Abstract

ABSTRAKMasyarakat di Kecamatan Sungai Raya Kabupaten Kubu Raya denganjumlah penduduk mayoritas Muslim, merupakan asset dan potensi yangbesar diperoleh dari wakaf uang yang apabila dikelola dengan baik danprofesional sesuai dengan ketentuan syari’ah Islam, bagi kesejahteraanummat Muslim, permasalahannya bagaimana pelaksanaan wakaf uangberdasarkan Undang-Undang Nomor 41 Tahun 2004 Tentang Wakaf diKabupaten Kubu Raya, apakah yang menjadi hambatan dalam pelaksanaanwakaf uang yang ditentukan Undang-Undang Nomor 41 Tahun 2004Tentang Wakaf di Kabupaten Kubu Raya, upaya apa yang dilakukanPemerintah (Kementerian Agama) dalam pelaksanaan wakaf uang.Penelitian ini menggunakan metode hukum normatif, penelitiannormatif dilakukan melalui studi kepustakaan dan informan diperoleh daripejabat LKS-PWU (Lembaga Keuangan Syariah Penerima Wakaf Uang)adalah Bank Muamalat, Bank Negara Indonesia Tbk. Divisi Syariah danBank Syariah Mandiri, Kantor Wilayah Kementerian Agama ProvinsiKalimantan Barat dan Kantor Kementerian Agama Kabupaten Kubu Raya.Berdasarkan hasil penelitian, dapat diketahui : 1). Wakaf uang belumdapat dilaksanakan di Kecamatan Sungai Raya Kabupaten Kubu Raya, 2).Adapun yang menjadi hambatan dalam pelaksanaan wakaf uang tersebutadalah Peraturan pelaksana yang menyangkut perwakafan khususnya wakafuang yang belum diatur secara terinci dan ketentuan peraturan tersebuthanya bersifat administratif tidak bersifat Imperatif, masih terdapat pro dankontra pandangan mengenai boleh tidaknya wakaf yang dibatasi waktu(wakaf untuk sementara), masyarakat lebih cenderung memilih mewakafkantanahnya ketimbang wakaf uang, serta belum tersedianya Nazhir yangprofesional.Perlu dilakukan sosialisasi terhadap ketentuan peraturan perundangundanganyang mengatur wakaf uang kepada masyarakat khususnyamasyarakat di Kecamatan Sungai Raya Kabupaten Kubu Raya secaraberkesinambungan, hendaknya masyarakat berupaya juga untukmendapatkan informasi dari instansi terkait agar dapat melaksanakanwakaf uang, hendaknya dari Kementerian Agama Kantor Wilayah ProvinsiKalimantan Barat mengadakan pelatihan/sosialisasi tentang wakaf uangdengan melibatkan masyarakat di Kecamatan Sungai Raya KabupatenKubu Raya.Kata kunci : Pelaksanaan Wakaf Uang4ABSTRAKSPeople in the River District Kubu Raya regency Kingdom with apopulation of Muslim majority , is a great asset and a potential money earnedfrom endowments that if managed properly and professionally in accordancewith the provisions of the Islamic Shari'ah , for the welfare of the Muslims,the issue of how the implementation of cash waqf by Law No. 41 Year 2004 onwaqf in Kubu Raya district, whether that be a bottleneck in theimplementation of the specified cash waqf Law No. 41 Year 2004 on waqf inKubu Raya District , any attempt by the Government ( Ministry of ReligiousAffairs ) in the implementation of waqf money..This research used in This study uses the normative legal, normativeresearch is done through the study of literature and the informant obtainedfrom official LKS-PWU (Islamic Financial Institutions Endowment MoneyRecipients) are Bank Muamalat, Bank Negara Indonesia Tbk. DivisionSyariah and Bank Syariah Mandiri, Ministry of Religious Affairs RegionalOffice of West Kalimantan Province and the Ministry of Religious Kubu Rayadistrict .Based on the research results, it can be seen : 1). Endowments moneycan not be implemented in the River District Kubu Raya Raya district , 2 ) .As for the obstacles in the implementation of the cash waqf is theimplementing regulations pertaining to particular waqf donation money thathas not been regulated in detail and the provisions of these regulations are notmerely administrative imperatives , there are pros and cons of views onwhether or endowments which may be limited by time ( waqf for while ) ,people are more likely to choose mewakafkan waqf land rather than money ,as well as the unavailability of professional Nazhir .Needs to be disseminated to the provisions of laws and regulationsgoverning the waqf money to the community , especially people in the DistrictSungai Kubu Raya district Kingdom ongoing basis , the public should alsoattempt to obtain information from relevant agencies in order to carry out thewaqf money , should be of the Ministry of Religious Affairs Office of theProvincial West Kalimantan conduct training / socialization of waqf moneyby involving the community in the River District Kubu Raya Raya district .Keywords : implementation of waqf money
