Abstract

One of the distinctive cultures that live sustainably in the boarding school environment is the khidmah tradition. Khidmah is interpreted as an attitude and wholehearted devotion activity carried out by a santri to his kyai or teacher, both during the study period at the boarding school or after graduation. Among Islamic boarding schools, this khidmah tradition has been deeply rooted since ancient times and is still maintained until now, and it is felt that it will persist into the future. More than just a tradition, this khidmah becomes an important identity of a santri as well as one of the benchmarks for his success in studying because in Islamic boarding school education. This study tries to explain the meaning and forms of khidmah, the factors behind the emergence of khidmah, motivation for khidmah, the theological basis of khidmah, as well as its virtues and benefits so that people can understand this khidmah problem more deeply and completely. This research is qualitative in the form of a literature study, with a conceptual approach to Sufism and morality. So it is possible to answer some aspects of the problem as mentioned earlier. After extracting the data and analyzing it, in this study several conclusions were obtained, including; first, khidmah is a form of devotion and service performed by a student (santri) to his teacher (kyai), as a form of respect and obedience to the teacher. This devotion can be in the form of devotion that has physical nuances, thoughts, possessions, or in the form of prayer. Second, the emergence of a khidmah tradition in Islamic boarding schools and other Islamic educational institutions is motivated by several factors such as strong moral education, especially morals for teacher (kyai), kyai who is believed to be pious and holy people, and the dormitory life system in the community a long period which builds an inner closeness between teacher and student. Third, some of the motivations that encourage students to be khidmah are to get the kyai's willingness (ridha) as well as an expression of gratitude and want to repay the kyai's services..

Abstract

Implementing the acquisition of foreign digital bank SeaBank Indonesia over Bank Kesejahteraan Ekonomi (Bank BKE) Bis based on the regulations of Law Number 40 of 2007 concerning Limited Liability Companies Article 125, Article 135. Banking Law No. 10 of 1998 on the licensing of foreign persons and institutions establishes and owns up to 90% of shares in national banks., Decree No. AHU-0002728. Ah.01.02 of 2021 issued by the Minister of Law and Human Rights of the Republic of Indonesia on January 15, 2021, concerning Approval of Amendments to the Articles of Association of Limited Liability Companies of PT Bank Seabank Indonesia. ; Decree No. KEP-12/PB.1/2021 issued by the Deputy Commissioner of Banking Supervision I of the Financial Services Authority dated February 10, 2021, concerning the Determination of the Use of Business Licenses on Behalf of PT Bank Kesejahteraan Ekonomi into a Business License on Behalf of PT Bank Seabank Indonesia. ; Letter No. S-32/PB.33/2021 issued by the Head of Bank Supervision Department 3 of the Financial Services Authority dated February 17, 2021, concerning Changes in the Bank's Logo. SeaBank Indonesia's acquisition of a foreign digital bank for Economic Welfare Bank (Bank BKE) is essentially an acquisition in the form of shares. Abstract

The gap between the potential of zakat funds and the reality of zakat collection is caused by the lack of trust and awareness among the community. This research aims to provide a solution through cultural reconstruction in zakat execution. This reconstruction is called cultural politicization, which combines social theory and legal institutions. Furthermore, this reconstruction generates an ideal organizational relationship proposal for zakat management institutions and reduces social non-compliance. By conducting in-depth interviews with zakat institutions (BAZNAS and LAZIZNU) in Sumenep Regency, Madura, using a qualitative-phenomenological approach, this research is based on legal sociology focusing on zakat culture and institutional relations. This research yields findings, namely the cultural construction in zakat law implementation consists of three aspects; 1) authority construction, where zakat collectors ranging from BAZNAS, LAZ to individual collectors (kiai, ulama, ustad) compromise the roles, with kiai and ulama as zakat collectors and BAZNAS as partners. 2) personal community construction, making the community as the subject of empowerment for productive fund programs and supportive stakeholders. 3) literacy-stigmatization construction, where the community is made as members of partner organizations of zakat collectors. Another finding is that the development of zakat management organization (OPZ) relations involves making BAZNAS, LAZ, and individual collectors as business partners who cooperate. This study also implies that BAZNAS acts as a regulator and formulator of productive zakat programs, while LAZ and individual collectors act as operators who carry out zakat management functions from collection to distribution and implement productive zakat utilization programs.

Abstract

Kajian dalam tulisan ini mendeskripsikan dinamika kontekstualisasi mustahiq zakat, mustahiq zakat telah dijelaskan dalam al-Qur’an surat al-Taubah (9) : 60. Bahwa mustahiq zakat itu mencakup delapan golongan, yaitu faqir, miskin, ‘amil, mu'allaf, riqab, gharim, sabilillah dan ibn al-sabil. Akan tetapi terjadi dinamika pemaknaan kontekstualisasi mustahiq zakat delapan golongan mustahiq zakat, mengikuti perkembangan zaman. Shari'at Islam sebagaimana di tegaskan oleh ahli usul, akan selalu dinamis, sesuai untuk setiap saat dan tempat (al-Shari’ah al-Islamiyyah Salihun Li Kulli Zaman wa Makan). Oleh karena itu dalam menetapkan hukum Islam selalu dituntut adanya kontekstualisasi terhadap perubahan zaman, kondisi, situasi dan lingkungan yang ada. Dinamika kontekstualisasi mustahiq zakat yang terjadi sesuai dengan maqasid al-shari’ah dengan memperhatikan pada pemeliharaan kemaslahatan manusia untuk menggapai mereka kepada kebahagiaan dunia dan akhirat dengan cara memberikan kemanfaatan dan menolak kesulitan kepada mereka. Dalam rangka pemeliharaan kemasla­hatan manusia, teori perubahan (elastisitas) hukum lantaran situasi dan kondisi yang berubah dan berbeda, para ahli hukum Islam sudah telah menyatakan bahwa letak kekuatan hukum Islam terlatak pada sifatnya yang akomodatif terha­dap perubahan zaman dan peralihan tempat.
