UNIVERSUM; Jurnal Keislaman dan Kebudayaan adalah Jurnal yang diterbitkan oleh LP2M Institut Agama Islam Negeri (IAIN) Kediri. Jurnal ini bertujuan mengembangkan kajian mengenai hadis dan menjadi wadah artikulasi bagi dosen, peneliti dan pemerhati kajian hadis untuk mendeseminasikan hasil penelitiannya yang terkait dengan studi hadis, yaitu kajian sanad, matan, living hadis dan studi manuskrip hadis.. UNIVERSUM; Jurnal Keislaman dan Kebudayaan memposisikan diri sebagai laboratorium pemikiran, tempat semua gagasan diolah dan didialogkan untuk memperkaya khzanah pemikiran hadis, baik klasik maupun kontemporer. UNIVERSUM; Jurnal Keislaman dan Kebudayaan diterbitkan secara berkala setiap enam bulan sekali pada bulan Januari dan Juli. Pada awalnya, UNIVERSUM; Jurnal Keislaman dan Kebudayaan diterbitkan pertama kali pada tahun 2007 dengan ISSN 1978-6948 yang dikeluarkan oleh LIPI dan masih bernama UNIVERSUM. Pada fase ini, lingkup kajiannya mencakup Islam dan Kebudayaan dan diterbitkan secara cetak. Seiring dengan transformasi jurnal di Indonesia, tahun 2015 jurnal ini berbenah dengan terbitan online versi OJS dan mendapat lisensi dari LIPI dengan E-ISSN 2502-6948. UNIVERSUM mengalami sedikit perubahan nama menjadi UNIVERSUM; Jurnal Keislaman dan Kebudayaan, sebagaimana dipakai saat ini. Perkembangan berikutnya, mulai tahun 2017 seiring dengan kebijakan penataan jurnal di lingkungan IAIN Kediri, Universum menfokuskan kajiannya pada hadis dan ilmu hadis, mencakup wilayah studi sanad, matan, living hadis dan studi manuskrip hadis.

Abstract

Religion that preached by means of persuasive with acculturation patterns, more easily accepted. And it create a new color in the existing cultural traditions. Klutuk farmers with all the ritual tradition is entrenched, able to accept the arrival of a new religion due to the new value that does not exclude and offend them as people who have been cultured before. Hinduism and Buddhism that come later, patterned religion earth, existence is able to maintain and further strengthen that tradition. Until Islam came, although he patterned sky religion whose mission is to spread (da’wah) teachings, but do not lead to confl ict with the tradition of the klutuk farmers. The result, in addition to reinforce, is also able to fi ll the spiritual void by providing transcendent value and a new outlook on the tradition. So, appear the traditions that shape, still relatively like the old one, but it has a value of renewal.

Abstract

For some time, Islam in Southeast Asia, especially in Indonesia, is considered a periphery Islam (peripheralism religion) due to the syncretism practice and accommodationists against local beliefs. Indonesian Islam is only a little tradition (small tradition) of great tradition Islam who was in the Middle East region. Great tradition is Islamic tradition that grows and develops in the center of culture, namely in the Middle East or more specifi cally in Mecca and Medina, while little tradition is Islamic tradition that developed outside the Middle East region, including Indonesia, and those are considered to deviate from the pure Islamic. The thesis thrive on the paradigm of modernism that spawned Islamologist like K.P. Landon, Winstedt, Van Leur and also Clifford Geertz with his Trichotomy approach which is famous for the Java community, the belief or confi dence is also shared by some Muslim scholars. This paper shows some bias in the paradigm of Modernism and Postmodernism as elaborate approaches in Islamic studies. Postmodernism did de-centering to dismantle the discourse about the center and the periphery, little tradition and great tradition. This is done by presenting Islam ethnographic Wetu telu in West Lombok as an example and the object of analysis.

Abstract

This article aims at discussing about a lawsuit of authority between a state court and a religion court related to authorities to receive, investigate, and decide a lawsuit of heir among Muslim. In this article, it is explained that receiving, investigating, and deciding a lawsuit of heir among Muslim are not absolutely the authorities of the religion court, but the state court also has these authorities. It is based on (1) The Law number 2, 1986 jo Stbl. 1937 number 116, the article 50 which states that the state court has duty and authority to investigate, decide, and solve criminal and civil cases in the fi rst level, and (2) the explanation of The Law number 3, 2006, article 49 about the religion court which states that the meaning of among Muslim is included people or companies which voluntarily follow Islamic law. Therefore, it can be conclude that the religion court has authorities to receive, investigate, and decide a lawsuit of heir among Muslim if they voluntarily follow the Islamic law, and the state court has authorities to receive, investigate, and decide a lawsuit of heir among Muslim if they do not voluntarily follow the Islamic law.

Abstract

This paper attempts to discuss Najmuddīn al-Ṭūfī’s thought on maslahah, as well as see the extent of his liberal idea. In order to unravel this problem, the author conducted a literature review to examine al-Ṭūfī’s work, Risālah fī Ri’āyah al-Maṣlaḥaḥ. This study resulted in two conclusions. First, al-Ṭūfī’s thought on maslahah is quite controversial because it is delivered with provocative words. Al-Ṭūfī states that in case of confl ict between naṣ and masalahah, the precedence is maslahah using Takhṣīs and Tabyīn mechanisms. Second, al-Ṭūfī’s thought can’t be put into the category of liberal thought. Since, although al-Ṭūfī states the permissibility displacing the position of naṣ with maslahah, the process must be carried out with the Takhṣīṣ and Tabyīn mechanisms which are already popular practiced in Islamic Legal thoughts.

Abstract

Waqf is a unique Islamic economic instruments that bases its function on the elements of virtue (birr), goodness (ihsan) and fraternity (brotherhood). Therefore, in order endowments can be managed productively, it is proper we reconstruct the management of waqf in Indonesia to study and refl ect on the country or institution that has been able to manage endowments properly. This article examines the management of waqf of Bangladesh and Malaysia. Focussing assessments on critical thinking and innovative endowments management system, covering Operationalization of the Social Investment Bank Limited in Bangladesh, Operationalization Certifi cate Endowments Money, Cash Waqf in Malaysia. The systems offered by Bangladesh and Malaysia are the commercial-style systems. Such trends illustrate that the strengthening of the role of endowments in both countries have been reconstruction (an increase towards better), namely (1) from the traditional to the waqf endowments productive, (2) of the goods remains to move goods, in this case the cash endowments, and ( 3) from the beginning that only relies on traditional instruments which is taking a direct benefi t from the existing endowment, the endowment development efforts through commercial instruments. If Indonesian muslims are able to carry out that reconstruction on a large scale, it will show the positive implications of the activities of the cash endowments, cash endowments have unique opportunities for the creation of an investment in the fi elds of religion, education and social services.

Abstract

The development of interpretation method and its approach have given place for academician to discuss about soul through scientific approach. It raises debate which has not been fi nished yet. In one side, there is a claim that this approach results inappropriate interpretation of Al-Qur’an. However, in other side, this approach can result contextual meaning of Al-Qur’an. Soul, the mysterious thing in life, can be used to be an object of research in science. Therefore, the research on the interpretation of Al-Qur’an through scientifi c approach results the definition of soul and the detection of its place which can be explained through scientific research.

Abstract

Indonesian bureaucracy issues were patched through program reform of the bureaucracy which is a postcrisis demand economic reforms in 1997. Bappenas asserts that other reforms will not be runs well without first reforming government bureaucracy. Bureaucratic reform aims to make the bureaucracy is able to carry out its duties more effi ciently and effectively so that it can be realized clean government and good governance. Bureaucratic reforms initiated by the government it is still not able to fi x the bureaucratic culture, especially presses bureaucratic behavior that tends to corrupt. In other words, the reform of the internal bureaucracy alone is not effective in combating corruption. A source of disease bureaucracy basically can be identifi ed from two loci, namely internal and External. Internal sources derived from the weaknesses and failures the existing system in the bureaucracy itself. Internally, the incidence of corrupt behavior the bureaucracy is also due to weak internal control systems. By hence the necessary tools to change the bureaucratic apparatus as spirituality the prevention and eradication of corruption. This is where the later Sufi governance will be a tool to overcome corruption. Sufi governance solution offered is to lean back on the right monotheism. Because the true monotheism then the bureaucrats in charge of serving the community will carry out their duties in a comprehensive manner; as which ones have been listed in the code of ethics bureaucracy, and he will always see the task as a mandate instead of a means to accumulate wealth and depriving people whom it serves. In addition, many research fi ndings show that spiritual approaches such as those in the Sufi concept of governance can be a solution for the government to eliminate corruption through a spiritual approach.

Abstract

Strip Stories adalah salah satu teknik yang efektif dalam pembelajaran speaking/berbicara. Menyediakan Strip Stories dapat meningkatkan minat siswa dan merangsang partisipasi siswa didalam kelas speaking/ berbicara. Berdasarkan asumsi diatas rumusan masalah penelitian dapat diformulasikan sebagai berikut: 1) Bagaimana kemampuan siswa dalam berbicara sebelum diajar menggunakan teknik Strip Stories? 2) Bagaimana kemampuan siswa dalam berbicara setelah diajar menggunakan teknik Strip Stories? 3) Adakah perbedaan yang signifi kan antara sebelum diajar menggunakan Strip Stories dan sesudah diajar menggunakan Strip Stories? Metodologi dari penelitian ini mengunakan penelitian pre-eksperimental sebagai desain penelitian, populasi dalam penelitian ini adalah semua siswa kelas sebelas MAN Tulungagung 1 sebanyak 9 kelas, sampel penelitian ini adalah kelas sebelas IPA 4 (kelas excellent) yang siswanya berjumlah 30 siswa, alat penelitian ini menggunakan tes. Teknik analisis datanya menggunakan teknik statistik untuk mengetahui perbedaan antara kedua variable. T-test digunakan untuk mengetahui apakah Ha diterima atau ditolak. Jika nilai T-test lebih kecil daripada tabel T, maka Ho ditolak. Jika nilai T-test lebih besar daripada nilai tabel T, maka Ha dapat diterima. Hasil dari penelitian ini menunjukkan bahwa nilai siswa sebelum diajar menggunakan teknik Strip Stories masih jelek sedangkan nilai siswa setelah diajar menggunakan Strip Stories meningkat. Nilai rata-rata siswa sebelum diajar menggunakan Strip Stories adalah 11.77. Sedangkan nilai rata-rata siswa setelah diajar menggunakan teknik Strip Stories adalah 14.17. hasil hitung dari T adalah 10.304 sedangkan tabel 0.05% dengan tingkat signifikan 1.699. Jadi T count lebih tinggi dibandingkan dengan T table. Ini berarti bahwa Ha yang menyatakan bahwa ada perbedaan skor antara capaian berbicara siswa sebelum menggunakan Strip Stories dan setelah menggunakan Strip Stories terhadap siswa Sebelas IPA 4 di MAN Tulungagung 1. Ha diterima sedangkan Ho ditolak. Dengan kata lain, teknik Strip Stories (Potongan Cerita) dapat digunakan untuk mengajar berbicara siswa tingkat SMA dan MA.

Abstract

This article discusses the phenomenon of ambruk tradition in Ngesong, Tiron village, Banyakan-Kediri. Ngesong community has a tradition in which candidate of bridegroom and bride which have not been legal based on Islamic law and State law stay in one house. Through sociology approach, this article tries to investigate this socio-culture context. Ambruk tradition is a tradition done after engagement session and the decision of the marriage day by transferring the candidate of bridegroom to the family of the candidate of the bride. Ambruk tradition has two aspects namely helping works of the candidate of the parent in-law and staying in the parent in-law’s house. In Islamic law perspective, ambruk tradition is prohibited; though helping the candidate of the parent in-law is permitted. Staying in the candidate of parent in law’s house although for helping them is ‘urf fasid since it is harmful and makes sin of khalwah and zina. Meanwhile, the afraid of making damage or sins must be prohibited. Therefore, based on sadd al-dhari’ah concept, ambruk tradition cannot be permitted.
