Abstract

Realitas pemberantasan tindak pidana korporasi di Indonesia banyak mengalami kendala, termasuk dalam perkara korupsi. Ketiadaan yurisprudensi yang bisa dijadikan pedoman bagi penegak hukum dan hakim menjadi persoalan yang mendasar dalam mengatasi kegalauan yang selama ini ada.Menarik dipermasalahkan yaitu bagaimanakah urgensi pembangunan yurisprudensi pemidanaan korporasi Pelaku korupsi untuk efektivitas penegakan hukum di Indonesia? Tujuan dari penelitian ini adalah untuk mendorong Mahkamah Agung menginisiasi pembentukan yurisprudensi pemidanaan korporasiPelaku korupsi. Jika telah ditetapkan sebagai yurisprudensi dapat berguna sebagai inspirasi dan dipedomani oleh penegak hukum dan hakim. Penelitian ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan, pendekatan konseptual dan pendekatankasus. Hasil pembahasan mengemukakan bahwa beberapa putusan pemidanaan terhadap korporasi Pelaku korupsi memiliki kaidah hukum baru yang perlu mendapatkan perhatian penegak hukum dan hakim Pengadilan Tipikor. Kaidah hukum baru tersebut perlu dipertimbangkan untuk dijadikan yurisprudensi sehingga bisa menjadi solusi atas kendala efektivitas pemberantasan korupsi korporasi yang selama ini ada. Mengingat persyaratan yurisprudensi pemidanaan korporasi Pelaku korupsi telah terpenuhi maka sesegera mungkin dapat dimulai proses dan tahapannya oleh Mahkamah Agung.The reality of the eradication of corporate crime in Indonesia has many obstacles, including in corruption cases. The absence of jurisprudence that can be used as a guide for law enforcers and judges to be a fundamental problem in overcoming the turmoil that has been there. Interest in question is how urgency of jurisprudence development corporations corruption Actors of corruption for the effectiveness of law enforcement in Indonesia? The purpose of this study is to encourage the Supreme Court to initiate the formation of corporate criminal prosecution jurisprudence. If it has been established as jurisprudence can be useful as an inspiration and guided by law enforcement and judges. This research uses normative research method with the approach of legislation, conceptual approach and approach of case. The results of the argument suggest that some criminal verdicts against corporations Perpetrators of corruption have new legal rules that need to get the attention of law enforcers and judges of the Corruption Court. The new law rules need to be considered for jurisprudence so that it can be a solution to the obstacles to the effectiveness of corruption eradication of corporations that have been there. In view of the requirements of corporations punishment lawsuit The perpetrators of corruption have been fulfilled as soon as possible can begin the process and its stages by the Supreme Court.

Abstract

This paper examines the regulation of piracy and armed robbery at sea in international law applicable globally and applicable only in a certain region. This research will review the elements of piracy and armed robbery at sea then made a distinction between both crimes. It will be found that there are problems that still not legally regulated in existing international regulation concerning piracy and armed robbery at sea or it has been regulated but still cause a problem in the prosecution of both crimes. It is a normative research which concludes that the regulation of armed robbery at sea is found only in regional international legal rules, unlike the regulation of piracy that exists in international rules that applied globally. The existing regulations leave problems concerning areas where a crime such as piracy-like act will be difficult to categorize as piracy or armed robbery at sea.

Abstract

Law No. 30 of 2014 concerning Government Administration (UU AP) stipulates two types of Administrative Actions, namely Government Decrees and Government Administrative Actions. In judicial practice in the administrative courts, the term Government Administrative Action is often interpreted differently from the concept of Real Action. This study aims to determine the concept of Government Administrative Action according to Law No. 30 of 2014 concerning Government Administration. The writing method used in this research is normative juridical method using statutory approach and conceptual approach. The results of the study show that the concept of "Government Administrative Action" in Article 1 point 8 of the UU AP can be interpreted grammatically, historically and systematically as Real Action as referred to in Article 87 letter a of the UU AP. The jurisdiction for administrative dispute where the objects are “real act” (government administrative action) and “written decision” (government decrees) lays on administrative court, where as for other legal acts which cannot be classified as real act (government administrative action) or written decision (government decrees) lays on the general court as residual jurisdiction (resrechter).

Abstract

The purpose of this research was to whether the actions of government (bestuurshandeling) based on its discretion can be classified as a criminal act of corruption or not. The Methodology of this research used juridical doctrinal. The result showed that based on legal frame such as Law of The Administrative Court, Law of ASN, Law of Government Administration and legal doctrines as well as the Decision of the judicial review of the Constitutional Court Number: 25 / PUU-XIV / 2016 responsibility of governmental actions (bestuurshandeling), which comes from discretionary (Freies ermessen) containing elements of abuse of authority resulting state loss but there is no element of corruption such as gratifications, bribe, then it can be accounted for by the administrative sanctions under the Law of Government administration Article 20 (6) and Article 80 paragraph (1) Jo Article 81 paragraph (3) in a balanced and case by case. If there is an element of abuse of authority that resulted in state loss and there are elements of corruption such as gratifications, bribe, then accounted for under the criminal law, especially corruption.Keywords: Public responsibility, corruption, governmental actions (bestuurshandeling), Public discreations (Freies Ermessen)

Abstract

Illegal fishing is a serious problem that must be addressed because it is very harmful to the preservation of resources and economically detrimental for the country. According to Article 73 paragraph (1) of Law Number 45 Year 2009 investigation of criminal offenses in the field of fisheries carried out by the Civil Servant of Fisheries Investigators, Navy Investigators (TNI AL), and/or Police Investigator of the Republic of Indonesia. Furthermore, in Article 69 paragraph (4) the investigator and/or fisheries supervisor can perform specific actions such as burning and/or sinking of foreign-flagged fishing vessels based on sufficient preliminary evidence. In the explanation mentioned that special action is performed is not arbitrary but is done when the investigator and/or fisheries supervisor convinced that foreign fishing vessels that have committed the crime of fisheries. For the commander of KRI the act of shooting and/or sinking foreign fishing vessels must meet the requirements of the state where the vessels are doing things that are contrary to the pursuit, arrest, inspection and investigation, for example escape or resistance. Research results can be concluded that the act of shooting or sinking and exterminating evidence of foreign-flagged fishing vessels that sufficient evidence of a criminal act fisheries in WPP RI in practice can be done by means of hot pursuit, in the process of investigation and carry out the determination of the court. Due to the sinking of the vessel does not bring bad influence on Homeland relationships with the countries concerned and will provide a deterrent to potential offenders of other fisheries crime act. Waqf is a legal act wakif to separate and / or give up some of their wealth either permanently or for a specified period in accordance with its importance for religious purposes and / or general welfare according to sharia. Abstract

In the last decade post Soeharto, Good Governance (GG) has been often heard like a `mantra'. GG seems easily uttered talkative, formalized, and grew into a dominant political ideals as well as major constitutional and public administration discourse which have rooted in law, policy, and higher education. Like a rooster crowing in the morning, he continued to speak out in the mornings, wide box spawn 'governance, such as 'good forestry governance, 'good financial governance, 'good university governance, and many others. GG, in that context, seems like an appropriate nutrition to overcome the weakness of the Indonesian legal system, corrupt bureaucracy, and the predatoric political leadership. In this regard, it should be viewed more closely, what is actually superiority owned when GG is talked? Obviously, the law is one of the tools to ensure the operation of the mantra in its implementation, and based on master research conducted in 2005-2006, focusing on the issue of the Law Reform by applying a socio-legal approach. As a result, this study gave the fact which is different or even contrary to the ideals of political buildings or formalized or materialized law and policy. For example, one study showed that the GG in the context of legal reform in Indonesia actually very sinister and weakening the guarantee of human rights. Law, especially product of legislation and institutions, as well as its machinery transmission are dominant in advocating free market (free market friendly legal reform). Perhaps, the conclusions is not popular in the middle of the noisy speech spelling of GG and its projects. However, Indonesia today shows the continuation of massive corruption, violation of human rights, impunity and all the non protection situation in the Indonesian legal system.Keywords: Good Governance, Law reform, Sosio Legal approach

Abstract

Pemerintah berupaya gencar memberantas penyalahgunaan dan peredaran narkotika di Indonesia yang kerap terjadi dan telah menerobos berbagai lapisan masyarakat. Di institusi TNI, tidak jarang ditemui oknum prajurit TNI terlibat dalam penyalahgunaan narkotika, terlihat dari banyaknya perkara pidana narkotika yang disidangkan di pengadilan militer di beberapa wilayah Indonesia. Sampai saat ini belum ada regulasi khusus dari internal TNI yang mengatur Oditur Militer dalam mengeksekusi terdakwa sesuai perintah putusan untuk melaksanakan rehabilitasi medis dan sosial di rumah sakit yang ditunjuk. Lebih lanjut, belum ditemukan peraturan yang menunjuk rumah sakit milik pemerintah ataupun rumah sakit milik kedinasan di institusi TNI sebagai tempat rehabilitasi medis dan sosial yang dikhususkan bagi Prajurit TNI aktif. Tujuan penelitian ini untuk mengidentifikasi upaya yang bisa dilakukan agar perintah putusan pengadilan untuk melakukan rehabilitasi medis dan sosial dapat terlaksana di lingkungan institusi TNI dan sesuai dengan amanat undang-undang. Penelitian ini menggunakan metode hukum normatif dengan didasarkan pada pengkajian hukum positif. Penelitian ini menggunakan bahan hukum primer berupa undang-undang dan putusan pengadilan, bahan hukum sekunder berupa buku-buku, jurnal, tesis dan lain sebagainya. Pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach) digunakan dalam penelitian ini. Beberapa putusan tingkat kasasi dalam amar putusannya memerintahkan terdakwa (prajurit TNI yang didakwa) untuk melaksanakan rehabilitasi medis dan sosial, hal ini merupakan langkah progresif atau terobosan baru di ranah peradilan militer. Namun demikian, ditemui kendala dalam pelaksanaan eksekusinya. Oleh sebab itu, perlu dibuat regulasi khusus di internal institusi TNI untuk menetapkan rehabilitasi medis dan sosial terhadap prajurit yang terlibat penyalahgunaan/pecandu narkotika. Inisiasi kerja sama institusi TNI dengan beberapa rumah sakit pemerintah dan/atau seluruh rumah sakit milik TNI yang dilengkapi dengan unit rehabilitasi medis dan sosial juga perlu dilakukan.The government has aggressively combat drug abuse and trafficking in Indonesia, which often happens that even had penetrated various layers of the society. This makes narcotics related crime was categorized as an extra ordinary crime, requiring special and ongoing handling. In TNI institutions there were many TNI soldiers involved in narcotics abuse as there are still many narcotic criminal cases being tried in military court in some parts of Indonesia. There is no special regulation within the TNI institution that regulates the Military Oditur to execute the defendant in accordance with the order of the decision to carry out medical and social rehabilitation at the designated hospitals. Furthermore, no regulations have been formulated that assigns state-owned hospitals or government-owned hospitals in TNI institutios as a special medical and social rehabilitation center for TNI soldiers. This study aims to identify measures that can be done in order to command the court's decision can be implemented in the environment and in accordance with the military institution mandated by law. The method used in this study is normative law research based on positive law study. This study uses the primary legal materials in the form of law and court decisions, secondary legal materials in the form of books, journals, theses and so forth. A statute approach and case approach were used in this study. Several judgments of appeal as yudex juris mention in the ruling ordered the defendant (TNI soldiers indicted) to carry out medical and social rehabilitation is a progressive step or a new breakthrough in the realm of military court, although encountered obstacles in the execution. Need to be made in the internal regulation of the military institutions to establish medical and social rehabilitation of the soldiers involved in the abuse / drug addicts. Initiation TNI cooperation with several goverment hospitals or owned hospitals in TNI institutions equipped with medical and social rehabilitation unit also needs to be done.

Abstract

Legal disputes between entrepreneurs and consumers are currently caused by several things, one of which is the inclusion of an exoneration clause. The inclusion of the clause has clearly contradicted Law Number 9 of 1999 concerning Consumer Protection and has detrimental to the rights held by the Consumer. In addition, in terms of the Agreement Law, the entreprenurs that includes the exoneration clause clearly does not heed the principle of good intentions by utilizing the weak position of the consumer. The violation of the rights held by consumers, consumers can claim compensation and sue the entrepreneurs through various legal remedies. given by law. In this study also will discuss the legal consequences and legal efforts that can be submitted by the Consumer for the application of the Exoneration Clause in an agreement. The research method that will be used in this research is normative juridical, namely the approach using various data sources such as articles of legislation, various legal theories, and scientific works of scholars. The data used in this study comes from secondary data and tertiary data collected in accordance with the object written. After that, all legal materials that have been collected are inventoried and identified according to the problems that have been formulated. The conclusion of this study is to provide a legal understanding to consumers who are disadvantaged by the inclusion of an exoneration clause and provide advice in the form of legal remedies that can be taken.

Abstract

Perubahan UUD NRI Tahun 1945 membawa perubahan besar dalam sistem kekuasaan kehakiman. Pembentukan lembaga baru seperti MK dan KY selain MA, diharapkan dapat mewujudkan cita-cita reformasi dengan prinsip checks and balances. Manifestasi pengaturan kewenangan lembaga kekuasaan kehakiman secara atribusi diatur dalam Pasal 24, 24A, 24B dan 24C UUD NRI Tahun 1945.  Berdasarkan sifatnya kewenangan kekuasaan kehakiman mencakup kewenangan limitative dan non limitative yang diatur melalui undang-undang masing-masing lembaga. Namun, pengaturan kelembagaan kehakiman tersebut menimbulkan dilematisasi dan ketidak harmonisan hukum. Hal ini diakibatkan multi tafsir pengaturan kewenangan masing-masing lembaga. Sehingga polemik kelembagaan tersebut diselesaikan melalui proses judicial review. Permasalahan muncul ketika proses revisi undang-undang yang dibatalkan oleh MK, tidak dipenuhi dalam proses legislasi sehingga tetap memunculkan disharmonisasi hukum antar kelembagaan kekuasaan kehakiman.
