Al Hikmah: Jurnal Studi Keislaman diterbitkan oleh Institut Agama Islam Al-Hikmah Tuban yang terbit sejak tahun 2011. Jurnal ini memuat kajian-kajian keislaman yang meliputi pendidikan Islam, sharî‘ah, pemikiran Islam, ekonomi, dan kajian Islam lainnya. Terbit dua kali setahun, yaitu bulan Maret dan September. Redaksi mengundang para akademisi, dosen, maupun peneliti untuk berkontribusi memasukkan artikel ilmiahnya yang belum pernah diterbitkan oleh jurnal lain. Naskah diketik dengan spasi 1,5 cm pada kertas ukuran A4 dengan panjang tulisan antara 20-25 halaman, 7000-9000 kata. Naskah yang masuk dievaluasi oleh dewan redaksi dan mitra bestari. Redaktur dapat melakukan perubahan pada tulisan yang dimuat untuk keseragaman format, tanpa mengubah substansinya. Alamat Redaksi: Jl. Abstract

The traditions of the Prophet hadist) is the source of Islamic teachingsbesides the Quran. However, both have differences in terms of narration from theProphet. The verses of the Qur'an as a whole are narrated in mutawatir narrations.It is defrerent from hadits. Some of its narrations are mutawatir and some othersare ahad. Therefore based on its status, the Qur'an has the so-called qath'i al-wurudas a whose and is no longer in need of any research on its originality. While interms of hadist, some have zanni al-wurud (especially categorized in the ahadhadists) so to determine whether the hadist has its originality from the Prophet ornot, it is necessary to study hadist in terms the quality and quantity of the chainsof narration (sanad). A study about the hadist on the deceased person tortured dueto the cries of his family, indicates that the hadist narrated by al-Bukhari,Muslim, al-Nasa'i, al-Tirmidhi, Ibn Majah, Malik and Ahmad ibn Hanbal based onthe chains of narrators, has such qualities as thiqah, ma'mun, hujjah, saduq, hafizzli al-Hadith, and ahl 'ilm. The totality of the value of the narrators has the statusmu'asarah and liqa' and can be used as evidence that al-Tirmidhi sanad iscontinued from mukharrij to Prophet Muhammad. While in terms of the quantityof its sanad, the hadist is ahad. This is because the number of the narrators in eachtabaqah is more than two people, two people in the tabaqah of Prophet'scompanions, then continued by the number of many narrators in any tabaqah untilthe so-called mukharrij hadist.

Abstract

In early Islamic history is described for government involvement in managing charity, with a model that is hardly the same, all of them can be said to be aimed at the welfare of the people. How does it happen in the context of the management of zakat in Indonesia! with a Muslim majority, is actually a good zakat management, will be able to prosper its people. This paper wants to answer two questions, namely; how the history of the regulation of zakat in Indonesia? and secondly, why is this zakat regulations should be regulated in the by-laws and regulations in Indonesia? This study used a qualitative approach with descriptive-comparative study-analytical, describing the history of the regulatory management of zakat in Indonesia, compare historical expert opinion, and then analyze it critically. Results of this study concluded that, first; history of the regulation of zakat in Indonesia characterized by a long struggle, and the tug between the interest of political Islamists and Islamist cultural interests and even the interests of the colonial occupiers in an effort to regulate the management of zakat. Secondly, this charity Regulation should be regulated by the State, is in order to improve the effectiveness and efficiency of service delivery in the management of zakat; and enhance the benefits of charity for the public welfare and poverty reduction. Effective management of zakat in Indonesia that this compound, requires legal certainty and clarity of regulations that govern them.

Abstract

That the decision of the Constitutional Court Number 46 / PUU-VII / 2010 regarding the judicial review of Law No. 1 of 1974 on Marriage contains the values of progressivism and would likely result in many possible issues in the future. Such values are contained in the legal interpretations made by the judges of the Constitutional Court in making a decision on the petition for the marriage law. The Constitutional Court did not simply decide it through positive law considerations, but through living laws in the community and legal norms even legal principles in order to create justice for the position of children born outside of marriage. The progressivism adopted by the Constitutional Court in its ruling on judicial review of Article 43 paragraph (1) Marriage Law No. 1 / 1974 results in the implications that drew criticism from the public. But the decision was the starting point in the protection of children born outside of marriage to have equal rights as other children. In the Constitutional Court's decision, the child will get a recognition in so far as he /she tries to prove it. The implication in this case is that there must be affirmative recognition of children out outside of marriage in the population administration. But the domino effect will continue with other children rights consequences when the recognition is applied. For example, the rights of inheritance and the ones of fulfilling the well-being of the child. For that reason, progressivism carried out by the Constitutional Court which is a form of protection for children born outside of marriage is still in need of regulations and restrictions on the implementation of the regulations.

Abstract

Kalam al-amr (command word) is a form of word that is widely used in the Islamic law (shari'ah) either in the Qur'an and hadith. The word could raise multiple interpretations. The interpretation of kalam al-amr aims to know the meaning of a text to understand the laws contained therein. Basically, differences in interpreting the meaning of Kalam al-amr among Muslim scholars can be concluded that the Kalam al-amr generally indicates the meaning of obligatory, but it can be changed if it indicates other meanings, as well Kalam al-amr can show the meaning of ikrar or vice versa when any evidence that shows the meaning. Differences in interpreting the meaning of Kalam al-amr have implications on how to understand a proposition that ultimately leads to the different conclusions.

Abstract

Poverty has become a social reality that exists in every country in the world and has been for centuries. Social reality requires certain levels of society, and all layers have a size of each, can be from employment, position, breadth of knowledge, wealth, political, and religious descent. In measuring poverty, the government has put on poverty measurement approach that made the world body, such as the UNDP (United Nations Development Programme). UNDP sees poverty from two aspects, namely: poor income such as apparel, home, as well as basic necessities of food. And poor human capabilities, such as illiteracy, malnutrition, short life expectancy, education, sanitation, communication in general to support the sustainability of basic human capabilities. Poverty is the case in this country is poverty that women face, or the feminization of poverty. Feminization of poverty in Indonesia has several factors, namely: early marriage, divorce, education, social, cultural, and economic factors. These factors will be discussed along with the views of the author of the context of Islam in society. Because, however, the reality that occurs in the community is not as simple as religious texts. Would be interesting to discuss in this study, the author examines the female heads of household poverty in Sub Soko Tuban, causes of female heads of household poverty and how solutions to solve them.

Abstract

The Muslim scholars (ulama) have agreed on the highest position of the Qur'an for all Muslims. While, the position of the Prophet is in the second after the Qur'an. His position does not come from a community reception of the Prophet's presence as individual who has the power, but his position is clearly expressed through the God revelation. Allah has described the position of Prophet Muhammad in the structure as (a) the explainer of the Qur'an (b) the legislator, (c) the model for Muslim Society (d) the figure that must be followed by by society. Al-Hadith encompasses the human interaction that includes faith, moral, social and legal. The scholars of Hadith in the classical and contemporary era said that a hadith can be called sahih (authentic) if it is in line with four conditions: (1) It was narrated with sanad (chains of narration) which is muttashil (continuous) from the last narrator recording the hadith up to the Prophet as the source of hadith (2) the narrators were composed of people who have such properties as adl and dhabit. (3) the hadith does not contain the so-called syaz, (4) the hadith does not contain the so-called illat. If the four conditions were met, then it could be called authentic hadits.

Abstract

In the current era of globalization, inevitably that there have been many types and forms of learning media ranging from the simple to high-tech ones. The more complete media is used, the better the results are achieved. All educators and teachers are expected to choose the media that is good and is in accordance with the condition of students and subject matters in order to achieve the learning objectives, because the ability of teachers to choose the medium of education will determine the quality of teaching and learning processes. The use of instructional media in the learning process can also generate new desires and interests to encourage motivation and stimulation of learning activities and even bring a psychological impact on students. The use of instructional media at the stage of learning orientation will greatly help the effectiveness of the learning process and the delivery of messages and learning contents. Understandably that media is inseparable part of the learning process because it can arouse students' learning achievement and learning activities and expedite / help meet the learning objectives. One of the various learning media is the use of visual media.

Abstract

Abstract: Education is a process of interaction aimed at improving the quality of human resources, the entire education in Indonesia organized both structurally and not structurally is the responsibility of the Ministry of National Education regulated through legislation. Law of the national education system can serve as a milestone and a basis to build a better quality of national education, including the pattern of national development management. Various attempts have been attempted to improve the quality of madrasah education, the madrasah (Islamic schools) have still experienced many problems and obstacles that hinder the development and improvement of the quality of madrasah. The quality of education is not a stand-alone concept but is closely related to the demands of society that continue to move towards the future. Demands to improve the quality of education affect all sectors and have inevitably become the need that can must immediately be adderessed. There are many efforts to improve the quality of madrasah education for example by improving the quality of madrasah resources, managing madrasah governance to be effective and efficient, and increasing the role of the madrasah leader. To overcome the problems of madrasah there should be reviews of the vision, mission, commitment and institutional management periodically in accordance with the development of science and the demands of society.

Abstract

Abstract: There are two topics in this paper, what is the anatomy of corruption,in which it raises a question of how corruption can be mushrooming in Indonesiaand how to heal the ulcers of corruption. And what is the role of education incombating corruption? There are three (3) important aspects in understanding theanatomy or basic framework of corruption, (a) the monopoly of power; (b) theunlimited authority or discretion, and (c) no clear accountability orresponsibility. The trigger of the corrupt behavior is due to such factorseconomy, opportunities and low morality. The role of education in the field ofcombating corruption is to improve moral quality. Education here does not meansuch a school educational institution. It is also related to the education gainedfrom households and the environment (home or working places).

Abstract

Success of supervision should contribute to the achievement of learning and education objectives. Therefore the success of supervised learning to be seen with the evaluation of the learning supervision of three main components; supervisor and their programs, teacher supervised, and students after the teachers received treatment of supervision. Principals as supervisors play a role in carrying out supervisory functions, the approach chosen, implementasion and providing advice to teachers who supervised learning process to carry out repairs in the future. Teachers as learning leaders who receive treatment of supervision to evaluate the new understanding, increase competence, and their respond to the advice given by the supervisor to make improvements in the learning process. Then evaluation is conducted to students after teacher got the supervision to know the success rate of learning of the subject matter that has been received. Furthermore the learning supervision will get the impact to the school’s human resources development.
