Abstract

This research aims to clarify the authority of PT Amana Finance in Malang execution and fiduciary assurance describes the view of Islāmic law against authority PT. Amana Finance Malang in executing the fiduciary guarantee. A guarantee of financing, financing the many agencies that do the financing with a fiduciary guarantee. One example of a case, there is a financing institution that should have a duty to register the object fiduciary guarantee, but not listed as well in terms of execution. The financing agencies unilaterally undertake the execution of the object of the guarantee. This research is the empirical juridical, using the a statutory and conceptual research approach. The data sources are used the primary data, secondary data, and tertiary data. Data collection is done with the interview and documentation. Interviewees in this study was Mr. Ghazali as a responsible company and Lily as staff administration. The results of this research show that PT. Amana Finance Malang is not authorized to conduct the execution directly against a fiduciary guarantee of the objects, but rather keep it through the applicable rules in accordance with title execution. And based on the Islāmic law execution conducted by PT. Amana Finance Malang is invalid, because it is supposed to be a procedure that is done is with the process of awarding letter warning beforehand is not by doing a direct execution. Abstract

This study aims to examine the role of Majelis Permusyawaratan ulama Aceh on halal certification of home industry products in Banda Aceh City. The availability of various foods makes it easy for people to get it. On the other hand halal food products can be questioned. Guarantee halal of a food product can be realized among them in the form of halal certificate that accompanies a food product. The Majelis Permusyawaratan Ulama (MPU) through the LPPOM of the Ulema Council of Ulama which is authorized to grant halal certification. The type of this research is field research / empirical with qualitative descriptive approach. Primary data comes from interviews and secondary data derived from related literature. The results show that LPPOM Aceh has socialized the importance of halal food products, but not maximally to all areas, such as Banda Aceh and Aceh Besar located in the city center but not yet fully resolved. Viewpoints and attitudes of market participants in Aceh, be it producers and consumers who tend apatis and a priori with halal labelisasi on any product they consume to be an obstacle.Keyword: Halal certification, home industry product

Abstract

This research was conducted to find out the background of the issuance of sunset policy program by Malang city government and its mashlahah aspect. This study is an empirical research that uses a conceptual approach by using the concept of mashlahah that exist in Islam. Primary data in the form of interviews with some informants and secondary data in the form of books related to the concept of mashlahah. The result of this research is that sunset policy program is issued as a form of settlement effort of tax collection of Land and Building Tax of Malang city taxpayer which is part of delegation of authority of Land and Building Tax which done in the year 2013 ago preceded by census and cleansing. Sunset policy program provides benefits for city residents of Malang, especially taxpayers who pay late urban PBB in the form of lenient fees they have to pay. They only pay the principal of the PBB Urban taxes alone without the administrative sanction in the form of a fine of 2% of the tax principal to be paid. As for the city of Malang, the benefits obtained in the form of reduction of urban PBB receivables taxpayer Malang city. Sunset policy program has met the requirements mashlahah so it can be said as a Mashlahah. Keywords: Land and Building Tax, Sunset policy, and Mashlahah.

Abstract

Ineffectiveness of zakah as a means of poverty alleviation because its distribution is dominated by consumptive distribution, not productive distribution. This paper uses a qualitative approach in the form of desciptive-comparative research. Based on the synthesis-eclectic analysis, the construction’s thought of Yusuf al-Qardhawi and Sahal Mahfudh about economic community empowerment based on productive zakah as the findings of this paper are: First, productive zakah is a means to bridge the ideality of Islamic teachings that emphasize the economic prosperity with the reality of community moslems that face various economic problems. Second, the solution of economic problems based on “root of the problem” is through vocational training and funding as working capital; while the solution of zakah management problems based on “root of the problem” is through education of Sharia Zakah (Islamic law and ethics) and training of Zakah Management (professional and modern). Third, the implementing subjects involve systemic cooperation between Islamic scholars (‘ulama’), government (umara’) and society (ummah). Fourth, the objects in the form of working capital, work tools, vocational training and education. Fifth, the target is to increase the status of the recipient of zakah (mustahiq) to the giver of zakat (muzakki). Sixth, operational steps are based on POAC (Planning, Organizing, Actuating, Controlling) which is adheres to Islamic Sharia as well as modern disciplines.
