Abstract

AbstrakMelemahnya nilai tukar rupiah telah menimbulkan kesulitan likuiditas yang besar pada perbankan diperberat oleh lemahnya kondisi internal sektor perbankan, terutama sebagai dampak lemahnya manajemen, konsentrasi kredit berlebihan, moral hazard, terbatas dan kurang transparannya informasi kondisi keuangan bank, dan belum efektifnya pengawasan yang dilakukan Bank Indonesia. hal initercermin dalam ketentuan perbankan sebagai berikut Perlindungan nasabah kurang; Pengaturan kejahatan bank ragu-ragu; Pengaturan rahasia bank overacting; Pengaturan kewajiban bank kurang tegas; Bank terlalu bebas;Pengawasan bank kurang ketat. Maka diperlukannnya Good Corporate Governance, dalam pengaturan sistim Perlindungan Hukum terhadap Nasabah Bank. Bank Indonesia telah menetapkan upaya perlindungan nasabah sebagaisalah satu pilar Arsitektur Perbankan Indonesia terdiri dari enam pilar mewujudkan visi sistem perbankan yang sehat, kuat,efisien guna menciptakan kesetabilan sistem keuangan dalam membantu mendorong pertumbuhan ekonomi nasional yang struktur perbankan yang sehat, sistem pengaturan yang efektif, sistem pengawasan yang independen dan efektif, industri perbankan yang kuat, infrastruktur yang mencukupi, dan perlindungan nasabah.Kata Kunci: Sistem Perlindungan Nasabah, Good Corporate Governance

Abstract

Intellectual Property Rights (IPRs) defines as rights about the property arising of human intellectual abilities. The skills may include the field of technology, science, art, and literature. The law must be able to protect the intellectual work so the community can develop their creativity and ultimately leads to the successful goal of protecting IPRs. The aim of this study is to explore the legal protection of IPRs for the Lectures’ research findings. This study applies normative juridical research method that focuses on positive legal norms governing the Legal Protection of IPRs for lecturers’ research findings. The results of this study are (1) a substantive requirement that requires applied patent meets requirements include brand new product, inventive, applicable through the basic provisions of article 2 to 5 of Patent Law, and (2) Based on the existence of copyrighted books, as previously reviewed that the protection system adheres to automatically protection which means in order to obtain legal protection it is not compulsory for the creator to go through the registration process as the protection is existed since the work was created, such as books copyrights.

Abstract

After the passage of the final draft of the Job Creation bill into a Law, many groups objected to this act from various points of view, both procedural and substance. The purpose of this research is to discover the violations of the principles in the preparation and ratification of the Job Creation Law. The method used for this research is normative legal research. The results of this research are the Job Creation Law violates several principles in general such as, (1) The principle of accuracy if it is related to the General Principles of Proper Government Administration, (2) The principle of participation when referring to article 1 paragraph (2) UUD 1945 and Law number 12 of 2011, (3) The principle of constitutionality related to the Omnibus Law
