Abstract

 Perburuan dan perdagangan satwa yang dilindungi merupakan suatu tindak pidana yang serius karena selain mengancam lingkungan akibat dari tindak pidana ini juga menimbulkan kerugian bagi Negara, Selain karena factor ekonomi factor lemahnya penegakan hukum terhadap pelaku tindak pidana perburuan dan perdagangan satwa yang dilindungi ini juga menjadi pemicu maraknya perburuan dan perdagangan satwa yang dilindungi, Dalam sistem pemidanaan modern dikenal dengan adanya double track system yaitu penjatuhan sanksi pidana melalui dua jalur yaitu sanksi pidana sebagai penjatuhan nestapa terhadap pelaku tindak pidana dan juga sanksi tindakan sebagai pemberian pendidikan terhadap pelaku tindak pidana yang mana hal ini sudah menjadi kecenderungan internasional akibat dari dianutnya aliran neo klasik. Tujuan dari penulisan ini adalah untuk mengkaji bagaimana formulasi sanksi yang ideal terhadap tindak pidana perburuan dan perdagangan satwa yang dilindungi. Jenis Penelitian dalam penelitian ini merupakan penelitian normative dengan pendekatan konseptual dan juga pendekatan perundang undangan, Dalam penelitian ini ditemukan bahwa dengan tidak adanya batas minimal vonis terhadap pelaku tindak pidana perburuan dan perdagangan satwa yang dilindungi dalam UU No. 5 Tahun 1990 mengakibatkan ringannya vonis yang dijatuhkan sehingga hal ini tidak menimbulkan efek jera kemudian penjatuhan pidana penjara terhadap pelaku tindak pidana perburuan dan perdagangan satwa yang dilindungi masih belum efektif karena tidak adanya pemulihan dari akibat tindak pidana yang ditimbulkan.Kata-Kunci: Double Track System, Perburuan satwa, Perdagangan satwa, Ekosistem Hunts and wildlife trafficking that are protected are serious crimes because beyond threatening the environment the result of these crimes also causes harm to the state, it is not only because its economic factor In modern targeting systems, it is known as the double track system, which measures measures of criminal sanctions across two lines, and criminal penalties for assessing the convictions of convicted felons, which is already an international trend as a result of their inherent inaction. The purpose of this writing is to review how the ideal formulation for sanctions against the protected criminal hunts and animal trade. The kind of research in this study is normative research with a conceptual approach as well as a constitutional approach, In the study, it was found that with the absence of a minimum sentence against the convicted felons and wildlife trafficking protected in act no. 5 in 1990 resulted in a lightening of the sentence that was rendered so as not to have a lasting deterrent to those convicted of hunts and protected animal trafficking as ineffective.Keywords: Double Track System, Animal Hunt, Animal Trade, Ecosystem

Abstract

Besarnya biaya penanganan korupsi seringkali menambah pengeluaran keuangan negara terlebih lagi jika korupsi tersebut memiliki kerugian keuangan yang kecil. Pengembalian kerugian negara merupakan salah satu tujuan pemberantasan tindak pidana korupsi oleh sebab itu Kejaksaan dalam menyikapi hal tersebut mengeluarkan kebijakan pengembalian kerugian negara untuk korupsi dengan kerugian negara kecil melalui pendekatan restorative justice. Dengan menggunakan metode penelitian yuridis-normatif yang mencari mengenai alasan Kejaksaan menerapkan pendekatan restorative justice dan bagaimana peran Kejaksaan dalam menerapkannya. Hasilnya, Kejaksaan dalam menerapkan pendekatan restorative justice tersebut didasarkan pada efisiensi penanganan perkara seperti yang terdapat dalam teori analisis ekonomi terhadap hukum dan hanya diterapkan dalam tingkat penyelidikan dengan melakukan kerja sama dengan APIP/BPK.

Abstract

Related to terrorism, in general, these crime were committed by men, but there is interesting fact in the case of suicide bombing that occurred in Surabaya in 2018, in which the suicide bombing was not only committed by men but also involves women and children. The involvement of women and children in terrorism, such as the suicide bombing in Surabaya, is a new mode used by terrorists to deceive the security apparatus, because this involvement was previously undetected so that the security apparatus could not predict it could be happen. The purpose of this research is to find out what are the factors that cause the involvement of women and children in terrorism and to find out how prevention efforts can be made.  The research method used in this research is an empirical juridical research method through a statutory approach and a conceptual approach.  The results of this research explain that the factors that cause the involvement of women and children in terrorism in Indonesia are due to internal and external factors.  Prevention efforts that can be done are by  the State Defense efforts through Citizenship Education which are further carried out through the Development of State Defense Awareness such as Counter Radicalization, Counter Ideology, Counter Narrative, Education, Society and Society Leaders Role and Formation of Society Programs.

Abstract

Dengan perkembangan teknologi saat ini yang mempercepat arus informasi menjadi tantangan tersendiri bagi penegak hukum dalam menanggulangi kejahatan radikalisme dan terorisme di dunia maya. Media sosial membuat penyebaran radikalisme semakin cepat dan mudah untuk dapat diakses oleh setiap orang. Maraknya penyebaran radikalisme di dunia maya haruslah disikapi secara tegas oleh pemerintah, karena hal ini sangat berbahaya terhadap stabilitas kemanan bangsa Indonesia. Dari data statistik menunjukkan bahwa pengguna internet di Indonesia tertinggi nomer tiga dunia. Tinggi nya pengguna media social harus dipandang menjadi potensi yang dapat digerakkan pada hal positif, salah satunya adalah menggerakkan penggiat media sosial untuk dapat berkontribusi dalam upaya menangkal radikalisme di dunia maya. Penelitian ini bertujuan untuk menjelaskan peran penting penggiat media social dalam upaya menangkal faham radikal yang bertentangan dengan Pancasila khususnya di dunia maya. Selain itu, penelitian ini merekomendasikan untuk diakamodirnya penggiat media social ke dalam suatu UU atau peraturan lainnya guna menegaskan kedudukan dan peran penggiat media social dalam upayanya menangkal radikalisme di dunia maya. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan (statue approach), dan pendekatan konseptual (conceptual approach). Hasil dalam penelitian menunjukkan bahwa perlu adanya pengaturan yang jelas dan tegas mengenai peran penggiat media social dalam upaya menangkal radikalisme. Menyadari tentang pentingnya peran penggiat media sosial dalam upaya pencegahan radikalisme di dunia maya. Untuk itu, dibutuhkan perhatian pemerintah untuk merangkul dan mengakomodir kepentingan penggiat media sosial agar tetap solid dalam mencegah radikalisme melalui upaya kontra radikalisasi terhadap konten-konten yang bermuatan radikalisme di dunia maya.

Abstract

Penelitian ini bertujuan meneliti tentang problematika perlindungan hukum yang terjadi pada anak korban eksploitasi seksual dan bentuk ideal perlindungan hukum bagi anak korban eksploitasi seksual, penelitian ini mengunakan pendekatan koneptual (conseptual approach), hasil penelitian ini ditemukan bahwa korban eksploitasi seksual di indonesia setiap tahun selalu mengalami kenaikan disisi lain ditemukan kurang optimalnya perlindungan hukum yang dimana didalam pasal 20 Undang-Undang no 35 tahun 2014 mendeskripsikan bahwa perlindungan hukum merupakan kewajiban dan tanggung jawab seluruh kalangan baik pemerintah, masyarakat dan orang tua. Dan hasil analisis problematika tersebut penulis jadikan bahan untuk membuat konsep ideal perlindungan hukum bagi anak korban eksploitasi seksual, dan kesimpulan yang di dapatkan dalam kaitannya terhadap konsep perlindungan hukum yang ideal penulis berpandangan perihal beberapa konsep model perlindungan antara lain: Model yang berdasarkan hak-hak prosedural atau model partisipasi secara langsung atau aktif (the procedural right model), Model pelayanan partisipasi secara tidak langsung atau model pasif (the services model), Model Persuasif  atau Partisipatif, Model perlindungan komprehensif, Model penjatuhan pidana bersyarat, Model perlindungan preventif. Karna pada dasanya perlindungan hukum di katakan baik apabila undang-undang tersebut tidak lagi bekerja mengurusi korban melainkan bekerja menghentikan korban.

Abstract

Law enforcement without direction and not based on the three pillars of the justice of law, legal certainty and the benefits to society can break the law anyway even violate human rights. As one of the policies of the government that are not considered mencerminakan the values of justice and disturbing for the people, the government policy that acts of omission or delay in the application of the death penalty. This research is a normative legal normative juridical approach. The data collected is secondary data were analyzed using qualitative methods juridical analysis. Based on these results it can be concluded that in the application of the death penalty there are serious legal issues, this is due to government policies that commit omission or delay in the execution of the death penalty is a violation of human rights as stipulated in Article 28 of the 1945 Constitution. Abstract

Interception is an act that violates human rights is therefore authorized the interception can only be done by law enforcement officers. In reality interception authority by police to deviate from the provisions that have been mandated by law. This research is a normative legal normative juridical approach. The data collected is secondary data were analyzed using qualitative methods juridical analysis. Based on this study it can be concluded that the juridical consequences of the actions of police conduct authority lapses in implementing the interception an act that is against the law and may be subject to criminal sanctions, it is based on a systematic interpretation of Article 31 paragraph (3), the law enforcement officers who perform deviation authority interception the position equivalent to ordinary people who do the interception as stipulated in Article 31 paragraph (1). So the police action could be sanctioned as provided for in Article 31, paragraph 1 in conjunction with Article 47 of Law ITE. Keywords: Deviation, authorized, Interception, Law enforcement

Abstract

Abstrak Adanya kelalaian dalam proses penegakan hukum di Indonesia menyebabkan seseorang yang tidak bersalah menjadi bersalah, sehingga mengakibatkan hilangnya hak-hak asasi pada diri narapidana korban salah tangkap. Dalam hal mengembalikan hak-hak tersebut, Negara memiliki kewajiban untuk bertanggung jawab dengan cara memberikan kebijakan rehabilitasi dan kompensasi kepada narapidana korban salah tangkap yang diatur dalam Pasal 95 sampai dengan Pasal 97 KUHAP dan PP RI No. 27 Tahun 1983 sebagaimana telah diubah dengan PP RI No. 92 Tahun 2015. Penulisan ini menggunakan metode penelitian hukum yuridis normatif dengan studi kepustakaan dan pendekatan undang-undang serta pendekatan konsep. Pembahasan ini menghasilkan analisis tentang praktik pemberian kebijakan rehabilitasi dan kompensasi, dimana Negara masih belum dapat merealisasikannya dengan maksimal, karena memiliki proses yang sulit dan memakan waktu yang lama. Sehingga hak asasi narapidana korban salah tangkap belum bisa terpenuhi secara menyeluruh meskipun peraturan perundang-undangan tersebut sudah bagus dan jelas mencerminkan nilai-nilai Hak Asasi Manusia yang dibuat sebagai bentuk tanggung jawab negara atas kegagalan hukum yang disebabkan oleh kelalaian oknum penegak hukum. Dalam pemberian kebijakan kompensasi, Indonesia dapat mencontoh kebijakan di Negara Belanda berupa transparansi hukum terkait kasus salah tangkap dan kinerja aparat penegak hukum, serta terkait jangka waktu permohonan pengajuan kompensasi. Kemudian Indonesia juga dapat mencontoh Jepang dalam hal proses pencairan dana kompensasi secara cepat, tunai, dan langsung. Kata kunci: Narapidana korban salah tangkap, Rehabilitasi, Kompensasi, Hak Asasi Manusia. Abstract Negligence in the process of law enforcement in Indonesia causes an innocent person to be guilty, resulting in the loss of human rights to the convicted victim of wrongful arrest. In the event of restoring these rights, the State has an obligation to be responsible by providing rehabilitation and compensation policies to inmates of mis-arrest victims stipulated in Article 95 to Article 97 of the Criminal Code and PP RI No. 27 of 1983 as amended by PP RI No. 92 of 2015. This paper used normative juridical law research methods with literature studies and legal approaches as well as concept approaches. This discussion resulted in an analysis of the practice of providing rehabilitation and compensation policies, which the State still could not realize to the maximum, because it has a difficult and time-consuming process. So that the human rights of prisoners wrongfully arrested victims can not be met thoroughly even though the legislation is good and clearly reflects the values of Human Rights made as a form of state rights of prisoners wrongfully arrested victims can not be met thoroughly even though the legislation is good and clearly reflects the values of Human Rights made as a form of state responsibility for legal failures caused by negligence of law enforcement personnel. In granting the compensation policy, Indonesia can follow The Netherlands in the form of legal transparency related to cases of misapproanation and the performance of law enforcement officers, as well as related to the period of application for compensation. Abstract

The role of the Indonesian National Army (Tentara Nasional Indonesia “TNI”) in countering terrorism is part of the strategy to combat terrorism. With the escalation of the threat of terrorism which not only threatens national security, but also state sovereignty, the involvement of the TNI is a necessity in order to defend the country from threats or terrorist attacks. This study describes the urgency of the TNI's involvement in efforts to overcome acts of terrorism that threaten state sovereignty, and how the ideal role of the TNI in efforts to combat criminal acts of terrorism is described. The method used in this research is normative legal research, using a statutory approach (statute approach) and a conceptual approach (conceptual approach). The results of this study indicate that there is a need for regulations that clarify the main tasks and functions of the TNI in combating terrorism. The proposed efforts to involve the TNI in counter-terrorism include aspects of enforcement and prevention. In the aspect of prosecution, the technical involvement of the TNI in counter-terrorism operations is at the back, when the Anti-Terror Detachment 88 is in a condition beyond over capacity and the gradation of threats that endangers the sovereignty of the state. In the prevention function, the role of the TNI is more focused on the effective use of intelligence forces in supporting the prevention of criminal acts of terrorism. Technically, the role of the TNI that must be carried out is early warning, early prevention, and prosecution and restoration of an area as a result of acts of terrorism.

Abstract

Since the end of 2019 the world has been shocked by the emergence of the COVID- 19 virus, which spreads very quickly. Starting from the country of origin, namely the People's Republic of China, until in early March, Indonesia announced two positive cases of COVID-19. The COVID-19 pandemic is a threat to the Indonesian state. Various efforts have been made by the government to prevent and control the spread of this virus, ranging from restricting activities, maintaining distance, using masks, washing hands to developing vaccines. This effort is being carried out by the government as a form of state defense in fighting COVID-19. This research proves that COVID-19 is a social disaster that afflicts all walks of life, one of the methods for overcoming the Covid-19 outbreak by involving itself in the vaccination program organized by the authorities as a form of state defense.
