Abstract

In the second amendment to the 1945 Constitution of the Republic of Indonesiadetailing human rights (human rights) contained in article 28 (28 A to 28 J), one importantelement of human rights is health, regarding this matter our constitution states that everyonehas the right to live in prosperity physically and spiritually reside, and get a good andhealthy environment and the right to obtain health services, hospitals as organizations havean important role in optimizing the degree of public health optimally. In the last case therewas a hospital that refused emergency patients even though in accordance with the sound ofArticle 32 paragraph (2) which reads "in an emergency, health care facilities, both thegovernment and the private sector are prohibited from rejecting patients and / or asking foradvances. The purpose of this writing is; the first is the application of health personnelsanctions that reject emergency patients, the two factors that prevent the police fromenforcing the law against health workers who reject emergency patients.This type of researchcan be classified into the type of sociological research, because in this study directly conductresearch on the location or place studied to provide a complete and clear picture of theproblem under study. This research was conducted at the RI Ombudsman RiauRepresentative and Riau Regional Police, while the population and samples were all partiesrelated to the problems examined in this study, data sources used, primary data, secondarydata, and tertiary data, data collection techniques in research this is by observation,interview and literature study. From the results of the research problem there are two pointsthat can be concluded. The first is the application of sanctions to health workers who rejectemergency patients, that the imposition of sanctions on health workers is not carried out inaccordance with Law Number 36 of 2009 in the form of criminal sanctions and fines. The twofactors that were the friend of the police in enforcing the law against health workers whorefused emergency patients, while the obstacles faced by the police in enforcing the lawagainst health workers were due to a lack of public awareness about the law and becausethere were no reports from the public. Suggestion The author, first, is expected to imposecriminal sanctions on health workers who reject emergency patients need to be carried out inaccordance with applicable laws and regulations. Secondly, the police do not wait for publicreports because cases of health workers rejecting emergency patients are an ordinaryoffense. not complaint complaints so there is no need for a complaint or report to investigatethe case.Keywords: Sanctions - Health Workers – Emergency

Abstract

Perkawinan merupakan suatu ikatan yang sangat kuat sebagai penghubung antara seorang laki-laki dan seorang perempuan dalam membentuk suatu rumah tangga. Perkawinan juga ditujukan untuk terus melangsungkan kehidupan hingga ke generasi-generasi berikutnya dalam ikatan yang sah. Di Indonesia perkawinan di atur dalam Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan. Dalam ketentuan Pasal 1 Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan. Namun terkadang takdir berkata lain, perkawinan yang diharapkan berjalan bahagia penuh cinta dan kasih sayang ternyata harus kandas karena suatu hal. Kandasnya suatu pernikahan bisa disebabkan oleh seperti halnya perselisihan, pertengkaran hebat antara suami dan isteri (penggugat), maupun keadaan dimana salah satu pihak tidak melaksanakan kewajibannya sebagai suami maupun istri. Mencegah akibat buruk dari hal tersebut, Islam memberikan alternatif berupa jalan perceraian. Perceraian adalah berakhirnya suatu pernikahan, beragam faktor yang menjadi pemicu terjadinya perceraian mulai dari ketidakharmonisan, krisis moral, kekerasan jasmani, terus menerus berselisih, cacat biologis sampai dengan suami meninggalkan kewajibannya atau melanggar taklik talak,. Pelanggaran taklik talak adalah suatu talak yang digantungkan pada suatu hal yang mungkin terjadi yang telah disebutkan dalam suatu perjanjian yang telah diperjanjikan terlebih dahulu yang berfungsi mengikat pertanggungjawaban suami terhadap istrinya.Kata Kunci:Perkawinan - Perceraian - Cerai Gugat - Taklik Talak .

Abstract

Island rentals in Indonesia to foreign parties violate the principles of an island nation that emphasizes the integration between land, sea and air dimensions in carrying out national development. It can also eliminate the integration of the sea dimension or waters in national development. in the National Long-Term Development Plan (RPJPN), one of the points of the long-term development mission is to realize Indonesia as an archipelago / maritime country, while the nation's predecessors have fought steadily so that the principles of the island nation are recognized byinternational world as stated in UNCLOS 1982.This type of research used in writing this law is normative legal research that focuses on principles by formulating legal principles, both from social data and from positive written legal data. Whereas when viewed from the nature of this research is descriptive. this study uses secondary data, namely data that has been prepared.The results of this study are island leasing in the territory of the Republic of Indonesia sovereignty against foreign parties based on the 1982 United Nations Convention on Law of the Sea (UNCLOS) in the form of usufructuary rights and leases based on legislation that applies in the Republican sovereignty Indonesia. Indonesian foreign parties are given authority over island rentals as limited as managers. However, some foreign parties have exceeded the authority given to the detriment of the local people who are the people of Indonesia. Island leasing in the territory of the Republic of Indonesia sovereignty against foreign parties based on positive law in Indonesia has not been able to accommodate the interests of the Indonesian people in accordance with the 1945 ConstitutionIsland leasing to foreign parties is more oriented towards seeking profits to increase state income and naturally eliminate the rights of local communities over natural resources of Indonesian waters.Keywords: Island Rental, Foreign Parties, UNCLOS 1982

Abstract

Corruption is an enemy of every country in the world, and we all know that money is the mainsource of corruption. Lubis and Scott in their view of corruption say: "in the legal sense, corruption isbehavior that benefits self-interest by harming others by government officials who directly violate legalboundaries over such behavior, whereas according to government norms can be considered corruption ifthe law is violated or not in the business the action is despicable ". This criminal offense not only harmsstate finances, but also violates the social and economic rights of the community.This research is sociological or empirical research, namely the type of research that usescommunity assumptions in looking for facts that occur in the field to answer an existing problem. Thisresearch was carried out in the Riau High Prosecutor's jurisdiction. While the population and sample areparties related to the problems examined in this study, the data sources used, primary data, secondary data,and tertiary data. The technique of collecting data in this study was through interviews and literaturereview.From the results of the research the authors did can be concluded, firstThe role of the Riau High Prosecutor's Intelligence in the disclosure of alleged criminal acts ofcorruption is to conduct judicial intelligence activities and operations or investigations to collect data orinformation that can be used as evidence about whether or not a corruption has occurred which is thensubmitted to the Chairperson or party have an interest in further decision making. The obstacles faced byRiau High Prosecutor Intelligence in uncovering alleged corruption in the Riau High Prosecutor's lawregion, namely human resource (HR) factors, the factors of legislation that were felt to be incompatible withthe demands of community development, the difficulty factor for the Prosecutor Intelligence in obtainevidence in the form of letters, valuable documents, and related assets, factors in the lack of fundsallocation, factors in lack of coordination by the Prosecutor's Intelligence with related agencies, and factorsin the lack of planning carried out by Riau Prosecutor's Intelligence Office.Keywords: Juridical Ideas - Sexual Gratification - Corruption Crime.

Abstract

Chronological case number: 0675 / PdtG / 2013 / PA.Pbr. June 20, 2014, the late Hj. Sofiah binti Edek who own property together as husband and wife, in the form of a piece of land and its permanent building on teletak in Jalan Rajawali No. 62, RT.02, RW 04, Village Kedung Sari, District Sukajadi, Pekanbaru. The purpose of this thesis, namely; First, to determine the consideration of judges on case No. 0280 / Pdt.G / 2015 / PA. Pbr intestate heirs, Secondly, to find out the judge's decision was appropriate according to Islamic law.This type of study can be classified in this type of normative juridical research, which is a type of research that discusses the principles of law. This research was conducted by examining the library materials or secondary data in the form of legislation and the books written by legal experts associated with the title of the research, articles, journals, and other sources. Federally data sources used, the primary data, secondary data and data tesier, data collection techniques in this study with the study of literature or documentary studies.Based on the research there are two principal issues that can be inferred. First,Based on legal considerations and basic provisions of the law are used, the judge ruled that the right to be heir consists of four (4) persons younger boys and four (4) girls are Hj. Nurjanah bint Khalib Dain girls, Nurman bin Khalib Dain son-worthy, Nurhadi bin Khalib Dain son, Muhammad Aini bin Khalib Dain son, Rosma bint Khalib Dain daughter, Nurhayati binti Khalib Dain girls, Jamaluddin bin Khalib Dain son and daughter Khalib Dain Jaliah girls who all reside diPekanbaru. Second, the judge's decision on case No.0280 / Pdt.G / 2015 / PA.Pbrthere needs to be corrected according to Islamic law and contains the value or the quality of legal certainty. Land Hj. Sopiah bint Edek number of 325.08 m2 while the verdict of land distributed to the heirs of 324 m2, the division of the estate Hj. Edek and Sopiah binti Hj. Nurjanah bint Khalib first plaintiff who had died on Saturday 04th of April 2015. Based on the case that the Islamic law of inheritance, the heirs male resident balanced by the heiress in accordance with the position and function in families where male heir and women gained the right to a comparison 2: 1 (two to one). Suggestions Author, First Should the division of the inheritance of each heir can finish it amicably, because not a few families divided because of the division of the inheritance. Second, Sebeium apply to court and claim inheritance should know in advance where the heirs and follow the procedures in the Religious Court. Abstract

Minangkabau adheres to the matrilineal kinship system. Matrilineal kinship system is a kinship systemby drawing lineages based on maternal lines. Every offspring born from a marriage will enter his mother’sfamily. A marriage in minangkabau has a broad meaning. It is not just a meeting two peoples but morebroadly because it involves families of both parties. The marriage of the minangkabau community is exogamy.Exogamy which is done outside the tribe. It means that a person who wants to get married must find a partneroutside her/his tribe. The peoples who are married with some tribe called “tamakan pokok”. Minagkabaumarriage is regulated in a religious and customary manner.Some problem that will be discussed in this thesis namely: First, how to carry out the inter-teribalmarriage to melayu tribe community of Nagari Padang Sibusuk Kupitan Sub-District, Sijunjung Regency.Second, is the application of a marriage ban on intertribal marriage still maintained bt melayu tribecommunity of Nagari Padang Sibusuk, Kupitan Sub-District, Sijunjung Regency.the type of research is usesociological research, the form of the research is a law identification (unwritten law).The result of study can be concluded namely: First, the implementation of marriage between followmembers of the melayu tribe can occur as long as they come from different rumah gadang. Second, theprohibition on inter-tribal still runs in Nagari Padang Sibusuk, but in Melayu tribes it is possible to domarriage with fellow melayu tribes as long as they come from different rumah gadang. Abstract

Children are the next generation and successors to the development struggle as well as themandate and the gift of God Almighty, which we must always guard because in them the dignity, dignity andrights as human beings must be upheld. Legal protection for children is an effort and activity of all levels ofsociety in various positions and roles, who realize the importance of children for the nation and the nationin the future. If they are mature in their physical and mental and social growth, then they will replace theprevious generation.This research can be classified in the type of sociological legal research (empirical), which ismeant by sociological legal research (empirical) that is as a study that looks directly at the effect of theenactment of positive law on people's lives, because in this study the authors directly conduct research onlocation or place researched to provide a complete and clear description of the problem under study.Whereas viewed from the nature of the research reneline is descriptive, that is research that provides a clearand also detailed description of the problems examined by the author, namely Legal Protection AgainstChildren Who Become Victims of Torture in the Household in Pekanbaru Police Law Based on the LawNumber 23 of 2004 concerning the Elimination of Domestic Violence.From the results of the research the authors concluded, First, Protection of children in the LegalArea of the Pekanbaru City Police Resort is still not in line with expectations, because there are still manychildren who get violence and discrimination and violated children's rights while the protection that thegovernment should not provide well realized, secondly, the factors that cause obstruction of legal protectionfor children, are almost the same as law enforcement factors, which include the law, that in Law No. 23 of2004 not discussed in detail about how supervision of parents who commits a criminal act of abuse againsta child. law enforcers, that they did not regard the case as a criminal case, there was no further processregarding the perpetrators who escaped, the absence of a post mortem so there was a lack of evidence toprocess, and a lack of reports.Keywords: Legal Protection - Against Children - Victims of Torture in the Household.

Abstract

The process of resolving disputes through mediation is emphasized in the deliberations oragreements of the parties, so that there is no element of coercion between the parties and mediators, theparties request voluntarily to the mediator to help resolve the conflict. Therefore, a mediator domiciledhelps the parties to reach an agreement that can only be decided by the parties to the dispute. The mediatoris an employee of a government agency responsible for the field of labor who fulfills the requirements as amediator determined by the Minister to carry out mediation and has the obligation to provide written adviceto the disputing parties to resolve rights disputes, interest disputes, termination of disputes, and disputesbetween trade unions / labor unions in only one company.From the results of the research that the authors did, it can be concluded that the stages ofmediation at the Office of Social Services, Manpower and Transmigration in Rokan Hulu Regency were inthe stage of recording disputes, determining mediators to handle cases and research case files inaccordance with procedures stipulated by Law Number 2 of 2004 regarding Industrial Relations Disputes,but in the next stage, the calling of the parties is not in accordance with the provisions of the Law, namelymediators calling parties only through telephone calls which should be regulated by the parties sent aninvitation letter to attend the mediation session. Second, efforts that can be made to resolve industrialrelations disputes in the Social Service, Manpower and Transmigration Office of Rokan Hulu Regency canbe efficient and effective by increasing the trust of the parties to the mediator, increasing the number ofmediators and increasing the mediator's abilities and expertise, and making space a special session formediation that is clean and adequate.Keywords: Mediation - Disputes - Termination of Employment.

Abstract

Decision of the Constitutional Court No. 65 / PUU-VIII / 2010concerning Testing of Law Number 8 of 1981 concerning Criminal ProcedureLaw, provides an extension of the understanding of witnesses stipulated in article1 points 26 and 27 of the Criminal Procedure Code. The Constitutional Court asone of the judicial power institutions whose decisions are final and binding, canbe one of the sources of criminal procedural law in Indonesia. But in practicethere are still many judges who do not follow the Constitutional Court Decisionas one of the instruments of evidence of legitimate witnesses in court. The purposeof writing this thesis is, first: To find out the strength of the testimony of thetestimonium de auditu's testimony after the birth of the Constitutional CourtDecision Number: 65 / PUU-VIII / 2010. Second: To find out the implications ofthe Constitutional Court Decision Number: 65 / PUU-VIII / 2010 on thetestimonies of witnesses of the testimonium de auditu in the decision of thecriminal court.This type of research is normative juridical research, namely researchcarried out by examining literature with secondary data sources consisting ofprimary legal material in the form of legislation, secondary legal material legalbooks, and tertiary legal materials in the form of dictionaries. Abstract

The principle of due process of law in criminal procedure law contains two things processesand procedures. There must be no legal process without procedures, and the procedure is carriedout without the process of this procedure is prohibited in the procedural law. Based on LawNumber 8 of 1981 concerning Criminal Procedure Law, hereinafter referred to as KUHAP. Thescope of pretrial authority is regulated in Article 1 number 10 Jo Article 77 KUHAP Pre-trial aimsto protect the rights of suspects in the level of investigation and prosecution. Pretrial isstrengthened by the Constitutional Court Decision Number 21 / PUU-XII / 2014. Addition ofpretrial authority to examine and adjudicate whether or not the determination of the suspect, thevalidity of the search and acts of seizure. Through the Constitutional Court Decision Number Case102 / PUU-XIII / 2015 states Article 82 Paragraph (1) letter d of the Criminal Procedure Code iscontrary to the 1945 Constitution and does not have binding legal force as long as the phrase "acase has begun to be examined" is not interpreted the case has been delegated and the first trial hasbeen submitted to the subject matter on behalf of the pretrial defendant/ applicant".The purpose of this essay is: First, to know the principle of fast, simple and low-cost justiceassociated with due process of law against the death of pretrial based on Article 82 Paragraph (1)Letter d of the Criminal Procedure Code jo Decision of the Constitutional Court number 102 /PUU-XIII / 2015. Second, to find out article 82 paragraph (1) letter d of the Criminal ProcedureCode jo Decision of the Constitutional Court number 102 / PUU-XIII / 2015 has used due processof law.This type of research is normative legal research. Namely reviewing the principle of law.From the results of the problem research there are two main things that are concluded, first, thatthe word segara contained in Article 50 paragraph (2), (3) and Article 143 paragraph (1) of theKUHAP has been interpreted carelessly without looking at the quality of a case file which will bedelegated to the court and does not consider the principle of proof of the second, that there is nolegal standing against the pretrial death verdict carried out by investigators and / or prosecutors inthe delegation of court case files.
