Abstract

This study aims to discuss the potential problem of auction fraud carried out by the @xxx Instagram account in terms of Islamic law and Indonesian law. The research method used is descriptive qualitative, through a normative juridical approach, and is complemented by the results of observations and interviews with sources. The results of this study indicate some indications of fraud. First, the seller creates a fake account and colludes with his friend to make a fake offer. Second, the seller who entrusted the goods to the @xxx Instagram account did not send the goods to the auction winner. Third, the seller of the @xxx Instagram account sells goods by mixing genuine and fake products. It is contrary to Islamic law, which prohibits any intentional fraudulent activity. Of the several acts of fraud committed by the perpetrators, they can be subject to Article 28 of the 2016 ITE Law, Article 378 of the Criminal Code, Law no. 20 of 2016 concerning Brands and Geographical Indications, Law Number 11 of 2008 concerning Information and Electronic Transactions, and Article 16 of Law no. 8 of 1999 concerning Consumer Protection.

Abstract

Gacha system is a game from Japan. The popularity of mobile games with a freemium (F2P) business model that uses the gacha system as a game monetization tool has become a problem when viewed from the legality of transactions according to Islamic law. Purchases of virtual items in the game are referred to as microtransactions, where players use real money that is spent into virtual items or game currency as a medium of exchange for these items. The freemium strategy has an attraction for players to spend money to explore a game. Gacha is a method to get virtual items in the game, the concept of gacha is very dependent on the probability and rarity of the item. The rarer the item, the player is required to spend more money. In Japan, in 2012, gacha was banned for carrying out a misleading campaign. This study aims to analyze the validity of the microtransaction contract system for purchasing virtual items using the gacha system according to Islam. This research uses the library research method. In collecting research data, the researchers analyzed sources from previous studies related to freemium business strategies, microtransactions and the use of the gacha system, as well as the rules of Islamic law from these various transactions. The results show that transactions using the gacha system contain elements of maysir, taghrir and tadlis. Using the gacha system without doing microtransactions with real money does not fulfil the elements of maysir, taghrir and tadlis. Meanwhile, players who perform microtransactions to buy in-game items directly or without going through gacha are included in the ijarah agreement. Players can also get rewards (sell) in the form of certain items if they grind as a gift from the game developer.

Abstract

In the current digitalization era, many people are motivated to increase economic income in many ways, one of which is using digital technology NFT (Non-Fungible Token). The use of technology contained in NFT has a positive impact on people who have expertise in digital art; this is used to significantly increase economic income. This study discusses the history of NFT, the mechanism of buying and selling NFT, the characteristics of NFT and the view of Islamic law on buying and selling NFT transactions. The purpose of this study is to find out what is meant by NFT, the history of NFT, characteristics of NFT, how the mechanism of NFT sales is, and to find out how Islamic law views NFT buying and selling transactions. This research is a type of qualitative research; the author uses a descriptive-analytical approach which is classified as a qualitative research type by searching through library data or library research. The results of this study found that the history of NFT began in the BC era (Before Cryptokittes) 2012-2016, Cryptokitties and Cyptopunks (2017-2021), and the Decentraland Era (Metaverse) (2021-present). The law of buying and selling NFT is not found in the Koran or Hadith specifically but can be studied based on the pillars and conditions of buying and selling that have been regulated in Islamic law. According to Islamic law, transactions in the sale and purchase of NFT are included in the permissible sale and purchase; the transaction of buying and selling NFT is considered valid as a form of buying and selling in Islam because of the terms and pillars of the sale and purchase have been fulfilled.

Abstract

The internet has now been used as a medium for Online shopping; one of the media for Online shopping is e-commerce. Currently, a delayed payment system (debt) called PayLater has been implemented in e-commerce. The purpose of this study is to find out how the usage of PayLater in e-commerce is based on the perspective of Islamic law. This type of research is qualitative. Data collection methods used are library research, observation, and interviews. This study uses descriptive data analysis techniques, namely analyzing a phenomenon or social reality, by describing variables that are concerned with the problem and unit being studied and analyzed descriptively qualitatively using an inductive thinking approach, namely a way of thinking that departs from facts, events that occur. Then from the specific and concrete facts, generalizations that have a general nature are drawn. The results of the study prove that the law of buying and selling online according to Islamic law is valid as long as it does not contain haram elements and the goods being traded are halal. However, the practice of PayLater loans is not in accordance with Islamic law because there is an element of usury contained in it.

Abstract

Dengan hadirnya perguruan tinggi baik swasta dan negeri memberikan sumbangan tenaga ahli lulusan mahasiswa di setiap tahunnya, akan tetapi dengan predikat sarjana hal tersebut belum tentu menjanjikan untuk mendapat pekerjaan yang sesuai, terkadang dari banyaknya lulusan tak semua terserap di lapagan pekerjaan yang menyebabkan pengangguran. Pemberdayaan mahasiswa dari dini melalui program wirausaha merdeka tahun 2022 di universitas muhammadiyah surakarta dengan cara mengoptimalkan potensi yang dimiliki tiap – tiap mahasiswa merupakan sebuah hal yang penting dalam mengembangkan wirausaha muda. Tujuan dilakukannya program wirausaha merdeka ini yaitu untuk membantu mahasiswa dalam menciptakan pendapatan sesuai dengan kemampuan dan kompetensi dari mahasiswa tersebut agar mereka dapat mandiri, berkembang serta tidak selalu bergantung dari bantuan pemerintah dengan cara membantu peningkatan kelangsungan usaha yang dikelola oleh mahasiswa. Mahasiswa perlu mengetahui betapa pentingnya untuk tetap berwirawasta dalam masa mendatang. Tahapan kegiatan dirancang selama empat bulan yang didahului dengan kegiatan koordinasi dan komunikasi dengan peserta dan panitia maupun stack holder dalam mendukung program tersebut, salah satunya dengan mitra Praktik Magang peserta WMKUMS yang akan dilaksanakan di Unit Kerja Budidaya Air Tawar P2MK Alang-Alang Subur. Persiapan dimaksudkan adalah penetapan sasaran kegiatan, dan lokasi kegiatan. Hasil kegiatan ini sangat sesuai dengan yang diharapkan yaitu pada kegiatan yang dilaksanakan dapat membantu Wirausaha Mahasiswa yang secara aktif melalui bantuan pendanaan dan Dosen Pembimbing lapangan guna membantu peningkatan jiwa wirausaha Mahasiswa Universitas Muhammadiyah Surakarta.

Abstract

This research aims to measure the performance of the waqf institution (LAZNAS Yatim Mandiri) using a balanced scorecard (BSC). This study uses quantitative and qualitative analysis or mixed-method by using a balanced scorecard (BSC). The Balanced Scorecard is used to measure performance from both a financial perspective and a non-financial perspective, which includes four main perspectives: (1) finance, (2) customers, (3) internal business processes, and (4) learning and growth. The study found that an overall BSC score of 85,6% shows that the performance of LAZNAS Yatim Mandiri is categorized as very good. From each perspective, customer perspective is the highest BSC score, followed by financial perspective and internal business while learning and growth perspective gain the lowest score. The BSC suggests a direction of priority to improve each strategic goal of perspective. Customer satisfaction becomes the first place, followed by waqf collection and distribution as the second priority. The next priority is employee satisfaction while keeping other strategic goals to be maintained. The findings of this study could help Islamic philanthropic institutions define their vision and strategy, as well as change their vision and strategy into specific activities, by implementing measures that are accurate and comprehensive, as well as providing information that is accurate and correct for managers to make business decisions.

Abstract

Wasathiyyah Islam and human rights are one of the many terminologies that appear in Islamic thought, especially in counteracting radicalism. In the context of Muhammadiyah universities, all activities are recommended to refer to the Guidelines for Islamic Life for Muhammadiyah Members (PHIWM). This study aims to identify the implementation of Islamic values based on human rights and Wasathiyyah Islam in Muhammadiyah universities. This study used a qualitative method through a literature review approach. The results of the study revealed that the Al-Islam and Kemuhammadiyahan Development Institute is the motor for implementing Wasathiyyah Islamic values and human rights in Muhammadiyah universities. One of the main programs is the obligation to follow baitul arqam for the entire Muhammadiyah academic community.

Abstract

Thailand is a country in Southeast Asia and is in the form of a unitary state with a majority population of Buddhist beliefs. However, in Southern Thailand, the majority are Muslims with Malay cultural features and there are many Islamic-based educational institutions. It is not uncommon for the people of Southern Thailand to send their children to study in Indonesia. One of the problems faced is the small number of Muslim people who can speak Indonesian. Therefore, we conducted a 1-month training in the context of providing language training and Al-Islam Kemuhammadiyahan (AIK) to the Thai Muslim community in collaboration with the Association of Education Cultural International (AECI). The results of the activity showed that the students' understanding of Indonesian grammar at Eakkapapsassanawich Islamic School and Adameesuksavittaya School increased significantly. Likewise with understanding related to Al-Islam Kemuhammadiyahan.

Abstract

This study aims to analyze the factors forming the number of poor people in Eastern Indonesia. Panel data regression was utilized as the analysis approach, with a cross-section comprising 12 provinces in Indonesia's Eastern Region from 2010 to 2018. This study will examine the effect of total government spending on education, government spending on health, labor force participation rate, regional minimum wage, investment, and the Gini index on poverty in Eastern Indonesia. The results showed that government spending on health and regional minimum wages had a negative effect on the number of poor people in Eastern Indonesia. The number of poor people in Eastern Indonesia will decrease if the realization of government spending on health and the determination of regional minimum wages increases. The increase in the realization of government spending in the health sector indicates that regional policies on the allocation of health spending have been carried out in a proportional, efficient, and effective manner so that they are right on target. Meanwhile, government expenditure on education, investment, labor force participation rates, and the Gini index has no effect on the number of poor people in Eastern Indonesia.
