Abstract

Franchise is a relatively new phenomenon in Indonesia’s business world, although ithas been common in developed worlds like the United States and European countries. This busi-ness runs according to procedures made by the franchisor. The latter will assist the franchisee, and inreturn, he or she will pay the initial fee and royalty. This business is not contrary to Shariaprecepts, as long as the object of a franchise contract is not something forbidden by Islamic law.Franchise contract accords with terms and conditions of a proper contract in Sharia, avoids ambi-guity, and follows the principles of Ash-Shidq (honesty and trustworthiness) and AI-Kitabah (writ-ten).

Abstract

The validity of a contract in Islam has to be based on Al-Qur’an, Hadith and Ijtihad(legal thinking). One main principle in an Islamically sanctioned contract is that it is free fromusury, ambiguity and speculation. The rapid development of Islamic economy as shown by theestablishment of various Sharia financing units offering Sharia based products puts Islamic con-tracts (akad) in an important position. Foreseen disputes need to be anticipated so they will notcreate problems in the future. This necessitates a prudential standpoint and a compliance withIslamic law, so that the parties involved in an akad are legally protected. For this to happen, atransaction should be tied by a contract. The present article discusses how a Sharia credit card isanalysed from the perpective of Islamic contract.

In developing a nation, the common goal of having a nation-state will become aguide to unify the people. For Indonesia, the issue of development has been central, althoughother aspects of nation life are by no means less important. It is development that drives thedynamics of governance. Very often, there is a strong emphasis on economic development only.Although theoretically the economy does influence positively the development of a nation-state,the legal certainty cannot be ignored. Both are two sides of the same coin that need to be presentfor the citizens of a country to prosper.

Abstract

A disproportional understanding on wakaf assets, emphasising their immortality, cause people to give only non-moving things, mainly lands, as wakaf, while historically, Muslims also donated money or cash wakaf. This must become a common concern. Cash wakaf can be employed as an instrument to boost the economy of Muslim community through investments. It also supplements other philanthropic funds. Moreover, cash wakaf will provide a huge support to make non-moving wakaf assets more productive. Unused wakaf lands can be transformed into cash machines, using wakaf money, for example by making them cultivation areas, or to build factories, offices or a business center. By doing so, we do not need to depend on loans from foreign countries to alleviate poverty.

Abstract

Studies on tax generally focus on factors related to willingness of tax payers to pay theirtaxes. The present research develops previous study models by adding two new variables. Thefirst one is perception on the taxing officers and the second one is criteria of complying taxpayers. This study also employs an underused theory, the theory of planned behavior. Based onthe data gathered from 150 respondents, this study confirms the theory. More specifically, theawareness of tax payers, good perception on the effectiveness of tax service system, and percep-tions on the criteria of complying tax payers positively influence the overall willingness to paytaxes. Meanwhile, perceptions on taxing officers and knowledge and understanding on tax regula-tions do not influence the willingness of personal tax payers to pay taxes.

Abstract

This article relooks at khiyar (the right to choose between continuing or aborting atransaction) that starts to be ignored in the current business world. It covers various forms ofkhiyar and the philosophy behind the concept. The importance of this right lies on the rule that atransaction has to accord with the principle of ‘an tarâdhin (both parties are happy with a giventransaction). Khiyar is embedded in every transaction: it automatically applies. But our contempo-rary and more complex trade world moves towards the abandonment of this right to choose. Anindication of this is the often found store policy that reads ‘an item that has been bought cannotbe returned’. This is why a serious thinking is needed to keep the khiyar exist, so justice in anytransaction can be preserved.

Abstract

FIF Syariah is a non-bank Sharia-based unit running a financing business. The fact thatit follows Sharia precepts and that the majority of Indonesian citizens are Muslims make it pro-spective to be an alternative in distributing funds to people in Indonesia. In middle term, there isa big chance that FIF Syariah will have a speedy growth since the number of company that openSharia financing units is still relatively small. It is important that every stakeholder pay attentionsto these Sharia financing units so they can grow and stay in the right track (complying withIslamic law). The commitment of the government will certainly support the development ofSharia financing in Indonesia.

Abstract

The two big streams of thought coloring the world’s economy until today are socialismand capitalism. Capitalism demands freedom in weatlh accummulation, competitive politics, freemarket in trade, permissive social interaction and unrestricted government. Socialism has theview that people are brothers and sisters, believes in equal sharing, the abolition of the gapbetween the rich and the poor and a tight control of the pesantry by the socialist party. In itsdevelopment, socialism was then seen as neglecting individual freedom in economic activities. The two ideologies need to be balanced in a meeting point, that is a third straight way of eco-nomic thought whereby the capitalists have to give alms for the living costs of the haves-not. Themeeting point, a third idelogy is Islam that in its economic activities has this balance (evenwichtigheid)between capitalism and socialism. In Islamic economy, etics, logics and aesthetics are clear.
