Abstract

Restorative Justice merupakan penyelesaian perkara tindak pidana dengan melibatkan pelaku, korban, keluarga pelaku/korban, dan pihak lain yang terkait untuk bersama-sama mencari penyelesaian yang adil dengan menekankan pemulihan kembali pada keadaan semula, dan bukan pembalasan. Restorative Justice sebenarnya memiliki posisi yang strategis sebagai suatu sarana dalam mempertahankan hak-hak anak yang berkonflik dengan hukum. Namun yang menjadi kendala adalah bagaimana Restorative Justice itu tidak dapat berjalan secara efisien bila diterapkan bukan dengan cara yang benar. Penelitian ini dilakukan bertujuan untuk  mengetahui sinkronisasi/harmonisasi formulasi ide Restorative Justice di berbagai peraturan perundang-undangan anak di Indonesia, baik yang berlaku sekarang ini (ius constitutum) maupun di masa mendatang (ius constituendum). Dengan menggunakan metode Yuridis Normatif dalam arti luas, penelitian ini tidak hanya sebatas melihat secara logis/ sistematis dalam keseluruhan perangkat norma melainkan juga mencakup latar belakang filosofis, sosiologis, historis, komparatif, dari implementasi ide restorative justice itu sendiri. Tidak sebatas implementasi dalam formulasi ketentuan peraturan perundang-undangan saja, bagaimana ketentuan-ketentuan tersebut dilaksanakan dalam masyarakat juga perlu diperhatikan dalam mencapai suatu keadilan restoratif bagi anak.Restorative Justice is a settlement of criminal cases involving perpetrators, victims, families of perpetrators / victims, and other concerned parties to jointly seek a fair settlement by emphasizing restoration back to its original state, rather than retaliation. Restorative Justice actually has a strategic position as a means of defending the rights of children in conflict with the law. But the constraint is how Restorative Justice can not run efficiently if applied not in the right way. The aim of this research is to find out the synchronization / harmonization of Restorative Justice idea formulation in various laws of child in Indonesia, both current (ius constitutum) and in the future (ius constituendum). By using the Normative Juridical method in a broad sense, this research is not only limited to looking logically / systematically in the whole set of norms but also includes the philosophical, sociological, historical, and comparative background of the implementation of the idea of restorative justice itself. Not only the implementation of the formulation of the provisions of legislation only, how the provisions are implemented in the community also need to be considered in achieving a restorative justice for children.

Abstract

The purposes of this paper are to identify and examine the revocation of political rights for corruptors as an extra-ordinary measure. The research showed that law enforcement through penal policies still have shortcomings such as light criminal sentence for perpetrators of criminal acts of corruption as well as lack of awareness among judges to apply the additional sentence of fixed-time revocation of rights. Penal law enforcement requires integral and sustainable policies through non-penal policies (prevention). Preventive efforts should be responsive to the demands of the community at large for officials who are clean, honest and who have integrity. Non-penal law shall be enforced through the concept of developing smart and integrity-based politics.

Abstract

Restorative Justice is a philosophy, process, ideas, theories and interventions that emphasize the improvement of the harm caused or expressed by criminal behavior. This process is in sharp contrast to the standard way of handling crime as is commonly carried out in criminal law in Indonesia. Restorative justice finds a foothold in the basic philosophy of the fourth principle of Pancasila, namely deliberation on priorities in decision making. The purpose of the settlement by mediating victims of violators is to humanize the justice system, justice that is able to answer what the real needs of victims, perpetrators and the community.

Abstract

Abstract   Corruption in Indonesia systematically in all sectors of public life, has threatened the efforts of sustainable development and the achievement of social welfare in Indonesia. Society demanded that the death sentence meted out to the criminals, so that corruption can be prevented and eradicated systematically. However, until now there has been no single criminals sentenced to death. This happens because of the legal weaknesses in the formulation  death sentence for corruption. Some disadvantages juridical include: the death penalty only for offenses threatened enrich themselves / others / corporate corruption, death penalty only for corruption perpetrated under certain circumstances, the law does not formulate terms / limitations repetition acts criminal (recidive) for corruption, crime repeated terms and repetition period in terms of providing capital punishment for repeat offenses (recidive) for corruption. Reformulation of capital punishment for corruption should be threatened by the principal alternative to other types of criminal offense-specific corruption offenses considered very disgraceful and extremely harmful and damaging the wider society (nation / state). In addition, given the threat of the death penalty is a last resort in combating corruption should also formulated an alternative capital punishment or other forms of death penalty mitigation. Abstrak   Korupsi yang terjadi di Indonesia secara sistematis di semua sektor kehidupan masyarakat, telah mengancam upaya pembangunan berkelanjutan dan pencapaian kesejahteraan masyarakat Indonesia. Masyarakat menuntut agar hukuman mati dijatuhkan kepada para koruptor, supaya korupsi dapat dicegah dan diberantas secara sistematis. Namun, sampai saat ini belum ada satupun koruptor yang dihukum mati. Hal ini terjadi karena berbagai kelemahan yuridis dalam formulasi ancaman pidana mati bagi koruptor. Beberapa kelemahan yuridis tersebut antara lain: pidana mati hanya diancamkan untuk tindak pidana memperkaya diri sendiri/orang lain/korporasi dalam korupsi, pidana mati diancamkan untuk tindak pidana korupsi tertentu yang dilakukan dalam keadaan tertentu saja, undang-undang tidak merumuskan pengertian/ batasan pengulangan tindak pidana (recidive) untuk korupsi, syarat tindak pidana yang diulangi dan tenggang waktu pengulangannya dalam hal memberikan ancaman pidana mati untuk pengulangan tindak pidana (recidive) untuk korupsi. Reformulasi ancaman pidana mati untuk tindak pidana korupsi seharusnya diancamkan secara alternatif dengan jenis pidana pokok lainnya untuk delik-delik korupsi tertentu yang dipandang sangat tercela dan sangat merugikan dan merusak kehidupan masyarakat luas (berbangsa/ bernegara). Selain itu, mengingat ancaman pidana mati merupakan upaya terakhir dalam pemberantasan tindak pidana korupsi seharusnya juga dirumuskan alternatif pidana mati atau bentuk-bentuk peringanan pidana mati. Kata Kunci : kebijakan, reformulasi, pidana mati, dan korupsi.

Abstract

Cyber crime di bidang kesusilaan, yang berupa cyber pornography dan cyber sex dapat menjadi masalah yang serius apabila tidak diantisipasi melalui kebijakan hukum pidana. Kebijakan umum yang perlu diterapkan adalah dengan pendekatan integral/sistemik yang memadukan pendekatan teknologi, pendekatan budaya/kultural, pendekatan moral/edukatif, dan pendekatan global. Kebijakan penanggulangan cyber pornography dapat ditemukan dalam KUHP dan juga dalam UU No.32/2002 tentang Penyiaran, meskipun terdapat kelemahan dalam asas teritorial. Untuk mengantisipasi hal tersebut dalam Konsep RUU KUHP 2004/2005, dirumuskan perluasan asas teritorial dan perumusan delik Pornografi Anak melalui Komputer. Sedangkan cyber sex sulit dijangkau oleh hukum pidana positif saat ini, karena perbuatannya bersifat maya/abstrak/non-fisik dan sangat individual serta selalu bertolak dari paradigma perbuatan dalam arti fisik/materiel. Oleh karena itu dalam praktek peradilan, hakim dapat melakukan konstruksi hukum dengan menyatakan bahwa cyber sex atau "hubungan seksual non-fisik (maya)" ini merupakan bentuk zina dalam pengertian Pasal 284 KUHP. Hal itu didasarkan pada alasan juridis normatif, juridis konseptual/teoritik/keilmuan, jurisprudensi, pandangan pakar, agama, dan dari sudut akibat sosial (dampak negatifnya)Kata Kunci : Kebijakan Hukum Pidana, Cyber Crime, Cyber Pornography, Cyber Sex

Mediasi penal (penal mediation) sering juga disebut dengan berbagai istilah, antara lain : "mediation in criminal cases" atau "mediation in penal matters" yang dalam istilah Belanda disebut "strafbemiddeling", dalam istilah Jerman disebut "Der AuBergerichtliche Tatausgleich" (disingkat ATA) dan dalam istilah Perancis disebut "de meditation penale".
