Abstract

AbstrakPenelitian ini berjudul ―konsep Penyidikan restorative justice‖ yaitu penelitian yang mengkaji hakekat restorative justice sebagai suatu konsep pendekatan dalam penyelesaian perkara pidana. tujuan penelitian ini adalah untuk memberikan gambaran tentang konstruksi konsep penyidikan restorative justice dalam penegakan hukum pidana di Indonesia. Penelitian dilakukan dengan menggunakan jenis penelitian normative, menggunakan bahan-bahan hukum primer, sekunder dan tersier, dengan metode analisis menggunakan penalaran deduktif. Hasil penelitian penulis menunjukkan bahwa prnisip restorative justice banyak dikaji dalam pemahaman sebagai metode penyelesaian masalah pidana, dengan memposisikan diluar sistem peradilan pidana. Salah satu unsur yang menjadi kunci dalam penerapan prinsip restorative justice adalah proses konferensi atau mediasi antar pihak yang bersengketa. Secara faktual ternyata proses konferensi atau mediasi ini tidak mudah mendudukkan perkaranya, dan menempatkan orang-orang yang dilibatkan dalam proses mediasi. Proses mediasi tidak cukup hanya dengan pengakuan, karena akan menabrak berbagai asas dan norma lain seperti hak asasi manusia. Oleh karena itu, diperlukan proses investigasi ilmiah untuk menentukan status orang-orang yang terlibat dalam suatu perkara, serta mendudukkan perkaranya. Bersarakan pandangan ini, maka prinsip restorative justice idealnya diterapkan dalam sistem peradilan pidana. prinsip restorative justice dikonstruksi mulai pada tahap pra ajudikasi, ajudikasi dan pasca ajudikasi.Kata Kunci : Restorative justice, Penyidikan, Mediasi, sistem peradilan pidana.AbstractThis research entitled "Investigation concept of restorative justice" the study examines the essence of restorative justice as an approach to solving criminal cases. The purposes of this research to provide an overview of the construction of the investigation concept of restorative justice in the investigation of criminal law enforcement in Indonesia. The research was done by normative study, primary legal materials, secondary and tertiary, with the method of s deductive reasoning analysi. The results of this research, authors has indicated that the restorative justice principal had been almost studied in the understanding as a criminal problem-solving method, so it has done by the position outside the criminal justice system. One element that is a key in the application of the principles of restorative justice is a conference or mediation process between the parties to the dispute. Factually, it turns out the conference or mediation process is not easy to position the case, and put the people who are involved in the mediation process. The mediation process is not enough has just to recognition, because it will broke a variety of other such as principles and norms of human rights. Therefore, the necessary process of scientific investigation to determine status of those involved in a case, and position the case. Based on this view, the principle of restorative justice should ideally be applied in the criminal justice system. principles of restorative justice began to be constructed in the pre adjudication, adjudication and post-adjudication.Keywords: Restorative justice, investigation, mediation, criminal justice system.
