Abstract

Corruption has become massive societal phenomenon that has been regarded as extraordinary crimes threatening Indonesian economy and impeding national development. All societal elements expect that it will not be unresolved problems. Until recently, criminal law policy in its attempt to eradicate corruption has more put emphasis on the perpetrator. Such policy on witness protection, in the criminal case of corruption, needs to be optimized because it can be an alternative legal instrument in the attempt to eradicate corruption. Law-enforcement authorities face difficulties in unfolding a corruption case because it is often well systematically planned. In many cases, witnesses are reluctant to report a corruption case because of threat, intimidation, and criminalization posed to them. Problems are (1) How is the regulation of witness protection act and the corruption eradication in Indonesia? (2) How is the urgency of witness protection in the criminal cases of corruption eradication? (3) How is criminal law policy on witness protection to facilitate the corruption eradication in Indonesia? This research employs normative juridical approach with the descriptive research type. Findings show that(1) the development of witness protection act in the corruption case is highly relate to the witness stand on the criminal justice system; (2) the urgency of witness protection in the corruption eradication process is highly related to the common occurrence of intimidation and threat toward the witnesses. It indicate that the witness and victim protection is an important and urgent legal aspect; (3) criminal law policy in the corruption eradication process put more emphasis on the perpetrators and less concern on the witnesses involved in legal investigation. It is necessary to optimize the role of LPSK in criminal law policy including in giving the protection to witness in the case of corruption eradication; therefore, it is important to conduct legal update on the witness protection act in the case of corruption eradication process.

Abstract

Indonesia should optimize the criminal law policy about witness protection especially in eradication of corruption as criminal cases. Giving witness of corruption cases a maximum protection could be an alternative instrument in corruption eradication in Indonesia. It because the witness testimony is an important evidence to unveil the clarity of the case and to prove the criminal act that was done by subject. While the officers (of law enforcement) hard to reveal the well planned criminal act. Witnesses mostly are unwilling to denounce a criminal corruption act because of threats, intimidation, and criminalization that they receive from the subjects and their companions. It will be a good chance to protect the witnesses, as Whistleblower or Justice collaborator, as an effort to disclose the criminal corruption case in Indonesia while giving maximum protection only for subjects like what occur till today. Optimalisasi kebijakan hukum pidana tentang perlindungan saksi di Indonesia khusus dalam hal pemberantasan tindak pidana korupsi adalah sebuah gagasan yang harus segera diwujudkan, karena memaksimalkan perlindungan saksi pelapor tindak pidana korupsi dapat dijadikan sebagai instrument alternatif dalam upaya pemberantasan korupsi di Indonesia. Mengingat pentingnya keterangan saksi sebagai salah satu alat bukti dalam upaya mencari dan menemukan kejelasan tentang tindak pidana yang dilakukan oleh pelaku tindak pidana, sementara itu penegak hukum kesulitan untuk mengungkap sebuah kasus korupsi yang biasanya sangat terencana secara sistemik. Biasanya saksi dan/atau pelapor enggan untuk melaporkan sebuah kasus korupsi, karena adanya ancaman, intimidasi dan kriminalisasi terhadap terhadap dirinya dari pihak-pihak tertentu. Ada peluang dengan mengoptimalkan perlindungan saksi baik itu sebagai pelapor (Whistleblower) maupun saksi pelaku yang berkerjasama (Justice collaborator), akan dapat pula mengoptimalkan pengungkapan kasus tindak pidana korupsi di Indonesia yang selama ini kebijakan hukum pidana dalam pemberantasan tindak pidana korupsi lebih mengarah terhadap pelaku semata.

Abstract

ABSTRACT Indonesia's forests are a priceless national treasure. As the 34th province in Indonesia, North Kalimantan (Kaltara) has abundant natural resource potential (SDA). In Kaltara there are forest resources located in 2 districts, namely Malinau Regency and Nunukan Regency. This forest is also known as the “Heart of Borneo”. Illegal logging is a form of deviation from the proper use of the forest. The regulatory conditions and criminal law bases of prevention and eradication of illegal logging are not comprehensive enough and can answer the problem. The main problem in this research is First, how is the problem of handling illegal logging in the border area of North Kalimantan, Second, what is the community-based prevention model for action. Illegal Logging in the border area of North Kalimantan.To answer the problem formulation of this research, the research method used is juridical empirical legal research which in other words is a type of normative legal research and can also be called constitutional research.This research will be carried out in North Kalimantan, several problems in handling Illegal Logging Crime in the border area of Indonesia, including organized crime so it is difficult to disclose it, involvement of intellectual actors and including law enforcers, weak public knowledge. Then what is the prevention of community-based Illegal Logging Crime, namely utilizing community participation in order to prevent the occurrence of Illegal Logging Crime in North Kalimantan. Keywords: Prevention, Illegal Logging, Society. ABSTRAK Hutan Indonesia merupakan kekayaan nasional yang tak ternilai harganya. Sebagai provinsi ke-34 di Indonesia, Kalimantan Utara (Kaltara) memiliki potensi sumber daya alam (SDA) yang sangat melimpah.  Di Kaltara terdapat sumber daya hutan yang terletak di 2 Kabupaten yaitu Kabupaten Malinau dan Kabupaten Nunukan. Hutan ini juga dikenal dengan julukan sebagai “Heart of Borneo“. Pembalakan liar adalah bentuk penyimpangan dari pemanfaatan hutan yang seharusnya. Kondisi pengaturan dan dasar hukum pidana dari pencegahan dan pemberantasan pembalakan liar belum cukup komperehensif dan dapat menjawab persoalan.Yang menjadi pokok permasalahan dalam penelitian ini adalah Pertama, Bagaimanakah problematika penanganan  Illegal Logging di daerah perbatasan Kalimantan utara, Kedua, Bagaimanakah model pencegahan berbasis masyarakat terhadap Tindak Pidana Illegal Logging di daerah perbatasan Kalimantan Utara.Untuk menjawab rumusan permasalahan dari penelitian ini, metode penelitian yang digunakan adalah penelitian hukum yuridis  empiris yang dengan kata lain adalah jenis penelitian hukum normatif dan dapat disebut pula dengan penelitian Undang-Undang,Penelitian ini akan dilaksanakan di Kalimantan Utara, beberapa problematik penanganan Tindak Pidana Illegal Logging di wilayah perbatasan Indonesia diantaranya termasuk kejahatan terorganisir sehingga sulit pengungkapannya, terlibatnya pelaku intelektual dan termasuk penegak hukum, lemahnya pengetahuan masyarakat. Kemudian apa itu pencegahan Tindak Pidana Illegal Logging berbasis masyarakat yaitu memanfaatkan peran serta masyarakat dalam rangka mencegah terjadinya Tindak Pidana Illegal Logging di Kalimantan Utara. Kata Kunci : Pencegahan, Illegal Logging, Masyarakat.

Abstract

ABSTRAK Berdasarkan data Kementerian Ketenagakerjaan Republik Indonesia (Kemnaker RI) per 1 Mei 2020, jumlah pekerja sektor formal yang telah dirumahkan akibat pandemi Covid-19 sebanyak 1.032.960 orang dan pekerja sektor formal yang di-PHK sebanyak 375.165 orang. Sedangkan pekerja sektor informal yang terdampak Covid-19 sebanyak 314.833 orang. Total pekerja sektor formal dan informal yang terdampak Covid-19 sebanyak 1.722.958 orang. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana perlindungan hukum bagi buruh yang di PHK akibat pandemic COVID-19 serta upaya hukum yang dapat dilakukan oleh tenaga kerja terhadap perusahaan yang merugikannya. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan konsep dan pendekatan undang-undang. Kesimpulan dalam penelitian ini adalah pengusaha wajib memberikan uang pesangon bagi tenaga kerja yang di PHK sesuai dengan Pasal 156 UndangUndang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan sebagai bentuk perlindungan hukum. Upaya hukum yang dapat dilakukan tenaga kerja yang merasa dirugikan akibat dirumahkan dan di PHK adalah upaya hukum litigasi dan non litigasi. Kata Kunci: Perlindungan hukum, Buruh, PHK ABSTRACT Based on data from the Ministry of Manpower of the Republic of Indonesia (Kemennaker RI) as of May 1, 2020, the number of formal sector workers who have been laid off due to the Covid-19 pandemic is 1,032,960 people and formal sector workers who have been laid off as many as 375,165 people. Meanwhile, the informal sector workers affected by Covid-19 were 314,833 people. The total number of formal and informal sector workers affected by Covid-19 is 1,722,958 people. The purpose of this study is to find out how legal protection is for workers who have been laid off due to the COVID-19 pandemic as well as legal remedies that can be taken by workers against companies that harm them. This research is a normative legal research with a concept approach and a law approach. The conclusion in this study is that employers are obliged to provide severance pay for workers who have been laid off in accordance with Article 156 of Law Number 13 of 2003 concerning Manpower as a form of legal protection. Legal remedies that can be taken by workers who feel aggrieved due to being laid off and laid off are litigation and non-litigation legal remedies.Keywords: Legal protection, Labor, layoffs

Ada peluang dengan mengoptimalkan perlindungan saksi baik itu sebagai pelapor (Whistleblower) maupun saksi pelaku yang berkerjasama (Justice collaborator), akan dapat pula mengoptimalkan pengungkapan kasus tindak pidana korupsi di Indonesia yang selama ini kebijakan hukum pidana dalam pemberantasan tindak pidana korupsi lebih mengarah terhadap pelaku semata.
