Focus and Scope MARCAPADA: Jurnal Kebijakan Pertanahan is a scientific journal that focuses on agrarian-land issues, spatial planning, land management, problems that arise as the causes of a land policy. All terminology refers to the keyword "Policy" which intersects with Agrarian-Land. Land policy issues are built with multidisciplinary analysis, as they relate to scientific disciplines: Spatial, Social-humanities, and Technology. Technically, the Marcapada journal will contain research articles, brief policy studies, and broad land policy thinking. Abstract

Watershed normalization of Batang Agam was initiated in 2015 and continued until 2022 with a substantial budget allocation. But what has been the extent of its impact? Furthermore, it is essential to explore the alignment between the Detailed Spatial Plan (RDTR) of Payakumbuh City and the actual land acquisition process for normalization in three neighborhoods: Pakan Sinayan, Tanjung Pauh, and Tanjunggadang Sungai Pinago located in West Payakumbuh Subdistrict. This qualitative research, conducted through observation and surveys, delves into the implementation of normalization and the subsequent impacts it has caused. Normalization can be successful due to the support from various potential factors, including legal regulations, stakeholder collaboration, adequate funding, and community participation. Normalization brings about positive impacts across environmental, social, and economic aspects. However, it turns out that normalization also has negative impacts, such as natural responses to changes and physical developments, as well as various community activities that lack responsiveness to environmental sustainability.

Abstract

The conflict between the indigenous people of Kenegerian Senama Nenek and PTPN V/PT Perkebunan Negara (State Owned Enterprises/Badan Usaha Milik Negara-BUMN) has been going on for decades. Researchers' document studies and interviews have revealed that the Senama Nenek community's customary land was under PTPN V's unilateral control, which resulted in the loss of the community's customary land forest. The Kampar District Government and the Riau Provincial Government facilitate efforts to resolve the conflict through the courts (litigation) or outside the court (non-litigation), which involve relevant agencies. The conflict was declared resolved in May 2019 through a Limited Meeting Decision on the Acceleration of Settlement of Land Issues led by President Joko Widodo. The final decision was that the 2,800 ha of land was handed over in the form of individual ownership certificates to 1,385 indigenous peoples of the Kenegerian Senama Nenek and then followed up by cooperation with PTPN V with the Partnership Pattern

Abstract

The digitalization efforts undertaken by the land office do not necessarily guarantee the authenticity of its records or documents in the same manner as physical documents. Authentication is essential to reinforce the utility of digital land documents and bestow legal validity as admissible evidence in court. This research aims to analyze the implementation of digitalization and authentication of land documents at the land office. Furthermore, the analysis discusses the necessity of authenticating digital land documents to ensure that the resulting products can serve as valid evidentiary tools in legal proceedings. This research employs a descriptive qualitative approach. The study reveals that the execution of digitalization and authentication of land documents at the WG Land Office does not comply with Law No. 43 of 2009, Government Regulation No. 28 of 2012 concerning archiving, Head of the National Archives of the Republic of Indonesia Regulation No. 20 of 2011 on guidelines for authenticating electronic archives, and the Circular Letter of the Ministry of ATR/BPN No. 5/SE-100.TU.02.01/VIII/2019 on digitization standardization of warkah. In pursuit of legal certainty that aligns with formal legal truth, including the interests of all parties involved, the authentication of digital land documents as a source of juridical data is paramount in assessing and adjudicating a case before a panel of judges.

Abstract

Cluster 3 is a product of the Complete Systematic Land Registration/ Pendaftaran Tanah Sistematis Lengkap (PTSL) where physical data collection has been carried out on PTSL objects, but the certificate cannot be issued due to several reasons behind it. Cluster 3 in the implementation of PTSL in Pati Regency is 83,873 fields, this number is an accumulation of cluster 3 within a period of three years, namely from 2019 to 2021 and there has been no significant effort made by the Pati Regency Land Office to suppress or solve the cluster 3 problem. The method used in this study is a qualitative method with observation and interview. The results of research that has been carried out in two villages in Pati Regency, namely Prawoto Village and Wegil Village show that the factors causing cluster 3 in the implementation of PTSL are unproductive soil conditions, the delivery of information on the implementation of PTSL that is not on target to the community, there is a concern for the community towards the land program. Another thing is that the ease of access to capital (without land certificates) in banks contributes to the refusal of people to be involved in PTSL. The author concludes that the state should take more appropriate approaches regarding the needs and guarantees of legal certainty over residents' land, because the legalization of assets in addition to the state's need to map all land is also to be able to guarantee the certainty of land owned by the community.

Abstract

The significance of Technical Land Considerations (PTP) has grown in importance following the implementation of the Government Regulation replacing the Job Creation Law, particularly as an essential input for issuing Suitability of Spatial Utilization Activities (KKPR). Meanwhile, there are still many gaps in land use status that require effective monitoring activities. In order to effectively carry out land control, data and information regarding land control, ownership, and land use and utilization are required. PTP can be used as an effective land control instrument because it is an input to the issuance of KKPR and subsequently becomes a reference in land ownership applications. The effectiveness of PTP in land control is based on three factors that need to be properly applied: the presentation of the substance of PTP, PTP decisions, and PTP monitoring. PTP substances must be arranged in an accurate, objective, and up-to-date manner. PTP decisions must be informed by a comprehensive and thorough review and the impact of decisions on the community. Monitoring the outcome of the TPP decision is becoming a reference point for the continuation of the land ownership process. To ensure the ongoing issuance of PTP for various land activities, it is essential to incorporate the substance material of PTP into the records of land inspections. This integration facilitates the acquisition of comprehensive information that is pertinent to land ownership applications. In addition, the Land Office can anticipate problems with land tenure that is to be the subject of a land ownership application.

Abstract

The Special Region of Yogyakarta has experienced developments (or can also be termed as "regressions") in the enforcement of land regulation since time immemorial. A new chapter commenced following the enactment of Law No. 13 of 2012 on the Special Status of the Yogyakarta Special Region (UUK). One of the provisions in Article 7, Paragraph (2) of UUK pertains to land affairs, which, among other things, led to the issuance of the Yogyakarta Special Region Governor Regulation (Pergub) No. 34 of 2017 on Village Land Utilization. This research aims to identify the issues arising from the implementation of Pergub No. 34 of 2017 within the various institutions vested with authority in the implementation of this policy. A qualitative methodology was employed in this study, utilizing observation, interviews, and an intensive document analysis approach. Villages serve as the governing bodies directly responsible for Village-owned Land and are mandated to conduct an identification of Sultan/Pakualaman Ground for the purpose of changing its status to the ownership of the Sultan/Pakualaman. The Department of Land and Spatial Planning, acting as the facilitator for the planning and implementation of land affairs and spatial planning, subsequently carries out inventory, identification, and verification processes. Furthermore, it oversees the utilization of Village Land with the Right of Anggaduh. The implementation of Pergub No. 34 of 2017 on Village Land Utilization has been carried out by all relevant departments or stakeholders possessing authority and/or serving as facilitators on behalf of the Sultanate of Ngayogyakarta/Dutchy of Pakualaman.

Abstract

This research discusses the challenges of implementing electronic land certificates as a digital transformation step in the Ministry of Agrarian and Spatial Planning (Ministry of ATR/BPN). As technological developments require an organization to transform, public organizations are no exception. This study takes into account the Ministry of ATR/BPN's digital transformation of the public sector, particularly the implementation of electronic land certificates. The Ministry of ATR/BPN continues to follow developments with the times, but of course this is not easy because in its implementation it faces many challenges. The method used in this research is a normative juridical research method with a data collection model based on library research. This research tries to describe it descriptively so that it will become an illustration of the implementation of digital land certificates. And in the next discussion, we will discuss the challenges and solutions that have been taken by the Ministry of ATR/BPN. The author concludes that, in the future, electronic land certificates will be a necessity that cannot be avoided for various important reasons. Electronic certificates can also reduce the number of disputes, conflicts, and land cases. However, the process requires sufficient time because technology transfer requires skilled and adequate human resources.

Abstract

Stakeholder analysis makes it possible to map the categories of program recipients and organizations implementing agrarian reform programs. Through stakeholder analysis, it is hoped that program acceptance among beneficiary groups can increase. This article aims to examine the implementation of agrarian reform and stakeholder mapping in the case of implementing agrarian reform in Bilok Petung Village. The data for this paper was taken using qualitative methods. Data collection was carried out in two ways: interviews with 12 informants and document studies of journals, books, articles, and related regulations. The data analysis process will be carried out by separating secondary data (literature study) and primary data (field study results). The findings of this research show that there are 11 stakeholders who play an important role in the asset management program and 13 stakeholders who have a main role in the access management program. The findings were then mapped into four quadrants, namely: (1) subject, (2) key players, (3) supporters, and (4) other followers. This research also shows the role of stakeholders in the agrarian reform program, such as policymakers, facilitators, coordinators, planners, implementers, mediators, and accele­rators.

Abstract

As technology develops, geospatial information has been used for policy-making and decision-making. One of the geospatial technologies used is the Geographic Information System, which has been widely built and utilized by related agencies up to the village or district level. This article explains the strategy and parties involved in developing geospatial data and information integration in Margoluwih District and the benefits for these parties. The research method uses descriptive-qualitative data collection through interviews, observation, and documentation. The results of this paper show that geospatial data and information created by various parties can be integrated into an information system. The parties involved in providing data and receiving benefits from the development information system are the National Land Academy, Margoluwih District Government, Land Office of Sleman Regency, Land and Spatial Planning Office of Sleman Regency, Regional Financial and Asset Agency of Sleman Regency, UPTD Agriculture, Food, and Fisheries Extension Center Region III, Margoluwih Village Community Institution, and the Margoluwih Village Community. This indicates that the integration carried out provides benefits for multiple parties. The Margoluwih District Government, as data regent or information system manager, is expected to always maintain and update information independently and sustainably.
