Abstract

The judge's consideration is one of the most important points in realizing the value of a judge's decision which contains justice (ex aequo et bono) and contains legal certainty, of course it is also beneficial for the parties concerned. However, sometimes it is felt that the judge's decision in corruption decisions has not touched the legal objective. Therefore, the author wants to know about law enforcement in the consideration of judges in imposing a decision (Decision Study Number: 01/Pid.Sus.TPK/2017/PN.Mdn). The writing of this research uses the normative juridical research method, which is a method used to review/analyze data in the form of legal materials, especially primary legal materials and secondary legal materials related to the material discussed. Based on the results of the analysis, it can be concluded that the basic considerations of judges in imposing a decision are based on juridical considerations and non-juridical considerations. Where this is the District Court in determining judex facti, with the authority to examine the facts and evidence of a case. While the factors of law enforcement of corruption in the imposition of judges' verdicts (Decision Study Number: 01/Pid.Sus.TPK/2017/PN.Mdn) can be determined from 5 factors namely, Legal Factors, Law Enforcement Factors, Facilities and Infrastructure Factors, Community Factors and Cultural Factors. Where from the judge's verdict can analyze law enforcement.

Abstract

Papua Province with 23 regencies and 1 city showcases diverse sectors. Jayapura excels in agriculture, plantations, services, crude oil, and palm oil, while Timika stands out for mining. The province's economic growth relies on an increasing Gross Domestic Products. In 2020, the GDP was IDR 198.93 trillion and IDR 137.68 trillion. Notably, Papua experienced a 24.68% growth in Q2 2018, mainly due to the mining sector's contribution of 56.03%. Women in Papua play dual roles in households and the economy, yet face challenges like marginalization, subordination, double burden, stereotypes, and violence. Although Papua's Human Development Index rose to 61.39 in 2022, its health index remains low. Delivery coverage in 2013 was only 33.31%, and maternal mortality rates are high. Poor health adversely affects economic growth, reducing productivity, increasing healthcare costs, and limiting livelihood opportunities. Furthermore, low health levels hinder Papua's HDI achievement. This study explains the impact of female labor force participation on Papua's economic growth. The research focuses on the GDP by Field of Activity as the dependent variable and female labor participation as the independent variable. A sample of 15 data points will undergo multiple linear regression analysis and classical assumption tests using software EVIEWS 10. The results of this research indicate that female labor participation does not have a significant effect on Papua's economic growth.

Abstract

The development of stock returns of manufacturing companies shows fluctuating movements from year to year. Return movements like this indicate that the condition of the manufacturing company is unstable so that it has an impact on the resulting stock returns. This uncertainty will certainly create its own concerns for investors who will invest in shares in manufacturing companies. With this, it is important for investors to analyze the company's condition first so that the investment made can provide returns. One aspect of the company that can be assessed by investors is the company's performance through financial statements. Helfert (2012: 98) grouped company performance measurements into three groups, namely (1) Earning Measures, (2) Cash Flow Measures, (3) Value Measures. Performance measurement based on value measures is economic value added (EVA), market value added (MVA), and refined economic value (REVA) This performance measurement holds the view that increasing value means also increasing long-term shareholder investment returns. Steward (2013: 115) states that value measures are considered to have capabilities that exceed Another performance measurement, because it takes into account all factors related to the creation (value) of the company that have an impact on the increasing prosperity of shareholders. The purpose of this study is to test EVA, MVA, and REVA against stock prices and stock returns. In this study using a research sample of 104 manufacturing companies taken through random sampling in the period 2014-2016. Data analysis and hypothesis testing in this study used the Partial Least Square Path Modeling (PLS-SEM) method. The results of this study show that EVA, MVA, and REVA have a significant positive relationship with stock price and stock return . By looking at the results of this study, it shows that performance appraisal using the EVA, MVA, and REVA methods has a strong influence on stock prices and stock returns . This shows that value-based valuation is important because every investment cannot escape the consequences of the incurring cost of capital as compensation for the funds used to finance the investment. The return on an investment will only mean that if the amount of return exceeds the cost of capital incurred to realize the investment, measurement certainly requires an accurate valuation method.
