Abstract

The Multicultural value has Known and to be part of social life in Nusantara. It has included in Kutaramanawa as Constitution of the Majapahit Kingdom who has made at 1350 Th. The purpose of this research is to implement the multicultural education value of Majapahit Constitution-based Internet of Things (IoT), especially for the student in elementary school. Application Multicultural education value for elementary school students has very important for strengthening tolerance and push peace in the long term. The type of this research is qualitative research. Monitor the technique of data validity using a triangulation technique. Data analysis technique will be used perspective analysis model and interactive. The results of this research show that the Majapahit constitution is some regulation about multicultural values that have enumerated in their social activity life. The multicultural will be a good real example for students, especially if learning methods use the Internet of Things (IoT) through Augmented Reality and Virtual Reality media in order more effective, attractive, and interactive for known of students.

Abstract

Tulisan ini bertujuan untuk mendeskripsi, memahami dan menganilisis omnibus law sebagai reformasi hukum investasi di Indonesia berdasarkan asas hirarki peraturan perundang-undangan. Adapun dalam penulisan artikel ini  menggunakan penelitian hukum normatif. Selain itu penulisan artikel ini menggunakan pendekatan teoritis dan yuridis. Hasil penelitian ini menunjukan bahwa dalam pembentukan omnibus law sebagai aturan yang mempermudah investasi Indonesia akan berlaku asas hirarki peraturan perundang-undngan. Kemudian ada beberapa urgensi pembentukan omnibus law dalam aspek investasi. Salah satunya teori negara kesejahteraan yang berlaku bagi Indonesia menjadi peran untuk meningkat perekonomian di bidang investasi melalui omnibus law dalam rangka mewujudkan amanat konstitusi indonesia yaitu memajukan kesejahteraan umum dan sebesar-besarnya sebagai kemakmuran rakyat Indonesia. (This paper aims to describe, understand and analyze omnibus law as a reform of investment law in Indonesia based on the hierarchical principle of laws and regulations. The writing of this article uses normative legal research.  In addition, the writing of this article uses a theoretical and juridical approach. The results of this study indicate that in the formation of the omnibus law as a rule that facilitates Indonesian investment will apply the principle of a legislative hierarchy. Then there is the urgency of establishing an omnibus law in the investment aspect. One of them is the theory of the welfare state that applies to Indonesia as a role to increase the economy in the field of investment through the omnibus law in order to realize the mandate of the Indonesian constitution, namely to promote public welfare as much as possible as the prosperity of the people of Indonesia)

Abstract

Abstract :The Covid-19 pandemic has slowed the pace of economic growth in Indonesia. As a result, several business sectors in the community experienced a decline, so the state issued a legal policy to take steps to resolve it. Legal politics as a form of government policy in an effort to restore the national economy is a necessity. This article uses a type of normative juridical research method, with a statutory and conceptual approach, legal materials (primary, secondary, tertiary) are analyzed using the content analysis method. This article shows and emphasizes the urgency of the government's legal politics in efforts to recover the national economy due to the Covid-19 pandemic. In the process of its formation, it certainly requires a comprehensive, integrated and targeted policy set. The 1945 Constitution Article 22 paragraphs (1-3) provides space for the government to stipulate Perpu No. 1 of 2020 becomes Law No. 2 of 2020 as a legal umbrella in an effort to maintain the resilience of all elements of the nation from all threats that endanger the safety of the people of the nation and state. The role of the government's legal policy in national economic recovery has a central position in anticipating a fragile "system" and management. The national economic recovery policy cannot be separated from the legal politics policy itself, of course by taking into account the principles of prudence, good faith and full integrity and remains based on the principles of good governance, accountability, and transparency.Keyword: Legal Politics, Economic Recovery, Covid-19, Economic Constitution.Abstrak :Pandemi Covid-19 memperlambat laju pertumbuhan ekonomi di Indonesia. Akibatnya beberapa sektor usaha bisnis di masyarakat mengalami penurunan, sehingga negara mengeluarkan kebijakan hukum untuk mengambil langkah penyelesaian. Politik hukum sebagai bentuk kebijakan pemerintah dalam upaya pemulihan ekonomi nasional menjadi keniscayaan. Artikel ini menggunakan jenis metode penelitian yuridis normatif, dengan pendekatan perundang-undangan dan konseptual, bahan hukum (primer, sekunder, tersier) dianalisis menggunakan metode content analysis. Artikel ini menunjukan dan menekankan urgensi politik hukum pemerintah dalam upaya pemulihan ekonomi nasional akibat pandemi Covid-19. Dalam proses pembentukannya tentu membutuhkan perangkat kebijakan yang komprehensif, terintegrasi dan tepat sasaran. Konstitusi UUD 1945 Pasal 22 ayat (1-3) memberikan ruang bagi pemerintah menetapkan Perpu No. 1 Tahun 2020 menjadi UU No. 2 Tahun 2020 sebagai payung hukum dalam upaya dan menjaga ketahanan seluruh elemen bangsa dari segala ancaman yang membahayakan keselamatan masyarakat bangsa dan negara. Peran kebijakan hukum pemerintah dalam pemulihan ekonomi nasional, memiliki kedudukan sentral guna mengantisipasi “sistem” dan manajeman yang rapuh. Abstract

The New Normal era during the covid-19 pandemic resulted in industry 4.0 business players having difficulty in dealing with dispute resolution due to financial problems and policy restrictions. The reformation of online dispute resolution media is needed due to the difficulty of mobility and the high cost cutting. Before the implementation, it is necessary to have concrete formula of an online dispute resolution concept because the legal basis in Indonesia is not yet qualified. This study aims to conceptualize the legal basis for online dispute resolution in the business world, which is currently not accommodated by the Indonesian laws. It also examines the development of an online dispute resolution model as a technical regulation applied to the industrial sector 4.0. This study uses legal normative research. The study approach uses an online dispute resolution conceptual system and alternative dispute resolution legislation. The results show that online dispute resolution is a new form of quick, inexpensive justice principle that can reform business law in the technology era. Several dispute resolution models can be developed online and used for implementing regulations, especially for dispute resolution media in the industrial sector 4.0.Era New Normal di masa pandemi covid-19 mengakibatkan para pelaku usaha industri 4.0 mengalami kesulitan dalam menangani penyelesaian sengketa karena masalah keuangan dan pembatasan kebijakan. Reformasi media penyelesaian sengketa secara online perlu dilakukan untuk mengatasi kendala sulitnya mobilitas dan pemotongan biaya tinggi. Sebelum dilaksanakan, terlebih dahulu perlu ada rumusan konkrit konsep penyelesaian sengketa secara online karena landasan hukum di Indonesia belum memenuhi syarat. Tujuan dari penelitian ini adalah untuk mengkonseptualisasikan dasar hukum penyelesaian sengketa online di dunia bisnis yang saat ini tidak diakomodir oleh undang-undang Indonesia. Selain itu juga mengkaji pengembangan model penyelesaian sengketa online sebagai regulasi teknis yang dapat diterapkan pada sektor industri 4.0. Studi ini menggunakan penelitian hukum normatif. Pendekatan yang digunakan ialah sistem konseptual penyelesaian sengeketa online dan perundang-undangan alternatif penyelesaian sengketa. Hasil studi menunjukkan bahwa penyelesaian sengketa online adalah bentuk baru dari asas keadilan yang cepat dan murah yang bisa mereformasi hukum bisnis di era teknologi. Beberapa model penyelesaian sengketa dapat dikembangkan secara online dan dapat digunakan sebagai dasar implementasi aturan, khususnya untuk media penyelesaian sengketa di sektor industri 4.0.
