Abstract

The development of financial technology (fintech) has given rise to various financial service applications, including the Flip application. Flip provides a variety of technology-based financial services, such as interbank transfers, buying credit, and E-Wallet top-ups. The Flip application is widely used by the general public, including cadres of the Wahdah Islamiyah mass organization. This research examines fintech transactions from an Islamic perspective, tracing fintech contracts in the Flip application, and the views of Wahdah Islamiyah cadres regarding the use of the Flip application in fintech transactions from an Islamic economic perspective. This research uses qualitative methods with descriptive analysis and a grounded theory approach. Observation, interviews, and documentation all played a role in the data collection process. The results of this research show that: 1) in Islamic terms, fintech is something that is permitted as long as it is free from prohibited elements such as usury, gharar, maysir, tadlis, dharar, zhulm, and haram. 2) Fintech contracts in the Flip application are wakalah, wakalah bil ujrah, and bay' (buying and selling) contracts, which are basically permitted. 3) Flip users among Wahdah Islamiyah cadres view that Flip services such as interbank transfers, credit purchases, and E-Wallet top-ups are in accordance with Islamic economic principles because they are free from usury, gharar, and dharar and contain maslahah and taysir (convenience). Implications of this research: 1) The socialization of Islamic economic principles in fintech-based financial services is needed. 2) can develop research on other fintech features of the Flip application.

Abstract

Micro, Small, and Medium Enterprises (MSMEs) have a very important role in socio-economic development in Indonesia. But the problem that often occurs is its vulnerability to changes that result in losses. This is because MSMEs have limited resources. In fact, MSMEs have proven to be a safety valve for the national economy and are able to survive and become economic drivers, especially during times of economic crisis.  The results showed that the resilience of MSMEs in terms of their competitive advantage is easily replicated and replaced at any time, depending on their ability to manage and run a business. So it takes resources and capabilities to achieve core compatibility. The resilience of MSMEs in facing uncertain crisis conditions must be supported by the application of Islamic Entrepreneurship, this is because resilience is influenced by two factors, namely Internal and External. These internal factors cannot be eliminated by humans in running life, namely spirituality, faith, and optimism. Because sharia refers to the command of Allah Swt.

Abstract

Penelitian ini berfokus pada perkembangan dan evolusi kerangka hukum Keuangan Syariah di Indonesia seiring berjalannya waktu. Peraturan dan standar syariah yang mengatur industri Keuangan Syariah di Indonesia, dimana akan mengeksplorasi peran penting mereka dalam menjaga kepatuhan terhadap prinsip-prinsip Islam. Serta implementasi hukum Keuangan Syariah di Indonesia dan dampaknya terhadap pertumbuhan serta kinerja lembaga keuangan syariah, termasuk bank syariah dan lembaga keuangan mikro syariah. Keuangan Islam adalah sistem keuangan yang beroperasi berdasarkan prinsip-prinsip Syariah yakni berpegang teguh kepada Alquran dan Hadits sehingga lebih di kenal keuangan syariah. Penelitian ini bertujuan untuk melakukan analisis mendalam terhadap kerangka hukum Keuangan Syariah di Indonesia dan dampaknya terhadap ekonomi, sosial, dan lingkungan, sehingga dapat menjadi salah satu alternatif penting dalam menghadapi tantangan global dalam sistem keuangan kontemporer.  Metodelogi dalam penelitian ini Melibatkan kajian dan analisis berbagai dokumen, termasuk peraturan, undang-undang, dan kebijakan terkait keuangan syariah di Indonesia. Metode ini membantu dalam menelusuri sejarah dan perkembangan hukum keuangan syariah. Hasil dari penilitian ini Kerangka hukum Keuangan Syariah di Indonesia mengalami evolusi yang signifikan seiring waktu, didukung oleh adopsi berbagai regulasi. Pembentukan Bank Syariah, Badan Pengawas Keuangan dan Pembangunan Syariah (BPKPS), serta pengesahan Undang-Undang Perbankan Syariah pada 2008 dan Undang-Undang Keuangan Syariah pada 2011 adalah langkah-langkah strategis yang bertujuan memfasilitasi pertumbuhan industri keuangan syariah dan memastikan kepatuhan terhadap prinsip-prinsip syariah.Implementasi hukum Keuangan Syariah di Indonesia memberikan dampak positif, terlihat dari pertumbuhan nasabah, diversifikasi produk dan layanan, serta peningkatan kepercayaan masyarakat.

Abstract

This study aims to discuss how the application of the law in protecting consumers and from a religious point of view, namely Islamic law. The existence of a consumer protection law is able to regulate the production of business actors so that they do not do things that can harm consumers. It is very worrying because the position of consumers here is very weak, given the lack of consumer knowledge and awareness on each side, both business actors and consumers. This study focuses on the application of UUPK in protecting the rights of consumers, demanding compensation from business actors if consumers are harmed. The method used in this research is library research or literature review, which collects data from the literature and other sources that support and relate to the discussion in this study. The results show that the application of Law Number 8 of 1999 concerning Consumer Protection (UUPK) is in line with Islamic economics, where this law is equally prioritizing the safety and comfort of consumers. In the UUPK it is also emphasized that one of the rights of consumers in article 4 paragraph (c) is the right to correct, clear and honest information regarding the conditions and guarantees of goods and or services, this is also recommended in Islam not to be fraudulent, honest and not prejudice weighing scales or deceiving

Abstract

Sharia financial institutions are a reflection of the growing desire among individuals for sharia-compliant economic operations. This study aims to find out what factors cause low productive financing at PT. Bank Syariah Indonesia KCP Gowa, the strategy used by PT. BSI in increasing productive financing (mudharabah and musyarakah). The research approach used in this research is descriptive qualitative with data collection methods, namely using observation, interviews and documentation studies. The types of data used in this research are primary data and secondary data. The results of the research show that there have been ups and downs in the growth rate of total productive financing in the last 4 years and there are 5 (five) factors that cause the low level of productive financing (mudharabah and musyarakah), namely crisis of confidence, financing risk, profit sharing, limited to customers who already have business as well as the limited business sectors that are financed and there are several strategies in increasing productive financing (mudharabah and musyarakah) at PT. Bank Syariah Indonesia KCP Gowa, namely education, increasing the capacity of the bank's Micro Head Unit (UHM), collaborating with other partners to provide guidance to debtors, and this guidance must be carried out on an ongoing basis. This is very important for PT. Bank Syariah Indonesia KCP Gowa has the potential to generate profits which will affect the level of profit obtained by the bank.
