Abstract

In Islamic marriage system, mahar is one of the prior concern although it is not any of rules (rukun) of  the marriage itself. Etymologically, mahar means dowry. Terminologically, it refers to something which is given by a husband to his wife as replacement or guarantee from him from what he takes from her. It can be either in form of things or sevices (such as setting slaves free, teaching, etc. Basically, mahar is genuinely the right of a wife. That means it is the wife that determines what and how many/much she wants it to be given to her. Even if she does not want anything for her mahar, a husband does not need to force to provide it. However, if his wife requires him to give her mahar,  it should be whole and kind hearted gift to her. This reasonable since mahar symbolizes deep and true feeling of love and legal evidence of bond between a husband and a wife. However, in its implementation, mahar is not a simple as it may seem. Involving traditional and religious leaders in determining and approving mahar (as in Binabo Julu village) made few marriages postponed, unregistered (siri) or even cancelled. Abstract

This study aimed at examining the relationship between Islamic values and public services. To achieve the purpose it employed survey research design. The patients in Ibnu Sina Islamic hospital were assigned as respondents and questionnaire was used to assess their perceptions toward the values and the quality services provided by the hospital. The findings showed that 1) the implementation of the Islamic values provided by the hospital was in general was ‘good’,  2) the quality of public services in general was also ‘good’, and 3) the correlation between the implementation of Islamic values and the quality of public services was ‘positive’ (0.458 on Pearson Product Moment index). It can be concluded that the more Islamic values were implemented, the quality of public services tended to be more realized. Theoretically, the finding were expected to yield evidence that there was positive correlation between organizational culture, especially religious values, and organizational performance, especially quality of public services. Practically, the findings encouraged the hospital managers to keep improving their implementation of Islamic values since the of quality of public services tended to increase as well.Kata kunci: nilai-nilai Islam, pelayanan publik, rumah sakit Islam Ibnu Sina

Abstract

Approaches in Islamic studies should be appropriate with the object under studies. Linguistic approach is one of the approaches in Islamic studies whose object is scripture (manuscripts or texts). Therefore, as the main source of Islamic laws, al-Quran should use linguistics in one of its approaches. Linguistic approach which is used emphasizes upon two categories, namely linguistic and concept analyses as well. Kata kunci: pendekatan, linguistik, al-qur’an, hermeneutik.

Abstract

Zakat is a part of the discussion of Islamic economics. In the perspective of Islamic economics zakat has a very important role. Zakat has a strategic role in the fight against poverty or economic development. Zakat has an enormous influence in many respects human life, among which is the effect on the economy. Zakat is a tool that can be used to stabilize the economic life, zakat can strengthen economic solidarity among members of society, and ultimately will create economic stability. Abstract

Murabaha financing is a form of financing which is provided by sharia banking. However, murabaha financing  can be granted by Islamic banks only at the risk of default on the part of the customers. Therefore, Islamic banks are allowed to require security to customers. One of the requirements is that the customers should submit a number of insurance premium amounts depending upon how much the ceiling of financing provided to customers, However, the implementation of provisions of the insurance premium is not suitable with the provision of guarantees and insurance concepts in Islamic economy. Such mechanism is not approved by sharia insurance fund forfeited as it is found in conventional insurance. It implies that if the customers of murabaha financing has fulfilled their obligations to pay the mortgage financing (he did not pass up defaults or die), they should get the collateral back since their debts have fully repaid.Kata kunci: premi, murabahah, perbankan syariah

Abstract

Sharia banking in Indonesia has approached 24 years of age. This age implies that it such sharia banking has shifted to maturity phase. It has developed significantly compared to that of previous years. It can be observed from its average growth of its assets, DPK, PYD which is 45% higher than the years of 2000 up to 2014. However, it is expected that it must able to make use of opportunities which are presently available to encounter challenges in the future, Consequently, it should be able to take advantage of supports and contributions of other such related parties as government, ulama, society, academicians, and students majoring in sharia banking as well. Abstract

Marriage is basically the main element in the establishment of sakinah, mawaddah and rahmah family. Consequently, to realize such expected family, fixed laws are needed. The implementation of such laws in marriage is aimed at maintaining rights, ….. and responsibilities of the family members in order to realize everlasting and qualified family which is suitable with marriage purposes. Therefore, administrating marriage which has been stated in laws is becoming obligation to carry out. If it is viewed further from maslahah approach, administrating marriage can be included into maslahah in the level of dharuriyah in which such maslahah  must be fulfilled unless it will jeopardize the existence of nasab.Kata kunci: pencatatan, nikah, maslahah

Abstract

In terms of Islamic laws, anything that concern with faith (aqidah), worship (‘ibadah) dan deed (muamalah) are basically aimed at ensuring safety in the world and hereafter as well. maslahah  is the most important concept in developing economy and the principles of maslahah  in economic field have been taken as guidance in order to achieve maqasid syariah. Obeying sharia laws is the way to realize maslahah . Abstract

Corporate Social Responsibility (CSR) is basically the moral responsibility of companies and enterprises toward societies. The responsibility itself can be initiated by the company itself, employees, other companies, social environments, and even the State where the business is established. The concept of CSR can be seen from two different perspectives. First, it concerns with the company’s goal is for profit. Therefore, CSR is believed to be parts of business. Second, it deals with the purpose of a company is for profit while ensuring people’s welfare and environmental sustainability become prior concerns. Islam strongly supports CSR since it cannot be denied that the businesses create a lot of unexpected social problems. Consequently, it is the companies and enterprises’ responsibility to fix those problems. Abstract

This study was purposed at identifying the various transactions in Islamic banking of West Sumatera were categorized on the “debts”; describing the implementation of the transaction; and analyzing the various transactions were based on the economic fiqh perspective. This study belongs to qualitative case study by using in-depth interviews as research instrument. The data were analyzed qualitatively based on the economic fiqh perspective, Al-Qur'an, Sunnah, Ijtihad the scholars, and the Fatwa of National Sharia Council (DSN) and Indonesian Council of Scholars (MUI). The results of this study revealed that the types of transactions were categorized “debts” was murabahah, qardh (bailout pilgrimage), hiwalah, and rahn (pawning gold). Murabahah was presented on all Islamic Bank but not all transactions on Islamic banking of West Sumatera based on the economic fiqh perspective such the calculation of the margin murabahah based on the amount of banks financing. Then the calculation of ujrah on the bailout pilgrimage was still based on the amount of bail. Furthermore, the calculation of ujrah on pawning gold was not based on the calculation of the treatment period but to the amount of “debt” funds. The conclusion was the implementation of the “debts” contract in Islamic banking of West Sumatera not run well as the economic fiqh perspective.
