Abstract

Dosen Pembimbing:1.  Prof. Dr. Sunarmi, SH, MHum2.  Prof. Dr. Hasim Purba, SH, MHum3.  Dr. Dedi Harianto, SH, MHum The research problems formulated based on this case are: 1) What factors can cause the annulment of reconciliation agreement in PKPU process, 2) How about the legal consequence for the debtor if the annulment of the reconciliation agreement is approved or objected, 3) What the basis of the judge’s consideration to settle and pronounce the case in Case No. 376K/Pdt.Sus-Pailit/2017 and Case No. 749K/Pdt-Sus-Pailit/2016. The research applies normative juridical method with descriptive analysis. Library research and field research are done to collect the data by conducting document study and guided interviews. The data are analyzed qualitatively and the conclusion is drwan deductively, from general to specific things. The results of the resaerch demonstrate that the application for an annulment of a reconciliation aggreement, that has been validated by the Judge and approved by creditor and debtor, can be either objected or accepted.Keywords: Reconciliation, Homologa tie, PKPU (Suspension of Debt Payment Obligation)

Abstract

Dosen Pembimbing:1.  Notaris Dr. Suprayitno, SH, MKn2.  Notaris Dr. Henry Sinaga, SH, Mkn3.  DR. T. Keizerina Devi A, SH, CN, Mkn The objective of the research was to find out the correlation between Notarial Protocols and the Removal of archives according to Law No. 43/2009 on Filing, the urgency of removing Notarial Protocols, and how about a Notary’s liability for Notarial Protocols when they are removed. The research used the Theory of Legal Responsibility and Legal Certainty, and juridical normative and descriptive analytic method, supported by the result of interviews with the Head of Regional Supervision Council of Medan and with three Notaries. The result of the research shows that an archive will be in effect for 30 years; after that, it is expired and invalid as evidence before the Court. Therefore, it is futile to maintain it since it has been expired so that a Notary as the holder of Notarial Protocols has to remove them since they are a State Archive.Keywords: Keywords: Notary, Notarial Protocols, Archive Removal

Keizerina Devi A, SH, CN, MHumCooperative it needs a strong legal ground relating to the deeds of cooperative such as memorandum of Associattion, the deed of the amandement of Articles of Associations, and so on. A cooperative's Memorandum of Association made by a Notary has to be approved by Minister of Cooperative since where are many amandements of its law, The research used judicial empirical method which was aimed to solve the research object by analyzing secondary data toward primary data in the field in order to find the solution of the research problems from the field on the secondary data.Keywords: Deed, Notary, Cooperative
