Abstract

In the legislative system, Pancasila is a basic norm (staatsfundamental), which successively then verfassungnorm UUD 1945, grundgezetznorm or MPR provisions, and gezetznorm or the Act. But in reality, Pancasila is equalized and equated with the 1945 Constitution, the Unitary State of the Republic of Indonesia, Bhinneka Tunggal Ika, which is then referred to as the Four Pillars of Nation and State. The Constitutional Court as the constitution gatekeeper institution returns the position of the Pancasila as the state foundation through the Decision of the Constitutional Court Number 100/PUU-XI/2012. The decision is part of the implementation of the authority of the Constitutional Court which has 4 (four) authorities and 1 (one) obligation as stipulated in Article 24C paragraph (1) and paragraph (2) of the 1945 Constitution. In addition to being a guardian of democracy ) The Constitutional Court is also the Protector of the state's foundation and legal source.

Abstract

The journey of the Regional Representative Council (DPD) in the constitution is considered to still not compensate for the dynamics of proliferation of legislation. The reason is that the function of the DPD with the DPR in the field of legislation has been tugging and there has been intense competition in the formation of legislation, on the one hand the existence of the DPR as an institution holding a legislative function born earlier is considered to dominate the formation of legislation. On the other hand, the existence of the DPD as a new institution that is also given a legislative function, its authority is considered to be too small when compared to the authority of the DPR in the process of establishing legislation. Even the DPD is considered to add to the problem of over regulation in Indonesian legislation. Borrowing the term Richard Susskind mentions that hyper regulations or obesity are legal and over regulation. This situation led to the implementation of the DPD's legislative function not being optimal because it tends to be half-hearted. In other words, the existence of the DPD as the holder of legislative power is still under the shadow of the DPR, so it has not been taken into account in the process of establishing legislation in Indonesia, even though it has been corrected by the Constitutional Court through Decision of the Constitutional Court Number 92/PUU-X/2012 and Decision Constitutional Court Number 15/ PUU-XIII/2015, but the decision was ignored.

Abstract

The mechanism for removing The Head of local goverment from the Office based on Article 83 Subsection (1) of Law Number 23 Year 2014 on local Government begins with the status of a head of local goverment being charged with criminal offense, followed by temporary removal from his/her office based on a register at a Court. It is also found that the officer in charge of removing a Head of local goverment is the President for an offending Governor and a Minister for an offending Regent or Mayor, without the need for a consultation with the local House of Representatives. Meanwhile, the legal consequences of a removal of a Head of local goverment  that the offender’s rights and responsibilities are assumed by Vice Head of local goverment, until a legally binding verdict on the matter has been issued by the Court. Whenever a Head of local goverment being indicted is not removed from his/her office, then the President or the Minister concerned may be charged of unlawful conduct that cause legal uncertainties within the bureaucracy of the regional government involved.

Abstract

Based on analysis in this research, shows that: First, The Mechanism of Filling the Deputy Head of Region is done in the perspective of Government Regulation Number 49 of 2008 regarding the third amendment to Government Regulation Number 6 Year 2005 regarding the Election, Approval, Appointment and Dismissal of Regional Head and Deputy Head of Region, Second, The direct impact to the community due to the absence of a deputy head of the region can be seen from the heavy workload of regional heads in managing local governments that have many problems where it can not be resolved without the help of a representative, so that many services and development will be disrupted.

Abstract

AbstractThis research has purposes of knowing the interpretation of the supplementary worker rights definition after Constitutional Court Decision Number 67/PUU/XI/2013. This research has also purposes of knowing the preventive legal protection of the supplementary worker rights after the Decision of Constitutional Court No. 67/PUU-XI/2013. The results of this research are, firstly, the supplementary rights of worker are classified into: (a) normative, meaning that the supplementary rights which are provided and regulated by acts, such as severance payment, gratuity and compensative payment. (b) non-normative rights, meaning other rights are provided and regulated by the parties in accordance with the agreement in the employment agreement or collective labor agreement. Secondly, there are already legal protection of supplementary non-salary rights in Decision of Constitutional Court No. 67/PUU-XI/2013 but they are not completely protective because the supplementary rights of the worker are not included in separatist creditor payment.AbstrakPenelitian ini bertujuan untuk mengetahui, penafsiran definisi hak-hak lainnya dari pekerja/buruh Pasca putusan Mahkamah konstitusi Nomor 67/PUUXI/2013. Penelitian ini juga untuk mengetahui, perlindungan hukum preventif terhadap hak-hak lainnya dari pekerja/buruh Pasca putusan Mahkamah konstitusi Nomor 67/PUUXI/2013. Hasil penelitian ini adalah pertama, hak-hak lainnya pekerja/buruh dibagi menjadi: (a). bersifat normatif, adalah hak-hak lain yang diberikan dan diatur oleh Undangundang, misalnya uang Pesangon, uang penghargaan masa kerja, uang penggantian hak dan (b). Hak hak lainnya yang tidak bersifat normatif, berarti diberikan dan diatur oleh para pihak menurut kesepakatan baik dalam Perjanjian Kerja (PK) atau Perjanjian Kerja Bersama (PKB). Kedua, perlindungan hukum hak-hak lainnya dari pekerja/buruh Nomor 67/PUU-XI/2013 sudah ada namun tidak sepenuhnya terlindungi, dikarenakan hak-hak non upah pekerja/buruh dikecualikan pembayarannya oleh kreditur Separatis.

Abstract

The purpose of this writing is to find suitability of breast-feeding rights regulated in Act No. 13 of 2003 on Labour with the philosophy of woman’s reproductive rights. This writing is a writing normative laws. This writing is done by means of literature study to obtain secondary data in the field of law. From the result of study it can be concluded that first, in general provisions concerning of breast-feeding rights in Act No. 13 of 2003 on Labour was already conformed the philosophy of woman’s reproductive rights. Second, in specifically provisions concerning of breast-feeding rights in Article 83 of Act No. 13 of 2003 on Labour still has not been entirely conformed with the philosophy of woman’s reproductive rights, because it has not guaranteed full rights to female workers who breastfeed their babies.

Abstract

AbstractAct No. 18 year 2013 on the Prevention and Eradication of forest Destruction was legitimated on August 6 2013 as a governmental effort to cover of the weakness of the regulation, particularly related to the prevention and overcome organized forest destruction. Nevertheless, the regulation that combines both of penal policy and non-penal policy within the framework of the criminal policy is apparently getting some record even when the Act was still as a draft. besides assessed cannot resolve the core of the problem of crime. The Act became a new threat to the existence of indigenous peoples who live inside and around forests. The principle of legality as representation of positivistic paradigm transformed in the formulation of clauses in the Act, lead into the excesses of the existence of indigenous peoples who live in the forest. AbstrakDisahkannya Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan pada tanggal 6 Agustus 2013 merupakan sebuah bentuk usaha dari pemerintah untuk menutup beberapa kelemahan aturan khususnya yang berkaitan dengan upaya untuk mencegah dan menanggulangi perusakan hutan terorganisasi. Meskipun demikian, undang-undang yang mengkombinasikan antara sarana kebijakan hukum pidana (penal policy) dan sarana kebijakan di luar hukum pidana (non penal policy) dalam sebuah kerangka kebijakan kriminal (criminal policy) tersebut ternyata mendapatkan beberapa catatan bahkan saat undang-undang tersebut masih berbentuk rancangan. Selain dinilai tidak menyasar jantung masalah kejahatan, undang-undang tersebut justru menjadi sebuah ancaman baru bagi keberadaan masyarakat hukum adat yang hidup di dalam dan sekitar hutan. Asas legalitas yang merupakan representasi dari paradigma positivistik dan terjelma di dalam rumusan pasal dalam undang-undang tersebut membawa ekses bagi keberadaan masyarakat hukum adat yang selama ini hidup di sekitar kawasan hutan.
