Abstract

Leasing is a mutual agreement by each party which causes a bond to eachother. The case which is ruled by the Supreme Court of the Republic of Indonesia No. 1507 K/PDT/2010 indicates that there has been land leasingrelationship since December 20, 1959. The claim of the case occurred because the heir of the lessee stopped paying for the rent and because the  heirs of both parties did not renew the agreement; therefore, the  relationship was cancelled by law. This case is stipulated in Article 2 and Article 21, paragraph (1) of the Government Regulation No. 44/1994 on House Occupation by Non-Owner which states that house occupation by non-owner is valid when there is an agreement or permission by the owner, and housing leasing contract, written or unwritten, which does not mention the time limit and had occurred before Law No. 4/1992 was enacted, is declared dissolved within three years since the law is enacted.

Abstract

Bankruptcy was a form of general confiscation covering all assets of the debtor for the benefit of creditors. Article 55 chapter (1) of Act 37, 2004 stated that the lender Mortgage holders which were not affected by the bankruptcy so that the execution would be able to exercise the rights even though the debtor was declared bankrupt. Article 56 chapter (1) of Act 37 of 2004, the execution creditor the right Mortgage holders might be suspended for a maximum period of 90 days from the date of the decision of bankruptcy so they could still carry out the execution right, even though the debtor was declared bankrupt. Legal issues that arouse in a bankruptcy auction for the Mortgage boodle the explanation of Article 59 chapter (2) wider than the norm, as the holder of Mortgage bank registered with the security bill on behalf of shareholders or a third party, auction buyers obtained a problem because there were security certificates Mortgage-holders so it isn’t canceled by HT holders.

Abstract

Since the kind of company obtains its capital from the public, there are many stakeholders who have an interest in it. The urgency of the existence of an independent supervisor in one company is undeniably very important. An independent commissioner plays an important role. Generally, a corporation is managed by a stockholder manager. A corporation which collects its capital from the public needs more control because it deals with public interest. The Indonesia Stock Exchange and Bapepam (Capital Investment Supervisory Board) regulates the status of independent commissioners more specifically besides Law No.40/2007 on Corporation.They regulate that in the statues of a corporation, a corporation can assign at least one independent commissioner and one representative commissioner. Beside that, every corporation should specify one article in its statues about responsibility of an independent commissioner for realizing the principles of good corporate governance in a corporation in Indonesia.

Abstract

Abstract

The development of current technology influenced much on the field of Intellectual Property Right. The technology of internet with various easiness not only gave benefit to the copy right but also affected loss which affect on law’s breaking virtually. The digital technology improvement nowadays affected on increasing copy right law breaking in Indonesia, especially the digital copy right.  The law protection on copy right which was based on digital technology in Indonesia led to the acts No 19, 2012 about copy right. The law of copy right basically had accommodated the development of technology in Indonesia but law enforcement for the cases in digital technology basis was important element. The state’s responsibility was to give protection towards the copy right based on the government law. The law should also be implemented precisely, to make sure that the developed digital technology did not ruin basic principle of copy right

Abstract

Land certificate was underhanded written evidence which was not as powerful as the authentic deed, but since the land certificate could be categorized as the legal basis or judicial data to the land and could be used as the accessory for requesting land rights as stipulated in the legal provisions, the land certificate could become an important document in the process of issuing land rights certificate. The unlawful act in land ownership as it is used as the legal basis in the process of registering the land for the first time before the certificate is held by the last owner will cause all evidence of ownership, since the first time the unlawful act was conducted, to be legally abrogated, including the registration of the transfer of the land rights even though it is legally done. If the abrogation and the expropriation of ownership certificate cause the loss of the purchaser who has good intention, this purchaser can file a complaint to nearby District Court to claim a compensation for the execution by the verdict of the State Administrative Court. Abstract

The implementation of collecting BPHTB (Tax on Land and Building Rights Acquisition) after the imposition  of  Law No. 28/2009 on Regional Tax and Regional Retribution, had caused a problem at Pematangsiantar. The problem arouse because Pematangsiantar Regional Administration collected BPHTB without following the regional regulation as it is stipulated in Law No. 28/2009 on Regional Taxes and Retribution. The central government states that the act of collecting taxes is contrary to the prevailing rules. In consequence, due to the public objection, the tax return was paid back to taxpayers. It is recommended that the central government shoud make transitional provisions in enacting legal provisions, Pematangsiantar Regional Administration should be careful in collecting taxes from people, and taxpayers should always control any kinds of tax collection by the government. Abstract

The legal basis for the protection of the Red Cross emblem in Indonesia has been included in the International humanitarian law and the laws and regulations in Indonesia. Protection of the Red Cross emblem in Indonesia in Article 6 paragraph (3) letter (b) of Law Number 15 of 2001, Ditjend. Intellectual Property Rights will reject an application that uses the brand that imitate or resemble the symbol of the Red Cross Indonesia, although not listed in the Ditjend. Intellectual Property Rights, because the Red Cross emblem is a symbol of the international agency's position where the institution is recognized by the Government of Indonesia. Indonesia Red Cross emblem should be given legal protection because it is an internationally recognized symbol of possession by the Indonesian government as a consequence of judicial participation in the Geneva Conventions Indonesia Year 1949.
