Abstract

Piracy in intellectual property arises from the times that continue to take advantage of the development in technology. Various advantages have been arises from this phase of the development, such as an easy access to information, the availability of various information to the ease of convenience that occurs as a result of the technology development. Until then, the protection of intellectual property, which is the right of every community in the world becomes an issue that is the joint responsibility of the countries in the world. Indonesia and United States of America are taking an advantage in Intellectual Property Rights development. These two countries hid a bilateral cooperation in the economic field called Trade Investment Framework Agreement signed in 1996 which aims to protect the intellectual property rights of each country. Both country, United States of America and Indonesia through this agreement increase trust and enhance a good image for both countries in relation to compliance with international agreements. This study uses the concept of compliance approach in determining the attitude of two countries, and talks about efficiency, national interests and norms.

Abstract

Data menunjukan hasil bahwa di tahun 2020 jumlah aktivitas terjadinya perkawinan anak di bawah umur di Indonesia berjumlah 1,781,000. Angka ini membawa peringkat Indonesia ke dalam sepuluh besar negara dengan keberadaan perkawinan anak terbanyak di dunia. Indonesia adalah salah satu negara yang turut meratifikasi Convention on The Rights of the Child. Penelitian ini berusaha mengangkat fenomena dan literatur menyangkut keberadaan aktor non-negara dan signifikansinya dalam politik internasional, serta proses aktivitas advokasi transnasional mengenai isu perkawinan anak. Yes I Do adalah program buatan oleh PLAN International dan Rutgers Indonesia yang dilaksanakan dalam periode waktu 2016 sampai 2020. Program ini dikenal dengan berbagai aktivitas yang dilakukan dalam bentuk kerja sama dengan berbagai aktor domestik lainnya dan prestasi yang diakui pemerintah setempat. Lombok Barat dikenal sebagai salah satu wilayah Indonesia dengan angka perkawinan anak yang tinggi terutama dengan keberadaan kebudayaan lokal ‘merariq’. Melalui Teori Transnational Advocacy Networks (TANs) penulis akan menganalisis strategi jaringan aktivisme di Yes I Do terhadap fenomena perkawinan anak di Lombok Barat, serta hasil pengaruh program ini dalam membawa tekanan kepada pemerintah daerah mengenai keamanan bagi anak dan aktor negara disekitarnya.Data has shown the result that in 2020, number of activities for child marriage in Indonesia make a total to 1,781,000. This figure brings Indonesia's ranking into the top ten countries with the most child marriage activities in the world. It is acknowledged that Indonesia has ratified Convention on the Rights of the Child. This study seeks to raise phenomenon and literature regarding the existence of non-state actors and their significance in international politics, as well as the process of trans-national advocacy in the issue of child marriage. Yes I Do is created by PLAN International and Rutgers Indonesia which was carried out from 2016 to 2020. This program is known for the various pursuit to build collaboration with various other domestic actors in addition of the achievements recognized by the local government. This program takes three regions of Indonesia one of it which is West Lombok. West Lombok is known as one of the regions of Indonesia with a high number of child marriages, especially with the presence of the 'merariq' culture. Through Transnational Advocacy Networks (TANs) theory, the author will analyze the strategy of advocacy networking in activism by Yes I Do with the phenomenon of child marriages in West Lombok, moreover is the implications of this program regarding security for children.

Abstract

The purpose of this research is to know and understand Indonesian government effort or actions on protecting Human Rights for child refugee that live in Indonesia’s Immigrant Detention House. This research used the concept of Human security and qualitative method for the research analysis. The results of this research explain that Rudenim Jakarta, Semarang and Surabaya in the fulfillment of human rights of the displaced children are in accordance with the Regulations the Director General of Immigration Number F-1002.PR.02.10 of 2006 and the United Nations Development Programme 1994 on a structured and overall handling and procedures for the placement of a stranger. I recommend that Immigrant Detention House in Jakarta, Semarang and Surabaya to coordinate more efficiently with related agency or institution, and increase their Human resources so they will be able to perform maximally in handling Child Refugee’s rigths. Indonesian Government should also make a policy that could clearly state and explain the status of asylum seeker in Indonesia to fulfill their rights.
