Abstract

A peace treaty as the result of a process of dispute settlement should be in a written form in order to prevent from the reemergence of the same dispute in the future. Therefore, the process can be done outside of the court by making a deed, a peace treaty which can be underhanded or authentic made by a Notary. A Notary has to provide legal counseling and can answer any questions asked by his clients. He must not give wrong explanation which violates the law. His role in making peace treaty is to make authentic deed as stipulated in Article 16 of UUJN and to formulate the willingness and action of the persons appearing into the authentic deed. He also has to attach the register number of the Court in the peace treaty made before him. He is not liable for the content of the deed made before him; he is only responsible for its formal form according to legal provisions. Keywords: Notary, Reconciliation Deed, Dispute Settlement

Abstract

Personal Appearance comes from the word ‘Comparant” which has broader meaning i.e. it does not only refer to the act of appearing, but also regarding identity of the person appearing. Analyzing personal appearing is important in order that whenever there is any misquote or mistyped in the personal appearing writing, caused by Notary’s carelessness or indirectly caused by other people who do not give true statement that influence the deed and all parties as well as the Notary are authorized and going to be responsible civilly and criminally. Therefore, it is interesting to analyze these problems; how to make personal appearance an authentic deed in a notarial deed, how about Notary’s liability for personal appearance error in a notarial deed reviewed from the Ruling No.51/PK/TUN/2013, and what efforts should be made by a notary in order to prevent such error in making person appearance in a notarial deed. This was a judicial normative research which applied prescriptive approach. The data collection was obtained from library study. Based on the research done, it was figured that personal appearance of an authentic deed consists of identities. Positions refers to act for one self or as an authority or its holder according to the power of attorney and various representative. Based on the case No. 51PK/TUN/2013, the Notary was administratively sentenced for violating the stipulation in Article 85 of UUJN (Laws on Notary’s Position) and a Notary must perform his/her duty in accordance with the principles of Notary’s. Abstract

Ground in Aceh, particular Punie Village, District Darul Emirate Aceh Besar district that the land has not been that much certificate and no correspondence, but the land has been passed down from parents in advance without any letter. Basic description of that land in Aceh Besar district is customary land ownership is a Certificate issued by Keuchik (Village Head), which describes information about the history of the land as well as knowing the limits and known by the public. Transition customary land rights in Aceh Besar district uses Deed of Sale and Purchase made by and in front of the Land Deed Officer (PPAT), authorizing the legal acts of sale and purchase between the seller and the buyer. But in terms of the transition here, PPAT check and ask the seller if there is a certificate of Keuchik that the land is the land ownership rights of indigenous before making a purchase, the Land Office in this case the measurement was imported also re-measure the land, to ensure certainty broad, if a time will be registered rights. Abstract

The agreement between PT Angkasa Pura II (Persero) and business partner embodied in the contract which is in accordance with Article 11 of the Regulation of the minister of State for BUMN No PER-09/MBU/07/2015 which is called Credit Contract because its nature is nearly the same as the credit in which fostered partners pay it by installment. The agreement is made in standard format in Article 3 on Evidence of Contract, Article 5 on Right and Obligation, Article 6 on Sanction, and Article 7 on Settling Overdue Payment. Besides that, in the contract is the charge for administrative service of 6% (six percent) per year of the credit limit which is contrary to the purpose of providing aid for business partners. When fostered partners are not able to return their loan, the effort to recover it is by rescheduling or by reconditioning. Keywords: Giving Credit, Small Businesses in Partnership Program

Abstract

Tamil Moslem community is a group of Indian Tamils who are Moslems. They have kinship, wedlock, and inheritance which are influenced by their own original culture. Since they become Moslems, they have to comply with the Islamic law. However, it seems that acculturation plays an important role in creating law. The problems of the research were as follows: how about the inheritance system, how about its influence, and what factors which impede the settlement of dispute in inheritance in it its distribution in the Tamil Moslem community in Medan. The research used normative empirical method. The data were gathered by performing sociological research or a judicial research by optimizing judicial normative materials and primary data which were obtained from the informants who were related to the heirs of the inheritance case. The gathered data were analyzed by using qualitatively and the conclusion was drawn deductively and presented descriptively. The result of the research shows that the inheritance system used by the Tamil Moslem community in Medan is male inheritance system in which the oldest man in the family has the right to lead, control, and organize the inheritance. The Islamic inheritance law has its influence in the Tamil Moslems on determining the classification of heirs and the portion between male heirs and female heirs. This influence is caused by religious and educational factors which influence someone in adopting a certain law. The inhibiting factors in settling the dispute in inheritance in Tamil Moslem community in Medan are internal and external factors. Internal factors include consanguinity system in the Tamil Moslem community which tends to be secluded, law which is determined by the heirs in distributing inheritance is not consistent, and dominant control by the oldest brother. External factors include the influence of limited social environment and lack of socialization about the Islamic law. Abstract

Right to Manage is based on the Decree of the Agrarian Minister (now the Minister of Land and Spatial Plan) No. 9/1965. The HPL (Right to Manage Certificate) in the name of PT. Pelindo I (Persero) with area of ± 63,000 m2 was issued on March 3, 1993. The Supreme Court’s Ruling No. 246/K/TUN/2008 could be implemented by the issuance of the Directive of the Head of the National Land Agency of the Republic of Indonesia No. 3/2011 on the Management of Study and Handling Land Cases. The Verdict of the District Court in Article 54 states that BPN RI has to implement the court’s verdict which is final and conclusive. The obstacle of implementing the Supreme Court’s Ruling No. 248/K/TUN/2008 is that plaintiff does not file a request to the National Land Agency to revoke the HPL according to the Supreme Court’s Ruling No. 248/K/TUN/2008. The Panel of Judges in the Supreme Court’s Ruling No. 248/K/TUN/2008 handed down a Ruling that the HPL No. 1/Desa Belawan on March 3, 1993 in the name of PT. Abstract

Etimologically, certificate comes from Dutch “Certificat” which means evidence letter or a clarification letter that proves something. In the Kabanjahe District Court’s Ruling Number 30/Pdt.G/2009/Kbj Ishak Charlie files a complaint on Land Title with good faith in which there are doubled land title certificates with different areas and borders and Ishak Charli claims that he has purchased the land in accordance with the existing procedures. The research type is normative. The research is descriptive analysis. In Kabanjahe District Court’s Ruling Number 30/Pdt.G/2009/Kbj, it is stated that the claim is void due to the incomplete claimed subject so that Ishak Charlie does not obtain justice in his claim despite witnesses and documents that have been proven in the District Court, the certificate possessed by Ishak Charlie has been pronounced annulled before law by State Administrative Court and the valid certificate that is recognized by the State Administrative Court is the one that belongs to Syamsuddin Arifin. Abstract

The use of SKMHT (The Power of Attorney to Grant a Morlgage) by the Creditor to the Debtor is motivated by some reasons, such as the collateral is outside the authority of the Notary/PPAT (Official Land Deed Registrar), it is in the application process at BPN (National Land Agency) (for example Release, Title Transfer, Mortgage Right, Merger, or Certtficate Application), and the Debtor cannot attend by the time of the signing of Mortgage Loan Deed. The legal position of tlrc second SKMHT (II) and lureinofier refer to the extension of the first SKMHT (I) which has been expired was that it should be signed before a Notary and PPAT attended by witnesses and numbered and dated according to when the SKMHT was signed by the parties as regalated in UUJN and PJN. The legal efforts made by the Creditor over the Debtor's "Bad Credit" who did not want to sign the extension of SKMHT consisted of 3 ways, namely by applying forMediation, A Claim to the District Court, and filing to the Commercial Court. The sanction to the Notary who hod made the SKMHT which was not in line with the provisions in UUJN besides Compensation, indemnity, and the interest to the Notnry as the injured party can also be sentenced as stipulaed in Article 1,7 pagraph (11) of UUJN.
