Indonesian Journal of Pancasila and Global Constitutionalism (ISSN Print: 2830-0629 ISSN Online: 2830-0610) is an open access a double blind peer reviewed journal published by Faculty of Law, Universitas Negeri Semarang and managed by Pancasila and Constitution Studies Center, Center for Legal Drafting and Law Student Debating Community. Pancasila is an important issue in the Indonesian and the global context. This Journal aims to be a forum for academics, researchers, practitioners, and students in the study of Pancasila and Global Constitutionalism, including in the study of the worlds major ideologies. The Journal offers an interdisciplinary space for addressing the foundations, limitations and contestations of the principles and norms of political order and their dynamics over time on a global scale. The Journal publishes cutting-edge peer-reviewed work which refers to and advances global constitutionalism and study of Pancasila as an interdisciplinary field. Submissions are invited from a broad range of disciplines including International Law, Political Science, International Relations, Comparative Constitutional Law, Comparative Politics, Political Theory and Philosophy including the comparative analysis of Pancasila practices and another national ideologies in the global perspective.

Abstract

In conducting the state implementation, Indonesia as a state needs regulations in accordance with the national cultural values. The values are mirrored in Pancasilaas the spirit of constitutional law which is The Constitution 1945. Indonesian governmental system is presidential; the president is the state chief and the governmental chief. The state power is in three powers, that are legislative, executive, andjudicial powers. Those three powers have relations in sharing the powers. This practice is not the same as the original theory of Montesquei about power divisions. In the implementation, The Constitution 1945 has supporting institutions. They are People's Consultative Council, House ofrepresentative, President, Supreme Court, Constitutional Council, Judicial Commission, Financial investigator, Police, and the Army.

Abstract

Public service is one of the commitments in government administration. Good, measurable, and humane public services have a significant impact on the impetus for accelerated development. However, negative issues in public services, especially in Indonesia, are still often encountered, ranging from issues of bribery, corruption, abuse of authority, to discrimination in the implementation of public services. This study aims to analyze the general principles of good governance (AAUPB) in the delivery of public services in Indonesia. Using the study approach of law, constitution, and Pancasila, this study confirms and finds that the implementation of AAUPB in public services includes several things ranging from transparency, community participation, efficiency, and aspects of convenience.

Abstract

Indonesia is a multicultural country that has a variety of cultures. This is due to the geographical location of Indonesia which is an archipelagic country that stretches from the western end of Sabang Island to the eastern end of Merauke Island. So in conditions like this, various tribes, customs, ethnic cultures and beliefs emerged in Indonesia. This diversity has both positive and negative impacts. The positive impact is that diversity can strengthen unity, but the negative impact is that it can lead to division. One of the problems that can lead to the division of the Indonesian nation is the intolerant behavior of the people. Intolerant behavior often occurs in people's lives in various fields. The fields of politics, economics, religion, social and culture are always inseparable from intolerant attitudes, especially in the development of the flow of information in the current era of globalization. There are many cases that trigger inter-ethnic divisions that circulate in the mass media, especially social media. Therefore, a guide for the Indonesian people is needed to deal with the issue of division, namely Pancasila. Pancasila which is the nation's ideology has values ​​that become the view of life of the Indonesian people which are always relevant to the times, especially in the current era of globalization. By implementing and preserving Pancasila in all areas of people's lives, it means that we are trying to realize a common life that is conditional on the values ​​of unity, kinship, justice, tolerance and humanity.

Abstract

Pancasila and Human Rights are a concrete form of implementing the constitution and protecting citizens in accordance with the goals of the nation as stated in the Preamble to the 4th paragraph of the 1945 Constitution of the Republic of Indonesia. In its implementation, Pancasila and Human Rights guarantee equality of all levels and groups of society in service and participation as citizens. The process of entering Chinese ethnicity into the civilization of Indonesian society certainly cannot be separated from various aspects, including history. Ethnic Chinese migrated to Indonesia through trade routes and gave birth to cultural acculturation. Over time, the influence of the presence of ethnic Chinese in Indonesia experienced upheavals, resulting in various discriminatory practices against them. The existence of discriminatory practices that occur shows that between the indigenous people and the Chinese there are gaps and various problems. Examples of discriminatory cases or practices that occurred include Riots during the reform era, restrictions on participation and political rights, expulsions, rapes, and others that are still happening today. In this case, the indigenous people feel competitive economically and in other aspects.

Abstract

The rise of fake news (hoax) circulating in the community is a serious threat to the Indonesian nation, because it can divide the unity of Indonesia. Indonesia, which is a multi-cultural country consisting of various religions, ethnicities, races, and ethnicities, is vulnerable to conflicts between community groups. Fake news is news that contains information that is not in accordance with the actual situation. Fake news aims to deceive, cause hatred, or hostility to certain individuals or groups of people based on religion, race, and between groups. This paper explains how fake news or hoaxes can break Indonesian unity. How is fake news in the perspective of criminology to find out the motives and goals of the perpetrators of spreading fake news, fake news in the perspective of Pancasila, as well as the efforts that can be made by the community and government to prevent and overcome the spread of fake news. The thing to do to prevent fake news is to sort out the news in order to prevent believing in fake news (hoax), by not only reading the news title, but also paying attention to the URL address of the site, and checking the facts, whether the content of the news is credible and sourced from official institution.

Abstract

The Industrial Revolution 4.0 is a change in the mechanism for the production of goods and services marked by a number of characteristics, namely the use of the internet of things, big data, automation, robotics, lay computing, to artificial intelligence. This change is not only felt by the private sector, but also by government organizations. What the community, especially students, can do to play a role in this industrial era and take steps and places as the driving force of this country is to develop a pattern of critical thinking that is not easily eroded by negative influences. This means that with the amount of information that can be obtained, students must be able to see which information can be trusted and which is not and do not immediately believe in any information that is not necessarily true. In addition to the various opportunities offered in the Industrial Revolution 4.0 era, there are many new public issues that must be faced, such as online transportation polemics, the threat of e-commerce to conventional shops/retails and cybercrime. This time, we focus on cybercrime, and the problem of violence that occurs through online media in fact poses a problem for the whole community. For this reason, everyone needs to get a good understanding of the impact of cybercrime, and the potential emergence of women as victims of these crimes, such as cyberstalking and cyberpornography.

Abstract

Research in this journal discusses the ideologies that exist in the world and compares and looks for differences with the ideology of Pancasila. The research method used is descriptive analysis which discusses the differences between the ideology of Pancasila and the ideology of communism. In the Pancasila ideology, it is true that the attitudes and characteristics of the humble and flexible Pancasila ideology have contained all existing values ​​and have other ideologies. While the ideology of communism according to Karl Max is so easy to use as a tool of the rulers to realize their desires, either by coercion or using radical methods. Of course, the two ideologies are very inversely proportional, so the Indonesian people establish the ideology of Pancasila by instilling noble values ​​and openness to realize the ideals of the Indonesian State.

Abstract

In this era of globalization where the times are increasingly modern and increasingly advanced, especially in Indonesia, which respects human rights very much, to be able to equalize the right to education in Indonesia is not easy because the territory of Indonesia is very wide and has many differences. Technology in various regions also plays an important role in progress in equitable distribution of education considering that in eastern Indonesia technological progress itself is not evenly felt throughout the community. it is the duty of the government to overcome this challenge for the future of the Indonesian nation and to realize Indonesia's goal of educating the nation's life. Not only because of the region, the difference in social status in society can also affect the distribution of education in Indonesia. In writing this article, it is hoped that it will be a correction for all Indonesian people to always uphold the right to education for all levels of Indonesian society indiscriminately in order to realize it in the ideals of the Indonesian nation as expected by the ancestors.

Abstract

Globalization is unavoidable for all nations, the existence of globalization triggers the entry of capitalism in the joints of the Indonesian economy. The purpose of this study is to analyze the existence of the implementation of the people's economy as an economic sub-system based on Pancasila to face the onslaught of global capitalism. The method in this paper uses the literature study method, by explaining the theory related to the title, which is obtained from journals, documentation books, and the internet. A people's economy based on Pancasila and the 1945 Constitution and Article 33 is an economic system based on the people's economic strength. Where the manifestation of the people's economy itself is in the form of cooperatives and various economic activities or businesses carried out by the people in practice are in the form of MSMEs. The existence of a populist economy can be realized by prioritizing the principles of kinship and justice based on Pancasila and the role of economic actors as partners, to counteract the currents of global capitalism.

Abstract

Pancasila has become a nation of Indonesia as the basis of the agreement of the Republic of Indonesia. Pancasila as the outlook of the nation need to be implemented in everyday life, this has been exemplified by the founders of the nation through hard work and struggle that resulted in the independence of Indonesia. Growing concerns the legal conditions that favor so much of the element of justice makes the thought keen to discuss whether the values taught by the pancasila is still disregarded or ignored. Pancasila which is the ideology of the nation as a way of life and the foundation in the activities of society, nation and state were impressed only used rote without application was included in the legal field. The quality of a country that became the benchmark guarding against the ideology of the nation's highly anticipated to control the implementation of the law with justice is based on the noble values of pancasila. All legislation must be an elaboration of the principles of pancasila. All laws and regulations that are inconsistent with pancasila, null and void. Therefore, in order to understand the accuracy of a legislation then it should be understood by studying the concepts, principles and values contained in pancasila.
