Abstract

Based on the results of this study it is known that all court decisions fully adhere to the principle of legality in the application of legal subjects and offenses under the Banking Act listed in Article 46 s.d. 50 A, which no one applies corporate crime. In addition, there is the application of the Special Law, namely the Law of the Republic of Indonesia Number 20 Year 2001 on the Amendment of Law Number 31 Year 1999 on the Eradication of Corruption, for banking crimes which contain elements of state losses. Banking Act is more oriented on the offender (person), not yet seen victim-oriented criminal type so it should also be considered the existence of criminal damages and corporate probation for corporations with the condition to pay compensation to the victim. However, this idea has not been able to work because of Law Number 10 Year 1998 on Amendment to Act Number 7 of 1992 concerning Banking, the corporation is not a subject of criminal law and may be threatened under the Banking Act.Based on the court ruling that always adheres to the principle of legality, the Special Law related to banking crimes that have included corporations as legal subjects, the application of corporate crime in some countries, the concept of the Criminal Code and some research results or studies of banking victims (bank customers), it is necessary to amend the Banking Law by using Strict Liability theory (in the application of Article 46 paragraph (2) for corporations undertaking unauthorized fund raising) and elaborating Vicarious Liability and Identification theory (particularly the application of Articles 49 and 50 A) so as to include some elements, namely 1) adding the subject of corporation law; 2) in the case of the criminal sanction penalapaan maximum penal amount of material damages suffered by the community (bank customers) and seize the property of perpetrators who came from banking crime to be used to compensate victims (bank customers); 3) to extend the scope of criminal subjects which previously only regulates Shareholders, Board of Commissioners, Directors, Employees and Affiliated Parties to include parties involved in banking crime. Key Words: criminal liability, corporation, banking.

Abstract

The background of this research is Law number 30 of 2014 Section 20 states that if the result of Supervision of Government Internal Apparatus (APIP) in the form of administrative error, follow up in the form of administrative improvement, if there are administrative errors that cause loss of state finance done financial loss state and state losses are imposed on the Governing Body, if an administrative error occurs not due to an element of abuse of Authority. This is certainly contrary to the law of corruption. The issues raised in this study are how the role of the Police and the obstacles in handling reports of alleged abuse of authority in corruption after the enactment of Law No. 30 of 2014 on Government Administration, as well as what steps are needed for the handling of corruption can effectively prevent loss of state finances. This research uses qualitative method with empirical juridical approach. The results of the research indicate that the role of the Police in handling the report of alleged misuse of authority in corruption crime after the enactment of Law No.30 of 2014 is in handling the report of alleged abuse of authority, it is first the Police consult with experts, general experts, social experts and politics whether abuse of authority is included in the criminal realm or administrative error domain. In addition it is suggested to put forward on the results of supervision of APIP. Polri's obstacles in handling reports of alleged abuse of authority are: a) investigation of alleged misuse of authority done by APIP, b). No involuntary summons c) If there are administrative errors that incur losses of state finances, subsequent reversals are made to the state's financial loss so it can not be criminalized. Measures necessary for the handling of criminal acts of corruption can effectively prevent financial losses of the state a) Police cooperate and / or coordinate with BPK, KPK, PPATK, and other government agencies in law enforcement efforts and state financial loss returns; b) corruption prevention and prevention is actualized in the form of strategies to minimize the four aspects of the causes of corruption. Abstract

The problem of seafarers' protection in the implementation is still far from expectations. This is evident in the employment practices in the maritime field there are still things that are not in accordance with those established in the Manpower Act. Where entrepreneurs still make their own rules for the benefit of the company regardless of what the rights of its workersBased on the results of the study it was concluded that the state protection for maritime workers is still weak and slow from the threat of maritime security and safety. Other issues such as wages, maritime employment contracts, Indonesian maritime profession certification, strikes, unilateral layoffs, severance pay, freedom of association of maritime workers, and foreign seafarers' labor are issues that have hitherto been a problem both from shipping companies and labor Indonesian seafarers. The state must be fair in the payroll system, the internal control function must still have external supervision, the need for ministerial or presidential decree on the standard salary of Indonesian seafarers.Keywords: Legal Protection, Sailors, Contract System

Abstract

AbstractThis study is made to know and understand about the roles that are performed by the political parties in doing some supervisions of the cadres on DPRD. So that, based on the supervisions above are expected to improve the performances and qualities for the citizen’s representation. The council members are the representation of their citizen. They must be able to reflect on their wishes of their represented people in country. But, in fact the roles of the political parties are the most dominant and able to shift the meaning of the actuality representatition it self.The authority is strenghtened with the right of politic parties to make an interm change for all the members of council who are unfollow their rules and make the cadres are unfreely to vote.This study is using Descriptive Analyst Method through by some interviews with the most valuable competent persons to answer all the problems. The council members are the representation of their citizen. They have a responsibility in accomodating people’s aspiration. In other hand, they also as a representation of their political parties because they are chosen by political parties they have joined. So, they are bound indirectly with the rules and the decisions made by their parties. So that, with this fact can show that the council members are unfreely speak out on behalf of their citizen’s aspirations.Keyword : The Council Members, Political Parties,Supervision, Citizen. AbstrakPenelitian ini bermaksud untuk mengetahui serta memahami bagaimana peran yang dilakukan partai politik dalam melakukan pengawasan terhadap kadernya yang duduk di DPRD, dengan adanya fungsi pengawasan yang dilakukan partai politik diharapkan dapat meningkatkan kinerja dan kualitas perwakilan bagi anggota DPRD sebagai wakil rakyat. Anggota Dewan merupakan representasi masyarakat yang diwakili, maka harus mampu mencerminkan atas keinginan masyarakat yang diwakili. Namun, besarnya peran partai politik mampu menggeser makna dari representasi yang dimiliki anggota dewan. Kewenangan partai politik diperkuat dengan hak partai untuk melakukan pergantian antar waktu bagi anggota dewan yang tidak mengikuti garis partai, yang menjadikan anggota dewan tidak mempunyai kekuasaan secara bebas dalam bersuara mewakili konstituen. Penelitian ini menggunakan metode deskriptif analisis, melalui wawancara dengan pihak-pihak terkait yang dipandang kompeten, untuk menjawab permasalahan yang ada. Anggota DPRD merupakan wakil rakyat, yang mempunyai tanggungjawab menampung aspirasi masyarakat, namun anggota DPRD juga merupakan representasi partai politik karena mereka dipilih melalui partai politik, sehingga secara tidak langsung mereka terikat oleh aturan atau keputusan yang dibuat oleh partai politik. dengan kenyataan ini menunjukkan bahwa anggota dewan tidak dapat secara bebas dalam bersuara mewakili aspirasi konstituenya.Kata kunci: Anggota Dewan, Partai Politik, pengawasan, Masyarakat / Konstituen

Abstract

ABSTRAKOptimalisasi peran DPRD adalah hasil kerja yang dicapai oleh DPRD sesuai dengan wewenang dan tanggung jawabnya. Indikator pengukuran kinerja organisasi publik adalah efektivitas, responsivitas, akuntabilitas. Undang Nomor 23 Tahun 2014 menegaskan terkait dengan fungsi DPRD sebagai berikut, dalam pasal 149 ayat (1)fungsi pembentukan perda, (2) fungsi Anggaran; dan (3)fungsi pengawasan, dilihat dari ketiga fungsi tersebut dalam penelitian ini difokuskan pada fungsi pembentukan perda. Hasil penelitian menunjukkan bahwa DPRD kota Pekalongandalam menjalankan fungsi pembentukan perda bertumpu pada tiga pengertian, yaitu prakarsa pembuatan Perda, Pembahasan rancangan Perda, serta persetujuan atas pengesahan rancangan perda. Berdasarkan fakta yang ada bahwa pelaksanaan fungsi pembentukan perda DPRD kota pekalongan dilihat dari jumlah produk yang dihasilkan cenderung menurun, dilihat dari kehadiran dalam sidang rendah,dilihat dari tata kerja sering tidak mematuhi tata tertib, dilihat dari pengalaman banyak anggota yang baru, dilihat dari hubungan kemasyarakatan sering gagal mengolah informasi sehingga pelaksanaan fungsi pembentukan perda DPRD Kota Pekalongan masih terbatas pada persetujuan dan pengesahan perda saja sehingga boleh dikatakan belum optimal.Langkah-langkah yang perlu ditempuh untuk mengoptimalkan fungsi pembentukan perda DPRD Kota Pekalongan adalah berkomitmen yang tinggi akan pekerjaanya, komunikasi yang supel disemua lini, bintek profesional yang berkesinambungan, dan adanya sanksi yang tegas dari partai politik pengusungnya.Kata kunci: Optimalisasi, DPRD, Pembentukan Peraturan Daerah. ABSTRACTOptimizing the role of DPRD is the work achieved by the DPRD in accordance with the authority and responsibility or as a description of the size of the results achieved from an activity whether viewed qualitatively and in accordance with the vision, mission of an organization concerned. Performance indicators of public organization, responsiveness, accountability. Law Number 23 Year 2014 functions related to the Regional People's Legislative Assembly as follows, in Article 149 Paragraph (1) The Functions of Regional Regulation, (2) The Function of the Budget; (3) Supervision, seen from this function in this research.The result of the research shows that the DPRD of Pekalongan City in carrying out the function of the formation of perda rests on three definitions, namely the initiative of Perda making, Discussion. Local regulations, and approval of approval. Based on the fact that there is a design of the function of the local parliament of the city of Pekalongan seen from the number of products it produces decreased, seen from the low scale, seen from the working order is often not crowded the order, seen from the experience of many new members, seen from community relations often fail to process information , seen from the lack of educational relevance, so that the implementation of the function of the formation of regional parliament of Pekalongan City is still limited to the approval and legalization of local regulations only to be considered not optimal.The steps that need to be taken to optimize the function of the formation of perda DPRD Pekalongan City is a high commitment to the work, the communication in all lines, professional continuous bintek, and the firm action of the political party bearers.Keywords: Optimization, DPRD, Formation of Local Regulation.
