Abstract

The results found out that Aceh Province is an autonomy region, as related to the Ownership Rights over Motor Vehicle related to its tax payment to Aceh Province, the tax obligation is attached to the taxpayer which is determined according to the vehicle registration and identification stages; thus, the vehicle which is registered outside Aceh tax administration area has to be transferred. Administrative ownership/ possession of a vehicle is different from civil ownership/ possession; therefore, if there is a vehicle which right is not transferred yet administratively in Aceh Province, its tax obligation is not transferred yet. The legal protection for the vehicle which tax is paid on behalf of another person’s name is that it cannot be accepted to be processed because the tax obligation is attached to the taxpayer so that the payment made by someone whose identity is different from the vehicle registration and identification has to be made with a power of attorney. Abstract

In its development, Indonesia as a developing country has abundance of traditional knowledge and geographical indication although it does not maximally realize its potential because of weakness in knowledge, skill, professionalism in human resources and funds. This condition is used by developed countries that are more advanced in technology, financial and technical skill, and the operation of various multinational companies. Since it has the variety of traditional knowledge and great culture, Indonesia today becomes of hijacking from foreign countries. Foreigners learn, search for, patent and sell traditional medical science and indigenous medical plants with high price to the third world. The research used judicial normative method by analyzing legal provisions in patent rights under Law No. 13 of 2016 on Patents and some other literatures related to Paten Rights on Traditional Jamu in Indonesia. Abstract

Collateral is legal protection for creditor when debtor cannot take his responsibility to pay off his debt to the creditor. The pay off to the creditor is by selling the collateral through public auction. The problem in auction occurs when the winner does not have the collateral he has bought since it is difficult to get it and there is complaint from the debtor. the process of the auction will cause the collateral is shifted from the seller to the winner of the auction, but it brings about a problem such as the winner cannot own the auction object. In this research, the implementation of auction has been ion accordance to the Decree of the Minister of Finance No. 93/PMK/06/2010 on the Operational Manual, the responsibility of the auctioneer, and the Bank in withdrawing the collateral auctioned is not involved so that the auction buyer/winner does by himself in withdrawing the auction object or the winner submit a request for execution to the District Court where the object is placed. Legal protection should be given to the auction winner in order to create legal certainty for the auction winner on the auction object he has bought. The conclusion is that an auction winner who has good faith (intention) has not yet obtained legal protection so far. Keywords: Legal Protection, Auction Winner, Auction Object

Abstract

A dispute which costs less money and spends a little time can be settled by litigants to reconcile. The Supreme Court’s Ruling No.2/2003 on the Procedure of Mediation in the Court states that all civil cases in the District Court have to be settled through reconciliation with mediators. They can also be settled before a Notary by making Reconciliation Deeds. A Notary’s authority to make all deeds, including reconciliation ones, otherwise stipulated differently by law, is based on Article 15, paragraph 1 of Law No. 30/2004 in conjunction with on Notary’s Position in conjunction with Law No. 2/2004 on the Amendment of Law No. 30/2004 on Notary’s Position. An authentic deed made by a Notary is strong evidence needed by the related parties. The reconciliation deed can be used as evidence before the court which can be the judge’s consideration in handing down a Ruling as reconciliation in the Medan Appellate Court. The research used descriptive analytic method on Reconciliation Deed made by a Notary as the Judge’s Consideration to Hand Down a Ruling, using juridical normative approach related to Reconciliation Deed made before a Notary. The result of the research showed that Reconciliation Deed made before a Notary can be one of the alternatives in settling a dispute outside the Court with quick process and less money spent on it. It is recommended that litigants can reconcile by making a reconciliation deed before a Notary in order to settle it quickly with less money. Keywords: Reconciliation Deed, Notary, Appellate Court

Abstract

The case in the Ruling of MA RI (the Supreme Court of the Republic of Indonesia) No.1144K/PDT/2012 started with a lease agreement of some parts of a place on the upper side of a building owned by H. Darmawan Kasim as the installation of telecommunication tower belonging to PT.Telkomsel. Darmawan Kasim claimed PT. Telkomsel to indemnify the loss incurred because the tower fell on his building, while PT.Telkomsel refused because according to them it was caused by force majeure such as earthquake striking the area. The research results revealed how to determine force majeure in a legal event i.e. by studying its elements; namely, the rented object is vanished, there is no element of debtor’s mistake (schuld) or neglect; the legal event in this case was not an event that can be predicted earlier and the debtor did not have any bad intention, they in fact have good intention when the legal event took place. The tower owner will definitely no loner be able to execute the agreement because the building has been vanished due to the earthquake. The judge’s consideration to fine the tower owner is regarded to be improper because the loss due to force majeure is not the tower owner’s risk or legal liability. Abstract

One of the ways to settle bad credit done by a bank is cessie or debt transfer and or hand over (Article 613 of the Civil Code). The case in the ruling of Pekanbaru District Court No.22/Pdt.G/2016/PN.Pbr is a claim by a new creditor (Nelmawati) who has bought the debt from PT Bank Tabungan Negara (Persero) Tbk Pekanbaru against the debtor (Ema Damayanti) who has bad credit to Pekanbaru District Court to permit the transfer of Land Title Certificate which is made collateral of the debtor on behalf of herself. The research problems are related to the legal consequence of the debtor’s collateral if the former creditor transfers the debt by cessie to the new creditor, the efforts to settle the bad credit that can be made by the new creditor related to the prohibition of beding, and the legal analysis of the Ruling of Pekanbaru District Court No.22/Pdt.G/2016/PN.Pbr.

Abstract

Attention to children has long existed in line with human civilization itself which from day to day progresses. The child is the son of life, the future of the nation and state. Abstract

Hasil penelitian menunjukan bahwa kepemilikan tanah bagi Warga Negara Asing dengan menggukan perjanjian simulasi telah melanggar azas Nasionalitas Pasal 9 UUPA dan Pasal 21 ayat (1), Pasal 26 ayat (2) UUPA, yang menyebabkan perjanjian simulasi tersebut batal demi hukum karena tidak memenuhi syarat-syarat sahnya suatu perjanjian Pasal 1320 KUHPerdata Syarat ke empat “Suatu Sebab yang Halal”, sebagaimana Perjanjian simulasi tidak memenuhi unsur obyektif meliputi keberadaan pokok persoalan yang merupakan obyek yang diperjanjiakan, dan causa dari obyek yang berupa prestasi yang disepakati untuk dilaksanakan tersebut haruslah sesuatu yang tidak dilarang atau diperkenankan menurut hukum. Namun tujuan perjanjian simulasi tersebut hanya untuk mengelabui UUPA, agar Warga Negara Asing tersebut bisa menguasai Tanah dan Bangunan Permanen dengan status Hak Milik. Terhadap putusan hakim pada tingkat PN dan PT sudah tepat, sudah sesuai dengan hukum dan tidak terdapat kekhilafan hakim dalam memutus.Kata Kunci : Perjanjian, Simulasi
