Abstract

Overcapacity in prisons usually happens due to the high number of incoming inmates which is not directly proportional to the capacity of the correctional institution. It is a problem in realizing the aim of both the correctional system and the criminal justice system and raises the urgency of alternative penalties application. This research aims twofold: First, to uncover the causes of prison overcapacity, Second, to elaborate on how policy is being developed toward alternative punishment to reduce overcapacity. This study takes a normative and empirical legal approach, with data gathered through literature reviews and field studies. In conclusion, it would appear that alternative punishments are essential to change the negative views regarding the application of criminal sanctions in prison into the application of alternative criminal sanctions for social work that have a positive impact. The punishment that can be used as an alternative to imprisonment is the social work penalty. The social work penalty is considered to reduce the negative impact on the implementation of imprisonment in prisons that experience overcapacity. This research suggests that the social work criminal formulation policy should be immediately formulated in the Draft of Criminal Code (RUU KUHP).

Abstract

The resolution process of law enforcement related to press offences differs in Indonesia. The disparity in resolving legal issues arising from press violations in Indonesia is due, in part, to differing interpretations of press regulations. Some actions were taken under Law No. 40 of 1999 Concerning the Press (Press Law). Some issues were resolved through the Criminal Code or the Kitab Undang-Undang Hukum Pidana (KUHP). This study is interested in looking into law enforcement against the abuse of mass media through online media in terms of press law and the Criminal Code and the barriers to its enforcement. The method used in this research is a normative juridical and empirical juridical approach. Subsequently, data analysis uses qualitative analysis methods. The paper concludes by arguing that enforcing press law against abuse of mass media through online media is accomplished by enforcing Article 5 paragraph (1) of the Press Law. However, Article 5 paragraph (1) of the Press Law does not regulate or formulate the delusions of defamation and insults as regulated in Article 310 of the Criminal Code. The absence of norms and conditions for when and in what cases the press can and cannot be brought to court for violating criminal law and sentenced to criminal sanctions is a barrier in law enforcement on the misuse of mass media through online media associated with press laws.

Abstract

Easy access to the world of information technology currently impacts the rise of cybercrime, including the crime of online gambling. Many efforts have been made by the government and law enforcers, including, in this case, the police, to prevent and take action against this online gambling crime, either block sites that are gambling arenas or improve the national security system to stop these gambling sites. This research aims to look at law enforcement against online gambling crimes in Bandar Lampung City and determine the factors that became an obstacle in law enforcement of online gambling crimes at Lampung Regional Police. This research method uses a normative juridical approach. Based on the discussion and research results, law enforcement against online gambling crimes in Bandar Lampung City is carried out by applying the instrument of Article 303 of the Criminal Code rather than Article 27 Paragraph (2) Jo. Article 45 of the ITE Law. The research also shows the factors that became an obstacle in law enforcement of online gambling crimes at Lampung Regional Police are: (1) Longer Detention Period for Online Gambling Crimes in the Criminal Code Instruments than the Gambling Control Act, (2) Lack of Investigators' Awareness in Information Technology, (3) Use of Electronic Evidence Requires Expert Information is inhibiting law enforcement against online gambling crimes in Bandar Lampung. Suggestions from the research are to conduct information technology guidance training to the Bandar Lampung Police Investigation and Criminal Unit.

Abstract

An error in persona in the implementation of the criminal justice system is a type of destructive action by law enforcement officers that can cause harm to someone. The use of authority by investigators to arrest and detain and detention and prosecution by public prosecutors is a concrete form of persona error. This study focused on the mechanism of a compensation claim through pre-trial due to a persona error in implementing the criminal justice system and an impediment to the implementation of the pre-trial judge's decision on the granting of the compensation claim. The method used is normative and empirical juridical research. The results showed that the mechanism of a claim for compensation through pre-trial due to an error in person in implementing the criminal justice system was carried out fundamentally at the formulation stage. These formulations outlined in the Code Of Criminal Procedure (Kitab Undang-Undang Hukum Acara Pidana/ KUHAP) and Government Regulation Concerning Implementation of The Book of Criminal Procedure Law as a basis for the implementation of pre-trial and the application stage. The statutory factors of Decree of the Minister of Finance of the Republic of Indonesia Number: 983 / KMK.01 / 1983 (Keputusan Menteri Keuangan RI Nomor 983/KMK.01/1983) are an impediment in implementing the pre-trial judge's determination of the compensation claim because the regulation governs administrative procedures that are lengthy and involve government agencies.

Abstract

Trial proving in Indonesia has always been limited to Criminal Procedural Law and other regulations. Following the recent development of electronic criminal case trials, there has not been any precise regulation aside from Supreme Court Regulation 4 of 2020. The contradiction between KUHAP and Supreme Court Regulation causes problems, especially regarding trial proving. The purpose of the paper is to provide a legal solution to the problem of the legal emptiness regarding the regulation of trial proving in electronic criminal case trials from the perspective of Dignified Justice that will provide advantageous, responsive, and adaptive justice towards the needs of the community. The methodology of this research is based on normative research. The normative research methods used in this research are the statute approach, normative approach, and comparative approach. The result showed there shouldn't be a conflict between the effect of KUHAP and Supreme Court Regulation. Yet, the regulation of trial proving in an electronic criminal trial should be regulated at a statute level.

Abstract

The existence of children is not only limited to biological and sociological recognition, but it is also critical for the State to formally recognize the existence of a child where they live and stay. It is challenging for children to have a right because they cannot consistently enforce or waive their rights. In contrast, the realization of children's rights is critical in implementing the concept of Child-Friendly Cities. Child-Friendly City is a concept that applies to all communities' governance, including children, large and small, urban and rural. This study was conducted to determine the implementation of the fulfillment of civil rights and children's freedom in Ternate as an indicator of realizing a child-friendly city. Empirical Law research with a conceptual approach and a legal instrument approach was used. The collected data were analyzed descriptively and qualitatively, with conclusions reached using deductive to inductive methods. The findings indicate that the fulfillment of civil rights and children's freedom in several variables has not been fully realized, seen from several examples such as; the low number of children who have access to Child Identity Cards, the formation of children's forums that are not evenly distributed across sub-districts, and the lack of child-friendly information facilities

Abstract

The challenging aspect of a large number of sexual violence in Indonesia currently makes the draft law on the Elimination of Sexual Violence included in the National Legislation Program Priority 2021. For this reason, the government is expected to ratify the draft law on the Elimination of Sexual Violence to regulate sexual violence comprehensively. The goal of this study is to determine the evolution of data on sexual violence in Indonesia and to assess the urgency of ratifying the draft law on sexual violence elimination in light of the reality of the high number of sexual violence in Indonesia. This study employs a normative legal research method with statutory, conceptual, and case approaches. According to the findings of this study, sexual violence crimes continue to rise in a variety of forms, including not only physical contact but also non-physical contact. Several factors contribute to the high rate of sexual violence, including the structural readiness of institutions and human resources to deal with sexual violence crimes remains very low. Substantially, existing regulations have not comprehensively accommodated various forms of sexual violence, so there is no legality to serve as a foundation for preventing, dealing with, and recovering victims of sexual violence. Thus, the Act on the Crime of Sexual Violence (UU TPKS) is currently an urgent matter as a social control to reduce and overcome the occurrence of sexual violence.

Abstract

Given the lack of a specific institution in Indonesia that oversees the protection of personal data, the importance of protecting personal data is frequently debated. Along with technological developments that continue to occur, it will be directly proportional to the legal risks caused. Hence, these developments need to be balanced with existing legal rules to minimize the occurrence of criminal cases, one of which is the misuse of technology today, which is related to property rights to personal data, especially personal data on social media. This paper uses a normative research method that aims to determine the essence of the formation of legal products and independent authority institutions in Indonesia in maximizing protection and law enforcement against misuse of personal data. Based on the results of the study, it is known that the urgency of establishing this independent authority greatly influences the protection of the misuse of personal data, especially personal data on social media.

Abstract

Le droit, entendu comme l’ensemble des règles qui organisent la vie dans une société donnée (sens objectif) et reconnaissent des prérogatives aux membres de ladite société (portée subjective), est incapable de lutter efficacement contre la pauvreté. En effet, le droit semble être désarmé face à ce fait, voire fléau, social au point qu’il lui affiche des attitudes parfois contradictoires se cristallisant par une catégorisation juridique mouvant. Heureusement qu’il ne se résigne pas : il réinvente perpétuellement des « stratagèmes »  tendant à établir une égalité artificielle entre les membres de la communauté et protéger les plus faibles ou les plus vulnérables d’entre eux. La justice est l’un des secteurs sociaux où se manifestent particulièrement les interactions entre « droit » et « pauvreté ». S’il s’avère que la pauvreté peut constituer un frein à l’accès à la justice, la restriction du droit d’accès à la justice renforce ou conduit (à) la pauvreté. Cette contribution se fonde sur une approche historio-épistémo-comparative : elle a d’abord utilisé la méthode exégétique pour rechercher la portée et le fondement de l’encadrement juridique de la pauvreté et de son implication sur l’accessibilité à la justice, avant de recourir à la méthode comparative et historique en vue de dégager l’origine des solutions proposées par le droit congolais sur la question vis-à-vis des systèmes belge et français avec qui il entretient des liens sociologiques étroits. L’étude démontre, de ce fait, la difficulté qu’éprouvent les pays en voie de développement, particulièrement la République démocratique du Congo, pour relever ce défi, aussi bien dans le domaine de la justice pour adultes que celui de la justice des mineurs où le problème se pose avec plus acuité, surtout sous un autre angle

Abstract

Eradicating members of terrorist organizations is not limited to actions such as prison sentences. However, it can be a persuasive approach through welfare and the installation of national values. This right attempts to help terrorists understand and return to the teachings of the Indonesian Constitution and the Unitary Republic of Indonesia. To address the nature, characteristics, motives, and objectives of terrorism, this research formulated the concept of a persuasive approach to members of the Jemaah Islamiyah (JI) terrorism organization based on Law Number 5 of 2018 concerning the Eradication of Criminal Acts of Terrorism. This paper also emphasizes the concept of deradicalization through a persuasive approach based on law Responsive to JI members involved in criminal acts of terrorism. This study employs a qualitative approach that is analyzed descriptively and normatively. According to the findings of this study, the essence of terrorism is an activity that causes unrest in people while masquerading as religion and has various characteristics and motives. Law enforcement is holistic, comprehensive, and long-term, both through a repressive legal approach model. The process of a repressive legal approach through the criminal justice system, in which the deradicalization process is expected to reform a terrorism prisoner from radical to moderate while in prison while serving a criminal sentence
