Abstract

DOSEN PEMBIMBING:1. Muhamamd Yamin2. Sunarmi3. Sutiarnoto Article 27 of the Directive of the Minister of Finance No. 27/PMK/065/2016on Guidelines for Implementing an Auction states that an auction can be revokedonly when it is asked by the seller or by the Court’s verdict. There is a problem asfollows: Syahbuddin Purba, through the Consumer Dispute Settlement Board ofCoal’s Ruling No. 126/P3K/JS-III/BPSK-BB/IV/2016, revoked foreclosure sale ofhypothecation. The research problems are how about the revocation of foreclosuresale of hypothecation for realizing legal protection, how about the authority of BPSKof Coal to revoke the foreclosure sale of hypothecation, and how about legal remedyof the revocation of auction to the buyer based on BPSK of Coal’s Ruling.The research used juridical normative and descriptive analytic method.Primary data were gathered by conducting interviews and secondary data consistedof Law No. 4/1996 on Hypothecation on Land and Anything Found on It, theDirective of the Minister of Finance No. 27/PMK/065/2016 on Guidelines forImplementing Auction, Law No 8/1999 on Consumer Protection, and the DirectiveNo. 1061 K/Pdt.Sus-BPSK/2016. Secondary legal material consisted of books, andtertiary legal material consisted of dictionary and dictionary of jurisprudence.The result of the research showed that revocation on foreclosure sale ofhypothecation can be revoked when it does not comply with legal provisions, theauction does not meet Article 1320 of the Civil Code, the buyer is foreign citizen ormixed marriage based on Article 21 in conjunction with Article 28 of Law ofAgrarian Affairs. The authority of BPSK is merely to impose on compensation on thedamage, pollution, and/or consumer’s loss as the result of consuming the goodsand/or using business people’s service so that revocation cannot be done. Legalremedy for revoking foreclosure sale of hypothecation to buyers through the Rulingof BPSK of Coal No.126/P3K/JS-III/BPSK-BB/IV/2016 cannot be done because theregulation on the revocation of a credit contract which becomes the ground for prateexecution right has to be through District Court’s verdict and not through the Rulingof BPSK so that Syahbudin Purba should do legal remedy through litigation.Keywords: Revocation, Auction, Consumer Dispute Settlement Board

Abstract

Dedi Harianto A credit contract is a consensus agreement between a debtor and a creditor ( Bank) leading to payable accounts, in which the debtor is required to return the credit provided by the creditor, under terms and conditions approved by both parties. The research problems are how about the criteria of creditor’s default as stated in the debtor’s lawsuit concerning the implementation of the banking credit contract with addition of collateral to the total amount of the credit facility, how about the legal force of the lawsuit on default filed by the debtor against Bank Sumut as the creditor concerning the implementation of the credit contract which has been effective in line with PMK (Approval to Make Credit) No.32/KC-15/KCP-070/KAL/2011 on November 6, 2011; and how about the analysis on the ground of the Supreme Court Judges’ consideration in the Ruling No. 1932.K/Pdt/2016 in debtor’s lawsuit against creditor’s default.This is a normative juridical research which studies the prevailing laws and regulations, in this case, Law No.7/1992 in conjunction with Law No.10/1998 on Banking, Law No. 42/1999 on Fiduciary Collateral, Law No. 4/1996 on Mortgage, and the third book of the Civil Code on Contract. This is analytical descriptive which describes, explains and analyzes the problems, and finds the right answer to the problems.The research showed that one of the parties did not fully comply with the agreement in implementing the credit contract, did not completely fulfill their obligations or they did not fulfill their obligation punctually. The claim filed by debtor, RE, does not meet the elements of default since it is proved in the Court’s hearing that Bank Sumut has defaulted and the claim is considered error in personal toward the defendant. The Supreme Court Ruling has been in line with the prevailing legal provisions in a credit contract since there is no written evidence in the credit contract that requires Bank Sumut as the creditor to add the number of credit facilities when the collateral is added by the debtor.Keywords: Creditor, Debtor, Default, Credit Contract

Muhammad Hamdan In running a buiness activity in baking field, board of directors frequently encounters a polemic that obliges them to make a decision and take responsibility for the bank which is potentially bankrupt. Board of derectors is the body of company which is authorized and fully responsible to manage the company for its sake, in line with its significance and objective, and represents the company inside and outside a court in accordance with the provisions in Article of Association. A systemic bank is the bank that, due to its size of asset, capital, and obligation as well as its involvement with other financial sector, can fail some parts or all parts of other banks or financial service, either operationally or financially, if it undergoes trouble or fails. The research problems are how standards are determined in a systemic bank, how a director's liability in a systemic bankis, and how fiduciary duty doctrine and business judment rule are implemented.

DOSEN PEMBIMBING:1. Hasim Purba2. Sunarmi3. Suhaidi One of the problems studied in this research is related to the subsidized KPR or what is called KPR Rumah Sejahtera. It also focuses on the private relationship between bank and developer in which the developer of KPR Rumah Sejahtera acts as the seller and bank acts as the executor. The results of the research demonstrate that the target group of non subsidized KPR is people with middle-upper economy and that of subsidized KPR is people with middle-low economy. The down payment for KPR which is not subsidized by the government is 15% whereas that of subsidized KPR is IDR. 4,000,000.- (four million Rupiahs). In addition, the cooperation between Bank Artha Graha Internasional Tbk, Medan Branch and the developer is written in a cooperation agreement regulating the procedures, credit agreement and money disbursement which is made gradually, namely 80% before the signming of AJB, SKMHT, APHT and 20% after the signing of AJB, SKMHT, and APHT.Keywords: bank, developer, cooperation agreement.

Sunarmi Istilah simulasi dalam Bahasa Belanda dapat disebut juga “Schijnhandeling”yang diterjemahkan dalam Bahasa Indonesia dengan perkataan “perbuatan purapura/perbuatan semu”, yaitu perbuatan dimana dua orang atau lebih bahwamereka keluar menunjukkan seolah-olah terjadi perjanjia antara mereka, namunsebenarnya secara rahasia mereka setuju bahwa perjanjian yang nampak keluar itutidak berlaku, ini dapat terjadi dalam hal hubungan hukum antara mereka tidakada perubahan apa-apa atau bahwa dengan perjanjian pura-pura itu akan berlakuhal lain. Penelitian ini bersifat yuridis normatif. Hasil penelitian ini menunjukkanbahwa perjanjian simulasi yang dilakukan oleh kedua belah pihak dalampenelitian ini hanya berlaku bagi mereka yang membuatnya dan tidak berlakubagi pihak ketiga. Sehingga Majelis Hakim Mahkamah Agung dalam putusannyamenyatakan bahwa berdasarkan bukti otentik berupa akta notaris telahmembuktikan adanya hubungan hukum berupa pengikatan jual beli objeksengketa, sehingga bukti berupa akta otentik tersebut adalah sah dan mempunyaikekuatan pembuktian sempurna di Pengadilan.Keyword : Perjanjian, Simulasi, Pengikatan Jual Beli

Edy Ikhsan One of the main objectives of the enactment of Law No. 5/1960 on UUPA is to realize the legal certainty of land title for all Indonesian people. In order to realize the legal certainty of the rights over the land in the society, PTSL (Fully Systematical Land Registration) is established to hasten the process to issue land title certificates to the society in general and citizens in Kepulauan Meranti Regency in particular. This research employs the normative juridical research method. This research is descriptive analytical. The results of the research find out The number of land registered before PTSL program is implemented in 2017 was 10%) of total area of 5,795.24 hectare i.e. 579.24 hectare or 8,560 parcel of land in Kepulauan Meranti Regency. The internal obstacles are the lack of coordination among institutions, experts in land mapping and measurement. Abstract
