Abstract

Dosen Pembimbing:1.  Prof. Dr. Budiman Ginting, SH, MHum2.  Dr. Jelly Leviza, SH, MHum3.  Dr. Maria Kaban, SH, MHum Every transfer of land title through a sale and purchase has to be made before a PPAT (Land Title Registrar). A sale and purchase is a mutual agreement in which a seller promises to hand over his ownership rights over something, and a buyer promises to pay for the price consisting of an amount of money as a reward from the ownership right acquisition. The objective of the research is to discover the position of the land title that is verbally acquired pursuant to the positive law in Indonesia, to study the legal protection for the verbal sale and purchase of land title when the seller defaults, and to analyze the juridical and non-juridical consideration of the judge in the ruling No.114/PDT/2015/PT.MDN. This is an analytical descriptive research with normative juridical approach. Qualitative analysis method is employed to process and analyze the Court Ruling and the prevailing laws and regulations.Keywords: Sale and Purchase, Land Title, Verbal, Default

Abstract

Zamakhsyari Bin Hasballah Thaibm LC, MA, PhD3.  Notaris Dr. Suprayitno, SH, MKn A loan transfer or subrogation is the replacement of creditor’s rights by a third party by paying the debtor’s remaining debt to the initial creditor. The loan transfer from a conventional bank to sharia bank applies the principle of Qardh, sharia bank firstly pays off the debtor’s remaining debt before making the deed. The deed transfers the debts and collateral between the debtor and conventional bank. This is an analytical descriptive research with normative juridical approach. Qualitative analysis method is employed to process and analyze the data resulted from the research. The conclusion is drawn by applying deductive reasoning method through normative framework. The research results demonstrate that there are two factors influencing the loan transfer from a conventional bank to a sharia bank, namely internal and external factors. Internal factors consist of profit from pricing, needs for plafond addition, products with more interesting installment, easy requirements, profit share basis (nisbah), and banking promo.Keywords: Loan Transfer, Collateral, Mortgage, Conventional Bank, Sharia Bank

Abstract

Dosen Pembimbing:1.  Prof. Dr. Hasim Purba, SH, MHum2.  Dr. Dedi Harianto, SH, MHum3.  Dr. T. Keizerina Devi A, SH, CN, MHumA spoken agreement used the ground of the relationship between parties, in which they have made a mutual agreement, in accordance with the prevailing laws and regulations is stated to be legally valid, but it has soft legal force in the court because it does not have any written evidence, so when it is claimed to the court, it cannot provide evidence. All parties in the court shall present some proof such as: evidence, witness, presumption, confession, and an oath. A spoken agreement can annul an authentic deed of the sale and purchase contract when it does not meet the subjective requirements, the heirs have not obtained a renewed permit as the holder of the land use. Thus; the concerned person can renew the permit use the land by submitting an application to the Mayor or regional authorities. A land use holder is prohibited to transfer the land use permit to another party without firstly obtaining a written notice.Keywords: Spoken Agreement, Legal Force, Certificate

Abstract

Keizerina Devi A, SH, CN, MHum3.  Dr. Syafril Sofyan, SH, MKn Leasing is a contract between two parties which is usually called bilateral agreemet. It causes right and obligation between them. This research analyzed a leasing contract of a building with its office equipment between the Indonesian citizen who was the lessor and a foreiger as the lessee or tenant. The research used juridical normative method by analyzing prevailing legal provisions such as contract law and the Civil Code. Its nature was descriptive analytic which gve argumentation of the result of the research. The result of the research shows that in a leasing contract of building the lessee is required to maintain, to take care of, and to keep the building he is renting ss if it were his.. The Panel of Judges' legal consideration of the Supreme Court's Ruling No. 2542.K/Pdt/2016 in the case of dispute in leasing a building is that the damage of the rented building owned by I Nyoman Yudhiawan is caused by the lessee's default in carrying out the clauses in the leasing contract, especially about the clause which states that a lessee should act as the owner of the owner of the house as it is stipulated in Article 1564 of the Civil Code in which the lessee is required to take the responsibility for all the damages in the materials he is renting during the leasing period unless hecan give evidence that all the damages have not heed done by him.Keywords: Good Faith, Leasing, Default

Dosen Pembimbing:1.  Notaris Dr. Henry Sinaga, SH, MKn2.  Notaris Dr. Tony, SH, MKn3.  Notaris Dr. Suprayitno, SH, MKn The research problems are firstly, how the authority of a notary in the principle of recognizing notary service users is; secondly, how the obligations of a notary as the reporting party in relation with the implementation of the principle of recognizing notary service users; and thirdly, the legal protection for a notary as the reporting party concerning his obligation to implement the principle of notary service users. The research employs the theory of legal authority, theory of obligation, and theory of legal protection to answer its problems. The results of the research demonstrate that a notary is obliged to implement the principle of recognizing notary service users, by the time he is having business relationship with his service users.Keywords: Authority of a Notary, Obligation of Reporting, Suspicious Financial Transaction

Many Minangkabaunese are married with the Melayunese in this research area. The research problems are about which inheritance system is applied in a marriage between the Minangkabaunese and the Melayunese ( a case study in Kelurahan Kota Matsum III, Medan), how inheritance is split to the children of the marriages , and how inheritance is split to the widow of the marriages. This thesis employs empirical juridical research type with descriptive analysis. It uses primary data collected from interviews with the people having marriages between the Minangkabaunese and the Melayunese and with the traditional leaders. It also uses secondary data consisting of primary legal materials such as Compilation of Islamic Laws and Marriage Act, secondary legal materials such books, and tertiary legal materials such as dictionaries.Keywords: Inheritance, Minangkabaunese, Melayunese.

This case has encouraged a further research entitled “A juridical Analysis of Final Income Taxation for the Application for Registration of Granted Land grounded on the Government Regulation No. 34/2016.” The research problems are how the provisions concerning the authority of National Land Office are stipulated regarding the Final Income Taxation for Land and/or Building Right Transfer in the application for registration of the land granted to a first degree relative, how the legal certainty principle is about the Final Income Taxation for the application for registration of the land granted to a first degree relative, and how the justice principle is fulfilled about the exception in the Final Income Taxation for Land and/or Building Right Transfer in the application for registration of the land granted to a first degree relative. This is a normative juridical research with descriptive analysis. It uses secondary data consisting of primary legal materials such as Law No. 36/2008 on Income Tax and the Government Regulation No. 34/2016 on Land and/or Building Right Transfer made in a Sale and Purchase Contract for the Land and/or Building and any changes on them (PHTB-PPJBTB), secondary legal materials such as books, and tertiary legal materials such as dictionaries.Keywords: Tax, Application for Land registration, Grant

The RegionalRegulation of Agam Regency No. 7/2011 on BPHTB and theRegulations of the Reagent of Agam No. 40/2017 on the procedures ofBPHTB has caused legal uncertainty of this tax collection system.
