Abstract

This is the underlying idea of of the research on the coorperation agreement in management between Sofyan Hotel and Saka Hotel with the problems as follows: how about the rights and responsibilities of all parties involved in the cooperaton agreement in management between Sofyan Hotel and Saka Hotel, and how about the settlemment of the legal dispute in the cooperation  agreement in management between Sofyan Hotel and Saka Hotel. The research applied the descriptive method with judicial empirical approach. This results showed that in the implementation of the cooperation agreement in the management of Sofyan Hotel and Saka Hotel Medan between Sofyan Hotel and Saka Hotel was made in underhanded contract and in standard form. In this case, one of the parties was weak and not in the position to bargaining. As to cooperation agreement, Sofyan Hotel is more profitable it is the one that makes the contract which is for its own sake. Meanwhile, when one of the parties defaults, a negotiation will be made for a good solution. However, in case a negotiation is not effective, a legal remedy is made by bringing the dispute to the central Basyarnas (National Sharia Arbitration Agency). Abstract

A marriage in Mandailing is called perkawinan manjujur in which the bridegroom’s side gives valuable material or money to the bride’s side. After Law No. 1/1974 on Marriage is in effect, Article 2 of the law states that “A marriage is legitimate when it is done legally according to their respective religions and beliefs.” This research used judicial empirical method. The research result showed that according to Mandailing tradition, a marriage has to follow the Islamic law. The existence of Mandailing community as a tribe or an ethnic group realizes their own identity and cultural unity which makes them feel that they are different from the other communities. Abstract

In a banking credit contract, a Bank is usually more interested in mortgage given by a debtor that can bound with collateral. The collateral has to legally belong to the debtor according to the prevailing legal provisions. The research used judicial normative and descriptive analytic. The result of the research shows that the hypothecation is implemented when a debtor is default in paying off his debt so that creditor has the fight to sell the collateral in auction hall in order to get his right and give the remaining to the debtor. The legal ground of judge's consideration in revoking the foreclosure sale because the debtor has no right to give the collateral under the verdict. that the Bank as the creditor who holds Hypothecation certificate does not have any authority/privilege as stipulated in UUHT No. 4/1996 on the Collateral. Abstract

The distribution of wakaf of a plot of land underhandedly occurred in Kwala Air Hitam, Selesai Subdistrict, precisely at Aljihad Mosque. Now it becomes a problem complained by one of the heirs of the wakif (the donor). The problems of the research were as follows: how about the legal consequence of the implementation of donating a plot of land underhandedly in a written form but it was not agreed by the heirs, how about the right and obligation of nadzir (inspector of wakaf) in the Islamic Fiqh and Law No. 41/2004 on Wakaf, how about the settlement of dispute on donating a plot of land underhandedly in a written form at Al-Jihad mosque, Selesai Subdistrict, Langkat Regency. The result of the research shows that 1) legal consequence of the implementation of donating wakaf on land underhandedly in which its status is not approved by the heir does not have any legal force because it has not been registered; therefore, nazir has to make AIW (Wakaf Oath Certificate) and/or Substituted Wakaf Oath Certificate, 2) based on the Islamic Fiqh, there is no regulation or explanation about registering wakaf land since a wakaf is valid when it has met the requirements for it. However, according to Law No. 41/2004, nazir has the responsibility to register a wakaf land in order that it has legal protection, and 3) the dispute of donating wakaf land underhandedly at Al-Jihad Mosque, Selesai Subdistrict, Langkat Regency has been settled by conducting reconciliation. Abstract

Land registration is aimed to ensure legal certainty. If land is not registered, there will be no legal certainty so that other people will easily claim that it belongs to them. The settlement of dispute in land certificate at Binjai according to the Ruling of the Supreme Court No. 175/K/TUN/2012 is related to the problem of land registration on old rights so that it takes a long process, to the legal force of legal base on land which has not had BPN (National Land Agency) Certificate, and to the legal ground for the consideration of Panel of Judges and its legal consequence of the Ruling of the Supreme Court No. 175/K/TUN/2012. The legal force for written evidence as legal basis on land which has not had BPN Certificate is weaker than that which has BPN Certificate. The consideration of the Panel of Judges on the Ruling of the Supreme Court No. 175/K/TUN/2012 is based on the control of land as a dispute object which is continuously occupied by the petitioner who has gotten the land from his parents.  The legal consequence of giving legality of ownership has motivated him to continue requesting for registering disputed land. Legal basis on the old land and the other evidence should be increased to become BPN Certificate for the sake of law in order to guarantee legal certainty and legal protection. Abstract

The result showed that, regarding the Goverment Regulation No. 43/2015 about informer in the Prevention and Eradication of Criminal Act of Money Laundering, Article 3 of this Goverment Regulation states a notary as as informer to a presumption of money laundering for the deed that he/she has made. Meanwhile, UUJN (Law about Position of Notary)  obliges a Notary to keep the confidentiality of the deeds he/she has made. According to the system hierarchy of statutory law in Indonesian, in line with Article 7 of the Law No.12/2011 about The Establishment of Statute stating that the position of Law is higher than that of the Goverment Regulation. Therefore, principally Goverment Regulation is void to be implemented on a notary as long as he/she carries out his/her duty and function in accordance with the UUJN. Abstract

Making an inheritance certificate for a Chinese Indonesian citizen is regulated under Article 111, paragraph 1, letter c of PMNA No. 3/1997 which states that inheritance certificate for a Chinese Indonesian citizen is drawn up by a Notary. In practice, a Notary draws up inheritance certificate in three different types: authentic deed, in originali deed, and underhanded deed. In its authentic form, it is called Inheritance Certificate, in its underhanded and in originali form it is called Inheritance Rights. The problems of the research were as follows: how about the difference in the forms of inheritance certificates made by Notaries in Medan, how about the legal consequence of the different forms of inheritance certificate, and how about the advantage and the disadvantage of making different forms of   inheritance certificate. Abstract

The kinship system influences the thought and the way of ownership of property and the way how to settle the transfer of property. This can be seen in the practice of distributing inheritance throughout Indonesia and it is practiced by Sakai community in Mandau Subdistrict. Sakai community thats follows matrilineal system is contrary to the Islamic line of descent (bilateral system). Sakai inheritance system which is done collectively is also contrary to the Islamic law which is done individually. The research was about Sakai adat community that was Moslems. It was conducted in Mandau Subdistrict, Bengkalis District, Riau Province. The result of the research showed that the community had known the Islamic inheritance law (faraidh), but not all community had known the Islamic inheritance law (faraidh) which could be seen from the portion of the inheritance. Dispute in distributing inheritance to Sakai community could be settled by reconciliation, either through family reconciliation with or through reconciliation with adat leaders. Abstract

The result of the research showed that the implementation of the wakaf land compensation at Tanjung Village done by individuals was not in accordance with Law No. 41/2004 on Wakaf because it was not registered and there was no approval from the Agrarian Minister and the Indonesian Wakaf Board. Besides that, the process of transfer was not in accordance with Article 40 F of Law No. 41/2004 on Wakaf because it was not for public interest. According to the Islamic law, land transfer which is not in accordance with its area and price of its original ones was not legally justified by the Islamic law. In consequence, it had no legal certainty; therefore the solution should be based on negotiation stipulated in Article 62, paragraph 1 of Law No. 41/2004 on Wakaf and on the Acehnese customary law, and it should be held at the level of Gampong (village). Abstract

In public opinion, joint property is the property which is obtained by a married couple so that when there is a divorce there will be the claim on it by both of them. If there is no agreement before a marriage occurs and a divorce takes place, there will be a dispute on it between husband and wife. In this case, each of the couple claims that the property is his or hers. Each of them (the widower or the widow) thinks that he or she has the right on the joint property. The legal provision on the property (land and building) given by the wife’s parents during the case of marriage when there is a divorce in which the husband claims that it is a joint property. It also analyzes legal protection for the ex-husband who claims that he has the right on the property given by his wife’s parents during their marriage.The result of the research showed that in the Marriage Law, there is no detailed explanation on joint property and pre-marital property. In the case of joint property in which each of the married couple thinks that the disputed property does not belong to joint property is determined by the capacity and the success of the plaintiff and the defendant in proving that the disputed property has been obtained during the marriage whether the money which has been used to buy it comes from his or her own effort or it comes from their mutual effort.
