Abstract

This paper aims to discuss the revitalization of the logical reasoning’s epistemology of Islamic Jurisprudence using the sociology of knowledge' approach as the reconstructive effort to see the relation of the religious text and political context of Indonesian social reality. Based on the historical analysis of the diachronic data, comparing the various political phenomena in the past Islamic history to the nowadays situation, the study revealed that the logical reasoning of Islamic jurisprudence was always related dialectically with the human social life as a fact that Islamic studies have been able to change the paradigm and mindset of the civilization.

Abstract

The intellectual debate of this age in the field of Islamic studies is the discovery of the relationship of religion and the nation-state. Religion in the old age is understood by fiqh (Islamic jurisprudence), then the theory of religion on the concept of politics was called the doctrine of fiqh’s politics. The present age shows that the religious man does not speak only about the position of religion in political discourse, but also about the concept of the humanity of the state. I want to apply my study on Islam and humanity of state in the Indonesian context because there are multitudes of nationalities and cultures. This research uses an integrative approach that combines the phenomenological approach with the sociological approach. This research aims to analyze the relation between the religion of Islam and the activity of human thought on the concept of the human state by transforming the concept of the fiqh of politics to the fiqh of citizenship. This research proves that the conceptual transformation from fiqh of politics towards fiqh of citizenship, with all its consequences, must be seen as a process of political agreement and it can be accepted as long as it always pays attention to social justice and general welfare.

Abstract

الملخص:فإن الشريعة الغراء قد أولت موضوع الأسرة عناية فائقة وظهر ذلك في الأحكام المنظمة لإنشائها وتكوينها واستمراريتها، قد اعتنت جميع الدول بقانون الأحوال الشخصية المنظم لهذه العلاقة. وشرع الطلاق باعتباره أبغض الحلال إلا في حالة الضرورة وعند العجز على المصالحة بين الزوجين لتباين الأخلاق وتنافر الطباع, كما أن الطلاق أيضا يمكن أن يكون وسيلة لتأديب الزوجة وهو آخر وسيلة يلجأ إليها الزوج بعد استكمال كل الوسائل الممكنة لحل النزاع بين الزوجين. لقد تحدث الباب الرابع من قانون الأحوال الشخصية الأردني عن انحلال عقد الزواج, وذكر الفصل الأول منه موضوع الطلاق. فهذا البحث يتحدث عن الطلاق من المادة (80) إلى المادة (90) في هذا القانون وهو قانون الأحوال الشخصية الأردني رقم 36 لسنة 2010. فيتطرق هذا البحث على دراسة تحليلية في عملية تطبيقبة معاصرة عن الطلاق في ضوء الفقه الإسلامي وقانون الأحوال الشخصية الأردني. Abstrak: Keluarga dalam syariat Islam merupakan salah satu objek kajian yang penting. Hal itu terbukti dalam berbagai macam hukum yang mengatur tentang keluarga mulai dari pembentukan, pertumbuhan hingga kelanggengannya. Semua negara pun memiliki perhatian yang sama dalam hal ini. Adapun mengenai masalah Talak, meskipun ia merupakan perkara yang sebaiknya dihindari, namun dalam keadaan tertentu ia dapat dijadikan sebagai solusi alternatif. Misalnya ketika kedua pasangan (suami-istri) tidak lagi bisa saling memberi manfaat, atau mungkin juga sebagai bentuk pelajaran kepada sang istri agar berubah menjadi lebih baik. Talak di sini merupakan solusi terakhir yang dapat dijatuhkan oleh sang suami kepada istrinya. Ini berarti bahwa Talak adalah keputusan final setelah mereka benar-benar mencoba berbagai macam cara untuk menyelesaikan konflik rumah tangga, namun masih tetap tidak berhasil juga. Talak sendiri dalam Undang-Undang Ahwal Al-Syakhsiyyah Yordania dibahas secara khusus dalam Bagian Pertama pada Bab Empat mengenai Putusnya Akad Perkawinan mulai dari pasal 80 hingga pasal 90. Undang-Undang yang dimaksud di sini adalah Undang-Undang Ahwal Syakhsiyyah Yordania Nomor 36 tahun 2010. Dengan demikian, kajian ini bertujuan untuk meneliti berbagai hal mengenai Talak dalam perspektif Hukum Islam dan penerapannya dalam Undang-Undang Ahwal Al-Syakhsiyyah Yordania.

Abstract

Islamic legal theory (popularly known as uṣū al-fiqh in Islamic term) runs into difficulties when dealing with social and humanities issues. Religious texts, according to Hassan Hanafi’s perspective, should not only be positioned as a source of law, but also at the same time must be seen as a phenomenological experiences of religiosity. The dialectic of religious text and today's empirical context needs to be reformulated. By using phenomenological as a methodological tool, Hassan Hanafi makes an effort of reepistemification of uṣū al-fiqh reason into three typologies of consciousness; historical, eidetic, and praxis. These three aspects constitute the discursive relationship to present an anthropocentric dimension in uṣū al-fiqh reason. This article uses qualitative research methods with interpretation criticism approach. This article aims to analyze the new formula offered by Hassan Hanafi’s uṣū al-fiqh reason, and to examine it to criticize the slogan “Back to the Qur'an and Sunna” as a phenomenon of religiosity. Abstract

This paper aims to track the construction of maqāṣid al-sharī‘ah reasoning and reading patterns of maqāṣid al-sharī‘ah according to Ibn Taymīyah perspective. The study of the philosophy of Islamic Law in the perspective of Ibn Taymīyah in Islamic thought is still not much discussed, even not yet formulated with a comprehensive framework of construction of reason. Maqāṣid al-sharī‘ah in Ibn Taymīyah’s perspective has a reciprocal reading pattern in quadric jalb al-maṣlaḥah and daf‘ al-mafsadah at one time simultaneously. These quadrics here are relational dialectics between min jānib al-wujūd and min jānib al-‘adam. Ibn Taymīyah as one of the most knowledgeable scholars of science has a unique reading pattern on how the legal texts (ayāt al-aḥkām) and their intentions (al-maqāṣid) are dialecticalized.

Abstract

This article lies on the basic assumption of the heavy influence of power relation in interpreting religious texts. That is because the meaning of religious texts is often determined by the framework of interpretation and the model used by the exegetes. The discursive relations between the exegete and his tendency of political interest in the dialectical discourse of texts (al-na?? ) and power (al-sul?ah), are likely potential to produce a rhythm of meaning that is non-humanitarian (al-lâ insânîyah). As a result, religious texts that should be interpreted in egalitarian sense are of marginalized. This study attempts to trace the basic paradigm of the interpretation of the khilâfah as an aqidah to the power as political ideology until the emergence of the movement of takfîrî. These three terms are a series of interpretive concepts in the framework of naz}arîyat al-tafwîd} al-ilâhî which are translated into the theory of divine authority. At this point, the enigma of politicizing religious texts comes into two models of interpretation: authoritarian and egalitarian.

Abstract

Studi keagamaan merupakan diskursus pengetahuan yang berkaitan dengan cara manusia membaca dan mengkaji ajaran agama atau laku keagamaan manusia beragama. Agama tentu tidak melulu tentang ritual peribadatan semata, melainkan juga tentang peradaban manusia. Keberadaan manusia yang terikat dalam ruang dan waktu mengindikasikan bahwa pengalaman dan pengetahuan manusia itu berbatas. Kesadaraan keagamaan dalam diri dan/atau masyarakat beragama meniscayakan perbedaan pemikiran dan tingkah laku dalam frame intelektual dan interaksi sosialnya. Maka problem filsafati yang muncul adalah dapatkah manusia, berdasarkan pengalamannya, benar-benar mampu memahami pengalaman manusia beragama lain yang sepenuhnya berbeda? Serta bagaimana agar kajian keagamaan tetap menjaga objektivitas dari subjektivitas pengkajinya? Berdasaran standpoint ini, perspektif Insider/Outsider memainkan peran penting, namun dalam konteks kehidupan beragama yang heterogen, plural dan multikultural tidak berhenti pada pola baca kuadrik dimensional sehingga membutuhkan pendekatan yang jauh lebih komprhensif. Pada titik ini, multidimensional approaches sebagai pola baca studi keagamaan yang ideal memiliki pijakan paradigmatiknya di mana ia berupaya untuk mengentitaskan agama yang sakral agar dapat dipahami oleh manusia secara netral. Abstract

THE INDICATION OF TEXTS' SIGNAL AND ITS IMPACT ON THE UNDERSTANDING OF SHARI'A AND POSITIVE LAWS AbstractThis paper aims to discuss one of the meanings of the words, namely the Indication of the Text Evidence in terms of its concept and how it is used in the process of deriving judgments from the texts of Islamic jurisprudence and the texts of the positive laws. This paper deals with an analytical study through the indication of the text evidence from the Holy Qur'an and the Sunnah, and the Jordanian Laws, in particular, the Jordanian Civil Code, the Jordanian Evidence Law and the Jordanian Personal Status Law. It decides the importance of this research, which is one of the terms of the Islamic legal theory including the benefits of its rules and an important task that is indispensable to the scholar instead of denying it, whether he is a man of the Islamic jurisprudence or a man of positive law. Keywords: The Indication of the Text’s Signal, Sharia, Positive Laws.

Abstract

Islam is not mean just a religion but a civilization. The expectation for Islamic inaugural re-experience on the contemporary era is a major occupation for today's thinkers. The efforts of reconstruction of the religiousness understanding is the main idea which cannot be avoided because the event of Islamic Studies contest strives to inculcate sensitivity towards the diversity of the meaning of religious text. So, the attempts to present a new reading of the classical Islamic corpus is a necessary activity. It is intended that human values which have precipitated can be raised and be realized. If on the initial period of Islam, the Prophet PBUH and the Companions called out to create a single society, it is now the opposite; plural and multicultural. Therefore, there should be a progressive creations to transform a religiousness worship valuesas a set of humanity social values.

Based on the pattern of relational dialectics, the relationship between Religion, Humanism and the Orientation of Nation should be understood as a single entity wich mutually reinforcing in achieving the ideal life of civil society. Indonesia as a country that recognizes the diversity of religion, language, ethnicity and culture has positioned the Pancasila as ideology of the state can not be contested legitimacy. NU as an social religious organization be aware of the Indonesian nation must be guarded sovereignty also dignity. Islam Nusantara as a religious idea of nationality strives to instill religion awareness in the state and nation. Its one important task is to unravel the roots of the conflict through awareness of ethics; ranging from Tyranny of the Majority issue to Human Rights issues in the application of the death penalty in Indonesian context. Therefore, this article head to examine the transformative process of religious values into a form of consciousness nationality oriented towards the sovereign and the dignity state.
