Jurnal Studi Agama dan Masyarakat (JSAM) is an academic journal, publishing two issues per year (June and December). JSAM is published by Lembaga Penelitian dan Pengabdian kepada Masyarakat of Institut Agama Islam Negeri (IAIN) Palangka Raya, Indonesia. This journal seeks to provide a venue for sharing new empirical research and theoretical analysis of intersections between religion and societies. JSAM publishes original works that contribute to scientific discussion of the relationship between Islam and societies. The journal’s primary focus is on contemporary issues of Islam and culture, politics, economics, law, communication, and history within Indonesian contexts such as local wisdom, multiculturalism and pluralism. However, works on the issues of world religions and global societies are welcome.

Abstract

One of the major contributions of Ibn Qayyim is about wali mujbir guardian in marriage. He expressed a parent or guardian should not be married off forcibly if it is not accompanied with the consent and approval of the child. This perspective is different from the scholarly (the majority of scholars) that states a parent or guardian may be married off forcibly although without the consent and approval of the child. This study is a literature study (library research) using a contextual approach presented in descriptive and deductive. Data were analyzed through content analysis and hermeneutic methods and study uṣul fiqh. Results from this study: (1) Especially girls (as well as boys) should not be forced to marry and must not be married except with his/her agreement. (2) The Method used legal istinbāt. (3) Relevance thought Ibn Qayyim Al-Jawziyya about mujbir guardian in marriage (a child’s right perspective) in accordance with the spirit of child rights and relevant to contemporary conditions. Thought Ibn Qayyim are considered able to accommodate the growing problems of law in society in order to avoid forcing the parents to their children to marry without first requested permission and consent of the child.

Abstract

The background of the authority Elder Son In Divisonof property inheritance at the village of Bagendang Permai district at MentayaHilir Utara of East Kotawaringin, the basis of the authority of Elder Son In Divison was entrusted to distributed the property inheritance at village BagendangPermai district of MentayaHilir Utara of East Kotawaringin, the implementation of the distribution  property inheritance by the oldest child of his/her family at the village of Bagendang Permai of the district Mentaya Hilir Utara of East Kotawaringin. This study used qualitative descriptive method which collected data derived from the words obtained in observation, interviews, and documentation, subjects were 10 family. The results showed that the oldest child has an obligation to distribute the property inheritance owned by parents to each heir is the right to receive. The basicof authority  was entrusted by oldest child to distribute of the property inheritance, because the mandater entrusted by their parents elder son In Divison to distribute left to heirs. The impelementation of the distribution of property inheritance by the eldostchild to his/her family at the village of BagendangPermai, the family gathered for deliberation to distribute the properti inheritance owned by their parents were led by Elder Son in the family.

Abstract

The aggrement of marriage can be used as a legal instrument prevention of household violence. Payload contents in a marital agreement in the form of protection against violence carried out both from the husband to the wife to the husband or wife. The study belong to library research. More specifically, the type of research was also called normative legal research within the framework of prescriptive Islamic law by using approaches law (statue approach), the conceptual approach (conceptual approach), and analytical approach (analytical approach), using the method of data collection descriptive and deductive. The results of the study concluded that: Covenant marriage of a preventive nature has legitimate power, because it made notaril by the competent authority (notary) and legal certainty for married couples to refrain from domestic violence and to husbands and wives can exercise their rights and obligations in household well. The marriage covenant can be used also as a condition of lawful that must exist in marriage to provide legal protection in concrete terms with a form of protection and certainty in guaranteeing the rights and duties of husband and wife in order to realize the objectives of households that sakinah, mawaddah, dan rahmah as an objective.

Abstract

The background of the tradition of the muslim community in dividing the inheritance amicably was due to advice from one or more of the heirs which the most dominant in the division of inheritance,  because inheritance heir of inadequate if distributed with the way faraid, in addition there are also which based on the message of  inheritor before died to the heirs to share of inheritance the amicably. The purpose of this research was the tradition of the muslim community in dividing. This research uses descriptive qualitative approximation is collect and describe the data and facts matching in with situation which to exist at field and that obtained from the result of observation, interview and documentation. The result of this research demonstrate that The practice of implementation of the division of inheritance traditions amicably, there are two i.e. ways the division which done with the way agreement the family and the based to testament of the inheritor in moment still living, whereas the impact of the division of inheritance with the way amicably which done based on the message of inheritor before died to the heirs to divide of inheritance with the way amicably it is the positively impact.

Abstract

                Research conducted by the researchers focused on three things. First, how the background of the idea of the circuit court of the Religious Courts Sampit. Second, what is the basic provisions that allow a circuit court Sampit Religious Court. Third, how the effectiveness of the implementation of the circuit court Sampit Religious Court.               This research is the study of law (legal research) is research that uses the type of sociology of law studies with persefektif EMIC. Using descriptive qualitative approach and a sociological approach to examine perceptions and behaviors that occur in the field of law. The data used in this study of primary data and secondary data. Subjects in this study there are 8 (eight) that three judges Religious Court Sampit, clerks replacement Religious Court Sampit, bailiff Religious Court Sampit, cashier/administration Religious Court Sampit, head of the Religious Affairs Office District of Seruyan Hilir Seruyan, head of the Religious Affairs Office Subdistrict Katingan Katingan Hilir district and subdistrict head of the Religious Affairs Office of the Middle Katingan Katingan. Collecting data through interviews, observation, documentation and to pengabsahannya through source triangulation techniques. Meanwhile, the data analysis through three stages, namely data reduction, display data, and Conclusion.               These results indicate that the background for the circuit court in the Religious Sampit three factors. First, the distance is quite far away. Second, geographical location or terrain traveled not only by land but there are also passing through the waterway. Third, to facilitate justice seekers get justice in the legal field. The legal basis that allows the circuit court Sampit Religious Court that the Supreme Court Circular (SEMA) No. 10 Year 2010 on Guidelines for Providing Legal Aid, gave an order from the High Court of Religion and Government Contracting Palangkaraya East Kotawaringin with DIPA funds given to the implementation of circuit courts Operational costs. While the effectiveness of the implementation circuit court conducted Religious Courts Sampit runs well and is very effective for society. The procedural law is used also law applicable in ordinary proceedings (litigation regular), which differ only in their implementation outside the Religious Court Sampit, namely in the Religious Affairs Office (KUA) local.

Abstract

Islam is a religion that has a righteous character li wa kulli zamānin makānin. Islam also has a universal doctrine, meaning that applies overall for all nations, place and circumstances. Islam as a religion with a grounding Quran and sunnah in certain respects may experience a variety of interpretations and changes in interpretations according to the context of the times, especially in verses mutashabihat and focused on passages that are muamalah, not the verses which is ubudiyah. For it is necessary that activities remain perpijak ijtihad to the Quran and al-Hadith. All modern thinkers assume that if Islam wants to survive and deal with the modern developments, he must undergo a re-definition, re-construction and re-actualization. Among the modern Islamic thinkers who ask these thoughts are Fazlur Rahman Malik and M.Arkoun. Fazlur Rahman Malik asserted that the condition of Muslims will not escape from a variety of problems, difficulties and backwardness unless Muslims back and adhering to the Quran. Ignoring a past history does not only imply a denial of the existence of history itself, but also can lead people to lose self-existence and belief systems within the framework of contemporary history.

Abstract

The begraund of this research is widow marriage law in the ‘iddah period according to Palangka Raya religious adviser on religious law. The fact is the woman completed the trial court divorce then remarry without spending that ‘iddah period consistently. The objective of this research are: How is the law status widow marriage in the ‘iddah period according to religious adviser on religious law? What is law used to answer the problem of widow marriage in the ‘iddah period according to religious adviser on religious law?. This study is sociological law research or empirical which use descriptive qualitative approach. The data is collected by interviewing and documentation and validated with source triangulation technique. The data analyzed in three steps are reduction, display and conclusion drawing/classification. The result of this research conclude that: According Palangka Raya religious adviser on religious law widow marriage in the ‘iddah period is haram because it is imperfect which caused damaged to one of the conditions of marriage. The most important widow marriage legals in the waiting period are Al-Qur’an, Surah At-Thalaq paragraphs 1, 2, 4, 6, dan 7 and Surah Al-Baqarah paragraphs 228-234. There is provision of marriage law in Indonesia number 1 of 1974.
