Abstract

The notion of MBKM allows students to choose their learning activities. It takes the willingness of lecturers to respond to this policy to succeed. In the development of the MBKM, there are pros and cons and cons in the community, so a clear legal umbrella is needed to accommodate the policy. This study uses an approach with data collection through library searches sourced from electronic journal articles. After getting a number of articles, the articles that meet the requirements with a data inclusion strategy are selected and then analyzed descriptively. From the selection process, 10 articles were taken as the data and analyzed using content analysis. The results of the study show that the independent campus policy is a government breakthrough in providing autonomy and independence to each university from complicated employees and also giving students the freedom to choose their own study program. In its development, this policy took the form of reaping the pros and cons in the community so that several legal umbrellas were made that could accommodate them, but in the author's view the legal umbrella is still very important because only ministerial regulations need to be made such as laws or higher regulations of government.

Abstract

The general goal of education is to develop Indonesian people completely in the sense that carried out education still maintain unity, diversity and develop individual’s ideals. Every citizen has the right to obtain education equally with excellence and a balance (equity) between the utilization (access) with achievement. The higher education system must be able to create a quality higher education that is also affordable by the people of Indonesia. A university leader must be in-line and lead a "quality revolution". All energy and attention are focused on the "quality revolution". For this reason, this paper will examine the Implementation of Higher Education Quality Management Systems. As a case study is that has implemented a Quality Management System. According to Law No. 12 of 2012 concerning Higher Education. Quality Higher Education is Higher Education that produces graduates who are able to actively develop their potential and produce Science and / or Technology that is useful for the Community, nation, and country. The government operates a higher education quality assurance system to get quality education. The Higher Education quality assurance system referred to consists of: a. internal quality assurance system developed by Higher Education; and b. external quality assurance system carried out through accreditation. Implementation of Quality Management Systems in Higher Education can produce Quality and Affordable Education.

Abstract

The Covid-19 pandemic has had a significant impact on the implementation of teaching and learning activities, especially libraries as critical factor in maintaining good education. The Covid-19 outbreak has impacted the availability of instructional resources, reading materials, literacy, and other information. To ensure successful implementation, libraries must constantly innovate services through the use of information technology advances, including developing e-digital library services, online libraries, and book delivery services, as well as developing big data and digital library applications that involve libraries throughout Indonesia. Even the world through the use of a system that is frequently found in digital e-commerce platforms.

Abstract

The establishment of the Act must be approved by the President as stated in Article 20 of the 1945 Constitution paragraph (2). Interesting when Indonesia uses a presidential system with the separation of powers. However, in the formation of the Act involving the President. Article 20 paragraph (2) of the 1945 Constitution confirms the necessity of mutual agreement in the discussion and ratification of the Law. However, there are other assertions, namely that in Article 20 paragraph (5) of the 1945 Constitution, even without the President's signature, the Act can still be promulgated within 30 days of the Draft Law being discussed. Things like that can't just happen without a reason. Therefore, the writing of this study will look for the meaning of the agreement between the DPR and the President in the formation of the Law and how the legal politics of Article 20 paragraph (5) of the 1945 Constitution. The writing of this study is focused on researching and searching for the meaning of mutual agreement and focusing on legal politics from Article 20 paragraph 5 of the 1945 Constitution. The research method in this writing is normative juridical. The results of the research can be concluded that the meaning of the joint agreement between the DPR and the President in the establishment of the Law is an agreement in determining the policy in the form of a Law which is a reflection of the principle of checks and balances. Abstract

The issues discussed in this paper concerning the regulation of transportation services based on information technology in the Laws and Regulations. And the legality of information technology-based transportation services in the perspective of Law no. 22 of 2009 on Road Traffic and Transport (UU LLAJ). This paper uses a normative juridical research type, using a statute approach, conceptual approach and analitycal approach. The information technology-based transportation services are regulated in the LLAJ Law, Government Regulation Number 74 Year 2014 on Road Transportation (PP No. 74 Year 2014), and Regulation of the Minister of Transportation Number 118 Year 2018 on the Implementation of Special Rental Transportation (Permenhub No. 118 Year 2018). Regarding the legality of information technology-based transportation services in the perspective of LLAJ Law, it is said to be legal if it is subject to the provisions of Permenhub. 118 of 2018.

Abstract

The purpose of this study was to analyze access to the paradigm shift in the right to education during the pandemic for students from the perspective of human rights. This study uses a type of juridical-normative research. The primary legal sources used in this research are the 1945 Constitution of the Republic of Indonesia, Law No. 20 of 2003 concerning the National Education System, the 1948 Universal Declaration of Human Rights, and the International Covenant on Economic, Social and Cultural Rights. The types of legal sources used in this study are primary and secondary sources of law. Based on the analysis of legal sources, it can be concluded that the implementation of education is a right to education protected by the 1945 Constitution of the Republic of Indonesia and confirmed by the Human Rights Act. Understanding the right to education is more broadly understood as obtaining educational services in various forms/methods of online learning. Learning to use internet media also confirms that the right to education is closely related to the completion of the right to information following Articles 13, 14 and 15 of the Covenant on Economic, Social and Cultural Rights.

Abstract

This study aimed to determine the position of the business competition supervisory commission as a state auxiliary organ in the Indonesian constitutional system. Legal writing is included in normative legal research using primary legal materials and secondary legal materials. The techniques for collecting legal materials in this study are primary and secondary legal sources. Meanwhile, the technique of collecting legal sources in this study uses the method of studying legal literature and constitutional law. Legal sources collected from the research results are then processed and analyzed using qualitative processing techniques The Indonesian Competition Commission is accountable to the President for the performance of its tasks. On the basis of the data analysis, it can be determined that the Indonesian Competition Commission is an independent institution free of the Government's influence and power. The Indonesian Competition Commission is accountable to the President for the performance of its tasks. As one of the institutions responsible for implementing Law Number 5 of 1999, this commission is responsible for the early stages of implementing the Act. Decisions taken by the Oversight Commission can be appealed to a higher court level. This commission has broad jurisdiction and has four main tasks, namely: 1) legal function; 2) administrative function; 3) mediating function, and 4) police function.

Abstract

Tujuan penelitian ini adalah untuk menganalisis Persekongkolan Pengadaan Barang dan Jasa Pemerintah yang ditinjau dari Perspektif Hukum Persaingan Usaha. Penelitian ini menggunakan metode yuridis normatif. Sumber hukum yang digunakan dalam penelitian ini adalah sumber hukum primer dan sumber hukum sekunder. Dalam penulisan ini, teknik yang digunakan oleh penulis adalah teknik silogisme sedangkan proses analisis bahan hukum yang ada dengan menggunakan pendekatan kualitatif deskriptif. Pasal 22 UU Persaingan Usaha yang melarang persekongkolan dalam pengadaan barang dan/atau jasa. Pengaturan ini dimaksudkan agar dalam pasar PBJ pemerintah tidak terjadi persaingan usaha yang tidak sehat dalam bentuk persekongkolan antar pelaku usaha yang terkait dalam rangka memenangkan menentukan pelaku usaha yang dapat memenangkan tender.

Abstract

Perdebatan terkait konsep posisi dominan dan implementasi penafsiran ekonomi dalam kasus persaingan usaha seringkali menjadi perhatian stakeholder persaingan usaha di dunia internasional. Di sisi lain, perdebatan menjadi makin menarik jika disandingkan dengan acuan konsep posisi dominan dalam ranah regulasi relatif tetap. Penelitian ini membahas perdebatan dan kontroversi terkait definisi posisi dominan yang tertuang dalam rumusan hukum persaingan usaha di beberapa negara. Penelitian ini bertujuan untuk mendiskripsikan pendapat dan perdebatan terkait dengan definisi dan kriteria dari posisi dominan dalam perspektif regulasi yang berlaku di Indonesia serta perspektif ekonomi yang berkembang di berbagai negara. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan pendekatan konseptual (conceptual approach), perundang-undangan (statue approach) dan perbandingan (comparative approach). Penelitian menyimpulkan bahwa Perdebatan mengenai konsep posisi dominan masih akan terus berkembang, sebagaimana perkembangan konsep ilmu ekonomi dan hukum yang melandasinya. Perbedaan substansial dalam definisi posisi dominan terdapat antara Uni Eropa dengan Amerika Serikat. Abstract

Tujuan penelitian ini adalah untuk mengetahui penegakan hukum persaingan usaha dalam sektor ekonomi digital. Penelitian ini menggunakan jenis penelitian yuridis empiris. Jenis bahan hukum dalam penelitian ini adalah bahan hukum sekunder yang dikumpulkan dengan metode studi literatur. Jenis penelitian ini mengacu pada penelitian hukum sosiologis, mengacu pada hukum yang telah berlaku dan terjadi dalam kehidupan bermasyarakat serta dengan mengumpulkan berbagai fakta serta teori yang dibutuhkan. Metode analisis data yang digunakan dalam penelitian ini adalah analisis kualitatif. Berdasarkan hasil analisa sumber hukum, dapat disimpulakan bahwa regulasi yang digunakan di Indonesia untuk mengatur persaingan usaha dalam era digital ini belum secara khsusus dirumuskan. Belum adanya regulasi yang mengatur tentang pasar digital sangat disayangkan mengingat hal ini sangat urgent untuk diperhatikan oleh pemerintah sebab struktur pasar ini sangat berbeda dalam segala aspeknya dengan pasar konvensional yang telah dikenal, dan sangat berpotensi untuk dikembangkan
