more is one of the many reasons put forward by the heirs for refusing. However, the concept of refusal of this kind is not found in Islamic inheritance law. Even though the reasons above do not rule out the possibility of being experienced by Muslim heirs. Therefore this paper aims to analyze the refusal to become an heir in the perspective of Islamic law and the Civil Code. This paper uses a normative juridical research method with three (3) approaches namely, statutory approach (statute approach), conceptual approach (conceptual approach) and comparative approach (comparative approach). The conclusion that the author draws is that the Islamic inheritance system does not recognize any refusal to become an heir because the inheritance system uses the principle of ijbari. While in kuperdata, warus can refuse to become heirs as long as the refusal is made expressly before the court where the inheritance is.AbstrakPenolakan menjadi ahli waris merupakan salah satu hal yang dimungkinkan dalam KUHPerdata. Adanya keengganan mengurus harta waris, besarnya hutang yang ditinggalkan, hingga keinginan untuk memberikan harta waris miliknya kepada ahli waris lain yang lebih membutuhkan merupakan salah satu dari sekian banyak alasan yang diajukan ahli waris untuk melakukan penolakan. Akan tetapi kosnep penolakan semacam ini tidak ditemui dalam hukum kewarisan islam. Padahal alasan-alasan diatas tidak menutup kemungkinan juga dialami oleh pewaris muslim. Oleh karenanya tulisan ini bertujuan untuk menganalisis penolakan menjadi ahli waris dalam prespektif hukum islam dan KUHperdata. Tulisan ini menggunakan metode penelotian yuridis normatif dengan tiga (3) pendekatan yakni , pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach) dan pendekatan perbandingan (comparative approach). Adapun kesimpulan yang penulsi ambil adalah sitem kewarisan islam tidak mengenal adanya penolakan menjadi ahli waris karen sistem pewrisanya menggunakan asas ijbari. Sementara dalam kuperdata, ahli warus bisa melakukan penolakan menjadi ahli waris selama penolakan tersebut dilakukan secara tegas di hadapan Pengadiln dimana harta warisan tersebut.
