Abstract

Traditional market is the embryo of the beginning of the economy in Indonesia. But lately the traditional market seems to be eroded by the emergence of an increasingly modern market. Competition seems to occur clearly between these two markets, especially in the city of Semarang which is the number of modern markets are increasingly mushrooming. The existence of City Regulation No. 9/2013 Semarang which regulates the traditional market is expected traditional markets still exist in the modern era that has emerged modern market.In this study discusses the current condition of traditional markets in the midst of the emergence of modern markets in Semarang City and How the role of local governments in providing legal protection against the existence of traditional markets in the city of Semarang By using sociological juridical research methods, is expected to observe directly the implementation of the Act / Regional Regulations that have been established by the Local Government of Semarang City with the reality in practice. Researchers in this case make a direct observation about the trading process in the traditional market of Semarang City. The results showed that the economic activity in Traditional Market is slightly disturbed by the emergence of modern market in Semarang City. And with such conditions the traditional market usually makes a strategy to stay competitive with Modern Market. Traditional market conditions in the city of Semarang is still far from expected, the impression of slums, less regular arrangement is still found in the traditional market of Semarang City. And the government of Semarang city is still not maximized when giving sanctions against the economic actors who violate the rules that have been set.Keyword: The Role of Semarang City Government, Traditional Market

Abstract

In Indonesia there are many criminal acts, one example is the violence that often occurs in a household or commonly called the act of violence in the household. Households should be a shelter for all family members. However, in reality many households become places of suffering and torture because of violence. Domestic violence is a problem that can not be overcome by using the Criminal Code. Because in the Criminal Code only regulate the general form of violence. So that made Law No.23 Year 2004 about abolition of violence in the household. In handling cases of domestic violence is different from the handling of other criminal cases, and domestic violence is a crime complaint where the victim can revoke his report when it has considered everything for the good of his family. Household is a very privacy because household should not be public consumption hence handling of cases of KDRT usually experience barrier. Where a household should be a refuge for members of his family but often violence caused by several factors. In solving the domestic violence problem, it lacks sufficient and specific protection, and even the main problem relating to law focuses on the absence of laws that specifically provide protection for victims in domestic violence in Indonesia. Abstract

AbstrakSidik jari sebagai alat bukti dalam proses penanganan sebuah tindak pidana khususnya pembunuhan bukan menjadi hal yang baru karena termasuk dalam alat bukti yang sah sesuai dengan peraturan perundang-undangan yang terkait. Dalam penanganan tindak pidana pembunuhan, proses identifikasi pelaku menjadi sangat penting untuk mengetahui pelaku kejahatan dan dikaitkan dengan sebuah sidik jari dan dalam hal ini perlunya pemahaman analisa hukum terhadap fungsi sidik jari pelaku dalam penanganan tindak pidana pembunuhan. Terkait peran sidik jari sebagai alat bukti dalam mencari kebenaran pada sebuah tindak pidana, memiliki dasar hukum dimana bahwa dasar bagi kepolisian dalam melaksanakan penindakan sebuah tindak pidana dengan menggunakan alat bukti berupa sidik jari dalam hal ini bahwa wujud konkret dari keterangan atas suatu sidik jari dalam suatu perkara pidana dapat berbentuk surat keterangan yang dibuat oleh seorang ahli yang dapat dikualifisir sebagai alat bukti surat. Dalam hal ini Polres Tegal berupaya mengatasi hambatan-hambatan yang terjadi baik hambatan eksternal maupun internal dengan berbagai solusi dalam kasus pembunuhan yang dimana tidak mudah dalam melaksanakan identifikasi pengambilan sidik jari karena berhasil atau tidaknya perolehan sidik jari dipengaruhi oleh keadaan sekelilingnya.Keywords: Sidik Jari, Pelaku Tindak Pidana, Pembunuhan. AbstractFingerprints as evidence in the process of handling a criminal act especially murder is not a new thing because it is included in legal evidence in accordance with the relevant legislation. In the handling of criminal acts of murder, the process of identifying the perpetrator becomes very important to know the offender and associated with a fingerprint and in this case the need for an understanding of legal analysis of the fingerprint function of the offender in handling murder offenses. In relation to the role of fingerprints as evidence in seeking the truth of a crime, it has a legal basis that the basis for the police in carrying out a criminal act by using evidence in the form of fingerprints in this case that concrete form of information on a fingerprint in a a criminal case may take the form of a certificate made by an expert who can be qualified as a proof of mail. In this case the Tegal Police is trying to overcome the obstacles that occur both external and internal barriers with various solutions in cases of murder which is not easy in implementing fingerprint identification because the success or failure of fingerprint acquisition is influenced by the circumstances surrounding it.Keywords: Fingerprint, Criminal Act, Murder.

Abstract

ABSTRAKPenelitian dengan judul Upaya Direktorat Reserse Narkoba Dalam Penanggulangan Tindak Pidana Narkotika Jenis Baru. Berdasarkan uraian uraian dalam Penelitian ini, permasalahan yang akan diteliti adalah: 1) Bagaimana upaya yang dilakukan Direktorat Reserse Narkoba secara umum apabila ditemukan narkoba jenis baru dan cara menanggulangi penyebarannya? 2) Bagaimana kebijakan Direktorat Reserse Narkoba yang seharusnya dalam penanggulangan tindak pidana Narkotika jenis baru?Hasil penelitian menyimpulkan bahwa : 1) Upaya Direktorat Reserse Narkobadalam penanggulangan kejahatan tindak pidana narkotika jenis baru melalui dua cara yaitu menggunakan upaya secara non-penal dan penal. Upaya non penal yang dilakukan secara preemtif dan preventif dengan dilakukannya tindakan rekayasa sosial (Social Engeenering) dengan melakukan tindakan mengawasi. 2)  Upaya yang dilakukan oleh Direktorat Reserse Narkoba dalam penanggulangan tindak pidana narkotika jenis baru dengan menggunakan upaya secara penal. Apabila barang bukti tersebut ternyata mengadung zat narkotika yang sudah terlampiran dalam undang-udang narkotika maka penyalahguna narkotika jenis baru dapat dijerat menggunakan Undang-Undang Nomor 35 Tahun 2009 Tentang Narkotika sesuai golongan jenis zat narkotika yang ditemukan dalam barang bukti. Jika barang bukti tersebut memang tidak memiliki unsur turunan dari narkotika yang sudah ada maka masih bisa dilakukan penanggulangan dengan Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan dan hukuman yang diberikan bagi penyalahguna narkotika jenis baru sangatlah ringan.Kata Kunci : Penanggulangan Tindak Pidana, Narkotika, Jenis Baru ABSTRACTResearch with the title Efforts of the Directorate of Drug Investigation in the Crime of New Narcotics Crime. Based on the description of the description in this Research, the issues to be investigated are: 1) How is the effort done by the Directorate of Drug Investigation in general if found a new type of drug and how to cope with the spread? 2) What is the policy of the Directorate of Drug Investigation that should be in the handling of new Narcotics criminal acts?The results of this study conclude that: 1) Efforts of the Directorate of Narcotics Investigation in the handling of crime of new types of narcotics through two ways, namely using non-penal and penal effort. Non-penal attempts are undertaken by preemptive and preventive action by social engineering (Social Engeenering) by taking control measures. 2) Efforts made by the Directorate of Drug Investigation in the handling of new types of narcotics using penal efforts. If the evidence is found to contain illegal substances that have been attached to the narcotics law then a new type of narcotics abuser can be charged under Law Number 35 Year 2009 on Narcotics according to the type of narcotic substance found in the evidence. If the evidence does not have a derivative of existing narcotics then it can still be done with the prevention of Law Number 36 Year 2009 on Health and punishment given to the narcotics abusers of a new type is very light.Keywords: Crime Countermeasures, Narcotic, New Type

Abstract

ABSTRAK Setiap instansi pemerintah (termasuk Polda Jateng), wajib mempertanggungjawabkan kinerjanya. Oleh karena itu perlu disusun suatu sistem akuntabilitas kinerja instansi pemerintah yang terintegrasi dengan sistem perencanaan strategis, anggaran, dan akuntansi pemerintah sebagaimana tertuang pada Peraturan Presiden RI Nomor 29 Tahun 2014 tentang Sistem Akuntabilitas Kinerja Instansi Pemerintah (SAKIP). SAKIP meliputi perencanaan, pengukuran, dan pelaporan kinerja. Pelaporan kinerja dikenal dengan nama Laporan Akuntabilitas Kinerja Instansi Pemerintah (LAKIP). Pada realitanya, Polda Jateng mengalami beberapa kendala saat mengimplementasikan SAKIP dalam bentuk LAKIP. Hal ini disebabkan karena Polda bukan merupakan entitas/satuan kerja yang mengelola anggaran, namun hanya melaksanakan kewenangan manajerial.Tujuan penelitian ini adalah untuk mengetahui upaya-upaya yang dilakukan Polda Jateng dalam mengatasi kendala pembuatan LAKIP.Penelitian ini merupakan penelitian hukum yuridis empiris, bersifat deskriptif analitis. Lokasi penelitian di Polda Jateng. Jenis dan sumber data terdiri dari data primer (LAKIP Polda Jateng) dan data sekunder (berupa bahan hukum primer dan sekunder). Pengumpulan data dilakukan dengan menggunakan metode studi kepustakaan, observasi, dan wawancara. Analisis data menggunakan analisis kualitatif.Hasil penelitian menunjukkan bahwa untuk mengatasi kendala pembuatan LAKIP, maka Polda Jateng melakukan evaluasi pencapaian target per indikator kinerja utama setiap tri wulan guna mengantisipasi adanya kegiatan yang bias atau kurang mendukung pencapaian indikator kinerja. Tim pokja juga memberikan masukan kepada wakapolda agar diadakan evaluasi secara terintegrasi dengan semua penanggung jawab fungsi per sasaran indikator kinerja utama.Kata Kunci : akuntabilitas kinerja, indikator kinerjaABSTRACT Every government agency (including the Central Java Regional Police), shall be held accountable for its performance. Therefore, it is necessary to develop a performance accountability system of government agencies integrated with strategic planning system, budget , and government accounting as stated in Presidential Regulation No. 29 of 2014 on Government Institution Accountability System (SAKIP). SAKIP includes planning, measuring, and reporting performance. Performance reporting is known as the Government Institution Performance Accountability Report (LAKIP). In reality, Central Java Police experienced several obstacles when implementing SAKIP in the form of LAKIP. This is because the Polda is not an entity / work unit that manages the budget, but only exercises managerial authority.The purpose of this research is to know the efforts made by Central Java Police in overcoming the obstacle of making accountability reporting performance according to Presidential Regulation Number 29 Year 2014.This research is an empirical juridical legal research, analytical descriptive. Research location in Central Java Police. The types and sources of data consist of primary data (in the form of performance accountability report of Polda Jateng) and secondary data (in the form of primary and secondary legal material). Data collection was done by using literature study method, observation, and interview. Data analysis using qualitative analysis.The results showed that to overcome the problem of making LAKIP, the Central Java Police made various steps. This step is evaluating the achievement of the target per key performance indicator every quarter to anticipate the existence of activities that are biased or less support the achievement of performance indicators. The working group also provided input to the police commander for an integrated evaluation with all personnel responsible for the key performance indicators.Keywords : performance accountability, performance indicators

Abstract

The 1945 Constitution of the State of the Republic of Indonesia authorizes local governments to organize and manage their own governmental affairs according to the principle of autonomy and co-administration. Implementation of local government in carrying out its duties, authorities, obligations and responsibilities under higher legislation may establish regional policies formulated in regional or local regulations. Such regional policy shall not be contrary to the higher laws and regulations and the public interest and other regional regulations.Local Government of Magelang Regency has a regulation regulating the implementation of Livestock Business namely Regional Regulation No. 2 of 2013 on Livestock Business (Lembaran Daerah Magelang Regency Year 2013 Number 2). However, there is disharmonization with other laws and regulations that are equal. There are several articles in Regional Regulation No. 2 of 2013 on Livestock Businesses that are not in harmony with other Regional Regulations resulting in disharmonization.The need for harmonious and integrated legislation is an indispensable requirement for the realization of order, ensuring legal certainty and protection. Efforts that can be done to overcome disharmonization of a legislation such as, namely; To revoke certain articles that have disharmony or all articles of legislation in question by the institution / institution authorized to form it, to submit a judicial review request to the judiciary, to ensure that the process of formulating the law shall be conducted in accordance with the principle of legal certainty, harmonization , Rounding, consolidation of the conception of the draft Local Regulation, is an attempt or process to realize harmony, conformity, harmony, suitability and balance among various elements in drafting the draft Law as a unanimity of a whole, compact or solid idea as an integral part of the whole system Hierarchically arranged legislation. Keywords: Disharmonization, Regional Regulation on Livestock Businesses of Magelang, Efforts to prevent disharmony

Abstract

The jurisdiction of the Central Java Regional Police (Central Java Regional Police) can not be separated from the investigation of telecommunication crime, reports often appear in the area of Central Java Province. One of them is based on Police Report. Pol .: LP / A / 176 / V / 2014 / Jateng / Reskrimsus, dated May 8, 2014, alleged criminal act of selling / trading telecommunication equipments and equipments that do not comply with the required standards & rules of law and / or sell / Trade in telecommunication tools and equipment not equipped with certificate number or not in accordance with the certificate number, as referred to in Article 52 Act no. 36 of 1999 on Telecommunications and / or Article 62 paragraph (1) of Law no. 8 Year 1999 About Consumer Protection. That is why law enforcement based on applicable law needs to be applied so that in its implementation there is no disadvantaged party especially the consumer as the buyer. The legal sanction is contained in Article 62 paragraph (1) of Law Number 8 Year 1999 concerning Consumer Protection, namely a maximum imprisonment of 5 (five) years or a fine of not more than Rp 2,000,000,000.00 (two billion Rupiah).Society as a consumer must be empowered and understand things related to consumer protection. Abstract

The Criminal Justice System as a system in criminal law enforcement seeks to address crime issues is interpreted as an attempt to control or limit crime to be within the limits of public tolerance. Issues raised in this study include: 1) what are the obstacles faced by Police investigators in the implementation of the investigation related to the criminal justice system and how to deal with these barriers ?; 2) how is the criminal justice system investigation policy that should be implemented?The approach method used in this research is normative juridical approach method.The results of this research are: 1) obstacles faced by Police investigators in criminal investigation process are: a) lack of witness participation in giving information in process of investigation; b) there are still many investigators whose education level is still low; c) limited number of investigators; d) inadequate income / salary factor of the investigator; e) lack of budget for investigation; f) inadequate facilities and infrastructure to support investigator performance. The way to overcome the obstacles faced by Polri investigators in the implementation of the investigation related to the criminal justice system in the police station is: a) the need to make the law on duty and authority; b) the need for presence or willingness to bear witness to what is seen, experienced, and known; 2) the investigation is regulated in the Draft of Criminal Procedure Code II of Investigator and Investigation and Chapter IV Arrest, Detention, Body Search, House Income, Foreclosure and Letters Inspection. The investigation process of Police as regulated by Draft of Criminal Procedure Code is as follows: a) arrest; b) searches; c) detention; d) eavesdropping. Keywords: Investigation, Investigator, Police, Criminal Justice System

Abstract

The number of criminal acts committed by the community, especially the criminal act of murder, made the police officers investigators to conduct investigations. In particular Criminal Acts Murder crime requires the use of evidence or some kind of other guidance commonly referred to as the reconstruction of criminal acts, this makes the author want to know how the reconstruction as an effort to uncover the crime of murder planning case study of banyumanik polsek semarang law. The issues raised are what is the implementation of the reconstruction in an effort to uncover the crime of premeditated murder, what are the necessary reconstruction in an effort to reveal the crime of premeditated murder, what kind of criminal law policy in Indonesia in the field of reconstruction in an effort to reveal the crime of premeditated murder in the future come.The method used by the authors in making this thesis is the method of sociological juridical approach, namely by conducting interviews and perform data collection both from primary data and secondary data.According to the results of the authors' research, the implementation of the reconstruction is regulated in the Attachment to Decree of the Chief of Police. Abstract

State losses are one of the elements that must exist in the criminal act of corruption in the core sense other than other corrupt acts such as gratification. The element of state losses is a fundamental element other than the element of the legal subject of corruption. For that state losses become one of the attention in handling corruption crime. Investigators as the spearhead in criminal law enforcement are those who have the duty and responsibility of conducting an investigation to determine the state losses as well as to find the suspect and how the criminal act of corruption is done and other matters concerning it.The criminal act of corruption in the perspective of positive law is an act that has a fundamental element of state losses. As in the perspective of Islamic Law a criminal act of corruption is a prohibited act or is an act of haram. Determination of state losses has an important existence. State losses are one of the main elements of corruption that must be proven. This causes the determination of losses of the state has a central position for whether or not criminal acts of corruption are prosecuted. Mistakes in determining state losses can lead to failure in law enforcement against corruption.It is necessary to stipulate the party that can determine the state losses other than the CPC and BPKP as mentioned in the Constitutional Court Decision Number 31 / PUU-X / 2012 dated October 23, 2012 due to the provisions on the agency and other parties (including from the company), which may indicating material truth in the calculation of state losses and / or may prove the case in hand as stated in the Constitutional Court ruling the scope is still too wide.Keywords: Existence, State Loss, Corruption
