Dosen pembimbing:1.  Prof. Dr. Budiman Ginting, SH, MHum2.  Prof. Dr. Muhammad Yamin, SH, MS, CN3.  Dr. Edy Ikhsan, SH, MA The implementation of land transaction among the middle and lower class of people, either by cash or credit, is through buying and selling. Sales deed made in the office of Notary/PPAT has legal force as evidence since it is made according to law. However, the Notary takes liability for the persons appearing whose deeds are made. An authentic deed as strong evidence plays an important role in every legal case. Right and obligation which are clearly found in an authentic deed guarantees legal certainty and can avoid any dispute.The research used juridical normative which was library research with historical and legal provision approach about the liability of the persons appearing involved in making deeds in the PPAT office with witnesses who sign them.Based on the research done by the writer, he get knowledge about the power of a deed as evidence and how a PPAT who had submitted deed protocol for which the receiver of the deed protocol was involved in making the deed as evidence when the parties file complaint on PPAT’s deeds.Keywords: PPAT Deed, Evidence, the Parties’ Complaint

Abstract

One of them is an auction winner cannot have the object he has bought through the foreclosure sale since the object of the auction done by KPKNL is fictive. The research used juridical prescriptive analytic method. Secondary data were obtained from primary, secondary, and tertiary legal materials. The data were gathered by conducting library research, documentary study, and interviews and analyzed qualitatively. The conclusion is that the fulfillment of the principles of auction on a fictive auctioned collateral for an auction winner, viewed from the perspective of the principles of auction, is not implemented properly. Nowadays, auction is only regulated repressively in its legal protection, but it is not regulated preventively in legal protection for an auction winner in the case of fictive auctioned collateral. The liability of KPKNL for a fictive auctioned object is only administrative.Keywords: KPKNL, Fictive Collateral

When a husband says the word, “thalaq” to his wife, although it is said in joking or emotionally, it is officially done. The people in Pulau Rakyat Sub-district who are Moslems in majority have some problems with the implementation of the Marriage Law even though Law No. 1/1974 has been practiced since three decades ago. However, the problem of thalaq is not stipulated in Law on Marriage and its violation still exists. The research problems are how about the regulation on thalaq in the Islamic fiqh, why the people in Pulau Rakyat Sub-district do not do thalaq according to Law No. 1/1974 on Marriage, and how about the perception of Law No. 1/1974 on thalaq in the Islamic fiqh.Keywords: Thalaq, Islamic Fiqh, Law No. 1/1974

The land that is reclaimed is called reclamation or landfill. In accordance with the Law, reclamation is defined as the activity that is done to increase the use of the land resources observed from enviromental and economical social views by means of land encirclement and drainage. In case the Government of DKI Jakarta Province wants to carry out reclamation of G Island to PT. Muara Wisesa, they have to prevent the rights of the people at Teluk Jakarta Utara form being violated. Keizerina Devi A, SH, CN, MHum According to Article2, paragraph 1, letter b of UU PPh (Law on IncomeTax), undistributed inheritance as a unit which substitutes heirs is called asubstitute Tax Subject. It is intended to impose PPh which comes from inheritanceby using testator’s NPWP (Taxpayer’s ID Number) deposited by the heir. Theresearch problems are how about why undistributed inheritanceis used as thesubject of PPh, how about the fulfillment of the principle of legal certainty indetermining undistributed inheritance as the subject of PPh, and how about theprinciple of justice in regulating undistributed inheritance for substituting testatoras the subject of PPh. Abstract

In consequence, allof a deceased person’s property will automatically goes down to the heirs.Usually, inheritance is distributed in cash; but in this case, the inheritance is inthe form of loan as it is stipulated in the Verdict No. 46/Pdt.G/2015/PN.Mdn.The thesis used juridical normative and descriptive analytic method.Secondary data were gathered by conducting library research and analyzedqualitatively, while the conclusion was drawn deductively.The result of the research shows that debt and credit among heirs towardinheritance collected physically or calculated before it can be distributed to heirs.Priority is given to zul furudl heir since his right is clearly described in the Koran.Some methods in settling loan inheritance due to one of the heirs’ default areSulhu, Ibra, and Hajr. In this case, sulhu is the most appropriate method insettling the dispute by negotiation to avoid prolonged dispute and to make thefamily tries between defendant and the plaintiff harmonious. The Panel of Judgesstate that the Deferndant is required to pay off his debts to the Plaintiff based onpromissory note ad since the Defendant does not have evidence which will stateon reverse.Keywords: Inheritance, Debt and Credit, Default, Heirs
