Abstract

A home is a place where every member gets protection. However, a home sometimes can be a source of suffering due to the acts of domestic violence. The enactment of Law No. 23 of 2004 on Abolition of Domestic V54+-iolence does not automatically lead to the rate decrease of domestic violence because many victims have no courage to bring the case as a legal matter. Actually the Act on Abolition of Domestic Violence provides severe penalties for the perpetrators, but in practice the imposed penalties for the perpetrators are often more lenient than the penalty suggested by the Act. This research is qualitative. The secondary data were taken from legal court verdicts. To complete the data, interviews were conducted to the judges making the verdicts in order to understand the considerations in deciding the penalities about domestic violence cases. The conclusion of this study is the fact that penalties imposed by the judges tend to be lower than the prosecutor’s demand. Besides, the trial process is more dominated by physical violence acts than the other three violences. In making their decision, the judges merely base on the Act on Elimination of Domestic Violence. For the cases involving children as the victims the judges also base their decisions on the Act on Child Protection. Seeing that the view from women’s interest appears to be a mainstream, the judges have to be extra careful in handling domestic violence cases in order to impose appropriate criminal penalties, that meet the principles of justice, expediency and legal certainty

Abstract

Peradilan restoratif merupakan alternatif penyelesaian perkara bagi anak yang berhadapan dengan hukum pidana. Cara penyelesaian perkara melalui proses peradilan umum dianggap sangat menghabiskan energi, biaya dan dianggap mengabaikan kepentingan korban, masyarakat dan kepentingan pelaku tindak pidana dan cenderung menimbulkan trauma pada korban dan pelaku. Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak telah mengatur mengenai Restoratif Justice. Namun undang-undang ini baru akan berlaku 2 (dua) tahun sejak diundangkannya (tahun 2012). Sementara dalam praktek ternyata praktek peradilan restoratif telah dijalankan dengan berbagai variasinya. Tulisan ini membahas tentang model-model penyelesaian perkara anak yang berhadapan dengan hukum, yang memakai pendekatan restoratif justice. Tulisan ini merupakan bagian pertama dari dua tulisan yang merupakan publikasi dari penelitian yang dilaksanakan, yakni tentang Model Peradilan Restoratif pada Penyelesaian Perkara Anak yang Berhadapan dengan Hukum Pidana, yang dilakukan di Kota Semarang, Surakarta dan Yogyakarta.

Abstract

Masyarakat membedakan perlakuan terhadap anak sah dan anak luar kawin. Demikian pula hukum membedakan anak menjadi anak sah dan anak luar kawin. Akibatnya status, kedudukan, serta hak anak luar kawin berbeda dengan anak-anak yang lahir dari perkawinan yang sah. Anak sah memiliki status keperdataan, kedudukan serta hak waris secara penuh. Namun tidak demikian halnya dengan anak luar kawin. Undang-Undang Perkawinan mengatur tentang anak luar kawin, namun tidak secara tuntas. Di sisi lain, hukum Adat Indonesia dengan keanekaragaman sistem kemasyarakatannya telah menempatkan anak luar kawin pada posisi yang cukup baik. Tulisan ini mendasarkan pada kajian kepustakaan, untuk meninjau bagaimanakah Hukum Adat memberikan penghormatan terhadap status anak luar kawin, khususnya sebagai sumber dalam pembentukan hukum positif untuk melindungi anak luar kawin.

Abstract

Anak adalah generasi penerus cita-cita bangsa. Di tangan merekalah kehidupan bangsa dan Negara kita titipkan. Namun dalam fakta sehari-hari, kehidupan seorang anak tidaklah selalu mudah, karena masyarakat bahkan hukum mendiskriminasikan anak berdasarkan ukuran yang dibuat oleh masyarakat maupun oleh hukum. Anak dibedakan menjadi anak sah dan anak luar kawin. Berdasarkan pembedaan tersebut, anak diperlakuan secara berbeda oleh masyarakat dan hukum. Tulisan  ini bermaksud untuk menguraikan bahwa status hubungan hukum yang telah menyebabkan seorang anak dilahirkan ke dunia mestinya bukanlah satu-satunya ukuran untuk memberikan hak keperdataan bagi seorang anak. Metode yang digunakan adalah metode kualitatif, dengan menganalisis persoalan perlindungan anak luar kawin mendasarkan pada paradigma Pancasila. Berdasarkan analisa ditemukan bahwa setiap anak berhak atas perlindungan hukum yang layak untuk mendapatkan pemeliharaan dan pendidikan, berhak untuk tumbuh kembang sebagaimana mestinya, serta mendapatkan hak-hak lain yang perlu untuk mendukung perkembangan jiwa raganya. Kata kunci: Anak Luar Kawin, Hak Keperdataan Anak, Paradigma Pancasila.

Abstract

 Kesepakatan antara para pihak merupakan ruhnya perjanjian. Namun dalam praktik, kesepakatan perjanjian tidak selalu diberikan secara bebas. Cukup banyak perjanjian yang memiliki cacat kehendak karena dibuat atas dasar keterpaksaan, ancaman, atau ketidaktahuan para pihak. Kecacatan pada kesepakatan bisa terjadi karena adanya dwang, dwaling, bedrog maupun karena terjadi penyalahgunaan keadaan. Perjanjian yang di dalamnya terkandung unsur penyalahgunaan keadaan berpotensi untuk digugat di pengadilan ketika salah satu pihak menyadari bahwa kesepakatan yang diberikan pada saat penandatanganan perjanjian bercacat. Metode penelitian yang digunakan dalam kajian ini adalah yuridis normatif, dengan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Berdasarkan kajian yang dilakukan, ditemukan bahwa dalam perkara gugatan penyalahgunaan keadaan, tidak selalu gugatan dimenangkan oleh pihak yang mendalilkan telah mengalami penyalahgunaan keadaan. Namun cukup banyak gugatan berdasarkan penyalahgunaan keadaan yang dimenangkan oleh pihak penggugat. Ini dapat diartikan bahwa dalil penyalahgunaan keadaan menjadi salah satu bentuk perlindungan hukum bagi pihak yang dirugikan karena masuk dalam sebuah perjanjian yang tidak berimbang. Kata kunci: perjanjian, cacat kehendak, penyalahgunaan keadaan.

Abstract

Children are heir of a nation’s future. Therefore, they ought to be comprehensively prepared both physically and psychologically in order to reach desired adulthood. Parents, trustee, and teachers together play important roles in this regard. To reach impeccable adulthood, fulfilling certain education extenthas been serving obligatory purpose since long time ago. Generally, one child’s education and well-being have been parent’s responsibility. However, stateguarantees every child access to proper education fulfillment, as it is written on UUD 1945 article 28 C, which ensures citizen development via basic physical needs fulfillment, including getting education and benefit from science, art, and cultural advantages in order to improve quality life. Yet in the middle of the process, sometimes they face obstacles in form of physical and psychological harassment. It can be, they find it delivered through playing groups, teaching teams, or surrounding adults. The complication has to be ignorance to education in general and school reluctant specifically. If the effect carries over they would eventually loss the opportunity of getting education rights served right.This paper aims to study access to education in general, harassment in school environment, and children-friendly school as an effort to fulfill education rights.According to the study the author concludes that education rights serve as one of human rights. Consequently, government guarantee its access to ensure education rights served right, including carrying out feasible actions and countermeasure to prevent and resolve problems in the society. The author would like to suggest children-friendly schooling in every city or regency in Indonesia.Key words: children rights, education rights, children-friendly school

Abstract

The specification of children into "legitimate children" and "illegitimate children" is well-known legally and socially. Illegitimate children suffer discrimination because of their status. In law, they only have their mothers and mother's family. Although there has been a Constitutional Court Decision No. 046 / PUU-VIII / 2010, but it does not automatically raise the dignity of illegitimate children. On the other hand Law No. 24 of 2014 has made the children who were not born from a marriage by religion lose their rights to be recognized. This paper was aimed to find the constitutional basis for the civil rights of illegitimate children as the basis to provide the civil rights for illegitimate children so that their civil rights are protected.The method used in this paper was normative.Based on the review, there is a constitutional basis to provide the protection to the civil rights of illegitimate children.

Abstract

The adoption or adopting transfer of rights to child from authority of parents, legal guardians, or other people who responsible for nurturing, educating, and raise the child to his foster parents family based on law or sentence. Adoption might be conducted to Indonesian children by parents of Indonesian or even in some special cases, adoption can be conducted by foreign nationals. The adoption of Indonesian children by foreign nationals is restricted. This is due to the protection of foster-children who adopted by foreign nationals, so that they do not experience unwanted things considering that the child will be taken abroad by the foster parents. Incidents such as children who, after being taken by their foster parents, experience violence or become victims of human trafficking are things that must be considered before deciding to allow the adoption of Indonesian children by foreign nationals.

Abstract

Communities and laws have long discriminated against children outside of marriage. This causes out of wedlock children to get a negative stigma in their daily lives. People call it with various terms such as: “anak haram”, “haram jadah”, “anak kowar”, “anak astral” and so on. Until now Indonesian law distinguishes the status, position and rights of children out of wedlock. An urgent issue to be resolved is disharmony in written legal norms that regulate the protection of children outside of marriage. The research objective is to evaluate and harmonize the legal norms that exist in the field of protection of civil rights of non-married children. Harmonization of these legal norms is based on the practice of legal protection, doctrine, and written norms that are directly related to the protection of extramarital children in Indonesia. This research is a complement to the dissertation. In this research, an inventory of positive legal norms in the field of status and position of out-of-child children, legal practices relating to the protection of children outside of marriage and the relevant legal theory to see the possibility of protection of children's rights. In this research, mapping of norms and institutions will be conducted to find out the parts that are conflicting / incompatible with each other, as a basis for formulating harmonization of laws and regulations in the field of status and position of children outside of marriage. From this harmonization, it is expected that norms that need to be revised will be found and formulas for norms that provide protection for civil rights for married children in Indonesia. Outputs are in the form of: draft dissertations that have been approved by promoters, reputable international scientific publications, accredited national publications, speakers of national and international meetings, and additional outputs in the form of draft reference books.
