Abstract

Kekerasan Dalam Rumah Tangga (KDRT) adalah fenomena universal yang dapat terjadi tanpa memandang usia, profesi, tingkat ekonomi maupun pendidikan dari individu yang mengalaminya. Data Komnas Perempuan pada tahun 2018 untuk periode tahun 2017 menyebutkan Jenis kekerasan terhadap perempuan yang paling besar adalah kekerasan yang terjadi di ranah personal (KDRT). Kasus kekerasan dalam rumah tangga yang terjadi di daerah wilayah hukum Pengadilan Negeri Purwodadi pada akhir tahun 2016 dan telah diputus oleh pengadilan pada pertengahan tahun 2017. Pelaku telah divonis bersalah dan dijatuhi hukuman penjara selama 7 tahun oleh hakim, akibat perbuatannya menyebabkan matinya istri.Permasalahan yang akan diteliti adalah Kebijakan Kriminal berkaitan dengan Perempuan sebagai Korban Tindak Pidana Kekerasan Dalam Rumah Tangga dan Pertimbangan Hukum Hakim terhadap Putusan Perkara Pidana Nomor 6/Pid.Sus/2017/PN.Pwd. Metode pendekatan yuridis normatif, spesifikasi penelitian yang digunakan adalah deskriptif analitis. Metode pengumpulan data yang dilakukan adalah dengan wawancara dan studi kepustakaan.Metode analisis data dalam penelitian ini adalah metode kualitatif.Hasil penulisan ini menyimpulkan bahwa kebijakan kriminal dengan menggunakan sarana penal pada perempuan sebagai korban kekerasan dalam rumah tangga telah di atur baik dalam Instrumen Hukum Internasional maupun Instrumen Hukum Nasional yaitu dengan adanya Undang-Undang No 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga dan terkait pertimbangan hakim dalam Putusan No. 6/Pid.Sus/2017/PN.Pwd telah tepat berdasarkan fakta-fakta yuridis dalam persidangan dan sesuai dengan peraturan perundang-undangan yang berlaku.

Abstract

AbstractThesis title "Societys? Perception on the Social Ethics of the College Students Live in Dormitory at RT 03 Kelutahan Bansir Darat Kecamatan Pontianak Tenggara". The main problem in this research is how is societys? perception towards social ethics of the college students who live at dormitory. This research uses qualitative approach with descriptive method. Technique data collection used are observation techniques, interviews, and documentation study. The results showed that: (1) Societys? appraisement towards social ethics of the college students showed that students who are sociable proven fairly with greeting and smile, interaction with society has not been good yet because interaction occurs only when there is needs (2) Forms of violation have done by the college students are coming home over time which it has to be not later than 11 pm and guest of the opposite sex visiting hours which it has to be not later than 10 pm (3) The control towards college students showed that the preventive and repressive controls done by society leader and the dorm owner towards college students is quite good because the prevention through rules and repressive reprimand in the form of warning, punishment in the form of expelling and advice in the form of calling students who violated the rules have been conducted.Keywords: Perception, Social Ethics, College students live in dormitory
