Abstract

ABSTRAK           Tinjauan Masalah Penerapan Sanksi Administrasi Terkait Reklamasi Pasca Tambang Berdasarkan Peraturan Pemerintah Nomor 78 Tahun 2010 Di Kecamatan Siluq Ngurai Kabupaten Kutai Barat. Di Bawah bimbingan Kunti Widayati, S.H, M.H, dan Malik Ibrahim, S.H, M.H. Masalah yang timbul pada kegiatan pertambangan adanya kerusakan lingkungan yang terjadi akibat kegiatan pertambangan dimana banyak sekali lahan galian yang terbuka menganga dan tidak di reklamasi dan pasca tambang oleh perusahan pertambangan. Adapun rumusan masalah yaitu bagaimana penerapan sanksi administrasi bagi pemegang izin usaha pertambangan yang tidak melaksanakan reklamasi pasca tambang dan bagaimana upaya pemerintah daerah pasca tambang terkait dengan reklamasi pasca tambang. Hasil penelitian ditemukan bahwa sanksi yang diberikan pemerintah daerah terhadap perusahaan pertambangan yang tidak melaksanakan kewajibannya untuk melaksanakan reklamasi dan pasca tambang adalah sanksi administrasi berdasarkan Peraturan Pemerintah Nomor 78 tahun 2010 Pasal 50 yaitu peringatan tertulis, penghentian sementara kegiatan atau seluruhnya operasi pertambangan, pencabutan IUP, IUPK, dan IPR. Berdasarkan hal di atas diharapkan para pimpinan dan kepala inspektorat tambang perusahaan untuk melakukan reklamasi pasca tambang sesuai Undang-Undang Nomor 4 Tahun 2009 Tentang Pertambangan Mineral dan Batubara serta Peraturan Pemerintah Nomor 78 tahun 2010 tentang Reklamasi dan Pasca Tambang.

Abstract

AbstractConsumer Dispute resolution agency (BPSK) under Act No. 8 of 1999 on consumer Protection established by the Government, is the body in charge of handling and resolving disputes between consumers and business actors. The establishment of BPSK is to cope with the process of litigation that is old, formal and complicated by the alternative path of dispute resolution outside the judicial Court of fast, simple and inexpensive cost.The method used is a sociological juridical method, which presents a statement in the field of the legal rules contained in the regulations or legislation in force. Furthermore, data is analyzed qualitatively.The result of the research that authors do this process of consumer report to the consumer Dispute resolution agency (BPSK) of Samarinda City, consisting of several stages, the first phase of the consumer filing a report on verbal written dispute resolution or Written to the secretariat of BPSK. Under Law No. 8 of 1999 on consumer protection can be pursued using litigation and non litigation lines, settlement through non-litigation pathways is conducted by BPSK by mediation, conciliation and arbitration. Settlement of consumer disputes regarding the form and the amount of indemnification is submitted entirely to the parties.

Abstract

ABSTRACT                    East Kutai Regency has several comparative advantages namely wide land, diverse natural resources that are diverse and supported by strategic geographical position. All the wealth of natural resources and the potential that exists in Kutim Regency will be more meaningful for the lives of present and future generations. The birth of Law Number 32 of 2009 brings new hope in environmental criminal law enforcement, because criminal law enforcement in this Law introduces the threat of minimum punishment in addition to maximum, expansion of evidence, punishment for violations of quality standards, integrated criminal law enforcement, and regulation of corporate crime.                   Referring to the legislation of natural resources whose estuary is based on the provisions of Law Number 32 of 2009 concerning the protection and management of the environment. Criminal law enforcement in Law 32 of 2009 concerning Environmental Protection and Management in the case of forest and land fires in Kutim District can be subject to Article 108 of Law Number 32 of 2009 concerning Environmental Protection and Management with a minimum of 3 (three) year and no later than 10 (ten) years and a fine of at least Rp. 3,000,000,000.00 (three billion rupiahs) and a maximum of Rp. 10,000,000,000.00 (ten billion rupiahs).                   The efforts of the East Kutai Government to prevent forest and land fires in Kutim Regency by disseminating information that the burning of land is a criminal form and can be subject to criminal and civil sanctions as stipulated in Article 108 and Article 88 of Law Number 32 of 2009 concerning Environmental Protection and Management and the Province of East Kalimantan has also issued a Regional Regulation on Land and Forest Fire Control.                   In order to prevent further damage to forests and air pollution as a result of forest and land fires, it is expected that the regional government apparatus should be given a supervisory role and the authority to take action against firefighters who deliberately burn, and are also expected in the contents of Regional regulations on Forest fires. Legal sanctions should be included on the perpetrators, and should be carried out appropriately so as to have a deterrent effect on people who do not pay attention to the provisions of the intended regional regulations, thus, this will make little by little every year forest and land fires can be reduced, if the provisions in the regulation not subject to sanctions, then the rules are just regulations

Abstract

AbstractDefinition of Marriage According to Customary Law Marriage is one of the most important events in the lives of indigenous peoples. The issue raised in this discussion is the implementation of Aoheng Dayak Customary Marriage in terms of Law Number 16 of 2019 Amendment to Law Number 1 of 1974 concerning Marriage and legal issues regarding the implementation of Aoheng Dayak Indigenous Marriage in terms of the LawType of Normative Juridical research is research conducted based on legal material and by collecting data, books in the library with the problems used in this study.Results of the study. Terms of Marriage Legality according to Aoheng Dayak Customary Law namely, Customary goods for Applications (Uvut Keneco'u), Customary Marriage (Besaa Adet), Tomo Pasing Toang Adet Procession, involving the community, Dayak Aoheng need to discuss Indigenous marriage is not applied to advanced age, Factors found also occur in terms of marriage registration, the existence of marriage registration costs which according to them are expensive and not affordable by indigenous peoples. They want to avoid convoluted bureaucracies and need a long time. They consider it better to work to earn a living compared to having to take care of marriage registration. Implementation of Aoheng Dayak Indigenous marriage regarding Age or Age compilation of marriage is not implemented as stipulated in Law Number 16 of 2019 concerning amendments to Law Number 1 of 1974 concerning Marriage.

Abstract

ABSTRACT This research entitled "A Juridical Study of the Protection of the Insured Person in Health Insurance at the Social Security Administering Body (BPJS) in Samarinda",The purpose of this study is to know clearly about the arrangements in order to protect the insured health insurance in the event of a claim that is greater than that covered by the health social security administering agency (BPJS), and aims to find out what efforts should be made by the government against the insured party of the health social security administering body (BPJS) to resolve claims that are greater than the insured amount.This research is a type of research that is normative in nature. The type of data used is primary data in order to obtain library materials and regulations related to the title of the thesis. The data collection technique used was carried out by literature study. In this case, what is examined is the implementation and payment of health insurance claims in the event of a claim that is greater than that covered by BPJSA health according to Law Number 40 of 2004 concerning the National Social Security System (SJSN).From the results of the study, it can be concluded that the implementation of payment for health insurance claims from health providers is greater than the insured, BPJS health is usually verified first by the BPJS Kesehatan by checking and studying written notifications from health service providers (PPK), BPJS health officers. come to PPK to verify the amount of claims borne by BPJS Kesehatan, check supporting evidence of claims submitted by PPK, and pay insurance claims in accordance with the verification results as well as efforts that must be made by the government to protect the insured party of BPJS Kesehatan to overcome claims of health providers that are larger than those be insured, namely making regulations on BPJS health by fostering a health service system that is efficient, effective and accountableKeywords: BPJS, Health Insurance and Claims Implementation.

Abstract

ABSTACTAs technology develops and advances in time, the world of health is also starting to experience a lot of progress, especially for several diseases that have been found new methods in treatment. For example by discovering new treatment methods by transplanting organs (transplants) for several organs such as kidneys, liver, lungs, and bones. But in practice the method of treatment by transplanting human organs can’t be done easily, bearing in mind that there are still very few organs needed compared to the needs of human organs. Thus causing high prices of a human organ that should not be commercialized, and many people are using this opportunity to meet economic needs by trading human organsThe research method used is normative legal research. Normative legal research is research that studies how the legal norms are. The data collection method uses the library research method. This study uses secondary data obtained from various literature and regulations relating to the problems in this thesis.The results of research or conclusions in this study indicate that the crime of trafficking in human organs has been regulated in several laws but in reality up to now there is only one case of trafficking in human organs that can be disclosed by the authorities. This is because there is still a lack of supervision by the government and the existing legislation still cannot reach the cause of the organ trade itself, so it is necessary to have laws and regulations specifically regulating organ trafficking and transplantation. Keywords: Crime, Human Trafficking, Organs

Abstract

ABSTRACT The main activity of the bank as an intermediary is to channel credit to the community by making credit agreements. The need for funds generally in the Indonesian banking world is called credit, sometimes associated with the guarantee of securing funds or credit itself. Credit is the largest part of the source of income for the Bank because loans given selectively and directed by banks to customers can support the implementation of development so that it is beneficial for the welfare of the community. Loans provided by banks as a means to encourage economic growth both in general and specifically for certain sectors.This research is normative legal research, namely legal research methods carried out by examining library materials or mere secondary data. The research procedure that is used is legal material collection research that will be used in this research is a literature study, namely data collection by reading the laws and regulations, official documents, and literature that are closely related to the issues discussed.From the results of research that have been carried out and analyzed by the Settlement in Overcoming the Inhibiting Factors of Bad Credit Through Under-the-Sale Sales of Objects Guaranteed Tied to Fiduciary by way of Notification of late payments, Giving warning letters and Submissions through the District Court. Abstract

AbstractProtection of the right to social security for workers is very important and necessary, especially when dealing with occupational risks even during the occurrence of work accidents. The problems examined in this study include 2 (two) things: first, what constitutes labor rights according to Law Number 40 of 2004 concerning the National Social Security System, Law Number 24 of 2011 concerning the Social Security Organizing Body and Law Number 13 of 2003 concerning Manpower. Second, how is the implementation of the right to labor social security at the Purwa Caraka Music Studio in Samarinda. The research method used in this writing is the Juridical-Empirical method with the fact approach method which is done by seeing firsthand the real situation at the research site, Purwa Caraka Music Studio (PCMS) Samarinda. The results of this study, the rights granted according to Law number 40 of 2004 concerning the National Social Security System, Law Number 24 of 2011 concerning the Social Security Organizing Agency is to provide social security in the form of work accident insurance programs, old age benefits, pension guarantees and death guarantees. Labor rights according to Law number 13 of 2003 concerning employment is to provide social health insurance for work health, decent wages, leave entitlements, etc. Then, the implementation of labor rights in Samarinda's PCMS is in accordance with applicable laws and regulations. As for workers who do not get social security because they are still on probation and when accidents occur, the form of protection provided is preventive protection by sending victims to clinics or hospitals and providing first aid kits on each floor and repressive protection measures by providing compensation treatment for workers who have had work accidents that have not been registered with the BPJS. The advice given by the writer first is that further research is needed to map the role of government, synchronize with other laws and regulations relating to the management of the social security system. Second, the Samarinda PCMS should further optimize work safety and health efforts for workers and workers should be registered on the first day of work. The government must also reinforce sanctions for companies that have not registered workers in accordance with applicable regulations. As well as providing information on the importance of occupational safety and health, as well as information on the existence of the Government's social security program, BPJS.

Abstract

ABSTRAK               Perjanjian waralaba (franchise) merupakan salah satu aspek perlindungan hukum kepada para pihak dari perbuatan merugikan pihak yang lain. Hal ini dikarenakan perjanjian tersebut dapat menjadi dasar hukum yang kuat bagi para pihak untuk menegakkan perlindungan hukum.Pertumbuhan bisnis waralaba (franchise) yang demikian pesatnya tentunya memiliki konsekuensi, yaitu membuka peluang bagi masyarakat untuk terlibat di dalam kegiatan bidang ekonomi. Peluang ini tentunya juga membutuhkan proses, pengaturan, pengarahan serta pembahasan untuk dapat menghindari kerugian dan pemutusan kontrak secara sepihak, khususnya dalam bidang waralaba (franchise) ini.Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif, dalam melakukan pembahasan terhadap permasalahan yang ada, penulis akan melihat pada ketentuan peraturan perundang-undangan yang ada kaitannya dengan franchise.permasalah yang penulis bahas dalam skripsi ini adalah mengenai pelaksanaan perjanjian franchise menurut Hukum Perdata di kota samarinda dan akibat hukum pemutusan perjanjian franchise secara sepihak oleh franchisor sebelum berakhirnya kontrak.Berdasarkan hasil penelitian maka dapat disimpulkan Dalam pelaksanaan perjanjian franchise para pihak yaitu pemberi waralaba (franchisor) maupun penerima waralaba (franchise) harus mendaftarkan usahanya dan memiliki Surat Tanda Pendaftaran Waralaba (STPW). Kata kunci : franchise, franchisor, wanprestasi

Abstract

AbstractPublic services are organized by the government or public service providers in terms of the petition filed by society, of course, expect to be met. But sometimes an application for a decree can not be met in terms of both requirements are not met nor of the procedural aspects of the old and long. One path taken apart complaint or objection submitted to the government, is through the legal system by submitting an application or a lawsuit at the Administrative Court of the State. Good application to obtain admission decision as provided for in Article 53 of Law No. 30 of 2014 on Government Administration and through lawsuits filed related to the refusal or decision fictitious negative as stipulated in Article 3 of Law No. 5 of 1986 concerning the State Administrative Cour., The resolution attempts through the courts is ultimium remudium (the last resort) for citizens to obtain the appropriate public service expected. Lawsuit or application to obtain the Decree of the Government would be expected to provide for community legal certainty, in addition as a correction for public servant in serving the community
