<![CDATA[Penelitian ini bertujuan untuk menganalisis implementasi mediasi penal dalam penyelesaian kasus kekerasan dalam rumah tangga (KDRT) di Polrestabes Kota Makassar. Penelitian ini menggunakan pendekatan yuridis sosiologis. Hasil penelitian bahwa pendekatan mediasi penal oleh Polrestabes Kota Makassar oleh pihak penyidik dilaksanakan sesuai dengan kapasitas institusi dengan landasan Surat Edaran Kapolri No. Pol. B/3022/XII/2009/sdeops Tanggal 14 Desember 2009 tentang penanganan kasus melalui Alternatif Dispute Resolution (ADR). Pertimbangan-pertimbangan Penyidik Polrestabes Kota Makassar dalam proses penyelesaian Kasus Kekerasan Dalam Rumah Tangga melalui pendekatan mediasi penal dititik beratkan bukan pada penegakan hukumnya akan tetapi pada nilai-nilai kemanfataan dan keadilan sebagai dasar kebutuhan atau kepentingan para pihak untuk mendapatkan solusi,serta penghindaran dari proses peradilan pidana yang panjang. This study aims to analyze the implementation of penal mediation in the resolution of cases of domestic violence (KDRT) in Makassar City Polrestabes. This research uses a sociological juridical approach. The results of the study that the approach to mediation by the Makassar City Police by the investigators carried out in accordance with institutional capacity on the basis of the Circular Letter No. Pol. B / 3022 / XII / 2009 / sdeops December 14, 2009 concerning the handling of cases through Alternative Dispute Resolution (ADR). The considerations of Makassar City Polrestabes Investigators in the process of resolving cases of domestic violence through the mediation of the penal approach are emphasized not on law enforcement but on the values ??of justice and justice as the basis of the needs or interests of the parties to obtain solutions, and avoidance of the judicial process long criminal.]]>
