Abstract

Dunia saat ini sedang menghadapi fenomena disrupsi, dimana pergerakan dunia industri bergerak sangat cepat dari tatanan lama menuju tatanan yang baru. Dalam perkembangan di bidang ekonomi pada era ini sejalan dengan perkembangan teknologi, dan salah satu perkembangan di bidang ekonomi adalah munculnya Bitcoin. Bitcoin adalah uang virtual yang menggunakan teknologi Cryptocurrency, sebagai salah satu uang virtual yang terkenal menjadi tren baru sebagai pembayaran internasional dengan semua manfaatnya. Di antara Cryptocurrency yang ada yang paling menonjol adalah Bitcoin. Di Indonesia, Bitcoin telah menarik perhatian dikarenakan beberapa kelebihan yang dimilikinya serta sudah mulai melakukan ekspansi besar dan sudah tersedia marketplace tersendiri. Dalam peredarannya di Indonesia Bitcoin menjadi polemik tersendiri di dunia maupun Indonesia. Ada beberapa negara di dunia yang melegalkan peredaran Bitcoin serta memiliki regulasi hukum dan juga ada negara yang melarang keras peredarannya. Di Indonesia sendiri belum ada kejelasan apakah Bitcoin boleh digunakan atau tidak sebagai suatu mata uang, serta sikap pemerintah yang menyatakan bahwa segala resiko penggunaan Bitcoin ditanggung oleh pemilik dan penggunaan Bitcoin di Indonesia yang justru bertentangan dengan pasal 28 UUD 1945 yang menyatakan bahwa negara harus menjamin kepastian hukum dan perlindungan hukum bagi setiap warga negaranya.

Abstract

Indonesia as a state of the law has guaranteed the constitutional rights of each of its citizens without exception as a form of protection of human rights contained in Article 1 paragraph (3) of the 1945 Constitution. Providing legal assistance to citizens who are unable as constitutional rights of every citizen and the State is obliged to protect the constitutional rights regarding obtaining guarantees, protections, and certainty of law that is fair and equal treatment before the law. Legal aid legally in Law Number 16 of 2011 is a legal service free of charge to legal aid recipients. The thing that becomes the basis for the provision of legal assistance by the State is because the State is responsible for providing legal assistance to disadvantaged citizens as a form of access to justice and equality before the law. The state has a role in terms of establishing regulations as the legal basis for implementing legal assistance for disadvantaged citizens. But in reality, in the development of legal aid, there are several problems between legal aid providers (advocates) and the State as a guarantor of the constitutional right to the realization of justice and equality before the law for every Indonesian citizen, including the poor.

Abstract

The end of this decade, transnational crime increased rapidly. Transnational crime greatly affects the defence, security, economy and social aspects of a country's society. In addition, transnational crime has caused anxiety around the world. Indonesia as a country that has a strategic geographic location and is often the target of transnational crime destinations, should make efforts to eradicate transnational crime. So far, Indonesia through NCB Interpol has made various efforts to overcome transnational crimes, such as cooperate with several other countries. This paper will discuss the role of the National Central Bureau (NCB) of Interpol Indonesia in extradition cooperation as the form of efforts to eradicate transnational crime. The purpose of this paper is to provide an overview of the systematics and roles of extradition cooperation carried out by Indonesia and the destination country. This paper uses a normative legal research method based on several governing laws and regulations. It is hoped that this paper can provide a new understanding of extradition cooperation in handling transnational crimes against readers.

Abstract

Corruption is one of Indonesia’s biggest problems. Various efforts have been made not only in enforcement of corruption cases, but also in various preventive efforts. Kebumen Regency is one of the poorest districts in Central Java with a high rate of corruption among other city districts in Central Java. Several large-scale corruption cases also involved the Kebumen district government. Various attempts have been made, but anti-corruption attitudes must be encouraged. One of them is through various educational networks. The anti-corruption character strengthening program for students is the basic provision for the nation's next generation to not only eradicate corruption collectively but also have high integrity. This program is carried out at SDN Tlogodepok, Kebumen Regency where through this program an anti-corruption character will be formed for students as an anti-corruption fortress from an early age. This program will be implemented in several methods: (1) lectures and outreach, (2) anti-corruption games, (3) anti-corruption learning assistance, (4) initiation of honesty stalls, (5) formation of anti-corruption student cadres, and (6) establishment of an integrity zone at SDN Tlogodepok

Abstract

Every year in Indonesia there are various cases of sexual violence against children whose quantity is increasing every year. Protection of children from all threats of crime that can threaten their survival is contained in the constitution of the State of Indonesia as a country that upholds law and human rights. When children experience incidents of sexual violence, their future will be threatened due to psychological, mental and social trauma factors. Therefore, in this paper, the author wants to examine how to handle cases of sexual violence in Indonesia from a legal and victimological perspective by identifying the problem, namely how is legal protection for children as victims in cases of sexual violence and how is the perspective of victimology in this case the study of victims in acts of violence. crime or crime.

Abstract

This paper aims to analyze the critical thinking abilities of law students in analyzing criminal law cases related to human rights. This paper uses a survey method where the respondents surveyed were students of the Faculty of Law, State University of Semarang who are actively involved in various student organizations. This research shows that to sharpen the critical thinking skills of law students, encouragement and stimulus are needed in the form of working papers and small groups in the analysis of criminal law cases. In addition, presenting cases in groups allows students to interact intensely and continuously.

Abstract

The world is currently facing the phenomenon of disruption, where the movement of the industrial world is moving very quickly from the old order to the new order. Developments in the economic field in this era are in line with technological developments, and one of the developments in the economic field is the emergence of Bitcoin. Bitcoin is a virtual money that uses Cryptocurrency technology, as one of the famous virtual money is becoming a new trend as an international payment with all the benefits. Among the existing Cryptocurrencies that stand out the most is Bitcoin. In Indonesia, Bitcoin has attracted attention because of its several advantages and has started to carry out major expansions and has a separate marketplace available. In circulation in Indonesia, Bitcoin has become a polemic in itself in the world and in Indonesia. There are several countries in the world that legalize Bitcoin circulation and have legal regulations and there are also countries that strictly prohibit its circulation. In Indonesia itself there is no clarity whether Bitcoin may be used or not as a currency, as well as the attitude of the government which states that all risks of using Bitcoin are borne by the owner and use of Bitcoin in Indonesia which is contrary to article 28 of the 1945 Constitution which states that the state must guarantee certainty law and legal protection for every citizen.

Abstract

Setiap tahunnya di Indonesia terdapat berbagai macam kasus kekerasan seksual pada anak yang kuantitasnya semakin meningkat setiap tahunnya. Perlindungan terhadap anak dari segala ancaman kejahatan yang dapat mengancam keberlangsungan hidupnya terkandung dalam konstitusi Negara Indonesia sebagai Negara yang menjunjung tinggi hukum dan hak asasi manusia. Ketika anak mengalami kejadian kekerasan seksual, maka masa depannya akan terancam karena adanya faktor trauma psikis, mental maupun sosial. Oleh karena itu dalam penulisan ini penulis hendak untuk mengkaji perihal bagaiaman penanganan kasus kekerasan seksual di Indonesia dalam perspektf hukum dan viktimologi dengnan identifikasi masalah yaitu bagaimanakan perlindungan hukum terhadap anak sebagai korban dalam kasus kekeras seksual dan bagaimana perspektif viktimologi dalam hal ini kajian terhadap korban dalam tindak pidana atau kejahatan.
